Magistrates' Court General Regulations 2024

Oath or affirmation of office: Both magistrates and judicial registrars are required by the parent Act to take an oath or affirmation before exercising their functions. Regulation 5 and Schedule 1 prescribe the exact wording for magistrates, who swear or affirm to "do equal justice to all persons" and discharge duties "without fear, favour or affection". Judicial registrars under regulation 6 and Schedule 2 have a slightly different form: they do not promise to do equal justice, and their affirmation adds "ill-will" to the list of prohibited motivations. The prescribed manner for judicial registrars requires that the oath or affirmation be administered by the Chief Magistrate or a Deputy Chief Magistrate, whereas for magistrates the form is prescribed but the manner is not specified in these regulations (the parent Act would govern). The distinction reflects the different statutory roles: magistrates exercise judicial functions with a broader equality commitment, while judicial registrars perform delegated quasi-judicial tasks. The inclusion of alternative wording for those who object to swearing by God accommodates religious diversity, but the prescribed wording is mandatory in substance.

Warrant particulars: Regulations 7 and 8 specify the information that must appear on court-issued warrants, filling in the parent Act's references to 'prescribed particulars'. For a warrant to arrest (regulation 7(1)), eight particulars are prescribed: the person's name and address (if known) plus any other details specified by the issuing officer; the reasons for issue including charges; whether the warrant is directed to a named officer or generally; the powers granted to the executing officer; the legislative provision under which it is issued; any bail conditions if endorsed for bail; the date and location of issue; and the name and office of the issuing officer. For other warrants such as warrant to seize property or to imprison for non-payment of a fine (regulation 7(2)), four particulars are prescribed: the type of warrant, the date of issue, the sum involved (if applicable) and the person named to execute it. Regulation 8 adds two more particulars for warrants to seize property: the direction to the sheriff and the fee payable for issue. These particularisation requirements serve a rule-of-law function: they prevent general warrants, ensure that the executing officer and the subject know the scope of authority, and create a clear record for subsequent review. Omission of any prescribed particular may render the warrant defective, exposing the execution to legal challenge.

Prescribed venues for extended remand: Section 82(3)(b) of the Magistrates' Court Act 1989 permits a remand of more than eight clear days only if the accused is remanded to appear at a prescribed venue. Regulation 9 and Schedule 3 list 56 venues including metropolitan courts (Melbourne, Broadmeadows, Dandenong, Frankston, Heidelberg, Ringwood, Sunshine, Werribee), regional courts (Ballarat, Bendigo, Geelong, Latrobe Valley, Mildura, Shepparton, Warrnambool, etc.), specialty courts (Drug Court at Ballarat, Dandenong, Melbourne, Shepparton), and smaller rural courthouses (Cobram, Corryong, Edenhope, Hopetoun, Kerang, Myrtleford, Nhill, Omeo, Orbost, Ouyen, Robinvale, St Arnaud, Stawell). The list can be amended by regulation without amending the parent Act, as occurred in 2025 with the addition of Wyndham Law Courts (Werribee). The practical effect is to concentrate longer remands at venues that have sufficient facilities and judicial resources, while shorter remands may occur at any venue. The list creates a compliance obligation: a magistrate who remands an accused for more than eight days to a venue not on the list acts without statutory authority, and the accused may challenge the legality of the remand.

Magistrates and judicial registrars: These are directly affected because they must take the prescribed oath or affirmation in the prescribed form (for magistrates, the form alone is prescribed; for judicial registrars, both form and manner are prescribed). A magistrate who uses a different wording may not be properly sworn, and any judicial act performed before taking the oath could be challenged for want of authority. Judicial registrars also must arrange for the oath to be administered by the Chief Magistrate or Deputy Chief Magistrate, adding an administrative step that may cause delay if those officers are unavailable.

Police officers and other warrant executors: Regulation 7 imposes an obligation on the issuing officer (usually a magistrate or registrar) to ensure warrants contain the prescribed particulars. But it is the person executing the warrant , a police officer, sheriff's officer or other authorised person , who bears the practical risk of executing a defective warrant. If a warrant omits a required particular, the execution may be unlawful and the officer may face civil liability or evidentiary exclusion. The regulation therefore creates an implicit due diligence burden on executors to check the warrant's face before acting.

