Main Roads (Engineering Cadets) Regulations 1982

The regulations build around a small set of recurring legal and administrative concepts. For practitioners dealing with this instrument it is useful to isolate and understand those concepts and where they sit in the text.

Cadetship and classes, Schedule 1. The term cadetship is defined at regulation 2, and Schedule 1 concretely ties each class of cadetship to a specific University award and to practical training under the Commissioner. The cadetship is both an employment category and an education pathway, so the regulatory machinery treats it partly as employment and partly as a funded study arrangement (see regulation 13, which grants cadets the same conditions of service as permanent officers while expressly excluding cadets from being an officer for the purposes of s 10(1) of the Main Roads Act 1930).

Agreement, surety and formality, regulation 6 and Schedule 2. No cadet may commence without entering the prescribed agreement with a surety. The surety must be the cadet’s legal guardian or another person approved by the Commissioner (regulation 6(2)). The agreement is in Schedule 2 and contains express clauses creating joint and several liability for repayment on termination (Schedule 2 clauses as read with regulation 16). The agreement survives suspension, extension and other administrative indulgences, with the Commissioner’s power to terminate preserved (Schedule 2 clause 5).

Selection and eligibility, regulations 3-5. Entry requires public advertisement (regulation 3(1)), assessment by an appointed officer taking into account academic record (regulation 3(2)-(3)), and production of documentary proof (regulation 5). Eligibility hinges on being qualified for admission to, or having completed at least one year of, the linked University course (regulation 4(b)), and passing any aptitude test required by the Commissioner (regulation 4(c)). A prior subparagraph, regulation 4(a), has been deleted, which the instrument marks in‑text.

Term and academic linkage, regulations 7 and 15. The default cadetship term is four years (regulation 7(1)). If the cadet has completed part of the course already, the Commissioner may reduce the term to reflect remaining years (regulation 7(2)). Completion of the cadetship is defined as both satisfactory completion of study and service of the full term including any extension (regulation 15(1)), thereby tying eligibility for post‑cadet employment and other entitlements to both academic and time elements.

Duties, performance monitoring and remedial measures, regulation 8 and regulation 9. The cadet must take leave without pay to undertake full‑time study (regulation 8(a)) and, if directed, perform work for the Commissioner during university vacations (regulation 8(b)). The Commissioner may suspend or terminate a cadetship for unsatisfactory examination results, conduct, diligence or fitness to continue (regulation 9(1)); may require repetition of course portions and restore the cadetship on passing (regulation 9(2)); and may extend the term up to two years if the cadet has not completed the University course by the end of the initial term (regulation 9(4)). Importantly regulation 9(6) provides that suspension or extension does not relieve the cadet or surety of liability under the cadetship agreement.

Remuneration and allowances, regulations 10-12. Salary is payable during periods of work for the Commissioner and annual leave only (regulation 10(2)); starting salary and increments are tied to an external salary scale (regulation 10(1), (3)). Where a cadet is not paid salary, the cadet is entitled to a sustenance allowance, with two categories depending on ordinary place of residence relative to 40 km from the Perth G.P.O. (regulation 12(1)-(4)). The Commissioner determines rates and publishes them in the Government Gazette (regulation 12(3)). Compulsory tuition fees for subjects comprising the cadet’s University course are paid by the Commissioner (regulation 12(6)), but faculty, service and amenities fees remain the cadet’s responsibility (regulation 12(7)).

Repayment mechanics on termination, regulation 16. If the Commissioner terminates the agreement, the cadet and surety are jointly and severally liable to reimburse all allowances and tuition fees provided under regulation 12 (regulation 16(1)). Where the cadet has commenced paid employment under regulation 15(2), the reimbursable sum is reduced in accordance with a formula specified in regulation 16(2), which references the number of weeks served (WS), the period required to serve the Commissioner (WP), the total allowances and fees paid (AF) and the reduction amount (R). Regulation 16(3) treats any fraction of a week as one week for the purposes of that calculation.

Administrative discretion and notification obligations. Many obligations and benefits are subject to the Commissioner’s approval or satisfaction: approval of sureties (regulation 6(2)), approval of increases to sustenance where accommodation costs exceed allowance (regulation 12(4)), determination of allowance rates (regulation 12(3)), satisfaction with academic results to trigger salary progression (regulation 10(3)), and direction to work during vacations (regulation 8(b)). The Commissioner must notify the cadet and surety in writing when suspending, extending, requiring a new agreement, or terminating a cadetship (regulation 9(5) and 9(7)).

Collectively these concepts create a statutory hybrid of employment contract and education funding contract, with the Commissioner holding significant discretion to condition allowances, progression and continuation of the agreement on academic performance and conduct, and with legally enforceable repayment obligations back to the Commissioner where the agreement is terminated.

The regulations directly affect a tight group of stakeholders, and indirectly touch several institutional actors.

