Magistrates Court Regulations 2005

The key concept is court constitution by JPs. Under the Magistrates Court Act 2004, the court is ordinarily constituted by a magistrate. These regulations create exceptions by specifying when and how JPs may sit instead. The regulations distinguish between two JPs and one JP sitting alone. A single JP is a statutory exception to the default of two JPs: one JP may constitute the court only if a registrar advises that it is impracticable to also get a second JP (regulations 7(1) and 11(1)). That threshold is lower than "not practicable" for a magistrate , it is about the administrative difficulty of finding a second JP.

Another core concept is the geographical division between metropolitan and country courts. "Metropolitan court" is defined by reference to the Metropolitan Region Town Planning Scheme Act 1959 definition of "metropolitan region". Country court means the Magistrates Court sitting at any place outside that region. The division is not merely cosmetic: country JPs have broader powers. In criminal matters, two country JPs may hear any charge (including indictable offences, subject to limitations) where the accused pleads guilty and both sides consent, or deal with absent accused on written pleas. Metropolitan JPs are limited to simple offences under road law. The disparity likely reflects the greater difficulty in getting a magistrate to regional and remote locations, so the regulations delegate more authority to local JPs.

The concept of "request" is crucial: JPs cannot volunteer; a registrar (or directed deputy registrar) must request them. Registrars can only initiate a request if (a) a magistrate has requested it, or (b) it is not practicable for a magistrate to constitute the court. For country courts, there are additional triggers: a magistrate is not listed to sit, or the listed magistrate cannot attend (regulation 8(2)(b)-(c)). That is a slightly broader gateway than the metropolitan test, which only says "not practicable" (regulation 4(2)(b)). The difference matters because a country registrar need not prove impracticability if a magistrate was never rostered.

Finally, the regulations define prescribed persons who may access court records under section 33(7)(i) of the Act. That list includes the CEO under the Working with Children (Screening) Act 2004, their officers for criminal record checks, the CEO under the National Disability Insurance Scheme (Worker Screening) Act 2020, the CEO under the Prisons Act 1981, and the department CEO assisting the Minister (regulation 12). This is a separate administrative concept, not about court composition.

The regulations directly affect justices of the peace in Western Australia. Any JP who might be asked to constitute the Magistrates Court must understand the jurisdictional limits of their role , whether they sit in Perth or the country, whether alone or with another JP, and what types of matters they can handle. JPs who exceed these limits risk acting without jurisdiction, which could invalidate proceedings and expose them to potential liability under the Act or common law. The regulations also affect registrars and deputy registrars of the Magistrates Court, who must decide when to request JPs, ensure that a magistrate has either requested it or is unavailable, and maintain records of such requests. Registrars must know the difference between the metropolitan and country tests to avoid unlawful delegation.

Magistrates are indirectly affected because their workload is reduced when JPs handle routine matters. The regulations preserve magistrates' primacy by requiring magistrates to request JP participation or for it to be impracticable for them to sit. Magistrates also retain exclusive jurisdiction over matters excluded from JPs , PBO proceedings (except adjournments), indictable offence determinations, and any charge where the accused does not plead guilty.

Accused persons are affected because their case might be heard by JPs rather than a magistrate. In metropolitan areas, this means a JP can only deal with them under very limited circumstances , mostly road-law simple offences with a guilty plea. In country areas, the scope is broader, including any offence (including indictable) if the accused is present, consents, and pleads guilty. Accused persons who do not want JP adjudication could withhold consent or plead not guilty, forcing the matter before a magistrate. However, for absent accused, JPs can still proceed on written pleas (no consent is required , see regulations 6(1)(e) and 10(1)(f)). That is a significant power: a driver fined for a road offence who writes a guilty plea by mail may have the case disposed of by two JPs without ever appearing.

Applicants and respondents in family violence restraining order (FVRO) and violence restraining order (VRO) matters are affected because JPs can hear applications at the initial hearing in the respondent's absence under section 26(2) of the Restraining Orders Act 1997 (regulations 5(1), 9(1)). That means a temporary order could be made by JPs without the respondent present.

