MAGNA CARTA (1297) 25 EDW 1 C 29

The republished text embodies a small set of legal concepts expressed in medieval language; the republication does not add statutory definitions. The central concepts that appear in the reproduction are these, as stated in the provision headed "29 Imprisonment etc contrary to law":

• Freeman. The text refers to "No freeman shall be taken or imprisoned" and addresses "all freemen of this our realm" in the prefatory material. The republication does not provide a statutory definition of "freeman". The term therefore appears in the Act only in its historical wording; the document does not explain how that wording maps onto modern categories of persons (see the reproduced preface and clause 29).

• Lawful judgment of peers or law of the land. The clause conditions deprivation of liberty or property on "lawful judgment of his peers or by the law of the land". Those two alternative predicates are the procedural standards the text identifies: either judgment by peers, or by the law of the land. The republication reproduces those expressions without statutory elaboration or operational detail about how contemporary courts are to apply them (clause 29).

• Property and liberties. The text protects "freehold, liberties or free customs" from dispossession ("disseised"). The terms are part of the medieval lexical field of property and customary rights; the republished law does not supply definitional detail or modern equivalents (clause 29).

• Prohibition on selling, denying or deferring justice. The sovereign's undertaking "We will sell to no man, and we will not deny or defer to any man, either justice or right" is reproduced as a direct obligation proclaimed in the text; structurally it is an assurance against commodification, denial or delay of judicial remedy (clause 29).

• Perpetual confirmation. The final sentences of the reproduced text are a ratification and confirmation, expressing that the gifts and grants (the liberties) "for ever shall be steadfastly, firmly and inviolably observed" and that the sovereign and heirs "renew the same". This is declaratory language incorporated in the Act as part of the reproduced text.

Beyond these concepts, the republication establishes two procedural editorial concepts about the status of the text in the ACT statute book: (1) the Parliamentary Counsel may make editorial amendments under Legislation Act 2001, part 11.3 and has done so for this republication (see About this republication), and (2) the 1986 Imperial Acts Application Act is the Commonwealth instrument that fixed the amended form of the text to apply in the ACT (see endnote 4). The republication also records that certain original chapters of the medieval statute were omitted from the ACT version by the 1986 Act (chapters 1-28 and 30-37 were omitted), so the present statutory concept set is deliberately narrow compared with the original text (amendment history).

The document contains no statutory definitions, no schedules, no modern procedural rules, and no express interaction clauses with contemporary human rights instruments. It preserves historical legal language and records the textual and legislative history that carries that language into ACT law. Any interpretative questions about the reach or contemporary meaning of terms such as "freeman", "law of the land" or "peers" are not resolved in the republication’s main text; the endnotes and front material instead supply the legislative provenance and editorial process.

The text of the republished Magna Carta uses the phrase "all freemen" and addresses archbishops, bishops, abbots, priors, earls, barons and "all freemen of this our realm" in its opening salutations. The republished instrument therefore names a class , "freemen" , as the primary beneficiaries of the protections in clause 29. The republication itself does not provide a statutory definition of "freeman" and does not set out exclusionary or inclusive criteria in modern terms; it leaves the historical term in place (see opening paragraph of the reproduced charter and clause 29).

Practically, the effect of the republication is to make the text part of the ACT statute book as an ACT enactment (see endnote 3). The legislation history traces how the original UK Act was in force in the NSW colony immediately before 1 January 1911 and then was continued and adapted by successive Commonwealth statutes (Seat of Government Acceptance Act 1909 s 6; Seat of Government (Administration) Act 1910 s 4) and later converted into an ACT enactment under the Australian Capital Territory (Self‑Government) Act 1988 s 34(4) (converted into an ACT enactment on 11 May 1989). That recorded chain of conversion means the clause now sits within the corpus of ACT laws, so the formal addressee of the rule is the body politic of the ACT as constituted by ACT law, rather than the English feudal polity for which the original text was drafted (see endnote 3).

Who decides whether an individual falls within the protective class remains an interpretative question not determined in the republication. The clause itself sets the decision‑maker for lawful deprivation of liberty as "his peers" or the "law of the land" (clause 29). The republication does not specify how contemporary courts are to construe "peers" (the historical sense might suggest jury or social equals) or the precise content of "law of the land", and it does not provide a mechanism for administrative classification of persons as "freemen". In that sense the statutory text addresses individual rights in abstract terms and places interpretative responsibility on judicial institutions and legal processes established elsewhere in ACT law.