Directly affected individuals and entities

• Cadets. The person employed in the cadetship under the agreement is the primary subject of the regulations. The cadet’s obligations, entitlements and liabilities flow from the regulations and the Schedule 2 agreement. Key impacts on the cadet include required full‑time enrolment and leave without pay for study (regulation 8(a)), the requirement to work during vacations if directed (regulation 8(b)), limited leave entitlements (regulation 14), entitlements to salary during work and annual leave only (regulation 10(2)), entitlement to sustenance allowance when not on salary (regulation 12(1)), tuition fees paid for compulsory subjects (regulation 12(6)), obligation to complete study and serve the term to be deemed to have completed the cadetship (regulation 15(1)), and potential post‑cadet service obligations (regulation 15(2)). The cadet and the cadet’s personal representatives are bound by the agreement (Schedule 2 clause 6(b)).

• Sureties. Every cadet must have a surety, normally the cadet’s legal guardian or another person approved by the Commissioner (regulation 6(2)). The surety is contractually bound and, if the agreement is terminated, jointly and severally liable with the cadet for reimbursement of allowances and tuition fees paid (regulation 16(1) read with Schedule 2). The surety remains liable despite suspension, extension or indulgences from the Commissioner (Schedule 2 clause 5).

• The Commissioner for Main Roads. The Commissioner is the administrative decision‑maker and contracting party; the Commissioner invites applications (regulation 3(1)), appoints the reviewing officer (regulation 3(2)), approves sureties (regulation 6(2)), sets allowance rates and determines increases (regulation 12(3) and (4)), decides on suspension, extension, termination and required repetition (regulation 9), pays salary and allowances according to the regulations (regulation 10 and 12), and enforces reimbursement claims (regulation 16). The Commissioner also determines operational requirements such as whether a cadet must work in vacations (regulation 8(b)).

Indirectly affected institutions and parties

• Universities. The University of Western Australia and the Curtin University of Technology are expressly named at regulation 2 and in Schedule 1; the cadetship scheme requires cadets to enrol in those institutions for the named Bachelor of Engineering awards (Schedule 1). Universities will be parties to the practical effect of the scheme in terms of student enrolment, subject offerings and potentially in handling tuition invoicing for compulsory subjects that the Commissioner pays (regulation 12(6)).

• Main Roads Department staff and bargaining arrangements. Salary references are tied to the Main Roads Department General Division Salaries Agreement No. 6 of 1982 or its equivalent (regulation 10(1)). The Commissioner’s payment obligations therefore interact with existing departmental salary frameworks and any agreements that replace the named instrument.

• Prospective employers and the civil engineering labour market. The regulations create a pipeline of engineers who, if required by the Commissioner, will serve as Engineer Class 1 for a post‑cadet period that may equal the cadetship term or be two years, whichever is greater (regulation 15(2)). That creates a contractual post‑training labour supply effect for the Commissioner and a restraint on cadets’ immediate mobility after completion while the service obligation operates.

Who pays

• The Commissioner pays salary, sustenance allowances and compulsory tuition fees in the circumstances set out in regulations 10 and 12. Where the cadetship agreement is terminated by the Commissioner, the cadet and surety repay those sums (regulation 16). Thus the public purse funds training and living costs during the cadetship subject to the contractual risk of reimbursement.

Who decides

• The Commissioner decides on selection administration, approval of sureties, allowance rates, whether work is required during vacations, salary progression based on academic results, suspension, extension and termination, and any reinstatement or requirement to enter into a new agreement (regulations 3, 6, 8-10, 12, 9, 17). Several provisions require that cadets be given written notice of these decisions (regulation 9(5), 9(7)).

Net effect on behaviour

• Prospective cadets must secure a surety and demonstrate academic suitability to be appointed (regulations 4-6). During the cadetship cadets face incentives to pass examinations and maintain conduct to keep allowances and salary progression, because suspension or termination triggers loss of allowances and possible reimbursement liability (regulations 9 and 16). Post‑completion, cadets face potential service obligations that tie them to the Commissioner’s employ for a significant period (regulation 15(2)). Sureties have a financial incentive to monitor the cadet’s performance and adherence to the agreement because of joint and several liability on termination (regulation 16 and Schedule 2).

The regulations therefore create a closed cohort of publicly funded engineering trainees, a contractual repayment mechanism to protect public expenditure, and concentrated decision‑making authority in the Commissioner, with direct legal and financial exposure for cadets and their sureties.

This section identifies the principal duties imposed and rights granted by the regulations, with pointers to the specific provisions that create them.

Duties of the cadet

• Full‑time study and leave without pay: The cadet must take leave without pay to undertake full‑time University study for the course specified in Schedule 1 (regulation 8(a)). That is a contractual duty rather than an employment leave entitlement entitlement in the ordinary sense.

• Work during vacations if required: If the Commissioner requires it, the cadet must work for the Commissioner during vacations between terms and between academic years (regulation 8(b)(i)-(ii)).

• Good conduct and diligence: Cadets must maintain conduct, diligence and efficiency sufficient to satisfy the Commissioner, who may suspend or terminate the cadetship for failing those standards (regulation 9(1)(b)).