The Sheriff and sheriff's officers: Regulation 8 specifically requires that a warrant to seize property be directed to the sheriff and state the fee payable. This affects the sheriff's office operationally: the sheriff must verify that the fee has been paid or is recorded before executing a seizure. It also clarifies that the sheriff is the default executing officer for property seizures, not police.

Accused persons and fine defaulters: The regulations affect the liberty of individuals. Warrants that improperly lack prescribed particulars may be challenged, and defendants remanded beyond eight clear days at a non-prescribed venue can argue that their remand is unlawful. The prescribed venue list therefore creates a right to be remanded only to a venue that can handle longer remands, which may affect access to legal representation, family visits and court facilities.

Legal practitioners and advocates: Lawyers representing accused persons must be alert to warrant defects and venue non-compliance. A failure to identify a defective warrant may prejudice a client, while a successful challenge can lead to release or exclusion of evidence. The regulations give practitioners concrete grounds for objection that go beyond general principles.

Court administrators and registry staff: The regulations affect administrative processes: forms for warrants must include the prescribed fields; the oath forms must be printed and available; court lists must be arranged so that extended remands are scheduled at prescribed venues. Staff also must manage the revocation of old forms and ensure the correct versions are used.

Duty of issuing officer to include all prescribed particulars: When issuing a warrant to arrest, the officer must include the eight items listed in regulation 7(1). For a warrant to seize property or to imprison for fine default, the four items in regulation 7(2) are mandatory. For a warrant to seize property, regulation 8 adds the direction to the sheriff and the fee payable. These are duties imposed by delegated legislation, not by the parent Act, but they have the force of law. Failure to include a prescribed particular does not automatically invalidate the warrant, but it exposes it to challenge. The duty is on the issuing officer, not on the applicant (usually the police or a complainant), but in practice the officer relies on information provided, so the applicant has an indirect duty to supply accurate details.

Duty of judicial registrar to take oath before Chief Magistrate: Regulation 6(b) prescribes the manner: the oath or affirmation must be administered by the Chief Magistrate or a Deputy Chief Magistrate. This contrasts with magistrates, for whom no manner is prescribed (likely the parent Act or common law allows any authorised officer). The duty is on the judicial registrar to arrange the ceremony; if they assume office before taking the oath, any judicial act they perform may be voidable.

Right of oath-taker to choose form: Both schedules offer an oath or an affirmation, and the oath includes a provision for naming a god recognised by the person's religion. This right protects conscience and religious freedom, consistent with section 116 of the Commonwealth Constitution and the Charter of Human Rights and Responsibilities Act 2006 (Vic). However, the wording is prescribed; the person cannot add or subtract phrases.

Right of accused to be remanded only to prescribed venues for extended remand: Section 82(3) of the parent Act restricts remands of more than eight clear days to prescribed venues. Regulation 9 and Schedule 3 give effect to that right by listing the venues. An accused remanded to a non-prescribed venue can apply for habeas corpus or seek review. This is a substantive right, not merely procedural.

Right to challenge defective warrants: Because the regulations set out mandatory particulars, an accused or a property owner can argue that a warrant lacking a required particular is invalid, and that any arrest, search or seizure conducted under it is unlawful. This right is not explicitly stated in the regulations but flows from the common law principle that a warrant must be precise. The regulations sharpen that principle by specifying exactly what is required.

No new rights for third parties: The regulations do not create rights for neighbours, relatives or business associates of the person named in a warrant. The particulars requirement may indirectly protect them by requiring the warrant to name the specific person, but no new standing is conferred.

The Magistrates' Court General Regulations 2024 do not themselves create any offences or penalties. They are purely prescriptive in nature, filling in details required by the Magistrates' Court Act 1989. Enforcement of compliance therefore occurs through indirect mechanisms. The most immediate consequence of non-compliance with the warrant particulars requirements is that the warrant may be held invalid or defective by a court. If a warrant to arrest fails to include, for example, the reasons for issue or the legislative provision under which it is issued, the person arrested may challenge the legality of the arrest in proceedings for false imprisonment or in an application for bail or habeas corpus. The court may exclude evidence obtained as a result of the defective warrant, or may quash the warrant and order the release of the person. Similarly, if a warrant to seize property omits the direction to the sheriff or the fee payable, the sheriff may refuse to execute it, or the property owner may seek an injunction or damages for trespass. In criminal proceedings, a defective warrant may lead to the exclusion of evidence if the defect is material and the conduct of the executing officer was oppressive.