The republication also affects government actors and offices indirectly because the clause declares an obligation on the sovereign: "We will sell to no man, and we will not deny or defer to any man, either justice or right" (clause 29). Where that declaration is treated as operative by courts or administrative organs, it imposes constraints on public decision‑makers in the administration of justice. The front material indicates the text was subject to editorial amendment under the Legislation Act 2001; that process and the 1986 amendments determine which parts of the original statute are in the ACT law as currently republished (see About this republication; endnote 4).

Finally, the instrument’s penalty unit paragraph records penalty unit values that apply to offences against the republished law at the republication date: $100 per unit for individuals and $500 per unit for corporations. The republication does not specify particular criminal offences within the clause itself; the penalty unit statement is a technical detail about monetary valuation that would be applied if an offence under this republished law were prosecuted (see "Penalties" paragraph).

The republished text primarily records rights rather than a detailed set of statutory duties. Rights created or stated in the textual reproduction are:

• Right not to be deprived of liberty except by lawful process: The clause provides that "No freeman shall be taken or imprisoned... nor will We pass upon him nor condemn him, but by lawful judgment of his peers or by the law of the land" (clause 29). That is a textual immunity against arbitrary detention expressed as a legal precondition for lawful deprivation of liberty or property.

• Right to property security from dispossession: The phrase "or disseised of his freehold, liberties or free customs" protects freehold and customary rights from being taken without lawful judgment or law of the land (clause 29).

• Right to access to justice without sale, denial or delay: The sovereign’s undertaking "We will sell to no man, and we will not deny or defer to any man, either justice or right" is a textual promise that no person shall be denied or delayed in the pursuit of justice, and that justice will not be commodified through sale (clause 29).

• A statement of permanence: The concluding sentences confirm and make strong the grants and declare that the charter’s articles "for ever shall be steadfastly, firmly and inviolably observed", which, in textual form, asserts permanence for the rights declared in the charter.

Duties identified by the text are primarily directed at the sovereign (or the public authority inheriting that sovereign capacity under the statutory history), and consist of obligations to observe the charter’s guaranteed liberties and to avoid selling, denying or deferring justice (clause 29 and the ratification paragraphs). The republication frames the duty in declaratory terms rather than prescribing an enforcement mechanism; the obligation is stated as a ratified commitment by the sovereign and heirs.

Enforcement and decision‑making modalities are implicit in the text rather than elaborated. The clause expressly conditions lawful deprivation of liberty or property on "lawful judgment of his peers" or "the law of the land". Those two predicates indicate procedural duties: either a decision by peers (the text does not define "peers") or a decision conforming to the law as understood in the polity. The republication does not restate or create the procedural infrastructure (for example, modern criminal procedure, trial by jury, or judicial review) that would operationalise those predicates; it leaves the appliance of those predicates to the ACT’s existing legal system and institutions as they operate under other statutes and common law, subject to judicial interpretation.

Because the republication does not contain modern definitional or procedural scaffolding, the immediate practical duties on administrators and courts follow from their existing statutory powers and responsibilities within the ACT statute book; the republished charter text supplies substantive limits or rights that those institutions may be required to take into account when interpreting or applying ACT law. The front and endnotes record how the charter was carried into ACT law and that editorial amendments have been applied to bring wording into line with drafting practice (About this republication), which may affect textual form but not the declared rights and duties as the Parliamentary Counsel has treated them.

The reproduced substantive clause (clause 29) does not itself prescribe a criminal penalty for breaching its terms; it states rights and the sovereign's undertaking with ratification language but does not attach a specified punishment within the clause. The republication, however, includes an administrative note on penalty units that applies to offences against the republished law at the republication date: $100 per penalty unit for individuals and $500 per penalty unit for corporations (see the "Penalties" paragraph in the front material). That note functions as a technical valuation for monetary penalties where an offence under the republished instrument is prosecuted, but the republished charter text contains no enumerated offences to which the penalty unit would automatically apply; it is therefore a logistical detail about penalty valuation in the ACT statute book.

