Magistrates' Court (Judicial Registrars) Rules 2025

The Rules operationalise two principal concepts: delegated judicial power to judicial registrars, and a defined internal review mechanism.

Delegation and Court constitution. Rule 15 provides that when a judicial registrar hears and determines a proceeding in accordance with the Rules, the judicial registrar constitutes the Court for that purpose and is delegated the same powers that the Court has in hearing and determining the proceeding. That delegation is bounded by the express limits the Rules impose. Rule 14 further provides that judicial registrars may exercise all or any powers of a registrar under the Magistrates' Court Act 1989 and any other Act or the Rules. The effect is that judicial registrars can act both in a quasi‑judicial capacity (hearing and determining matters as the Court) and in an administrative capacity (performing registrar functions), subject to the Rules' exclusions.

Scope of matters. Order 2 divides the subject matter into criminal (Part 1) and civil (Part 2) matters. Rule 6 lists criminal proceedings where judicial registrars may exercise Court powers, while Rule 7 enumerates additional statutory powers they may exercise in certain summary or indictable‑triable‑summarily matters, including powers under section 59 of the Criminal Procedure Act 2009, specified provisions of the Bail Act 1977 and the Criminal Procedure Act 2009, and incidental powers under the Confiscation Act 1997 and Firearms Act 1996. Rule 6 expressly limits exercise of powers to all or any powers except those set out in s 16I(b)(i), (iii), (iv), (v) and (vi) of the Magistrates' Court Act 1989; this cross‑reference signals statutory exclusions but does not replicate those excluded powers in the Rules.

Monetary threshold and civil exclusions. Rule 8(1)(a) allows judicial registrars to deal with civil claims for damages, debt, liquidated demand or under an Act where the amount claimed or value of relief sought is less than $25,000. Rule 8(3) permits judicial registrars to deal with specific statutory proceedings listed in that subrule. Rule 9 allows judicial registrars to make final orders by consent, subject to the other limitations. Critical constraints appear at Rule 10, which bars judicial registrars from dealing with claims for equitable relief unless these Rules provide otherwise, and at Rule 11, which carves out certain powers under the Magistrates' Court General Civil Procedure Rules 2020 (for example Rules 12.02 and 12.07 when amount is $25,000 or more; Rule 37.02; and Rule 15.08(1)), so that judicial registrar powers will not include those procedural powers in defined circumstances.

Review process. Order 3 sets the internal review mechanism. Under Rule 16 an application for review of a judicial registrar's determination must be in Form 1, include an affidavit of grounds and be filed within 28 days, subject to the Court's power to extend time. Rules 17 to 19 regulate notice, service and hearing of the review, provide that filing does not operate as a stay (but stays may be applied for), and direct that if review is granted the matter is reheard de novo by a magistrate (Rule 19(5)).

Schedule concept. Schedule 1 is a catalogue of specific statutory provisions from other Acts which judicial registrars may exercise in certain proceedings. The Schedule is lengthy and spans many Acts, notably the Domestic Animals Act 1994 and the Road Safety Act 1986, identifying exact section numbers that are within a judicial registrar's competence in specified contexts.

Statutory architecture. The Rules are subordinate legislation made under ss 16 and 16I of the Magistrates' Court Act 1989 (Rule 2). They revoke earlier judicial registrar rules and amendments (Rule 4). The Rules commence on 9 December 2025 (Rule 3) and, per the endnotes, will sunset ten years after making under the Subordinate Legislation Act 1994, creating a temporal limit on their operation.

The Rules affect three categories of persons and entities directly, and several categories indirectly.

Directly affected decisionmakers. Judicial registrars are the principal actors affected. Rules 6 to 15 extend to judicial registrars a defined slate of the Court's powers and responsibilities, both in criminal and civil matters. Judicial registrars will exercise Court powers in specified proceedings, perform registrar functions (Rule 14), and when hearing matters will constitute the Court (Rule 15). The Rules change the institutional allocation of adjudicative work within the Magistrates' Court by defining what matters may be heard by registrars rather than by magistrates.

Parties to litigation. Litigants in the Magistrates' Court will be affected because the Rules determine whether a matter is heard by a judicial registrar or must be allocated to a magistrate. For civil litigants, the $25,000 monetary threshold in Rule 8(1)(a) designates a large set of lower‑value claims to registrars. Parties in criminal summary matters and indictable matters triable summarily will see more powers exercised by registrars, as enumerated in Rules 6 and 7. Parties seeking equitable relief, family violence or Family Law matters are affected in the opposite way: such matters cannot be dealt with by judicial registrars under Rules 10 and 12, and thus must proceed to a magistrate.

