Magistrates' Court (Outworkers) Rules 2016

The Rules operate in the context of the Outworkers (Improved Protection) Act 2003, which targets the exploitation of outworkers - typically home‑based workers in the textile, clothing and footwear industries who are vulnerable to poor wages and conditions. Division 2 of Part 4 of that Act creates a permit‑based entry system that allows authorised union officials to enter premises to investigate compliance with industrial laws. The Rules give procedural shape to three key concepts from that legislative scheme.

Permit - Under section 45 of the Outworkers Act, a union secretary may apply to the Magistrates’ Court for a permit to be issued to an officer or employee of the union. The permit is the authorisation that enables the holder to exercise entry powers under Division 2. Form 2, prescribed by rule 7, requires the applicant to identify themselves as the secretary of a union (as defined in section 40(1) of the Act) and to name the proposed permit holder. The form does not require details of the permit holder’s qualifications or training; the substantive criteria for issuance are in the Act itself, which the Rules do not reproduce.

Order waiving notice of entry - Section 44(1) of the Act allows a person who already holds a permit to apply to the court for an order that the requirement to give the occupier of premises notice of their intention to enter be waived. This is a potentially significant power: it allows entry without prior warning, which can be justified on grounds such as a risk of evidence being destroyed or of the occupier frustrating the entry. Form 1, prescribed by rule 6, requires the applicant to state that they hold a current permit issued under section 45, and to set out the details of the orders sought - for example, the address of the premises and the date on which entry is proposed. The form is a single‑page document with minimal detail; the court must exercise its discretion under the Act without further procedural guidance from the Rules.

Revocation of permit - Section 46 of the Act permits an employer, a registered organisation of employers, or an information services officer to apply to the court for revocation of a permit. Form 3, prescribed by rule 8, requires the applicant to set out the grounds for revocation, which must refer to the grounds in section 46(2) of the Act. The Rules do not reproduce those grounds, so an applicant must look to the parent Act to know what must be proved (for example, that the permit holder has used the permit improperly or has ceased to be a fit and proper person). The form requires the applicant to name the permit holder whose permit is sought to be revoked.

The Rules distinguish these three application types from one another and from general civil procedure. The key concept is that this is a self‑standing procedural code, not a set of rules that incorporate standard Magistrates’ Court processes such as pleadings, discovery or summary judgment. The only hearing timeline is for revocation applications (28 days). The concept of “notice” appears only in rule 9 for revocation applications; there is no equivalent for permit or waiver applications, leaving the Act’s provisions to govern any notice obligations for those.

The Rules directly affect a narrow set of actors, each of whom must interact with the Magistrates’ Court in a specific procedural capacity.

Union secretaries and union officers/employees - A union secretary (the person who must sign Form 2) is the applicant for a permit. Once a permit is issued, the permit holder (the officer or employee named in the permit) is the person who may apply for an order waiving the notice requirement using Form 1. These individuals gain the benefit of a simplified procedural route, but they are also bound to use the prescribed forms. If a permit holder seeks a waiver of notice, they must already hold a valid permit; the Rules do not create any right to a waiver, only the procedure to apply for one.

Employers, registered organisations of employers, and information services officers - These are the categories of persons who may apply for revocation of a permit under section 46 of the Act. The Rules require them to use Form 3 and to serve the application on the permit holder within a reasonable time before the hearing (rule 9). This imposes a compliance cost on the applicant: they must arrange service, ensure it is timely, and be prepared to demonstrate reasonableness if challenged. The applicant also benefits from the 28‑day hearing timeline, which compels the court to hear the matter relatively quickly, but that timeline is a direction to the registrar, not an absolute right of the applicant.

The permit holder who is the subject of a revocation application - That person is entitled to receive a copy of the application under rule 9. The Rules do not specify a minimum notice period, only “a reasonable time before the date fixed for the hearing”. This creates uncertainty for both the applicant and the permit holder; a dispute over what is reasonable could itself become a preliminary issue. The permit holder also has the right to appear at the hearing (though the Rules do not expressly state this, it is implicit from the structure of permitting a revocation application).

Magistrates’ Court registrars - Registrars are responsible for fixing hearing dates for revocation applications under rule 10, and for receiving the applications and forms. They must ensure that the date fixed is no later than 28 days after the application is filed, but rule 11 allows the court (the magistrate, not the registrar) to change that date. This delegation to the registrar reduces the magistrate’s workload in scheduling, but the registrar’s docket management may be affected by the 28‑day deadline.