Enforcement in practice would be through the ACT legal system and the courts. The clause itself identifies the decision‑makers whose adjudication legitimates deprivation of liberty or property: "lawful judgment of his peers or by the law of the land" (clause 29). Those phrases point to judicial processes and legal standards as the enforcement mechanism, but the republication does not map the medieval wording onto contemporary procedural institutions or provide modern enforcement mechanisms such as a statutory right of action, administrative review pathways, or specified criminal sanctions for breach by a public official. The endnotes recording the conversion of the Act into an ACT enactment (endnote 3) indicate that the charter sits within the ACT legal order and therefore is subject to enforcement through the ACT courts in the ordinary way that ACT statutes are enforced; the republication, however, does not itself identify any particular judicial remedy or forum.

The front material also explains the editorial amendments made under Legislation Act 2001, part 11.3 and references ss 115 and 117 of that Act. Those sections (as cited in the republished material) mean that editorial changes made by Parliamentary Counsel when preparing the law for republication "have effect as if they had been made by an Act commencing on the republication date". That administrative detail affects the formal legal status of the textual form being enforced, since the text in the republication incorporates those editorial changes and they are treated as having effect for all legal purposes from the republication date.

Practical enforcement therefore depends on two things recorded in the republication: (1) the substantive text whose phrases direct that deprivation of liberty or property must be by lawful judgment of peers or by law of the land (clause 29), and (2) the contemporary statutory and judicial framework of the ACT (acknowledged by the legislative history in endnote 3) which supplies the courts and procedures that interpret and operationalise those phrases. The republication itself does not list civil procedure rules, criminal procedure rules, or administrative mechanisms for seeking remedies under the charter; it relies on the ACT legal system to give effect to the text.

Finally, the amendment history records that the Imperial Acts Application Act 1986 amended and fixed the text that applies in the ACT and omitted substantial chapters of the original statute (see amendment history, endnote 4). That legislative modification may affect the existence or absence of any remedial or penal machinery that might once have accompanied other parts of the medieval statute, because those omitted chapters are not part of the current ACT text.

The republication is explicit about its statutory genealogy and the instruments through which the original UK Act became part of the ACT statute book. The endnotes set out the chain of interaction with Commonwealth and ACT legislation:

• Seat of Government Acceptance Act 1909 (Cwlth), s 6: the legislation history records that the Magna Carta was "in force in NSW immediately before 1 January 1911" and was continued in force by the Seat of Government Acceptance Act 1909, s 6 (endnote 3). That shows an early interaction whereby the imperial statute continued to operate within Australian jurisdictional arrangements.

• Seat of Government (Administration) Act 1910 (Cwlth), s 4: the endnotes state that under s 4 the Act had effect in the ACT as if it were an ACT law, subject to ordinances made under the Seat of Government (Administration) Act 1910 (endnote 3). The republication therefore records that earlier Commonwealth legislation made the imperial statute operate within the local administrative framework.

• Australian Capital Territory (Self‑Government) Act 1988 (Cwlth), s 34(4): the endnotes explain that most former UK laws in force in the ACT were converted into ACT enactments by s 34(4) of the Self‑Government Act and that this conversion allowed the ACT Legislative Assembly to amend and repeal those laws; the Magna Carta was converted into an ACT enactment on 11 May 1989 (endnote 3). That conversion constitutes the legal mechanism by which the text became formally part of the ACT’s own legislative corpus.

• Interpretation Act 1967 (repealed), s 65: the endnotes say that under the Interpretation Act 1967 s 65, all former UK Acts in force in the ACT immediately before 10 November 1999 (including this Act) "became, for all purposes, laws made by the ACT Legislative Assembly", completing the transformation of former UK Acts into ACT laws (endnote 3). The republication thus records another vector by which the imperial text entered the local law.

• Imperial Acts Application Act 1986 A1986‑93 s 5 and sch 3 pt 2: the amendment history explains that the 1986 Act set out the text of the Magna Carta in an amended form and provided that the amended form was to apply as the text of the Act in force in the ACT (endnote 4). The 1986 Act also omitted chapters 1-28 and 30-37 from the imperial text as it applies in the ACT and amended enacting and confirmation provisions to remove obsolete words (endnote 4). Consequently, the content of the republished text is not the entire medieval statute but a truncated form selected and amended by the 1986 Commonwealth legislation.

• Legislation Act 2001, part 11.3: the front material indicates Parliamentary Counsel has authority under the Legislation Act 2001, part 11.3 to make editorial amendments and other formal changes when preparing the law for republication (About this republication). Those editorial changes are reported as included in the republication and are treated as having effect as if enacted on the republication date (see Legislation Act 2001, ss 115 and 117 as cited in the front material).