Government agencies involved in working with children and NDIS worker screening are affected by regulation 12, which allows their CEOs and officers to access court records for criminal history checks. The list also includes prison CEOs and the department CEO.

Legal practitioners must advise clients on whether a matter can be heard by JPs and, if so, whether the JP panel has jurisdiction. In country areas, practitioners need to know that JPs can hear indictable charges on guilty pleas, which might offer a speedier resolution than waiting for a magistrate circuit.

Registrars’ duties: A registrar must not request a JP to constitute the court unless a magistrate has requested it or it is not practicable for a magistrate to sit at that time and place (regulations 4(2) and 8(2)). For country courts, the alternative triggers are that a magistrate is not listed to sit or the listed magistrate cannot attend. A registrar also must not direct a deputy registrar to make such a request unless those conditions are met. This duty is absolute: if neither condition is satisfied, the request is unlawful, and the JP would be sitting without authorisation.

JPs’ duties and rights: A JP has no right to constitute the court unless requested. Once requested, the JP must stay within the boundaries of the regulation. For example, a single JP may only perform the functions listed in regulations 7(2) (metropolitan) or 11(2) (country) , bail for other than initial appearances, adjournments, and adjourning charges for certain simple offences. Two JPs have a broader but still bounded jurisdiction. JPs must also ensure, for matters requiring consent, that both accused and prosecutor have given it (regulation 6(1)(d)(iii), 10(1)(e)(ii)). If consent is not obtained or the accused pleads not guilty, the JP must adjourn the matter to a magistrate.

Accused’s rights: In metropolitan areas, an accused charged with a simple road law offence who is present has the right to have the matter heard by a magistrate by refusing consent or pleading not guilty (regulation 6(1)(d)(iii) requires consent and guilty plea). In country areas, the accused has the same right for any offence (regulation 10(1)(e)). If the accused is absent, they have no right to block JP adjudication on a written guilty plea , the JP can proceed without consent (regulations 6(1)(e) and 10(1)(f)). However, if no written plea is received, the JP can still adjourn the charge (regulation 6(1)(c), 10(1)(d)). For initial appearances, JPs have no bail power , that stays with magistrates (the regulations explicitly say "other than an initial appearance" for bail).

Applicants under the Restraining Orders Act 1997: They have the right to have an application heard by JPs in the respondent's absence for an interim order. But any final order or contested hearing must go to a magistrate.

Persons prescribed under regulation 12: They have a right to access court records for screening purposes, but the regulation does not create an obligation , it merely enables the court to provide information to them. The duty to protect privacy lies in the Act itself.

Prosecutors: In metropolitan areas, a prosecutor for a road law simple offence can consent to JP adjudication. In country areas, consent is required for all offences. If a prosecutor refuses consent, the matter must be heard by a magistrate.

The regulations themselves do not create offences or penalties. Penalties for acting beyond jurisdiction would flow from the Magistrates Court Act 2004 or general law. A JP who purports to constitute the court without a proper request (regulations 4(1) and 8(1) make it mandatory: "A JP must not constitute a metropolitan court ... unless he or she has been requested") would likely be acting without jurisdiction. Proceedings conducted by such a JP could be void or voidable. That could have serious consequences: convictions could be quashed, bail decisions set aside, and orders made without jurisdiction could be unenforceable. The JP could also be subject to disciplinary action under the JP legislation, potentially including removal from the panel.

A registrar who requests a JP in breach of the preconditions (regulations 4(2), 8(2)) also acts outside their authority. The Act might provide for internal disciplinary measures, but the regulations themselves do not stipulate a penalty. The practical enforcement risk is that a party affected could challenge the validity of the proceedings, causing delay and cost.

Regulation 12 does not impose penalties , it merely removes a statutory bar on disclosure. Breach of confidentiality by the prescribed person would be governed by other laws (e.g., the Working with Children (Screening) Act 2004 or privacy legislation).

The compilation table shows multiple amendments but no new penalty provisions. The lack of explicit penalties in these regulations is consistent with their nature as procedural rules. The real enforcement is through the supervisory jurisdiction of the Supreme Court, which can review decisions made without jurisdiction.