Practitioners and representatives. Solicitors, counsel and appeals practitioners must comply with filing, service and review procedures set out in Order 3. Rule 16 requires Form 1 and an affidavit stating grounds, Rule 17 establishes service rules (with criminal proceedings to follow Criminal Procedure Act 2009 service sections 391-393 and civil service under the Magistrates' Court General Civil Procedure Rules 2020), and Rule 19 prescribes the hearing format and the ability to rely on prior affidavits or transcripts. These procedural prescriptions change the steps lawyers take when challenging a registrar's decision, including time limits and the availability of stays.

Magistrates. Magistrates are affected because Rule 15(1)(a) recognises that when hearing a matter in accordance with these Rules, a judicial registrar constitutes the Court. However the magistracy retains supervisory and rehearing roles: Rule 19(5) provides for rehearing de novo by the Court constituted by a magistrate if a review is granted. Magistrates will therefore receive a pipeline of review applications and, in some cases, duplicate hearings.

Government agencies and regulators. Agencies enforcing statutes listed in Schedule 1 will encounter judicial registrars exercising specific powers under their Acts in certain proceedings. Examples include local councils and animal management authorities under the Domestic Animals Act 1994, road authorities under the Road Safety Act 1986, and policing or public safety bodies using provisions of the Control of Weapons Act 1990. Those agencies must be alert to service and evidentiary processes when matters are before registrars.

Victims, respondents and the public. For victims in matters excluded from registrar jurisdiction, such as family violence or specified personal safety orders, the Rules require that these matters be before magistrates, which may affect timeliness and forum. For the public generally, the delegation to registrars may change the speed of case resolution for specified low value civil and summary criminal matters.

Indirectly affected actors include registry staff, court administrators, expert witnesses, and parties who might otherwise have sought certain forms of interim equitable relief. Practical impacts include where procedural powers are excluded (Rule 11) and where stays are not automatic (Rule 18), which will affect tactical decisions by parties and their lawyers. The Rules also affect anyone who previously relied on the revoked 2015 Rules and their amendments, by changing the statutory instrument set in force (Rule 4).

The Rules allocate duties, limits and procedural rights to parties, judicial registrars and the Court. The central duties and rights are administrative and procedural rather than imposing new substantive offences.

Delegated functions and duties of judicial registrars. Under Rule 14 judicial registrars may exercise the powers of a registrar under the Act and any other Act or the Rules. Rule 15(1) confers that a judicial registrar hearing a matter constitutes the Court and is delegated the same powers the Court has in hearing and determining the proceeding. Rule 6 permits judicial registrars to “deal with and exercise all or any powers of the Court” in certain criminal proceedings listed in that Rule, subject to the s 16I exclusions. Rule 7 elaborates powers in summary and indictable‑triable‑summarily matters, authorising exercise of powers under specific statutory provisions such as section 59 of the Criminal Procedure Act 2009 and specified Bail Act and Criminal Procedure Act provisions. Rule 8 sets out where judicial registrars may exercise Court powers in civil matters, including claims under $25,000 and specified statutory proceedings.

Limitations on duties and rights. The Rules limit both what a registrar may do and a party may obtain from a registrar. Rule 10 establishes that judicial registrars cannot deal with claims for equitable relief, with examples given: freezing orders under Order 37A, search orders under Order 37B and injunctions under Order 38 of the Magistrates' Court General Civil Procedure Rules 2020. Rule 11 restricts judicial registrars from exercising certain powers under specified rules of the Magistrates' Court General Civil Procedure Rules 2020, for example Rules 12.02 and 12.07 where the amount claimed is $25,000 or more, Rule 15.08(1) and Rule 37.02 (save for inspection of property under Rule 37.01). Rule 12 bars registrars from dealing with proceedings under the Family Violence Protection Act 2008 or the Commonwealth Family Law Act 1975. Rule 13 excludes powers under Part 8 of the Personal Safety Intervention Orders Act 2010. These are not discretionary exclusions in the Rules; they are categorical.