Operationally, these interactions mean the republished Magna Carta text is not a free‑standing historical document; it is an ACT enactment whose current form is determined by a sequence of Commonwealth and ACT legislation and Parliamentary Counsel editorial changes. The document records that certain chapters of the original Act were deliberately excluded by the 1986 Act, so the present text interacts with other laws by omission as well as inclusion. The republication itself warns readers that uncommenced provisions and current modifications would be signalled by symbols (U and M) adjacent to provision headings, and that the endnotes list legislation and amendment history (About this republication); the present republication does not appear to have uncommenced provisions or modifications in the body text.

Users seeking to understand how the charter interacts with specific modern ACT statutes (for example, statutes setting out criminal procedure, administrative review, or human rights protections) must consult those statutes directly. The republished text supplies the substantive historical wording and the statutory genealogy that places the phrase within ACT law, but it does not replace or override later statutory provisions that may prescribe modern process, rights or remedies. The endnotes record the conversion mechanisms and the 1986 amendments that define the text’s present form and therefore its potential points of interaction with contemporary ACT legislation.

The republication includes a discrete amendment history summarised in the endnotes (endnote 4). The key amendment events recorded in the document are:

• Imperial Acts Application Act 1986 (A1986‑93), s 5 and sch 3 pt 2: This Commonwealth Act set out an amended text of the Magna Carta and provided that the amended form was to apply as the text of the Act in force in the ACT. The amendment history says the 1986 Act "set out the text of this Act in an amended form and provided for the amended form to apply as the text of the Act in force in the ACT" (endnote 4).

• Omission of chapters: The 1986 Act explicitly omitted Chapters 1-28 and 30-37 of the original imperial statute from the form applicable in the ACT. That means the republished instrument represents a truncated selection of the original medieval statute (endnote 4).

• Amendment of enacting and confirmation provisions: The 1986 Act amended the enacting provision and the confirmation provision at the end of the original statute "to omit obsolete and unnecessary words" (endnote 4). The republished text therefore reflects updated enacting language compared with the original form.

• No further amendments after 1986: The amendment history records that "This Act has not been amended since the enactment of the 1986 Act" (endnote 4). That means, according to the republication record, the content as fixed by the 1986 Act (adjusted by any Parliamentary Counsel editorial amendments incorporated under the Legislation Act 2001) is the current legislative text as of the republication date.

• Editorial amendments under Legislation Act 2001: The front material states that the Parliamentary Counsel has authority under Legislation Act 2001, part 11.3 to make editorial and formal changes when preparing a law for republication. It also notes that "This republication includes amendments made under part 11.3 (see endnote 1)". The endnote 1 explains the general effect of editorial changes, and the front material references ss 115 and 117 of the Legislation Act 2001 in relation to the legal effect of such editorial changes (About this republication and endnote 1).

The amendment history in the republication is therefore limited and specific. It records a single substantive Commonwealth amendment in 1986 which fixed the text for ACT purposes, omitted specified chapters, and altered some enacting language, followed by the inclusion of Parliamentary Counsel editorial amendments under the modern legislative republication process. The republication also explains that not all editorial amendments made under part 11.3 are annotated in the amendment history and that full details of amendments can be obtained from the Parliamentary Counsel’s Office (endnote 1). The legislative history (endnote 3) details the earlier continuity of the imperial statute into NSW and subsequent conversion steps into the ACT legal order.

Users should note that the republication claims no further substantive amendments have been made since the 1986 Act; however, the Parliamentary Counsel's editorial amendments have been incorporated and are treated as having legal effect from the republication date under the Legislation Act 2001, as stated in the front material.

The republished instrument contains no case law citations, no reported judgments, and no litigation docket entries. The text of the republication itself does not include a schedule of litigation, nor does the endnote material identify any judicial decisions interpreting the republicuted clause within the ACT. The document therefore records no litigation history for the text it reproduces.

Because the republication is primarily a textual and historical record, it does not supply interpretative gloss or judicial construction of the key phrases such as "freeman", "lawful judgment of his peers", or "law of the land". The absence of litigation history in the republication means that the document does not record whether or how ACT courts have treated the clause, nor does it identify judicial authorities that might illuminate how the medieval wording maps to modern procedural guarantees. The endnotes focus on statutory provenance and amendment history rather than case law.

For practitioners and researchers, that absence has these concrete implications drawn from the republication itself:

• The republished text should be treated as a historical statute now on the ACT statute book; whether it has been litigated, and how contemporary courts have interpreted it, cannot be ascertained from this republication alone because no such materials are included.