Magistrates - Magistrates hear the three types of applications. The Rules give them discretion under rule 11 to fix a new hearing date for a revocation application, overriding the registrar’s date. This is a modest procedural flexibility; it allows the court to accommodate unforeseen circumstances without requiring the application to be refiled.

Occupiers of premises - Although not direct parties to the applications, occupiers are affected because a waiver order under section 44(1) allows a permit holder to enter without prior notice. The Rules do not require the occupier to be notified of a waiver application; the only notice obligation in the Rules is for revocation applications. This asymmetry means an occupier may first learn of the entry when the permit holder arrives on the premises.

Legal practitioners advising any of the above - They must be familiar with the Rules’ forms and timelines, and with the fact that the General Civil Procedure Rules do not apply. A lawyer who assumes that the usual rules of evidence, discovery or service apply could be caught out.

The Rules impose a small number of specific duties and create corresponding rights, all of which are procedural rather than substantive.

Duty to use prescribed forms - Rules 6, 7 and 8 each say that the relevant application “must be in Form 1”, “must be in Form 2” or “must be in Form 3” respectively. This is a mandatory requirement. An application that does not use the correct form could be rejected by the registrar or dismissed by the court. The forms themselves are brief and require only basic identifying information and a description of the orders sought (for Form 1) or the grounds (for Form 3). The duty to use the prescribed form is the single most important compliance obligation in the Rules.

Duty to serve application for revocation - Rule 9 says: “The applicant must serve a copy of an application under section 46 of the Outworkers (Improved Protection) Act 2003 on the holder of the permit who is the subject of the application within a reasonable time before the date fixed for the hearing.” This duty applies only to revocation applications. The term “reasonable time” is not defined, which gives rise to a potential dispute. The permit holder has a corresponding right to receive the application and to have enough time to prepare a response. The rule does not say how service must be effected; presumably the general law of service applies, but the exclusion of the General Civil Procedure Rules means the specific service rules in those rules do not apply. An applicant could serve by hand, post, or possibly email, but the risk falls on the applicant to prove that service was within a reasonable time.

Duty of registrar to fix hearing date within 28 days - Rule 10 provides that the registrar “must fix a date for the hearing of an application under section 46 … that is no later than 28 days after the application has been filed in the Court”. This duty is owed to the applicant and the permit holder; it ensures a prompt hearing. However, rule 11 allows the court to override this date, so the registrar’s duty is in effect a default rule that can be displaced by judicial direction. The right of the parties is to have a hearing date set within 28 days, but they cannot enforce that right if the court later changes the date.

Right to apply for a new hearing date - Under rule 11, “The Court may fix a new date for the hearing of an application under section 46 … that is before or after the date fixed by the registrar under Rule 10. An application for the fixing of a new date may be made before, on or after the date fixed by the registrar.” This gives any party (or the court on its own motion) the right to seek a rescheduled hearing. The rule is flexible: it permits an application even after the original hearing date has passed. This protects against procedural unfairness if a party cannot attend the fixed date, but it also introduces uncertainty for the other party, who may have prepared for the original date only to find it moved.

No explicit right to be heard - The Rules do not explicitly state that a permit holder has a right to be heard on a revocation application, but that right is inherent in the procedural fairness requirements of the parent Act and common law. The notice obligation in rule 9 implies that the permit holder is expected to attend or respond. Similarly, an applicant for a waiver order or a permit presumably has a right to appear, but the Rules are silent on this.

No duties regarding notice for permit or waiver applications - There is no rule requiring the applicant for a permit (Form 2) or for a waiver order (Form 1) to give notice to any person. This is a notable gap. The parent Act may impose notice obligations for waiver applications (section 44(1) itself provides that an order can waive the requirement to give notice, which implies that notice is otherwise required), but the Rules do not add any procedural steps beyond filing the form.

The Magistrates’ Court (Outworkers) Rules 2016 do not themselves create any penalties. They are procedural only and contain no offence provisions, no fines, no imprisonment terms, and no civil penalty units. Enforcement of non‑compliance with the Rules is therefore indirect and must be found in other instruments or in the inherent powers of the court.

Consequences of using wrong form - If a person files an application that does not comply with rule 6, 7 or 8 by using the wrong form or omitting required information, the registrar may refuse to accept the application. The court may also strike out or dismiss the application for non‑compliance. This is not a penalty in the punitive sense but a procedural bar. The applicant may re‑file using the correct form, subject to any applicable time limits or the 28‑day timeline for revocation.