Procedural rights for parties seeking review. Rule 16 codifies a party's right to seek review under section 16K(3)(a) of the Magistrates' Court Act 1989. The application must be in Form 1 and accompanied by an affidavit stating grounds; it must be lodged within 28 days, subject to extension (Rule 16(3)-(4)). Rule 17 sets service timing and methods, with criminal‑proceeding service following Criminal Procedure Act sections 391-393, and civil service following the Magistrates' Court General Civil Procedure Rules 2020, unless the Court directs otherwise. Rule 18 clarifies that filing for review does not automatically stay orders; a party may apply separately for a stay to the judicial registrar who made the order or to a magistrate (Rule 18(2)). Rule 19 governs the hearing of the review, specifying open court, party attendance and the materials parties may rely upon, including prior affidavits and transcripts. If the review is granted, rehearing is de novo by a magistrate (Rule 19(5)).

Duty to notify where stays are granted. Rule 18(3) imposes a duty on the person who obtains a stay to notify all other parties of that stay. That is a party obligation linked to the review procedure.

Consent‑based final orders. Rule 9 permits judicial registrars to make final orders by consent, subject to the other Rules. The duty here is reciprocal: parties must expressly consent for registrars to make final orders in proceedings where otherwise limitations might apply.

Filing and form duties. Rule 16(1) requires a specific form (Form 1) and an affidavit stating grounds for the review. Rule 17(1) requires that a copy of the application and affidavit be served on each party within 7 days after filing, subject to the Court's extension power. These are precise procedural duties; failure to comply will risk non‑jurisdictional issues or may trigger extension applications.

Delegated powers under other Acts. The Schedule expressly lists many statutory provisions that registrars may exercise. Where a registrar acts under one of those provisions, they exercise the corresponding statutory powers, and must observe any procedural or review rights contained in those Acts. The Rules thus create both the right to have certain matters heard by registrars and duties on registrars to conform to statutory procedure when exercising powers identified in Schedule 1.

The Rules themselves do not create new criminal offences or penalty regimes, but they interact with enforcement mechanisms by reallocating who exercises statutory powers and by preserving applicable substantive penalty regimes in the underlying Acts.

No novel standalone penalties. The Rules do not introduce fines, imprisonment, or new administrative penalties. They are procedural instruments that delegate adjudicative authority. When a judicial registrar exercises a power under an Act listed in Schedule 1 or under the Magistrates' Court Act 1989, any substantive penalties or enforcement consequences flow from those underlying Acts or the court orders made in proceedings.

Enforcement through Court orders. Judicial registrars are authorised to make orders, including final orders by consent (Rule 9), within the bounds of the Rules. Where a judicial registrar makes an order that carries a penalty or an enforcement mechanism under an underlying Act , for example a fine under the Road Safety Act 1986 or an order under the Domestic Animals Act 1994 specified in Schedule 1 , the order's enforcement and penalty follow the statutory framework of that Act as applied by the Court. The Rules do not alter substantive enforcement mechanics; they alter who pronounces the order.

Review and stay affecting enforcement. Rule 18(1) specifies that filing an application for review does not operate as a stay of any order made by a judicial registrar. That has direct enforcement consequences: a party cannot rely on filing a review to suspend enforcement. A party may apply for a stay from the judicial registrar who made the order or from a magistrate (Rule 18(2)), and if a stay is granted the person obtaining it must notify other parties (Rule 18(3)). This procedural rule affects enforcement timing and risks, and increases the need to seek a formal stay rather than relying on the mere filing of a review.

Court supervision and rehearing. Rule 19(4)-(5) empowers the Court to grant review, list the matter for rehearing, or refuse the application. If the Court grants review and lists a matter for rehearing, the rehearing is de novo before a magistrate (Rule 19(5)). That means enforcement action taken by a judicial registrar may be subject to full reconsideration on rehearing, which affects the practical finality of enforcement outcomes until the review process is exhausted.

Consequences of exceeding delegated power. The Rules limit judicial registrars from exercising certain powers, for example equitable relief (Rule 10) and some procedural powers under the Magistrates' Court General Civil Procedure Rules 2020 (Rule 11). If a judicial registrar purported to exercise an excluded power, that would be open to challenge on review or by other judicial review mechanisms, and could result in orders being set aside on the basis the registrar exceeded the delegated authority. The Rules do not prescribe specific penalties for such errors, but the review and rehearing mechanisms are the enforcement pathway to correct jurisdictional overreach.