These regulations sit under the Magistrates Court Act 2004 (the parent Act). Section 33(7)(i) of that Act empowers the regulations to prescribe persons who can access court records. Regulation 12 exercises that power. The Act also creates the court and sets the default that a magistrate constitutes it; these regulations carve out exceptions for JPs.

The regulations frequently cross‑reference other WA statutes:

• Restraining Orders Act 1997: JPs at both metropolitan and country levels can deal with FVRO and VRO applications at the ex parte hearing under section 26(2). They also have bail powers under section 63(1) of that Act (regulations 6(1)(a), 7(2)(a), 10(1)(a), 11(2)(a)).

• Bail Act 1982: JPs have power under sections 5(2) and 7(1) for non‑initial appearances. Country JPs additionally have jurisdiction under section 59B (regulations 10(1)(b), 11(2)(b)). Section 59B relates to police bail decisions; the fact that only country JPs have this power suggests it is designed for remote areas where a magistrate is not available.

• Criminal Procedure Act 2004: JPs can deal with adjournment applications under that Act, perform functions under section 75 (which relates to procedural matters), and adjourn charges that must be adjourned under sections 50(3), 52(1) or 53(1). For metropolitan road‑law matters, JPs rely on the CPA for service of summons or court hearing notices.

• Prohibited Behaviour Orders Act 2010: JPs are expressly forbidden from dealing with PBO proceedings except to adjourn them for hearing by a magistrate (regulations 5(2)-(3), 9(2)-(3)). This is a clear ouster of JP jurisdiction , no interim powers, no consent powers.

• Road Traffic (Administration) Act 2008: Regulation 6 uses the definition of "road law" from section 4 of that Act to limit metropolitan JP criminal jurisdiction to certain offences.

• Working with Children (Screening) Act 2004 and National Disability Insurance Scheme (Worker Screening) Act 2020: These define the CEOs who are prescribed under regulation 12.

• Prisons Act 1981: The CEO and authorised officers are prescribed for accessing court records.

The interaction is largely hierarchical: these regulations expand or restrict the powers that JPs have under the primary Act and other statutes. They do not override other laws but rather operate within the framework they create. For example, a JP exercising bail powers under [regulation 6(1)(a)] is still bound by the Bail Act’s substantive criteria; these regulations only deal with who may exercise the power.

The regulations were originally gazetted on 28 April 2005 and commenced on 1 May 2005 (the same day as the parent Act). They have been amended eight times:

1. Magistrates Courts Amendment Regulations 2008 (22 Aug 2008, operative 23 Aug 2008): Inserted Part 4 heading and regulation 12, prescribing persons under section 33(7)(i) of the Act. This added the CEO under the Working with Children (Screening) Act 2004 and the department CEO.

2. Magistrates Court Amendment Regulations 2009 (27 Feb 2009, operative 1 Mar 2009): Amended regulations 10 and 11 to clarify country JP powers , added reference to Bail Act section 59B and added the prohibition on dealing with indictable offences in regulation 10(2). This was a significant expansion of country JP jurisdiction (adding bail revocation power) while also imposing a limit.

3. Magistrates Court Amendment Regulations 2011 (24 Jun 2011, operative 25 Jun 2011): Amended regulations 5 and 9 to insert references to the newly enacted Prohibited Behaviour Orders Act 2010, allowing JPs to adjourn PBO applications but not to deal with them substantively.

4. Magistrates Court Amendment Regulations 2012 (27 Apr 2012, operative 28 Apr 2012): Amended regulation 12 to add the CEO under the Working with Children (Screening) Act 2004 (paragraph (ba)), likely a refinement of the definition.

5. Magistrates Court Amendment Regulations (No. 2) 2014 (30 Sep 2014, operative 1 Oct 2014): Amended regulation 12 to add the chief executive officer under the Prisons Act 1981 and persons authorised by that CEO (paragraphs (ca), (cb)).