Consequences of failing to serve revocation application - Rule 9 requires service within a reasonable time. If the applicant does not comply, the court may adjourn the hearing to allow proper service, or may dismiss the application if the failure is egregious. The permit holder could also argue that the hearing should not proceed because they did not receive adequate notice. Again, this is not a statutory penalty but a procedural consequence.

Non‑compliance with hearing date timeline - Rule 10 says the registrar “must” fix a date within 28 days. If the registrar fails to do so, there is no express sanction. The applicant could apply to the court for an order directing the registrar to fix a date, or could seek a remedy under the Magistrates’ Court Act 1989 or the general law. In practice, the 28‑day requirement is a direction to the court administration; failure to meet it does not invalidate the application or the hearing. Rule 11 also allows the court to set a new date, so the timeline is flexible.

Enforcement of substantive Act - The Rules are a vehicle for applications under the Outworkers (Improved Protection) Act 2003. If a person fails to comply with the substantive provisions of that Act (for example, a permit holder who enters premises without a waiver order when notice was required, or an occupier who obstructs entry), enforcement occurs under that Act, not under these Rules. The Rules do not contain any enforcement mechanisms.

Inherent contempt powers - If a party deliberately uses the Rules to mislead the court (for example, by providing false information in a form), the court could potentially exercise its inherent contempt jurisdiction. This is a common law power, not derived from the Rules.

Sunset as a form of enforcement - Rule 4 of the endnotes notes that the Rules will sunset 10 years after the day of making, on 4 May 2026 under the Subordinate Legislation Act 1994. If the Rules are not remade before that date, the procedural framework for outworker applications under Division 2 will disappear, and the court would need to fall back on the General Civil Procedure Rules or new rules. This sunset provision is a legislative control mechanism, not a penalty for non‑compliance.

In summary, the Rules create no independent enforcement regime. The “penalty” for non‑compliance is procedural rejection, delay, or dismissal of the application. The substantive enforcement teeth remain in the parent Act.

The Rules sit within a legislative hierarchy and interact with several other instruments in a mostly one‑directional manner: they are subordinate to the Act they serve, they displace the general procedure rules, and they are subject to the Interpretation of Legislation Act 1984 and the Subordinate Legislation Act 1994.

Outworkers (Improved Protection) Act 2003 - This is the primary Act. The Rules are made specifically to give effect to Division 2 of Part 4 of that Act. They do not amend, override or supplement the Act’s substantive provisions; they only set the procedural vehicle for applications under sections 44(1), 45 and 46. The forms reference the Act and require the applicant to identify the section under which they apply. The Rules do not reproduce the criteria for issuing a permit, the grounds for revocation, or the circumstances in which a waiver of notice may be granted. Practitioners must read the Rules together with the Act; the Act is the source of the rights, and the Rules dictate how to exercise them.

Magistrates’ Court Act 1989 - The Rules are made under section 16 of that Act, which empowers the Chief Magistrate and Deputy Chief Magistrates to make rules for the Magistrates’ Court. The Rules also rely on “all other enabling powers”. The parent Act (the Magistrates’ Court Act) provides the constitutional basis for the Rules and defines the court’s jurisdiction. Any conflict between these Rules and the Magistrates’ Court Act would be resolved in favour of the Act.

Magistrates’ Court General Civil Procedure Rules 2010 - Rule 5 expressly excludes these rules from applying to any application under the Outworkers Rules. This is a purposeful interaction: the general civil procedure rules (which cover pleadings, discovery, interrogatories, summary judgment, and many procedural steps) are replaced by the far simpler Outworkers Rules. Practitioners cannot rely on the general rules for matters such as service of documents (except as provided by rule 9), hearings, or evidence. The exclusion is total; it does not carve out particular provisions. If a procedural issue is not addressed by these Rules (for example, how to file documents or what evidence is admissible), the court will need to rely on its inherent power or on the Magistrates’ Court Act, not on the 2010 rules.

Subordinate Legislation Act 1994 - The Rules are subordinate legislation. The endnotes confirm that the Rules will sunset 10 years after the day of making, on 4 May 2026, under section 5 of that Act. This means the Rules automatically expire unless remade. This interaction imposes a built‑in review cycle; if the rules are not updated, the procedural framework for outworker entry applications would lapse, potentially disrupting the operation of Division 2 of Part 4.

Interpretation of Legislation Act 1984 - The endnotes explain that provisions of the ILA govern the interpretation of the Rules. For example, headings, examples, diagrams, notes, punctuation and provision numbers form part of the Rules (section 36(1A)(2A)(2B)(3A)(3B)(3C)). The location of legislative items (penalties, examples, notes) is governed by section 36B. These interpretive rules ensure that the forms and notes attached to the Rules have legal effect. The ILA also applies to the construction of the Act itself.