Interaction with statutory enforcement regimes in Schedule 1. When judicial registrars exercise powers listed in Schedule 1, they step into the enforcement chain of the underlying Act. For example, orders under specified sections of the Road Safety Act 1986 will carry the enforcement processes of that Act. The Rules therefore reallocate who (registrar or magistrate) determines liability and sanctions in those statutory regimes, which has procedural knock‑on effects rather than creating new sanctions.

The Rules operate as subordinate legislation under ss 16 and 16I of the Magistrates' Court Act 1989 (Rule 2). They cross‑reference and integrate with numerous other statutes and procedural rules. The principal interaction modes are delegation of powers under other Acts, preservation of procedures in other Acts, and exclusion of certain subject matter or powers.

Delegation and statutory cross‑reference. The Rules explicitly authorise judicial registrars to exercise powers contained in other Acts. Rule 7(1) and (2) reference powers under sections of the Criminal Procedure Act 2009 and the Bail Act 1977. Schedule 1 lists many specific provisions of other Acts (for example many sections of the Domestic Animals Act 1994, numerous provisions in the Road Safety Act 1986, and select provisions of the Control of Weapons Act 1990, Graffiti Prevention Act 2007, North East Link Act 2020 and others). When a judicial registrar exercises any power under those cited provisions, they do so under the authority of these Rules but must apply the substantive and procedural rules of the underlying Act.

Interaction with the Magistrates' Court General Civil Procedure Rules 2020. Rule 11 identifies particular provisions of the Magistrates' Court General Civil Procedure Rules 2020 that are excluded from a judicial registrar's powers in covered civil proceedings. The Rules disallow registrars from exercising the Court's powers under Rules 12.02 and 12.07 when the amount is $25,000 or more, Rule 15.08(1), Rule 37.01 (other than inspection of property) and Rule 37.02. Those exclusions mean certain interlocutory or complex procedural powers , for example, those that may relate to discovery, affidavits, or broad search and seizure powers under the civil procedure Rules , remain within the magistrate's remit unless Parties consent under Rule 9.

Family and personal safety statutes. Rule 12 categorically excludes proceedings under the Family Violence Protection Act 2008 and the Family Law Act 1975. Rule 13 excludes Part 8 of the Personal Safety Intervention Orders Act 2010. These exclusions preserve existing statutory jurisdictional structures and ensure that matters raising family violence or family law issues are dealt with by magistrates, not registrars, thereby maintaining existing procedural pathways in those statutes.

Criminal procedure and service integration. Rule 17(2) mandates that, for criminal proceedings, service of an application for review must be in accordance with sections 391, 392 or 393 of the Criminal Procedure Act 2009 depending on who makes the application. That ties the review procedure into established criminal service rules and timelines, ensuring coherence between the review mechanism and criminal procedure rules.

Effect on enforcement Acts listed in Schedule 1. Where Schedule 1 confers on registrars the power to exercise specific sections of other Acts, the interaction changes operationally who enters decisions and orders under those Acts. However the Rules do not modify the substantive content of those Acts. For example, a power under s. 37(1) of the Domestic Animals Act 1994 (listed at Item 9) remains subject to the Domestic Animals Act's substantive requirements, but the decisionmaker may be a judicial registrar rather than a magistrate in proceedings falling within the Rules.

Sunset and subordinate legislation regime. The endnotes state the Rules will sunset ten years after making under section 5 of the Subordinate Legislation Act 1994. That interacts with the broader subordinate legislation framework; readers should note the Rules are temporally limited to December 2035 unless remade or extended, which may affect long term planning by court administration, registrars, and agencies.

Revocation of earlier rules. Rule 4 revokes the Magistrates' Court (Judicial Registrars) Rules 2015 and listed amendments. This interaction withdraws prior subordinate instruments and replaces them with the 2025 instrument, consolidating prior changes and altering the existing regulatory landscape for judicial registrars.

The Rules include their own revocation clause and an endnote providing a table of amendments and explanatory details. Mechanically the instrument replaces prior judicial registrar rules and various amendments, consolidating the scheme into a fresh statutory rule.

Revocations. Rule 4 expressly revokes the Magistrates' Court (Judicial Registrars) Rules 2015 and nine subsequent amendment instruments by statutory rule numbers set out in Rule 4(a) to (i). The endnotes provide the S.R. references and identify the making date as 4 December 2025 and commencement 9 December 2025 (Rule 3 and endnotes). The revocation list identifies prior material now superseded, which is relevant for practitioners who previously relied on the older texts.