6. Magistrates Court Amendment Regulations 2015 (10 Feb 2015, operative 27 Apr 2015): Amended regulation 6 to insert the definition of "road law" and to limit metropolitan JP criminal jurisdiction to simple offences under a road law, replacing broader language that previously allowed JPs to deal with any simple offence where accused was present. This was a restriction of powers.

7. Attorney General Regulations Amendment (Family Violence Restraining Orders) Regulations 2017 Part 6 (27 Jun 2017, operative 1 Jul 2017): Amended regulations 5 and 9 to reflect changes in the Restraining Orders Act 1997 terminology (FVRO and VRO), bringing the regulations up to date with family violence reforms.

8. Attorney General Regulations Amendment (NDIS) Regulations 2021 Part 3 (SL 2021/26, 26 Feb 2021, operative 27 Feb 2021): Amended regulation 12 to add the CEO under the National Disability Insurance Scheme (Worker Screening) Act 2020 and their officers.

A reprint 1 was issued as at 17 Aug 2012. The version now published reflects editorial changes under the Legislation Act 2021 (effective 14 Jun 2024), which made minor textual adjustments (likely to paragraphs (a) and (b) of regulation 12, though the table does not specify the exact change beyond authorising provision s.25(2)).

The historical trend is toward increasing the categories of prescribed persons (regulation 12 grew from one CEO to four plus officers), and toward refining JP powers , restricting metropolitan JPs to road law in 2015, but expanding country JPs in 2009 and clarifying PBO limits in 2011.

The text of these regulations contains no reference to any court cases, and there is no litigation history included in the source document. As a compilation note explains, the regulations are subordinate legislation, and the notes are limited to statutory amendments. In practice, there may have been cases in Western Australian courts challenging the jurisdiction of JPs under these regulations, but they are not recorded in the regulations themselves. It is important for practitioners not to assume the regulations have been judicially considered simply because they are old , the absence of cited cases is a gap that must be filled by independent research.

Possible grounds for litigation could include: (a) whether a registrar properly formed the view that it was "not practicable" for a magistrate to sit (a justiciable question); (b) whether a JP dealt with a matter outside the list (e.g., a single JP dealing with more than adjournments); (c) whether a charge dealt with by JPs was truly a "simple offence under a road law" for metropolitan purposes; (d) whether the accused's consent was informed and voluntary. No such cases appear in the source, so no conclusions can be drawn. The regulations themselves are tightly drafted, so successful challenges might be rare, but ambiguity exists , particularly around what constitutes "not practicable" and the meaning of "initial appearance" for bail purposes.

Several traps exist for the unwary:

1. The metropolitan/country boundary is not intuitive. The Perth metropolitan region is defined by reference to the now-repealed Metropolitan Region Town Planning Scheme Act 1959. The area includes more than just the City of Perth , it covers a large portion of the Swan Coastal Plain. A court sitting in Mandurah, for example, is within the metropolitan region? Possibly not, as Mandurah is outside the old scheme boundaries. Practitioners must check the current definition (the Act is repealed but the definition likely continues via transitional provisions). A mistake could mean a JP panel in a regional centre thinks it has country powers when it does not.

2. Country JPs can deal with indictable offences, but only on a guilty plea and with consent. Regulation 10(2) lists things they cannot do: deal with committal proceedings (Criminal Code s 5), section 138 CPA proceedings (which includes case management orders), determine the charge, or dismiss it for want of prosecution. But they can adjourn it, grant bail, or take a plea of guilty. If the accused pleads not guilty, the JP must send it to a magistrate. The gotcha is that a country JP might inadvertently step into case management or determination of an indictable charge if the accused changes plea. The limits in regulation 10(2) are absolute , even with consent, the JP cannot determine the charge.

3. Single JP powers are extremely limited. Regulations 7(2) and 11(2) list only three or four functions. Notably, a single JP cannot deal with any guilty plea, even for a road law offence. That is reserved for two JPs. A single JP also cannot deal with FVRO applications under the Restraining Orders Act , only two JPs can (regulations 5(1), 9(1)). A registrar might think one JP is enough for a simple bail application, but that is only for non‑initial appearances.