• Completion of study and service: To be deemed to have completed the cadetship, the cadet must both satisfactorily complete study and serve the cadetship term including extensions (regulation 15(1)(a)-(b)).

• Post‑cadet service if required: If required, a cadet must serve as an Engineer , Class 1 for a period equivalent to the cadetship term plus extensions or for two years, whichever is greater (regulation 15(2)). The obligation to commence such employment is contingent on the Commissioner’s requirement.

Duties of the surety

• Payment of reimbursement: On termination by the Commissioner, the cadet and the surety are jointly and severally liable to repay the Commissioner the sum of allowances and tuition fees paid (regulation 16(1) and Schedule 2 clause 4).

• Continuing liability despite suspension: The surety’s liability is not affected by suspension, extension or other indulgence granted to the cadet by the Commissioner; the surety’s consent is not required for such indulgence (Schedule 2 clause 5).

Duties and discretions of the Commissioner

• Advertising and selection: The Commissioner must invite applications by public advertisement (regulation 3(1)) and appoint an officer to consider and report on applicants (regulation 3(2)).

• Approval of sureties and allowances: The Commissioner approves the identity of the surety (regulation 6(2)) and may approve payments such as living and transport allowances, increases to sustenance allowances where accommodation cost exceeds the category rate, and any further allowances necessary for undertaking the University course (regulation 11; regulation 12(4)-(5)).

• Performance monitoring and remedial action: The Commissioner may suspend or terminate cadetships for unsatisfactory examination results or conduct (regulation 9(1)); may require a cadet to repeat portions of the course on specified terms and restore the cadetship on attainment of satisfactory results (regulation 9(2)); may extend the term up to two years for incomplete course completion at the end of the term (regulation 9(4)); and may require entry into a new cadetship agreement, with termination if the cadet refuses or cannot procure a surety for a new agreement (regulation 9(7)).

Rights of the cadet

• Salary when working or on annual leave: A cadet is entitled to salary while working for the Commissioner during vacations and while on annual leave (regulation 10(2)).

• Salary scale and progression: The salary is to commence at a rate equivalent to item 5 of the specified scale or at an appropriate scale point if the cadet has prior course years, and increases to the next item on satisfactory completion of each year of the cadetship, subject to the Commissioner’s satisfaction with academic results (regulation 10(3)). Additionally, a cadet aged 21 or over must be paid not less than the Commonwealth minimum wage for their age (regulation 10(4)).

• Sustenance allowance and tuition fees: When not receiving salary, the cadet is entitled to a sustenance allowance (regulation 12(1)), at category 1 or 2 depending on residence relative to 40 km from Perth G.P.O. (regulation 12(2)), and compulsory tuition fees for subjects in the cadet’s University course are paid on the cadet’s behalf (regulation 12(6)). The Commissioner determines rates and notifies them in the Government Gazette (regulation 12(3)).

• Conditions of service parity: During the whole term and any extension, the cadet is entitled to the same conditions of service as permanent officers employed by the Commissioner, with the explicit qualification that the cadet is not an officer for the purposes of s 10(1) of the Main Roads Act 1930 (regulation 13).

• Annual leave for recreation: Despite the limitation in regulation 13, cadets are entitled to annual leave for recreation at times approved by the Commissioner (regulation 14(1)).

Notification and procedural rights

• Notice of decisions: Where the Commissioner suspends, requires repetition, extends, requires a new agreement or terminates a cadetship agreement, the Commissioner must cause written notification of that decision to be given to the cadet and the surety (regulation 9(5) and 9(7)).

Financial penalty and repayment rights available to the Commissioner

• Reimbursement on termination: The Commissioner can recover all allowances and tuition fees paid under regulation 12 if the Commissioner terminates the cadetship agreement (regulation 16(1)). Where the cadet commenced employment under regulation 15(2), the amount to be reimbursed is reduced in accordance with the formula specified in regulation 16(2). The Commissioner’s right to repayment operates as a contractual debt enforceable against both cadet and surety.

Limitations and exclusions

• No full public service employee status for s 10(1): Regulation 13 gives cadets the same conditions of service as permanent officers but expressly excludes cadets from being an officer for the purpose of s 10(1) of the Main Roads Act 1930. For lawyers advising on statutory entitlements, that exclusion may have targeted legal effects anchored in s 10(1) that the regulations do not import.

• Leave other than annual leave is without pay: Regulation 14 limits leave entitlements to annual leave for recreation and otherwise grants leave without pay for study terms and vacations unless the cadet is required to work.

These duties and rights create a conditional bundle of benefits and obligations that tie academic performance to salary progression and entitlement retention, and embed contingent post‑service requirements and repayment exposure for terminating cadets and their sureties.

The regulations do not create criminal sanctions or express pecuniary fines. Enforcement is largely contractual and administrative. The principal enforcement mechanisms are termination, suspension, withholding of allowances and contractual recovery of amounts paid. Each mechanism and the legal consequences are set out below with statutory references.