No amendments yet to the 2025 Rules. The endnote Table of Amendments states that no amendments have been made to these Rules by statutory rules, subordinate instruments or Acts as at the version date (Version No. 001, as at 9 December 2025). This establishes that the instrument is newly made and unamended at the snapshot provided.

Links to earlier amendments and style changes. The Explanatory details and endnotes cross‑reference earlier S.R. numbers and explain which earlier rules or amendments correspond to provisions in the new instrument. For example, the explanatory details note that Rule 6(g) relates to S.R. No. 27/2019 as amended, and Rule 11 has its own amendment history recorded in the endnote. The endnotes also note style changes authorised by the Interpretation of Legislation Act 1984, which affect headings, examples, punctuation and provision numbers for subordinate instruments made since 1 January 2001.

Temporal limit. The endnotes record that the Rules will sunset ten years after making, under s 5 of the Subordinate Legislation Act 1994. The making date is 4 December 2025, so the instrument will cease by operation of the sunset clause on 4 December 2035 unless remade. Practitioners and institutional administrators must account for that sunset when considering the Rules' longevity.

Signed instrument. The instrument is dated 4 December 2025 and is signed by the Chief Magistrate and two Deputy Chief Magistrates. That signature block is part of the amendment history insofar as it indicates the authority under which the instrument was made.

Implication for future change. While the instrument, as at Version No. 001, has no later amendments recorded, the instrument revokes an earlier web of S.R. instruments. Future amendment will be recorded in subsequent versions and endnotes, per the usual practice for subordinate legislation. The present instrument consolidates prior changes and establishes the current delegated powers and review regime for judicial registrars.

The Rules themselves do not record any litigation history and do not cite cases. The instrument does not name judicial decisions. The following points describe the procedural avenues that may produce litigation or challenges, based solely on the text of the Rules.

Review mechanism for errors of jurisdiction or process. Order 3 provides an internal Court review pathway under section 16K(3)(a) of the Magistrates' Court Act 1989. A party dissatisfied with a determination of a Court constituted by a judicial registrar can file an application in Form 1 within 28 days, supported by affidavit (Rule 16). The Court then hears the review in open court unless directed otherwise, and may rehear de novo before a magistrate (Rule 19(5)). Any rehearing or refusal to rehear may generate litigation activity including applications in the Magistrates' Court on the standard civil or criminal rules.

Potential grounds for judicial review. While the Rules set out an internal review, they do not displace external judicial review remedies available under general administrative law, such as writs in the Supreme Court (not mentioned in the Rules). The Rules do not limit or address those external avenues directly, and nothing in the Rules should be read as creating or extinguishing remedies outside the Magistrates' Court Act framework.

Challenges to jurisdictional limits. Because the Rules set delegations and exclusions, litigants may challenge whether a judicial registrar had authority to make an order in a particular case. For example, if a judicial registrar purported to grant equitable relief notwithstanding Rule 10, or purported to exercise a procedural power excluded by Rule 11, a party could seek review under Rule 16 and, if necessary, litigate jurisdictional questions. The Rules provide the internal remedy (rehearing de novo by a magistrate) where the Court grants review.

Enforcement and appeals under underlying Acts. Decisions made by judicial registrars under the statutory powers listed in Schedule 1 may attract appeals or enforcement proceedings under the respective Acts. The Rules do not change the substantive appeal routes in those Acts, but they alter who issues the orders subject to appeal or enforcement.

No reported cases recorded in the instrument. The instrument’s endnotes explicitly note the absence of amendments and do not reference judicial decisions. Consequently there is no adjudicative or reported litigation history recorded in, or attached to, this version of the Rules.

Practical note for litigators. Given the Rules create an internal review process with defined time limits (28 days to file a Form 1), practitioners should expect to see application work at the Magistrates' Court level rather than immediate recourse to higher courts for routine challenges to registrar determinations. The rehearing de novo mechanism may reduce the immediate need for interlocutory applications to courts outside the Magistrates' Court, though external judicial review remains a possible avenue in appropriate cases.

The Rules contain a number of traps for practitioners and litigants which, if overlooked, can prejudice rights, delay proceedings or produce tactical missteps.