For the oath or affirmation requirements, non-compliance may have more serious consequences. A magistrate or judicial registrar who has not taken the prescribed oath in the prescribed form may lack the legal authority to perform judicial acts. Any orders, decisions or warrants issued by that person could be challenged as void ab initio. In practice, this risk is low because the swearing-in process is usually carefully managed, but an oversight could create significant procedural complications. The regulations provide no transitional provision for officers appointed under the revoked 2014 regulations, so it appears that those oaths remain valid (since the oath is taken once, not annually), but any new appointee must use the new form.

The prescribed venue requirement in regulation 9 is enforceable by the accused. If a magistrate remands an accused for more than eight clear days to a venue not listed in Schedule 3, the remand is beyond the power conferred by section 82(3)(b) of the Act. The accused can apply for a writ of habeas corpus or seek to have the remand set aside. The court would then have to either release the accused on bail or remand to a listed venue. The practical remedy is likely to be a variation of the remand order rather than automatic release. The 2025 amendment adding Wyndham Law Courts suggests that the Department of Justice monitors the list and updates it as new courthouses open, but there is no statutory penalty for an inadvertent remand to an unlisted venue.

The Subordinate Legislation Act 1994 imposes a sunset on these regulations (10 years from 13 August 2024), but this is not a penalty; it is a built-in review mechanism. Any person affected by the regulations could also seek judicial review of the regulations themselves if they were ultra vires the parent Act, but no such challenge is recorded.

The regulations are made under section 140 of the Magistrates' Court Act 1989, which empowers the Governor in Council to make regulations for "prescribing any matter or thing required or permitted by this Act to be prescribed, or necessary or convenient to be prescribed for carrying out or giving effect to this Act". Each regulation cross-references a specific section of the parent Act: regulation 5 refers to section 7(5) (appointment of magistrates, form of oath); regulation 6 refers to section 16DB(1) (oath or affirmation of judicial registrars); regulation 7 refers to sections 57(1A) and 57(2) (particulars of warrants); regulation 8 refers to section 73(3AA)(f) (particulars of warrant to seize property); and regulation 9 refers to section 82(3)(b) (prescribed venues for remand of more than 8 clear days). The regulations do not amend or override the parent Act; they fill in gaps left by the Act's use of the word 'prescribed'. The parent Act remains the primary source of the court's powers and jurisdiction.

The regulations also interact with the Subordinate Legislation Act 1994, which governs the making, tabling and sunset of statutory rules. The Explanatory Details note that the regulations will sunset 10 years after making (13 August 2034) under section 5 of that Act. This means that unless re-made, the prescriptions will lapse, and the provisions of the parent Act that depend on 'prescribed' matters will become inoperative until new regulations are made. Practitioners should be aware of this deadline for planning purposes.

The Interpretation of Legislation Act 1984 applies to the regulations through standard drafting conventions. The endnotes set out how that Act applies to headings, examples, notes, punctuation and provision numbers. These are not substantive rules but they affect how the regulations are to be read , for instance, headings form part of the regulations, so the heading "Warrant to seize property" under regulation 8 is legally part of the text.

The regulations do not directly interact with the Criminal Procedure Act 2009, the Bail Act 1977, or the Sentencing Act 1991, though those Acts may govern the underlying proceedings in which warrants and remands occur. For example, the Bail Act governs when bail conditions can be endorsed on a warrant; regulation 7(1)(f) merely requires that if bail is endorsed, the conditions must be stated on the warrant. The regulations are neutral as to the substantive law of bail.

There is also potential interaction with the Charter of Human Rights and Responsibilities Act 2006 (Vic). The oath forms include a conscience clause allowing affirmation, which aligns with the Charter's protection of freedom of religion and belief (section 14). The warrant particularisation requirements may support the right to liberty (section 21) by ensuring arrests are lawful and documented. However, the regulations do not reference the Charter, and no rights compatibility statement is included in the text.

