Magistrates' Court (Fees) Regulations 2022

The Regulations organise fees around a small set of core concepts: payer categories, jurisdictional partition, fee units, waiver/exemption rules, payment timing and responsibility, and transitional treatment.

Payer categories. Regulation 5 defines three primary classes. A corporate fee payer is an entity other than a standard or concession fee payer. A standard fee payer is either a natural person (excluding statutory office holders), certain not-for-profit entities meeting specified charity/corporate governance and distribution tests, entities with turnover less than $200,000 in the prior financial year, or an executor/administrator of a deceased estate. A concession fee payer is a person holding a current Commonwealth health care card when the fee is payable (reg 5).

Jurisdictional partition. Fees are split by criminal jurisdiction (Part 1, Schedule 1), civil jurisdiction (Part 2, Schedule 1, with tiering by claimed monetary amount for monetary claims) and administrative fees (Part 3, Schedule 1). Items are enumerated and priced in fee units or, in limited instances, per-page charges (Schedule 1).

Fee units. Fees are expressed in fee units, and the Monetary Units Act 2004 governs the dollar value per unit. The Endnotes state the value for 2022-23 is $15.29 per fee unit and permit rounding to the nearest 10 cents. The Treasurer fixes future annual values, subject to Gazette publication requirements (Endnotes).

Waiver and exemption rules. Three pathways remove or reduce fees. First, regulation 6 prescribes classes of proceedings where no fee is payable, specifically proceedings under the Family Violence Protection Act 2008, the Maintenance Act 1965 and the Personal Safety Intervention Orders Act 2010. Second, regulation 7 lists persons who are exempt from certain criminal jurisdiction fees, including police acting in the course of duty, persons acting on behalf of the Crown or municipal councils in specified public health contexts, POCTA inspectors and those legally represented pro bono through specified organisations, people granted legal aid, people detained in custody, and persons under 18 years. Third, regulation 18 creates waivers for civil fees in Schedule 1 Part 2 for parties represented pro bono by specified bodies, persons granted legal aid, detainees and minors.

Payment responsibility and timing. Regulation 13 prescribes that the requesting party pays, with the Court able to order otherwise or a court official directing payment where an order was made on the Court's own motion (reg 13(2)). Hearing fees are payable by the party seeking the hearing, and mediation fees by the party commencing the proceeding (regs 14, 15). Regulation 17 fixes payable timing at filing, lodging, rendering of service or occurrence of a specified event, unless a court official requires payment at the time of request.

Evidence, status and correction. Regulation 19 imposes an obligation on persons claiming standard or concession status, or a waiver/refund, to produce information or evidence when requested. Where a lower fee was charged because of misclassification, a court official may reinstate the correct fee and require payment of the difference (reg 19(4)).

Transitional measures. Regulation 20 imposes a temporary single-rate rule during the transitional period, meaning fees that would vary by payer type are charged at the standard fee payer rate for that period, unless the Minister specifies an earlier end date (reg 20).

Interaction with other instruments. The Regulations operate against several statutes and rules: they are made under the Magistrates' Court Act 1989 (reg 2); they refer to the Monetary Units Act 2004 for fee unit valuation (Endnotes); they exempt certain proceedings under family violence and personal safety Acts (reg 6); and they adjust fees for matters linked to VCAT applications under section 57B of the VCAT Act by substituting the fee that VCAT would charge (reg 11). The Rules (Magistrates' Court General Civil Procedure Rules 2020) are referenced for Orders relevant to enforcement, examination and mediation fees (definitions and Schedule note).

The Regulations have a direct operational effect on litigants, legal representatives, court users, public agencies and organisations interacting with the Magistrates' Court. There are several discrete groups and impact channels.

Litigants in civil matters. Civil claimants and defendants are affected by the tiered fee scale in Schedule 1 Part 2. The fee for commencing a civil proceeding varies by the amount claimed and the payer category, ranging from lower amounts for concession fee payers to higher rates for corporate fee payers (reg 9(2)-(4), Schedule 1 Part 2 items 2.1-2.4). Those who qualify as standard fee payers receive a mid-tier rate (reg 5). The definition of standard fee payer includes not-for-profit organisations that meet specific distribution tests, entities with turnover under $200,000 in the previous financial year and executors/administrators of estates (reg 5). Claimants in the Industrial Division pursuing unpaid wages have a separate fee rule; employees (including former employees) pay reduced commencement fees, 10 fee units for standard payers, 5 fee units for concession payers, and transitional relief applies to concession fees during the transitional period (reg 12).

Litigants in criminal matters. Fees for criminal jurisdiction processes are specified in Schedule 1 Part 1. The Regulations exempt certain persons from paying criminal jurisdiction fees, including police acting in the course of duty, Crown actors, authorised municipal officers in public health matters, POCTA inspectors acting in the course of duty, persons authorised under s 24ZW of the Prevention of Cruelty to Animals Act 1986, Business Licensing Authority, those represented pro bono by named organisations, legal aid recipients, those detained or serving sentences and young persons under 18 (reg 7). The Note to regulation 7 clarifies that criminal jurisdiction fees include extracts or material originating in the criminal jurisdiction regardless of intended use.