Filing a review does not stay the decision. Rule 18(1) makes clear that simply filing an application for review does not automatically stay a judicial registrar’s order. A party who assumes that filing a Form 1 suspends enforcement risks enforcement actions proceeding. To obtain suspension a party must apply for a stay to the judicial registrar who made the order or to a magistrate (Rule 18(2)). If a stay is obtained, the obtaining party must notify other parties of the stay (Rule 18(3)). Practically, urgent stay applications should be sought promptly and not assumed.

Strict time limit for review, but extension possible. Rule 16(3) requires filing within 28 days of the determination. The Court may extend this time either before or after expiry (Rule 16(4)). However extensions are discretionary and require argument; late filings without a clear explanation risk rejection. Practitioners should file promptly and seek extensions only with articulated grounds.

Form and affidavit requirements. Rule 16(1) requires that the application be in Form 1 and accompanied by an affidavit stating grounds. Failure to use Form 1 or to include an affidavit that specifically states grounds can result in procedural non‑compliance which the Court may not overlook. The Form requires particular information including the order made and whether whole or part of the determination is subject to review.

Service mechanics vary by proceeding. Under Rule 17(2) criminal matters must be served in accordance with sections 391 to 393 of the Criminal Procedure Act 2009 depending on which party applies. Civil matters follow the Magistrates' Court General Civil Procedure Rules 2020 unless the Court directs otherwise. For proceedings under the Personal Safety Intervention Orders Act 2010, the Court gives copies to parties in accordance with Rule 5.01 of the Magistrates' Court (Personal Safety Intervention Orders) Rules 2021 (Rule 17(4)). Mis‑serving a review application can create delay and may be fatal to the application.

Equitable relief is off limits. Rule 10 bars judicial registrars from dealing with claims for equitable relief unless the Rules expressly provide otherwise; the Rule gives examples of freezing orders, search orders and injunctions under the Magistrates' Court General Civil Procedure Rules 2020. Practitioners seeking such remedies must ensure the application is before a magistrate or establish that the Rules otherwise permit a registrar to hear the question.

Monetary threshold traps. Rule 8(1)(a) allows registrars to hear claims under $25,000. Rule 11 is specific: Rules 12.02 and 12.07 of the Magistrates' Court General Civil Procedure Rules 2020 are excluded where the amount claimed is $25,000 or more. This produces a hard boundary at $25,000 which affects procedural powers available before a registrar. Misstating the amount claimed or incorrectly drafting pleadings could result in a matter being placed before a registrar lacking competence to exercise certain powers.

Consent required for some final orders. Rule 9 permits final orders by registrars only with party consent and subject to other limitations in the Rules. If parties assume a registrar can make a final order in the absence of clear consent, that mistake can be corrected only by review or rehearing.

Excluded subject matter. Rule 12 excludes proceedings under the Family Violence Protection Act 2008 and the Family Law Act 1975. Rule 13 excludes Part 8 of the Personal Safety Intervention Orders Act 2010. Counsel must check statutory basis before proceeding before a registrar; hostile parties cannot be surprised by a registrar taking jurisdiction where the Rules exclude it.

Interaction with other Acts and procedural rules. Schedule 1 authorises registrars to exercise many statutory powers. However those powers often carry substantive or procedural prerequisites in their parent statutes not repeated in the Rules. Practitioners must check the parent Act for notice, evidence and appeal requirements, rather than assuming the Rules alone govern the process.

Review materials and reliance on transcript. Rule 19(2) permits parties to rely on affidavits admitted before the registrar, transcripts and other material as directed. Practitioners should secure accurate transcripts where hearings before registrars are contested, because the review hearing will commonly rely on those records.

Sunset provision. The endnotes state the Rules will sunset ten years after making under the Subordinate Legislation Act 1994, namely on 4 December 2035. Administrative planning or compliance systems should account for the Rules’ temporal limit.

Revocation of prior rules. Rule 4 revokes the earlier 2015 Rules and successive amendment rules. Any practice notes or precedent forms based on the older instruments need scrutiny and likely revision to conform to the 2025 Rules.

This section gives practical steps and a checklist to comply with the Rules when a party, practitioner or judicial officer is engaged with proceedings that may fall within a judicial registrar’s competence.