4. The registrar’s discretion is bounded but loosely worded. The test for requesting JPs is "not practicable" for a magistrate to sit (regulations 4(2)(b), 8(2)(b)). That is a low threshold but not automatic. A registrar who requests JPs because it is mildly inconvenient for a magistrate to attend may be acting outside power. There is no guidance on what "practicable" means , does it include cost? Travel time? Workload? That uncertainty creates risk for registrars and JPs.

5. Consent requirements are not universal. For metropolitan road law matters, both accused and prosecutor must consent (regulation 6(1)(d)(iii)). But for absent accused, no consent is needed (regulation 6(1)(e)). So a person who posts a written guilty plea for a speeding fine may have their matter decided by JPs without ever having agreed to that forum. The prosecutor’s consent is also not required for absent accused matters. In country areas, the same applies , consent is only needed when the accused is present (regulation 10(1)(e)(ii)). That asymmetry catches people off guard.

6. PBO proceedings are completely off‑limits for substantive decisions. JPs may only adjourn PBO applications. They cannot grant interim orders, vary, or cancel them. Even if both parties agree, the JP cannot deal with it. This is a hard limit.

7. Regulation 12 prescribed persons may not be exhaustive for all access. Section 33(7)(i) of the Act allows the regulations to prescribe persons for access. There may be other provisions in the Act allowing access for other purposes (e.g., police). Regulation 12 only covers screening and prison officials. Do not assume it is the only access gate.

8. The definition of "initial appearance" for bail is not in these regulations. Regulations use the phrase "other than an initial appearance" for bail powers, but the term is defined in the Bail Act or criminal procedure rules. A JP who grants bail at first appearance is acting outside jurisdiction, even if the accused has been in custody for days.

For justices of the peace, compliance requires verifying two things before each sitting: (a) that a registrar or deputy registrar has requested them (and they should ask to see confirmation); and (b) that the matters on the list fall within their jurisdiction. For metropolitan JPs, check whether the charge is a simple offence under a road law , not a regulatory offence under another act. For country JPs, check whether the charge is an indictable offence; if so, only proceed if the accused is present, both sides consent, and the accused pleads guilty, and never attempt to determine the charge, commit, or dismiss. For both, never attempt PBO proceedings except to adjourn. Record the consent of accused and prosecutor for present‑party matters. If sitting alone, limit yourself to the three or four actions listed; do not attempt to take a guilty plea even if the accused asks.

For registrars, compliance means first confirming that it is not practicable for a magistrate to sit, or that a magistrate has specifically requested JP involvement. For country courts, the alternatives are simpler , a magistrate may simply not be rostered. But registrars should document the reason for the request (e.g., "magistrate on leave", "no magistrate rostered at Geraldton on 15 July"). Avoid requesting JPs when a magistrate is available but could be inconvenienced , the test is practicability, not efficiency. When directing a deputy registrar to make a request, ensure the director is in writing or recorded. For bail and FVRO matters, ensure the file clearly indicates that the appearance is not an initial appearance.

For legal practitioners, compliance involves advising clients on their rights to magistrate adjudication. If the client wants a magistrate, they should decline consent (if present) or plead not guilty. If the client is absent and has posted a guilty plea, they cannot later complain about JP jurisdiction , but practitioners should warn clients that by pleading guilty in writing, they are consenting to JP disposition (even if they did not realise it). For country clients facing indictable charges, a JP guilty plea might be faster but could affect sentence , there is no guarantee the JP will be as experienced as a magistrate. Practitioners should ensure the client is fully informed.

For prescribed persons under regulation 12, compliance means ensuring they are accessing court records only for the authorised purpose (criminal record checks for screening). The regulation does not grant blanket access; the underlying legislation (Working with Children Act, NDIS Worker Screening Act, Prisons Act) must also be complied with. Records obtained cannot be used for other purposes.

Finally, all parties should keep abreast of amendments. The regulations have been amended eight times, and the geographical definition may change if the Perth metropolitan region is redefined. The current version with editorial changes as at 14 June 2024 is authoritative.