Finally, the regulations replace the earlier 2014 regulations and their amendments. Those earlier regulations are revoked from 25 August 2024. However, any warrants issued before that date would be governed by the old prescriptions, and any oaths taken under the old forms remain valid (as the oath is a one-time event). The revocation does not retrospectively invalidate actions taken under the old regulations.

The Magistrates' Court General Regulations 2024 have been amended once since their making. The amendment is the Magistrates' Court General Amendment Regulations 2025, S.R. No. 111/2025, made on 21 October 2025 and commencing on 10 November 2025. The amendment added a new entry to Schedule 3: "Wyndham Law Courts (Werribee)". This addition brought the total number of prescribed venues to 56. Notably, Werribee already appears as item 53, so the addition likely represents a new courthouse building or a clarification that the Wyndham Law Courts is a distinct venue from the older Werribee Magistrates' Court. The amendment table shows that the schedule was modified by inserting this entry. No other amendments have been made as at the version date of 10 November 2025.

The regulations themselves revoked five earlier instruments: the Magistrates' Court General Regulations 2014 (S.R. No. 112/2014, as amended by four subsequent instruments), the 2014 amendment dealing with judicial registrar oaths, and amendment regulations from 2016, 2018 and 2019. This revocation means that all previous prescriptions under the Magistrates' Court Act 1989 on these topics are now consolidated into the 2024 instrument. Importantly, the revoked regulations included amendments that had added or changed venue lists over time, so the 2024 Schedule 3 is a fresh list, not merely a continuation. The explanatory details note that each of the revoked instruments is identified by its statutory rule number, making it easy to trace prior law.

The amendment history is sparse, which suggests the regulations are relatively stable and uncontroversial. However, practitioners should note that the list of prescribed venues may be expanded from time to time as new court facilities open or as regional demands change. There is no indication in the source of any proposed further amendments. The sunset date of 2034 means that a comprehensive review will occur then, but individual venues could be added or removed by regulation before that date.

The source text does not contain any reference to litigation concerning these regulations. There is no mention of court cases, tribunal decisions, or judgments that have interpreted or challenged the regulations. This is not surprising given that the regulations are procedural and narrowly drawn. Most disputes involving warrants or remands would be litigated under the parent Act rather than the regulations themselves, with the regulations cited as the standard against which compliance is measured. For example, a challenge to a defective warrant would typically argue that the warrant lacked the prescribed particulars under the Act, with the regulations specifying what those particulars are. The regulations themselves are unlikely to be the subject of standalone judicial review. However, two potential sources of litigation can be inferred. First, a person remanded for more than eight clear days to a venue not listed in Schedule 3 could challenge the legality of the remand, and the court would need to interpret whether the venue falls within the prescribed list (e.g., whether a court annexe is the same as the listed venue). Second, an officer executing a warrant that omits a required particular might argue that the defect is not fatal, and the court would construe the regulation , for instance, whether the address requirement is mandatory or directory. No such cases are reported in the source. The absence of litigation history does not mean the regulations are immune from challenge; it may simply mean they have been consistently complied with, or that any issues have been resolved without reported decisions. Practitioners should be aware that the regulations are relatively new (2024) and that as time passes, challenges may emerge.

Sunset trap: The regulations will automatically sunset on 13 August 2034 unless re-made. Practitioners relying on these prescriptions in long-running matters (e.g., enforcement of fines or warrants that remain outstanding for years) should check whether the regulations are still in force. After sunset, the parent Act's references to 'prescribed' matters would be left without content, which could cause warrants and remands to become legally ineffective.

No transitional provisions: The regulations revoke the 2014 regulations and their amendments but include no savings clause for warrants issued before 25 August 2024 or oaths taken under the old forms. As a matter of statutory interpretation, an oath taken under the old form likely remains valid because it was a one-time act, but a warrant issued before the commencement that is later executed after commencement may arguably need to contain the new prescribed particulars if it is re-issued or varied. However, a warrant already in existence is a complete document; the regulation likely does not require retrospective amendment. The safer practice is to re-issue any outstanding warrant under the new regulation.

Judicial registrar oath manner: Regulation 6(b) requires that the oath or affirmation be administered by the Chief Magistrate or a Deputy Chief Magistrate. This is a departure from the magistrate's oath, for which no manner is prescribed. If a judicial registrar is sworn in by a different officer (e.g., a registrar or a justice of the peace), the oath may be invalid, and all actions taken by that judicial registrar afterwards could be challenged. The regulation does not provide any exception for emergency appointments.