Administrative sanctions

• Suspension and termination for academic or conduct reasons, regulation 9(1). The Commissioner may suspend or terminate a cadetship where dissatisfied with examination results for a portion of the University course or as to the cadet’s conduct, diligence, efficiency or fitness to continue. Suspension is an administrative step that, subject to the Commissioner’s directions, suspends entitlement to allowances and tuition fee payments (regulation 9(3)). Suspension is also not a defence to repayment liability, as suspension does not relieve the cadet or surety from liability under the cadetship agreement (regulation 9(6)).

• Repetition and restoration, regulation 9(2). Where suspension is tied to unsatisfactory examination results, the Commissioner may require the cadet to repeat the relevant portion on terms specified and shall restore the cadetship if satisfied with the results on repetition. That provides a remedial pathway prior to termination and recovery.

• Extension, new agreement, termination for refusal of new agreement, regulation 9(4) and 9(7). If the cadet has not completed the University course by the end of the term, the Commissioner may extend the cadetship up to two years; require entry into a new agreement; or terminate the agreement. If the Commissioner requires a new agreement and the cadet refuses or cannot procure a surety, the Commissioner may terminate the existing agreement (regulation 9(7)).

Financial enforcement and repayment

• Reimbursement obligation on termination, regulation 16(1). If the Commissioner terminates a cadetship agreement the cadet and the surety are jointly and severally liable to pay to the Commissioner a sum equal to all allowances and tuition fees paid on the cadet’s behalf pursuant to regulation 12. That creates a contractual debt in favour of the Commissioner.

• Pro rata reduction where post‑cadet employment occurred, regulation 16(2). Where termination occurs after the cadet has commenced employment under regulation 15(2), the reimbursable sum is reduced in accordance with a formula specified in regulation 16(2). The regulation sets out the variables used in the reduction calculation (WS, WP, AF, R) and requires fractions of a week to be treated as one week (regulation 16(3)). The formula is part of the regulatory machinery for calculating the enforceable debt.

• Joint and several liability, Schedule 2 clause 4. The Schedule 2 agreement restates and implements the joint and several liability of the cadet and surety to repay the reimbursement sum without demand, if the agreement is terminated (Schedule 2, clause 3 and clause 4 references). The Schedule also states that liability is not affected by suspension, extension or indulgencies granted by the Commissioner (Schedule 2 clause 5).

Contractual remedies

• Unconditional right to repayment without demand. Schedule 2 provides that where the Commissioner terminates the agreement, the cadet and surety are liable to pay the calculated sum without the necessity for any demand (Schedule 2 clause 3). That clause accelerates the Commissioner’s ability to claim repayment.

Procedural protections and notice

• Written notification, regulation 9(5) and 9(7). The Commissioner must cause written notification of decisions to suspend, require repetition, extend, require a new agreement, or terminate to be given to the cadet and the surety. The regulations do not prescribe an internal appeal or review process, but the notice requirement creates an evidentiary trail for any later dispute.

Practical enforcement implications

• Recovery will be in contract. Enforcement of the reimbursement obligation will proceed as contractual debt recovery against cadet and surety. The regulations create the substantive basis for the debt; the procedural route for recovery will be ordinary civil proceedings unless agencies or internal debt recovery policies supply administrative collection options.

• No specified limitation periods or procedural steps. The regulations do not specify time limits or procedural steps prior to termination or recovery; they leave discretion to the Commissioner in carrying out suspensions, requirements to repeat, extensions and terminations. For legal advisers, this absence means that common law and statute governing contract termination, natural justice in administrative decisions and applicable civil procedure rules will be relevant if disputes arise.

• Entitlements withheld during suspension. While suspended a cadet is not entitled to be paid sustenance or tuition fees unless the Commissioner directs otherwise (regulation 9(3)), which is an immediate economic sanction.

No criminal offences or administrative fines are set out in the text. The regulatory enforcement architecture therefore relies on contract, administrative discretion and debt recovery. For practitioners representing cadets, sureties or the Commissioner the focal points for dispute will typically be whether the Commissioner acted within its discretion when suspending or terminating, whether proper notice was given, whether academic results or conduct actually justified the action, and the correct calculation of any repayment sum under regulation 16(2).

The regulations are framed to operate alongside and reference several other statutory and industrial instruments. The text itself identifies those interactions and constrains the legal effect of the cadetship in relation to other statutes and agreements.

Main Roads Act 1930

• The regulations expressly operate under the Main Roads Act 1930, which the regulations define as “the Act” (regulation 2). Regulation 13 states that during the cadetship and any extension the cadet is entitled to the same conditions of service as permanent officers in the employment of the Commissioner, but that the cadet is not an officer of the Commissioner for the purposes of section 10(1) of the Act. That carve‑out will be important for lawyers considering the cadet’s substantive statutory status and any rights or obligations that hinge on being an “officer” under s 10(1), as the regulations explicitly exclude cadets from that category for that statutory purpose.

