35A Person may be examined without summons (1) The Chief Examiner may require a person who— (a) is present at an examination; and (b) is competent to give evidence at the examination— to give evidence or to produce documents that are in the person's possession at the examination even if a witness summons requiring the person to attend for that purpose has not been served on the person in accordance with Part 2. (2) A person required to give evidence or to produce documents under subsection (1) is subject to the same penalties and liabilities as if the person had been served with a summons in accordance with Part 2.