Warrant particulars are cumulative: Regulation 7 specifies eight particulars for arrest warrants, four for other warrants, and regulation 8 adds two more for property seizure warrants. These are in addition to any common law requirements. A warrant that contains the statutory particulars but is ambiguous or incomplete in other respects may still be invalid. The regulations set a floor, not a ceiling.

Venue list includes duplicate? Wyndham Law Courts (Werribee) was added in 2025, but Werribee already appears as item 53. It is possible that two separate court buildings exist in Werribee, but the regulation does not clarify. A remand to 'Werribee' may be insufficient if the intended venue is the newer Wyndham Law Courts. Practitioners should ensure the venue name matches exactly the entry in Schedule 3.

No definition of 'clear days': The regulations do not define 'clear days' for the purpose of the venue requirement. This term is used in the parent Act and may have a standard legal meaning (excluding the day of remand and the day of appearance, and excluding Sundays and public holidays), but the lack of definition could cause disputes. Additionally, the list is for remands of more than eight clear days; a remand of exactly eight clear days may not require a prescribed venue.

Warrant to seize property: fee payable: Regulation 8 requires the warrant to state the fee payable for its issue. This implies that the fee must have been paid or determined before issue. If no fee is stated, the warrant may be invalid. The regulation does not specify what happens if the fee changes after issue.

For court officers issuing warrants: Before issuing any warrant to arrest, ensure the warrant contains all eight particulars in regulation 7(1): name and address of the person, reasons including charges, direction to a named officer or generally, powers granted, legislative provision, bail conditions if any, date and location of issue, and name and office of issuer. For warrants to seize property or imprison for fine default, include the type of warrant, date of issue, sum if applicable, and person to execute. For property seizure, also include direction to the sheriff and the fee payable. Use a checklist to avoid omitting any item. If the warrant is in electronic form, ensure all fields are populated and visible. If a warrant is amended or re-issued, ensure the amended version still meets the prescribed requirements.

For judicial registrars: Before exercising any delegated judicial function, ensure you have taken the oath or affirmation in the form set out in Schedule 2, administered by the Chief Magistrate or a Deputy Chief Magistrate. Do not assume that any other officer may administer it. If you are a magistrate, the form in Schedule 1 is prescribed, but the manner is not regulated here; however, it is prudent to have the oath administered by a judicial officer or authorised person to avoid later challenge.

For police and other warrant executors: When receiving a warrant, check that all prescribed particulars appear on its face. If any particular is missing or unclear, do not execute the warrant until the issuing court has corrected it. Executing a defective warrant risks civil liability and evidentiary exclusion. If the warrant is for arrest, verify that the name and description match the person you intend to arrest; if the address is unknown, ensure the warrant says so. If the warrant is endorsed for bail, note the conditions and ensure they are communicated to the person upon arrest.

For court administrators: Maintain an up-to-date list of prescribed venues (Schedule 3). When scheduling a remand of more than eight clear days, only list a venue that appears on the schedule. If a magistrate orders a remand to a non-prescribed venue, bring the error to the magistrate's attention before the order is sealed. For judicial registrar oath ceremonies, ensure the Chief Magistrate or a Deputy Chief Magistrate is available to administer the oath. Keep copies of the prescribed oath forms on hand.

For legal practitioners: When representing a client who has been arrested or whose property has been seized, examine the warrant immediately. Check that all prescribed particulars are present. If any are missing, consider making an application to quash the warrant or to exclude evidence obtained as a result of its execution. For clients remanded for more than eight clear days, verify that the remand venue is listed in Schedule 3. If it is not, apply for habeas corpus or a variation of the remand order. For judicial registrar appointments, verify that the judicial registrar has taken the oath in the prescribed form and manner before they deal with your client's matter.

For the Department of Justice and Community Safety: Monitor the list of prescribed venues and amend Schedule 3 when new courthouses open or when venues close. Ensure that the regulations are reviewed well before the 2034 sunset to avoid a gap in prescription. Maintain accurate records of all warrants issued to facilitate any subsequent challenge.