Industrial agreements and minimum wages

• Salary scale reference, regulation 10(1)-(3). Regulation 10 links cadet salary commencement and increments to the “scale of salaries applicable to Group 1 Officers, as contained in the Main Roads Department General Division Salaries Agreement No. 6 of 1982 as amended from time to time, or the equivalent scale in any agreement made in substitution for that agreement.” The regulation therefore embeds an industrial agreement into the determination of salary points for cadets. Any successor industrial instruments that replace the named agreement will therefore affect the cadet salary scale.

• Minimum wage reference, regulation 10(4). The salary paid to a cadet who has attained the age of 21 must be not less than the minimum wage determined from time to time by the Commonwealth Conciliation and Arbitration Commission for a person of that age. That links cadet salary floor to federal industrial law determinations as they stood at the time of the instrument and as subsequently determined.

Public Service Act and Regulations

• Regulation 13 cross‑references the Public Service Act and Regulations implicitly by granting cadets the same conditions of service as permanent officers, subject to the exclusion noted above. That suggests that the conditions of service regime in the wider public service architecture is imported in substance even though statutory officer status is excluded in respect of s 10(1) of the Main Roads Act. Advisers will need to consider which specific conditions of service are adopted operationally and whether any other statutory definitions or exclusions in the Public Service Act alter the cadet’s entitlements.

University and tertiary law

• The regulations require cadets to undertake specified University courses at the University of Western Australia or Curtin University of Technology (regulation 2 definition of University; Schedule 1). Interaction with University rules, academic progress frameworks, fees rules and the universities’ obligations to provide enrolment, teaching and assessment services will be practical matters of interface. For example, the Commissioner’s obligation to pay compulsory tuition fees for course subjects (regulation 12(6)) interacts with University fee invoicing and remission policies.

Contract and common law

• The Schedule 2 agreement creates a deed between the Commissioner, the cadet and a surety. Common law principles on contract formation, interpretation of deeds, enforceability of surety agreements, unconscionability, restraint and the like will govern disputes arising under the cadetship contract, supplemented by the regulatory framework that imposes obligations and rights.

Administrative law and natural justice

• The Commissioner’s discretions to suspend, require repetition, extend, require new agreements and terminate (regulation 9) will sit within administrative law principles. While the regulations prescribe notice to cadet and surety (regulation 9(5)), they do not expressly establish an appeal or internal review mechanism. Legal advisers should therefore consider natural justice and procedural fairness obligations where the Commissioner’s decision has significant adverse consequences, including potential repayment liability.

Debt recovery and civil procedure

• The Commissioner’s right to recover allowances and tuition fees under regulation 16 is contractual. Recovery of the reimbursable sum, and any dispute about the calculation under regulation 16(2), will be resolved through ordinary civil enforcement channels, subject to limitation periods and procedural rules not specified in the regulations.

Other regulatory instruments repealed

• Regulation 18 repeals three prior Main Roads Department regulations relating to cadet admission (Main Roads Department Admission of Cadet Draftsmen (Engineering) Regulations 1966; Main Roads Department (Admission of Engineering Cadets) Regulations 1967 as amended; Main Roads Department Admission of Engineering Surveying Cadets Regulations 1967). The repeal signals an intent to consolidate or replace prior cadet admission frameworks with the present regulations.

In short, the regulations form a node in a network of employment, industrial, university and administrative law. Practitioners must take an integrative approach when advising, bearing in mind the explicit references to the Main Roads Act, the named industrial agreement, the Commonwealth wages determinations, university obligations and the common law of contract and administrative justice.

The text contains an explicit compilation table and in‑text amendment notations. Those are the only legislative history items provided within the supplied source. The key elements are as follows.

Primary instrument and commencement

• The Main Roads (Engineering Cadets) Regulations 1982 were made and gazetted on 26 November 1982 and commenced on the same date, as recorded in the compilation table at the end of the instrument.

1991 amendment

• The instrument records an amending instrument titled Main Roads (Engineering Cadets) Amendment Regulations 1991, gazetted on 5 July 1991, which also commenced on 5 July 1991 (Compilation table). Several in‑text notations indicate amendment of specific regulations and schedules on that date. The in‑text markers read, for example, “[Regulation 2 amended: Gazette 5 July 1991 p.3354.]” Similar amendment notations appear beside regulations 4, 7, 8, 9, 10, 12, 14, 15 and Schedule 3, and Schedule 1 bears the annotation “[Schedule 1 amended: Gazette 5 July 1991 p.3354.]”

Notable textual changes visible in the supplied instrument

• Deletion recorded in regulation 4. The text of regulation 4 shows that paragraph (a) has been deleted; the current operative eligibility paragraphs are (b) and (c) as printed. The deletion is explicitly marked in the regulation as “[(a) deleted]”.

• Multiple regulations and schedules annotated as amended on 5 July 1991. The in‑text amendment footnotes on numerous regulations and Schedule 3 indicate that the 1991 amendment affected a variety of provisions, though the supplied instrument does not reproduce the historical text that existed prior to amendment. The compilation table shows only the original 1982 regulations and the 1991 amending regulations.