• Any attempt to rely on the clause in litigation or administrative practice will require independent legal research outside the republished document to locate any ACT decisions, Commonwealth decisions, or other authorities that may have considered the clause or its equivalents.

• The republication suggests the clause was converted into ACT law through a statutory chain (see endnote 3), but the document does not provide any judicial determinations that confirm its contemporary enforceability, scope, or meaning in ACT courts.

• The republished instrument also notes the Parliamentary Counsel's editorial amendments under the Legislation Act 2001; if a future litigant seeks to rely on textual nuances, they should consider whether those editorial changes affect the interpretative posture of the wording as deployed in court (About this republication).

In short, the republication contains no litigation history and does not establish whether the clause has a settled body of judicial interpretation within the ACT. Users who require litigation context must consult case law databases, court reports and/or the Parliamentary Counsel’s records outside of the republished instrument.

Several practical risks and potential sources of confusion are evident from the text and the republication notes themselves:

• Archaic language and undefined terms. The principal substantive clause uses terms such as "freeman", "disseised", "freehold", "free customs", "lawful judgment of his peers" and "law of the land" without modern statutory definitions. The republication reproduces the historical wording but does not map these terms to contemporary legal categories. That creates interpretative uncertainty: the document does not specify who qualifies as a "freeman" under modern ACT law or how "peers" should be understood (clause 29).

• Partial preservation of the original statute. The amendment history records that chapters 1-28 and 30-37 of the original medieval statute were omitted by the 1986 Act. This means readers expecting the full medieval statute will be surprised; the republication is a deliberately truncated text in ACT law (endnote 4). Rights or mechanisms that might have been present in omitted chapters are not part of the current ACT text.

• Editorial amendments with statutory effect. The front material explains that Parliamentary Counsel made editorial amendments under Legislation Act 2001, part 11.3 and that those changes "have effect as if they had been made by an Act commencing on the republication date" (About this republication). That administrative mechanism can change wording to align with modern drafting practice; users should check Parliamentary Counsel records for any editorial adjustments that might affect punctuation, spelling or textual form that could matter in close interpretation.

• No modern procedural scaffolding in the text. The clause asserts procedural conditions ("lawful judgment of his peers or by the law of the land") but does not create or reference modern criminal procedure, trial by jury, administrative review machinery, or judicial remedies. Anyone seeking to rely on the clause must therefore locate applicable procedural statutes or common law mechanisms elsewhere in the ACT statute book.

• Penalty unit note without enumerated offences. The republication records penalty unit values for offences against the republished law at the republication date, but the clause itself contains no specified offence nor penalty. The presence of the penalty unit valuation may cause confusion: it is a valuation mechanism that will apply if an offence under this republished law is prosecuted, but the republication does not itself indicate what conduct would be prosecuted under a criminal rubric based on the clause (see "Penalties" front paragraph).

• Genealogical complexity. The legislative history shows a chain of Commonwealth and ACT statutes that carried the text into the ACT (Seat of Government Acceptance Act 1909, Seat of Government (Administration) Act 1910, Self‑Government Act 1988, Interpretation Act 1967), and a 1986 Commonwealth Act that amended the text. That chain means the present text’s legal status depends on a sequence of historical statutory acts; practitioners should not assume a simple direct continuity without checking the relevant conversion and amendment instruments cited in the endnotes.

• No litigation record in the republication. As noted, the republication contains no case law or judicial interpretation; absence of recorded litigation in the republication means users must search independently for any judicial treatment before attempting to rely on the clause.

• Reliance on the republication as authoritative text. The front material states the Parliamentary Counsel’s Office prepares authorised republications under the Legislation Act 2001 and that editorial changes do not change the effect of the law but have legal effect from the republication date (About this republication). Users should be aware that the republication is a prepared version and that full details of any amendments can be obtained from the Parliamentary Counsel’s Office; the republication itself cautions readers to consult additional sources for comprehensive amendment detail (endnote 1).

These "gotchas" are drawn directly from the republication text and endnotes; each arises from the republication’s combination of medieval substantive wording, selective omission of chapters, and modern editorial processes. They are practical flags for researchers, drafters and practitioners to verify interpretative scope, consult authoritative legislative records, and avoid assumptions about modern procedural content or definitional reach.