Magistrates’ Court (Outworkers) Rules 2006 - The 2016 Rules revoke the 2006 Rules (rule 4). The 2006 Rules had been amended by S.R. 123/2011. The revocation is complete; the new Rules replace the old ones entirely. There is no savings or transitional provision in the 2016 Rules, so any application pending under the old rules would presumably be dealt with under the new procedural regime, subject to the court’s direction.

No interaction with federal law - The Rules are purely state procedural instruments. They do not reference the Fair Work Act 2009 (Cth) or the Work Health and Safety Act 2012 (Cth), even though the substantive Act may intersect with those. The Rules’ interaction with federal law is indirect: the entry permits under the Outworkers Act may be used to investigate federal industrial laws, but the Rules themselves do not create or limit that interaction.

The Magistrates’ Court (Outworkers) Rules 2016 are Version 001. The endnotes state that there are no amendments made to these Rules by statutory rules, subordinate instruments or Acts. There are also no amendments not in operation at the date of publication. The Rules were made on 4 May 2016 and came into operation on 5 June 2016.

The instrument supersedes the earlier version: the Magistrates’ Court (Outworkers) Rules 2006 (S.R. No. 69/2006), which had been amended by S.R. Nos 123/2011. That amendment history is not relevant to the current Rules, but it indicates that the 2006 Rules were amended once to adjust the forms or procedures. The 2016 Rules do not carry over those amendments; they are a clean replacement.

Because the instrument is unamended, there is no track of revisions, no inserted or substituted rules, and no transitional provisions. The only change over time is the sunset date: the Rules will expire on 4 May 2026 unless extended or remade. Future amendment will likely be triggered by changes to the parent Act or by the sunsetting process.

The Rules themselves have produced no reported litigation that is cited in the instrument or in the endnotes. This is unsurprising: they are procedural rules of a very narrow scope, and they largely mirror the structure of the 2006 Rules. Challenges to the exercise of powers under Division 2 of Part 4 of the Outworkers Act would typically focus on the substantive provisions of the Act - such as the validity of a permit, the reasonableness of a waiver order, or the grounds for revocation - rather than on the forms or hearing dates prescribed by these Rules.

There are no annotations, case references, or explanatory memoranda attached to the published version. The Subordinate Legislation Act 1994 requires a regulatory impact statement for certain instruments, but there is no indication that one was prepared for these Rules (the endnotes do not refer to one). The absence of litigation history suggests that the procedural framework has been uncontroversial in practice. However, the lack of judicial interpretation means that uncertainties in the Rules - such as the meaning of “reasonable time” in rule 9 - remain unresolved. A future court may need to interpret that phrase in the context of a contested revocation application.

It is possible that the Rules have been cited in passing in judgments under the parent Act, but the instrument itself does not record those citations, and this analysis cannot invent them. The user should treat the litigation history as effectively blank.

Several aspects of the Rules are easy to overlook or misunderstand. These are traps for the unwary practitioner or litigant.

The General Civil Procedure Rules do not apply - Rule 5 is absolute. A lawyer who assumes that the usual rules for service, filing, evidence, adjournments, or costs will apply may find their application rejected or delayed. For example, there is no provision for summary judgment, discovery, or interrogatories. If a revocation applicant needs further information from the permit holder, they cannot rely on the General Civil Procedure Rules to compel it; they would need to apply to the court under its inherent jurisdiction or under the parent Act.

Only one notice obligation exists - Rule 9 applies only to applications for revocation under section 46. There is no rule requiring the applicant to notify the occupier of a waiver application (Form 1) or to notify anyone of a permit application (Form 2). Yet the substantive Act may impose notice obligations for waiver applications (section 44(1) refers to an order waiving “the requirement to give notice”, implying that notice is otherwise required). The Rules do not address this, so an applicant for a waiver order may need to check the Act and any relevant practice direction for notice requirements. If they serve notice, they risk alerting the occupier and possibly undermining the purpose of the waiver; if they do not, they may be in breach of the Act.

The 28‑day hearing timeline is only for revocation - Rule 10 applies only to applications under section 46. There is no timeline for hearings on permit applications (Form 2) or waiver applications (Form 1). Those could potentially be scheduled at the court’s convenience, leading to delays. A union secretary applying for a permit may need to wait weeks or months for a hearing date, while a revocation application is fast‑tracked. This asymmetry could work against permit holders.