How to read the amendment annotations

• The in‑text amendment annotations identify which provisions were amended and give the Gazette citation for the amending instrument. Those citations are the proper references for obtaining the exact text of the amendments and any explanatory material that accompanied them, which are not contained in this supplied instrument. Where the regulations themselves display replacement or deleted text, that change is reflected in the current printed version.

Limitations of the provided compilation history

• The compilation table in the supplied source lists only one amending instrument, the 1991 Regulations, and does not include any subsequent amendments or repeals beyond that date. Practitioners should treat the compilation table as reflecting the text in the supplied document only and should check the official recompiled statute database or Gazette records for any amendments after 5 July 1991, or for any consolidations, legislative reforms, or repeals that may have affected the scheme subsequently.

Practical recommendation based on what is recorded

• Where the exact content of an earlier version or particulars of an amendment matter to a legal question, the Gazette citation provided in the in‑text notes (Gazette 5 July 1991 p.3354‑5) is the starting point to retrieve the amending instrument and any associated explanatory materials. For matters such as the deletion of regulation 4(a), the Gazette and associated amending regulations will show the precise textual change and any transitional arrangements.

In summary, the supplied instrument records the original 1982 regulations and a single recorded 1991 amendment. The visible amendments include the deletion of a subparagraph in regulation 4 and multiple tagged updates to provisions and schedules. For authoritative historical detail beyond these annotations the primary sources are the Gazette entries cited in the in‑text amendment notes.

The supplied instrument contains no judicial decisions, case citations, or reported litigation touching these regulations. The text does not identify any litigation. The compilation table and the regulations themselves record the legislative instrument and a single amending instrument, but do not list judicial proceedings.

What the absence of recorded litigation in the instrument means practically

• No record in the instrument. Because the instrument as provided includes no litigation references, there is no source‑grounded case law to cite from within this text that interprets, construes, or applies these regulations.

• Practical search step. For any litigation history or judicial interpretation one must search external sources: court databases, tribunal decisions, administrative law reports and legal databases. The Gazette citations for the amending instruments are the place to locate the amending text, but they will not disclose litigated disputes. If a practitioner requires precedent on issues likely to arise under these regulations , for example, the scope of the Commissioner’s discretion to terminate, the enforceability of the repayment clause, doctrines of unconscionability in surety agreements, or natural justice in suspension decisions , those authorities will need to be found in general administrative law and contract jurisprudence, and any reported cases that specifically reference these Main Roads cadetship regulations.

Anticipated dispute themes where litigation might arise

• Termination and procedural fairness. Challenges may arise if termination is alleged to be procedurally unfair or ultra vires the Commissioner’s powers under regulation 9. Judicial review principles would be the likely law applied.

• Enforceability of reimbursement and surety obligations. Disputes between cadet, surety and Commissioner about the computation of reimbursable amounts under regulation 16, or claims that the surety agreement is voidable for unconscionability or other equitable grounds, could generate litigation.

• Interpretation of completion and service obligations. Where the cadet disputes whether they have “satisfactorily completed” the course or whether the Commissioner may lawfully require post‑cadet service under regulation 15(2), contractual interpretation and administrative law principles will be relevant.

Because none of these potential litigated matters are documented in the supplied instrument, practitioners must rely on external case law and factual investigation to advise on the likely judicial resolution of disputes concerning these regulations.

This section flags specific provisions and practical wrinkles that commonly give rise to legal and operational risk for employers, cadets and sureties. Each item is grounded in the statutory text and notes the concrete mechanism causing the issue.

Surety requirement and joint and several liability

• Mechanism. Regulation 6(1) requires a cadet and a surety to enter the Schedule 2 agreement before commencement, and regulation 6(2) limits the surety to the cadet’s legal guardian or another person the Commissioner approves. Under regulation 16(1) and Schedule 2 the cadet and surety are jointly and severally liable to reimburse allowances and tuition fees on termination.

• Practical risk. A cadet without a willing surety cannot commence; a surety may not appreciate the breadth of joint liability, including that liability survives suspension and other indulgences (Schedule 2 clause 5). Advisers should ensure sureties receive independent advice and that the Commissioner’s approval of an alternative surety is given in writing.

Commissioner discretion is broad and lightly constrained in the text

• Mechanism. The Commissioner may suspend or terminate for unsatisfactory examinations or conduct (regulation 9(1)), decide on allowance rates and increases (regulation 12(3)-(5)), approve sureties (regulation 6(2)), and require work during vacations (regulation 8(b)). Salary progression is conditional on the Commissioner being satisfied with academic results (regulation 10(3)).

• Practical risk. The regulations do not spell out objective standards or procedural steps beyond written notice on certain decisions (regulation 9(5) and 9(7)). That raises risk of procedural fairness claims where adverse decisions are made without fair process. Agencies should maintain contemporaneous records and reasoned decisions. Cadets and sureties should seek written reasons where adverse decisions affect entitlements or trigger repayment.

Repayment liability on termination is broad and may be immediate

• Mechanism. Regulation 16(1) makes cadet and surety liable to repay “a sum of money equivalent to the sum of all allowances and tuition fees paid” on termination. Schedule 2 provides that this liability requires no demand (clause 3 as read with regulation 16(1)).