Representatives and pro bono schemes. The Regulations expressly identify specified organisations whose pro bono representation triggers fee waivers or exemptions. Those organisations include the Victorian Bar, the Law Institute of Victoria, Justice Connect and the Federation of Community Legal Centres Vic (reg 5 definitions; regs 7, 18). A person represented under a pro bono scheme administered by or on behalf of those bodies is exempt or entitled to fee waiver as listed in the relevant provisions.

Court officials and the Court. Court officials are authorised to request evidence of fee status and to reinstate correct fees where misclassification has occurred (reg 19(2), (3), (4)). They may also require payment at the time of request in certain circumstances (reg 17(b)). The Court has discretion in fee allocation when proceedings are initiated by court motion, and to order otherwise with respect to who ultimately bears a fee payable as a result of a court order (reg 13(2)). The Court also handles fee calculation for matters brought under section 57B of the VCAT Act by applying the VCAT fee schedule instead of Schedule 1, per reg 11.

Public authorities. Agencies acting in official capacities are relieved in specific contexts. For example, persons acting for or by authority of the Crown, or municipal councils in public health matters, are exempt from criminal jurisdiction fees under regulation 7(b)-(c). The Business Licensing Authority is explicitly listed (reg 7(g)). Persons authorised to file charges under defined animal welfare provisions are covered (reg 7(d)-(e)).

Private-sector entities. Corporate fee payers pay the higher scale in civil matters (reg 9(2), Schedule 1 Part 2 columns 2 and 3). The corporate rate applies when at least one of multiple parties making a request is a corporate fee payer, under regulation 16. This can affect joint plaintiffs, co-claimants and other multiparty filings.

Service providers and vendors. The Court’s administrative fees affect legal practices, process servers and document retrieval businesses. The Regulations set per-page photocopying fees at 60 cents per page (Schedule 1 item 3.5), and set unit-based charges for supply of orders, subpoenas and searches (Schedule 1 items 3.1-3.4).

Those bringing specific classes of claims. Applicants in certain statutory processes, such as appeals or applications under the Road Safety Act 1986, have specified fees in the criminal Part (Schedule 1 item 1.5). Applicants seeking to have VCAT matters heard by the Court under s 57B of the VCAT Act are charged the relevant VCAT fee rather than the Court’s Schedule 1 fee (reg 11). Parties seeking enforcement measures prescribed by other statutes, such as attachments of earnings or judgment recovery processes, face itemised fees that reference other statutes and Rules (Schedule 1 items 2.7-2.9, 2.8, and associated references to the Judgment Debt Recovery Act 1984 and the Rules).

The Regulations allocate duties principally to fee payers, claimants, court officials and the Court, and they confer rights to fee exemption, waiver and correction. These are largely administrative duties rather than substantive litigation rights.

Duty to pay. The fundamental duty is that the party or entity at whose request a document is filed or a service rendered must pay the applicable fee, subject to specified exceptions and to court orders (reg 13(1)). Where a fee arises from a court order made on the Court’s own motion, the initiating party bears the fee unless the Court orders otherwise (reg 13(2)). Hearing fees are payable by the party seeking the hearing, which is defined as the party that commenced the proceeding, or the party making the interlocutory application, or another party seeking the hearing (reg 14). Mediation fees are payable by the party which commenced the proceeding (reg 15).

Duty to establish status and provide evidence. Persons claiming to be a standard or concession fee payer, or entitled to waiver or refund, must provide information or evidence when requested by a court official to establish that status or entitlement (reg 19(2)). This is a compliance duty; the court official determines the applicable fee category once satisfied by the evidence (reg 19(3)).

Duty to pay reinstated fees. If a fee payer was charged a lower fee in accordance with the Regulations but was not entitled to that lower fee, a court official may reinstate the correct, higher fee and require payment of the difference (reg 19(4)). This creates a post-filing financial liability for misclassification.

Right to waiver or refund. Regulation 18 specifies that specified civil fees in Part 2 are waived for parties represented pro bono by named organisations, legal aid recipients, detainees and persons under 18. Regulation 19(3)(c) states that where evidence entitles a fee payer to a waiver or refund, the fee is waived or refunded as appropriate. The person therefore has a right to exemption but must establish entitlement.

Right to VCAT-equivalent treatment. For matters heard or determined under s 57B of the VCAT Act, regulation 11(3) gives the party the right to have any related Court fee assessed as the fee that would be payable to VCAT if the matter were before VCAT, rather than the Schedule 1 fee. Regulation 11(1) and (2) also exempt the commencement and administrative fees in those circumstances.

Timing and selection duties. A court official may require payment before filing or service is rendered (reg 17(b)). The fee payer therefore bears the duty of immediate payment where requested. The Court retains discretion to order otherwise where fees result from a Court motion (reg 13(2)).