The “reasonable time” for service is undefined - Rule 9 does not specify a minimum period. Serving the application one day before the hearing might be unreasonable, but serving it two weeks before might be reasonable. The party at risk is the applicant for revocation: if the court finds the service period unreasonable, it may adjourn or dismiss the application. There is no guidance on what factors the court will consider (e.g., complexity of the grounds, location of the parties, prior dealings).

The forms are mandatory and minimal - Rules 6, 7 and 8 use the word “must”. The forms themselves are a single page each, with blanks for names, addresses, dates, and a brief description of orders or grounds. If an applicant provides insufficient detail (e.g., “grounds as per the Act” without specifying which ground), the application may be rejected. There is no provision for amending forms; a defective application may need to be refiled, potentially causing delay.

No electronic filing or service provisions - The Rules are silent on electronic filing. Given that they were made in 2016, the court’s standard electronic filing system may apply, but the Rules do not address it. Similarly, rule 9 does not specify whether service by email is acceptable. Practitioners should check the court’s practice notes.

Sunset in 2026 - The Rules expire on 4 May 2026 unless remade. Practitioners dealing with outworker matters after that date must verify whether the Rules have been extended or replaced. If they have not, the procedural vacuum could cause confusion.

No transitional provisions - When the 2016 Rules revoked the 2006 Rules, they included no savings clause for applications already filed. An application filed under the 2006 Rules after 5 June 2016 would presumably need to comply with the new forms; the court would likely give directions, but the Rules do not say so.

The name of the Act is long and easily mis‑cited - The parent Act is the Outworkers (Improved Protection) Act 2003. The forms refer to it as such. A typo in the Act’s name could lead to the application being rejected.

Compliance with the Rules is straightforward if the procedural steps are followed carefully. The following practical steps cover each scenario.

Applying for a permit (Form 2) - The union secretary must complete Form 2 exactly as prescribed. The form requires the secretary’s name, address, the name of the union, and the name of the officer or employee for whom the permit is sought. The form must be filed at the Magistrates’ Court at the appropriate venue (the form uses the placeholder [venue]; in practice, this will be the court closest to the union’s office or to the premises to be entered). No notice needs to be given to anyone under the Rules. The applicant should also check the Outworkers Act for any substantive requirements (e.g., that the proposed permit holder is a fit and proper person). The court will set a hearing date; there is no 28‑day timeline, so the applicant should inquire about expected wait times. The applicant must appear at the hearing (or have representation) to support the application.

Applying for a waiver of notice (Form 1) - The permit holder must complete Form 1. The form requires the applicant’s name and address, confirmation that they hold a valid permit (including the date and venue of issue), and a description of the orders sought - typically the address of the premises and the date of intended entry. The form does not require grounds, but the applicant must be able to satisfy the court under section 44(1) of the Act that a waiver is appropriate (e.g., likelihood of evidence being removed). The application is filed at the venue stated on the permit. No notice obligation is imposed by the Rules, but the applicant should review the Act to ensure compliance. The applicant should attend the hearing prepared to address the court on why notice should be waived.

Applying for revocation of a permit (Form 3) - The applicant (employer, registered organisation of employers, or information services officer) must complete Form 3. The form requires the applicant’s name, the permit holder’s name, and the grounds for revocation, which must reference section 46(2) of the Act. The applicant should set out specific facts, not just a recitation of the Act. The application is filed at the venue where the permit was issued (presumably). The applicant must serve a copy of the application on the permit holder within a reasonable time before the hearing. The term “reasonable time” will depend on the circumstances; a safe minimum would be at least 7 days, but the applicant should consider the need for the permit holder to prepare a response, the complexity of the grounds, and any urgency. Service can be by hand, post, or other means; retaining proof of service is essential. The registrar will fix a hearing date no later than 28 days after filing; the applicant and permit holder will be notified. If either party needs to change the date, they can apply to the court under rule 11. The applicant must attend the hearing and present evidence supporting the grounds.

General compliance tips - Use the exact wording of the forms. Do not alter or omit any field. If a field is irrelevant (e.g., the date in Form 1 if the waiver is for a future date), either fill it appropriately or include a note. File at the correct venue; if uncertain, check with the registry. Monitor the sunset date (4 May 2026) - after that, the Rules cease to have effect and the procedural framework will need to be reassessed. Keep a copy of the Rules as published (this version 001) because amendments may be made later. If the Rules are amended, check the Table of Amendments in the endnotes. Finally, if the parent Act is amended, the forms may become outdated; the court may accept forms that are “substantially” in the prescribed form, but it is safer to use the forms as gazetted.