• Practical risk. A terminated cadet can face a substantial debt for allowances and tuition. The regulations allow a reduction where paid employment has occurred, but the reduction is calculated under a formula in regulation 16(2) the specifics of which must be carefully applied. Parties should ensure accurate accounting of AF (all allowances and fees) and weeks served (WS), and allow for the regulation 16(3) rule that fractions of a week count as a week.

Limitations on leave and salary timing

• Mechanism. Regulation 14 limits leave entitlements to annual recreation leave and otherwise grants leave without pay for study terms and vacations, unless the cadet is required to work. Regulation 10 clarifies salary is payable only when working for the Commissioner or on annual leave.

• Practical risk. Cadets may assume continuation of salary during semester study periods; the regulations do not support that. Employers must ensure payroll and HR systems reflect the salary timing and leave without pay characterisation to avoid overpayments or incorrect leave accrual.

Tuition fee payment scope

• Mechanism. Regulation 12(6) entitles cadets to have compulsory tuition fees paid for those subjects comprised in their University course but expressly excludes fees for subjects taken as a repetition of or in addition to or substitution for any part of that course.

• Practical risk. If a cadet must repeat a subject because of failure, the Commissioner is not obligated to pay those repeated subject fees. That creates both an academic and financial risk for cadets who require repeats; the Commissioner’s discretion in payments under regulation 9(2) and 12(6) may be contested.

Salary scale linkage and minimum wage

• Mechanism. Regulation 10 ties cadet salaries to a named industrial agreement (Main Roads Department General Division Salaries Agreement No. 6 of 1982) and to the Commonwealth Conciliation and Arbitration Commission’s minimum wage for those aged 21 or over.

• Practical risk. Changes to industrial instruments or to federal minimum wage determinations will affect cadet remuneration; employers must track successor agreements and minimum wage adjustments to ensure compliance.

Written notification limited to certain decisions

• Mechanism. Regulation 9 requires written notification where the Commissioner suspends, extends, requires a new agreement or terminates, or requires repetition. Other discretionary approvals, such as approval of a surety, allowance determinations under regulation 12, or decisions to require work during vacations, do not carry a statutory written notification floor in the text.

• Practical risk. Lack of statutory notification for some decisions increases the evidentiary burden for affected cadets and sureties to prove what was approved or declined. Best practice is to document approvals and decisions regardless of whether the regulation mandates written notice.

Interpretation of “satisfactory progress” and disciplinary standards

• Mechanism. Regulation 2 defines “satisfactory progress” as pursuing to completion and passing examinations at a rate and in a manner that satisfies the Commissioner. The standard is therefore subjective and Commissioner‑determined.

• Practical risk. A subjective satisfaction standard invites disagreements about academic sufficiency and will be fertile ground for disputes. Agencies and advisers should clarify expectations and provide objective benchmarks where possible.

No internal appeal mechanism in the regulations

• Mechanism. The regulations do not establish an appeal or review procedure for decisions to suspend, terminate or require repayment.

• Practical risk. Affected cadets will need to rely on statutory review or judicial review remedies outside the instrument if they wish to challenge decisions; those routes are potentially time‑consuming and costly.

In short, the combination of a required surety, joint and several repayment exposure, broad Commissioner discretion, limited leave and salary entitlements during study, and a lack of procedural detail for appeals or internal review creates a set of legal and administrative risks that practitioners and clients should address at intake, agreement execution and during performance monitoring.

Compliance with the Main Roads (Engineering Cadets) Regulations 1982 requires attention to pre‑commencement, in‑service administration, recordkeeping and exit procedures. The steps below set out a practical checklist and process mapped to the regulations.

Pre‑commencement: selection, eligibility and agreement

1. Public advertisement and assessment. Ensure the Commissioner’s office publishes cadetship vacancies by public advertisement (regulation 3(1)). Appoint an officer to assess applicants and require that officer to document academic records and other suitability considerations (regulation 3(2)-(3)).

2. Verify eligibility documents. Require applicants to produce documentary proof of date of birth, evidence of course qualification or completion as required by regulation 4(b), evidence as to character, medical certificate of fitness, and a completed questionnaire on the Commissioner’s form (regulation 5(a)-(e)). Keep certified copies on the cadet’s file.

3. Conduct aptitude testing if required. If the Commissioner mandates an aptitude test, administer it and retain test records and scoring results (regulation 4(c)).

4. Approve and document surety. Confirm the surety is acceptable under regulation 6(2) and obtain written approval where the surety is an alternate person rather than the legal guardian. Provide the surety with independent explanatory materials and encourage legal advice, given the joint and several liabilities (regulation 6 and Schedule 2).

5. Execute the cadetship agreement before commencement. Sign and seal the Schedule 2 agreement with cadet and surety before commencement of the cadetship, and retain original executed copies. Ensure the agreement includes the specific term of cadetship determined under regulation 7 and reflects any reduction due to prior course years (regulation 7(1)-(2)).