Compliance in relation to this republished text falls into two interlocking categories: (1) compliance by public authorities and officials who administer justice or process detention or dispossession decisions, and (2) steps for private persons or practitioners seeking to rely on or challenge actions under relevant ACT law. The republication itself provides the substantive textual obligations and the legislative history that places those obligations within the ACT legal order; it does not supply procedural rules. Based strictly on the republication, the following practical compliance steps and checks are appropriate.

For public authorities and officials:

• Observe the textual constraints. The clause declares that no "freeman" shall be taken, imprisoned, disseised of freehold or liberties, outlawed, exiled or "in any other wise destroyed" except by "lawful judgment of his peers or by the law of the land", and that justice will not be sold, denied or deferred (clause 29). Officials exercising powers that could lead to detention or dispossession should ensure their decisions and processes are grounded in lawful statutory authority and procedural fairness as understood under the ACT legal framework, since the clause, as republished, asserts those substantive constraints.

• Consult contemporaneous procedural statutes. Because the republished text does not define "lawful judgment", nor does it prescribe modern procedural mechanisms, officials should rely on relevant ACT statutes (for criminal procedure, civil process, administrative law and human rights where applicable) that establish the procedures by which judgments and dispossessions are lawfully carried out. The republication does not list those provisions; compliance therefore requires cross‑reference to the ACT statute book.

• Avoid commodifying access to justice. The textual undertaking "We will sell to no man... we will not deny or defer... justice or right" indicates a qualitative obligation not to permit sale or denial of justice. In practice, this implies policies and practices that do not create de facto market barriers to obtaining judicial remedies (clause 29). Officials should ensure fee regimes, timetabling practices and administrative processes do not create unjustifiable denials or delays.

• Keep administrative records of legal authority and process. Given the clause’s emphasis on lawful process, administrative actors should document statutory authorization and procedural steps when detaining or dispossessing persons, to demonstrate conformity with the requirement of lawful judgment or law of the land.

For private persons, lawyers and compliance officers:

• Confirm who is a "freeman" in the ACT context before relying on the clause. The republished text does not define the term; a practitioner should not assume the medieval category corresponds neatly to contemporary citizenry or class of persons. Before bringing claims or asserting rights under the clause, establish whether courts have interpreted the term or whether modern statutes define the relevant class.

• Research authoritative materials beyond the republication. The republiclation contains no litigation history or interpretative guidance. Practitioners should search case law, consult the Parliamentary Counsel’s Office for full amendment records (the front material advises this), and review the relevant ACT statute book for procedural enactments that operationalise the clause’s requirements.

• Check current penalty unit values and offence framing. The republished front material lists penalty unit values as of the republication date, but those values and the existence of any prosecutable offence tied to the clause could change. Verify current penalty unit values and whether any modern offence provisions reference or rely on the republished text.

• Factor in the amendment and conversion history. The legislative history indicates the clause was converted into ACT law via a chain of statutes (endnote 3) and fixed in the form adopted by the 1986 Imperial Acts Application Act (endnote 4). Practitioners should be attentive to the exact textual form in the 1986 Act and any Parliamentary Counsel editorial changes when citing the text or advising clients.

Practical compliance checklist:

1. Obtain the full authoritative text from the ACT legislation register and the Parliamentary Counsel’s Office to ensure any editorial amendments and the precise 1986 alterations are included.
2. Identify the procedural and substantive ACT statutes that govern detention, dispossession and judicial remedies (the republication does not supply them), and confirm that any action taken under those statutes complies with procedural safeguards suitable to meet the requirement of "lawful judgment" or "law of the land".
3. Search for any judicial decisions that interpret the relevant phrases in clause 29 or apply the republished Magna Carta in ACT courts; the republication contains no litigation history so external legal research is required.
4. If contemplating litigation invoking the clause, prepare arguments on definitional scope (for example, whether claimant is within the class of persons the clause protects) and procedural grounding (what counts as lawful judgment or law of the land).
5. For policy makers and administrators, review fee, timetabling and access arrangements to minimise the risk of challenge that justice has been sold, denied or deferred in contravention of the clause’s undertaking.

These compliance steps are constrained to the republication’s text and endnotes: the instrument provides substantive wording and legislative genealogy but leaves operational detail, definitions and remedies to other parts of the ACT legal system. Users should therefore treat the republication as a component of the statutory landscape requiring supplementation by contemporary ACT statutes, case law, and Parliamentary Counsel records.