1. Determine entitlement to registrar forum.

• Check the proceeding type against Rule 6 (criminal) and Rule 8 (civil). For criminal matters, confirm the proceeding is within the list in Rule 6 and that the specific statutory provision sought to be exercised is not excluded by s 16I(b)(i), (iii), (iv), (v) or (vi) of the Magistrates' Court Act 1989. For civil matters, confirm the claim is for amounts under $25,000 per Rule 8(1)(a), or is an interlocutory application that Rule 8(1)(c) permits.
• If the matter involves equitable relief, family violence, family law, or Part 8 of the PSIO Act, do not proceed before a judicial registrar; Rule 10, Rule 12 and Rule 13 exclude these matters.

2. Check for procedural exclusions.

• Read Rule 11 and the specified Magistrates' Court General Civil Procedure Rules 2020 provisions cited there (Rules 12.02, 12.07 as applicable, Rule 15.08(1), Rule 37.01 except inspection, Rule 37.02). If your case requires one of those excluded powers, arrange for the matter to be before a magistrate or obtain party consent under Rule 9 to allow final orders by consent where appropriate.

3. Use Schedule 1 for cross‑statute powers.

• If your matter requires exercise of a power listed in Schedule 1, confirm the item number and the parent Act's procedural requirements. Prepare to comply with any notice, evidence or appeal requirements in the parent Act when the registrar exercises that power.

4. Consent for final orders.

• If seeking final orders via a judicial registrar, obtain and document express party consent as required by Rule 9. Ensure consent is recorded in a form acceptable to the Court and that the consent does not conflict with exclusions in Rules 10 to 13.

5. Prepare for review contingencies.

• If you anticipate a need to challenge a registrar’s determination, prepare Form 1 (Rule 16(1)) and an affidavit that plainly states the grounds for review. File within 28 days (Rule 16(3)). If you require more time, file a timely extension application explaining the reasons for delay (Rule 16(4)).

6. Service and notice steps.

• After filing an application for review, serve a copy of the application and affidavit on each party within 7 days after filing (Rule 17(1)), unless the Court grants an extension. For criminal matters, serve in accordance with Criminal Procedure Act sections 391-393 (Rule 17(2)). For civil matters, serve in accordance with the Magistrates' Court General Civil Procedure Rules 2020 (Rule 17(3)). For PSIO matters, note Rule 17(4) and Rule 5.01 of the Magistrates' Court (Personal Safety Intervention Orders) Rules 2021.

7. Apply for stays proactively when required.

• Do not assume filing for review will delay enforcement. If suspension of a judicial registrar’s order is required, promptly make a separate stay application to the judicial registrar who made the order or to a magistrate (Rule 18(2)). If a stay is granted, comply with the obligation to notify all other parties (Rule 18(3)).

8. Hearing preparation.

• Prepare to be heard in open court unless the Court directs otherwise (Rule 19(1)). Collate affidavits, transcripts of the original hearing, and any other evidence that was before the registrar or that the Court may direct (Rule 19(2)). Be ready for the possibility of rehearing de novo by a magistrate if the Court grants review (Rule 19(5)).

9. Registry and form compliance.

• Use Form 1 exactly as required by Rule 16(1) and include the particulars requested: venue, court reference, parties, date of the registrar’s hearing, the order made, which parts of the determination are under review, and exact grounds for review. Ensure signatures comply with the Form’s directions.

10. Liaise with court administration.

• Confirm local practice directions and registry processes, including whether the Court requires electronic or hard copy filing, and any specific filing fees or procedural tokens tied to criminal or civil proceedings. Note that the Rules revoke prior instruments (Rule 4) so prior forms and processes may have changed.

11. Recordkeeping and transcripts.

• If proceedings before a registrar are contested, arrange for a transcript to be obtained, because Rule 19(2)(c) permits reliance on the transcript in a review. Ensure transcripts and exhibits are archived to facilitate an efficient review hearing.

12. Consider tactical implications.

• Account for the cost and time implications of rehearing de novo by a magistrate if review is granted. Where parties can agree to a consent final order (Rule 9), that path may avoid review risk and duplication. Conversely, if you expect equitable relief will be required, plan to proceed before a magistrate rather than a registrar.

13. Monitor sunset and legislative change.

• The Rules are subject to sunset on 4 December 2035 under the Subordinate Legislation Act 1994 per the endnotes. Monitor for amendments or replacement rules which may alter the delegation, exclusions or review procedure.

By following the checklist above and consulting the precise rule references in the instrument (notably Rules 6 to 9, 10 to 13, and 16 to 19, plus Schedule 1), practitioners can align filings and courtroom strategy with the 2025 Rules and reduce the likelihood of procedural error.