In‑service: monitoring, pay and allowances

6. Implement leave and study arrangements. Record that the cadet is on leave without pay for full‑time study (regulation 8(a)) and document any Commissioner directives requiring vacation work and the terms under which such work is to be performed (regulation 8(b)).

7. Salary payments and scale progression. Pay salary only during periods the cadet is working for the Commissioner and during annual leave (regulation 10(2)). Determine starting salary consistent with the scale referenced in regulation 10(1) and document progression to the next scale point only upon the Commissioner’s satisfaction with academic results at the completion of each year (regulation 10(3)). For cadets aged 21 or more, ensure salary meets or exceeds the Commonwealth minimum wage for that age (regulation 10(4)).

8. Manage sustenance and other allowances. Pay sustenance allowances when the cadet is not on salary, classifying cadets appropriately as category 1 or 2 depending on ordinary residence relative to 40 km from Perth G.P.O. (regulation 12(1)-(2)). Apply Commissioner‑determined rates and publish any rate changes in the Government Gazette as required (regulation 12(3)). If a category 2 cadet’s accommodation costs exceed the allowance, approve an increase up to the limit of college residence rate (regulation 12(4)). Document all approvals and calculations for allowances and additional discretionary payments (regulation 12(5)).

9. Tuition fees and fee exclusions. Pay compulsory tuition fees for subjects comprising the cadet’s University course (regulation 12(6)), but do not pay fees for repeated, additional or substitutive subjects unless there is a specific Commissioner direction. Track faculty, service and amenities fees as the cadet’s responsibility (regulation 12(7)).

Academic performance and remedial measures

10. Monitor academic progress and maintain records. Record examination results, academic standing, and correspondence with the cadet concerning progress. Apply the regulation 2 definition of satisfactory progress where applicable and create internal guidance explaining what will constitute “satisfaction” to reduce subjective disagreement.

11. Exercise suspension, repetition and restoration procedures carefully. Where academic results or conduct give cause for action under regulation 9(1), give written notification to the cadet and surety (regulation 9(5)). If requiring repetition, set out terms and conditions in writing and track the cadet’s results to determine restoration. Maintain contemporaneous reasons for suspension or termination in case of dispute.

Extensions, new agreements and termination

12. Extensions and new agreements. If the cadet has not completed the University course by the end of the term, consider whether to extend the cadetship up to two years, require a new agreement, or terminate (regulation 9(4)). Where requiring a new agreement, provide written notification and, if the cadet refuses or cannot procure a surety, follow the regulation 9(7) termination pathway. Document each step.

13. Notice and record keeping on adverse decisions. Provide written notice for suspensions, requirements to repeat, extensions, requirements for new agreements and terminations to both cadet and surety (regulation 9(5) and 9(7)). Keep records of notice and any supporting evidence to support the Commissioner’s discretionary decision.

Repayment calculations and recovery

14. Calculate reimbursements per regulation 16. If terminating the agreement, calculate the reimbursable sum equal to all allowances and tuition fees paid under regulation 12, and where applicable apply the reduction formula under regulation 16(2). Preserve records that evidence AF (all allowances and tuition fees), WS (weeks served under regulation 15(2)), and WP (period required to serve), and apply regulation 16(3) to treat fractions of a week as one week. If the formula is unclear or the image in related print versions is missing, obtain the official legislative text or Gazette amending instrument for the precise mathematical expression.

15. Issue repayment notices and pursue recovery under contract law. Although Schedule 2 states repayment may be required without demand, best practice is to issue a formal written demand with itemised calculations and timing for payment, and to set out consequences of non‑payment; where recovery is required, commence civil proceedings or apply the agency’s internal debt recovery policy.

Suspension and readmission

16. Manage agreed suspensions using Schedule 3. If a cadet applies for suspension and the Commissioner approves, execute the Schedule 3 agreement to effect the suspension and ensure the suspension period and readmission terms are clearly recorded, including the financial suspension of payments during the suspension period (Schedule 3 clause 2).

General administrative and compliance practices

17. Maintain contemporaneous evidence of Commissioner satisfaction. Because many entitlements and progression points are conditional on the Commissioner’s satisfaction (for example regulation 10(3)), maintain records of the factual basis for satisfaction decisions to resist later claims of arbitrariness.

18. Keep cadet and surety informed. Given the joint and several liability and the potentially significant debt exposure, ensure communications to cadets and sureties are timely, in writing and comprehensible. Encourage sureties to seek independent advice before signing.

19. Track external instruments. Monitor changes to the Main Roads Department salary agreements and the Commonwealth minimum wage determinations that affect cadet remuneration (regulation 10(1) and 10(4)). Ensure Gazette publication of allowance rates is complied with (regulation 12(3)).

20. Legal review of standard forms. Periodically review the Schedule 2 and Schedule 3 forms to ensure that they reflect current law and policy, and to consider whether additional consumer protection or explanatory clauses should be appended consistent with the regulations and broader law.

Following these steps will create a defensible administrative record, reduce the risk of procedural fairness claims, ensure accurate financial accounting and provide clear bases for any enforcement action under the regulations.