Duty to follow prescribed categories for multiple parties. Regulation 16 provides a rule where multiple parties jointly request a filing or service. The payer classification with the highest applicable fee generally dictates the single fee payable. Specifically, where any requesting party is a corporate fee payer, the corporate fee applies; otherwise, if any requesting party is a standard fee payer, the standard fee applies.

Right to transparent fee schedule. The Schedule lists fees by item with fee-unit amounts, and the Endnotes explain fee unit valuation and rounding. The Court and officials must apply these figures when calculating payable amounts for each item.

Duty to comply with transitional rules. During the transitional period set in regulation 20, fee payers must accept that the standard fee payer rate applies to items where normally the fee would vary by payer type. The transitional period ends on 31 March 2024 unless the Minister specifies an earlier date by Gazette notice.

The Regulations establish administrative enforcement mechanisms for fees but do not create new criminal or civil penalties within the text for non-payment of the fees themselves. Enforcement is effected by Court processes, court official powers and the Court's discretion.

Administrative enforcement and collection. The primary enforcement mechanism is the Court's ability to require payment when a document is filed or a service is requested. Regulation 17 allows a court official to require the fee be paid at the time of the request, effectively using the filing process as a control point. Regulation 13(2) places responsibility for fees resulting from Court-initiated orders on the party which commenced the proceeding unless the Court orders otherwise, providing a basis for internal allocation through Court orders.

Reinstatement and recovery of undercharged fees. Regulation 19(4) allows a court official to reinstate the correct fee and require payment when a lower fee has been charged because of incorrect classification. Subregulation 19(4)(b) makes the fee payer liable to pay the difference between the fee originally paid and the reinstated fee. This creates a direct administrative recovery pathway for undercharged amounts.

Court discretion and orders. The Court has discretion to determine who bears fees when proceedings generate fees as a result of the Court's own motion (reg 13(2)). The Court can also order who pays in other circumstances, so enforcement can be effected via Court orders allocative between parties.

Absence of explicit statutory fines or imprisonment in these Regulations. The Regulations do not include express penalty provisions such as fines or imprisonment for non-payment. They operate as subordinate legislation that prescribes fees and administrative processes. Any enforcement beyond administrative collection would therefore rely on existing court powers, civil remedies for debt or other statute-based enforcement mechanisms external to these Regulations.

Refund and waiver processes as corrective enforcement. Regulation 19(3)(c) provides for waivers or refunds where evidence establishes entitlement. Conversely, regulation 19(4) provides for retroactive collection where entitlement was wrongly claimed. These are both administrative corrective devices the Court can apply to ensure the fee regime's integrity.

Interaction with other enforcement regimes. Where fees relate to other statutory processes or enforcement mechanisms, for example, attachment of earnings, warrants to enforce orders, or registration of interstate judgments, the Regulations specify fees for those processes (Schedule 1 items 2.7, 2.8, 2.13, 2.9). Enforcement of the underlying orders would follow the relevant substantive statute or Rules (e.g. Judgment Debt Recovery Act 1984, Magistrates' Court General Civil Procedure Rules 2020), and fees for those enforcement acts are specified here so enforcement costs are internally harmonised with those processes.

Transparency and publication requirements. The Endnotes explain that the fee unit value for future years is to be fixed by the Treasurer and published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. This gives advance notice of fee changes driven by the fee unit valuation procedure, which affects enforcement expectations based on monetary calculation (Endnotes, Fee Units).

The Regulations operate as subordinate legislation, and they explicitly reference and interact with several statutes and rules. These interactions determine fee treatment across cross-jurisdictional processes, exemptions and calculation methodology.

Magistrates' Court Act 1989. The Regulations are made under section 140 of the Magistrates' Court Act 1989, which provides the parent legislative authority for prescribing fees for the Court (reg 2). The Regulations therefore function as instrument-level operational detail authorised by that Act.

Monetary Units Act 2004. Fees are expressed in fee units rather than fixed dollar amounts, and the Endnotes explain that the value of a fee unit for the financial year commencing 1 July 2022 is $15.29, with rounding to the nearest 10 cents (Endnotes, Fee Units). The Monetary Units Act supplies the mechanism for converting unit counts into dollar amounts and for annual adjustments determined by the Treasurer.

Magistrates' Court General Civil Procedure Rules 2020. The Regulations define "the Rules" as the Magistrates' Court General Civil Procedure Rules 2020 and reference particular Orders under those Rules in the Schedule and Regulations. For example, items referencing attachment of earnings orders (Order 72), oral examination summonses (Order 67) and mediations (Order 50) tie fee items to procedural mechanisms in the Rules (reg 5, Schedule 1 Part 2 items 2.8, 2.10, 2.11).

Victorian Civil and Administrative Tribunal Act 1998. Regulation 11 implements a cross-instrument rule for matters heard or determined by the Court under section 57B of the VCAT Act. It replaces the normal Court commencement and administrative fees with the fee that would have been payable to VCAT for the same matter. Regulation 11(3) states explicitly that the fee payable to the Court is the relevant fee that would be payable to VCAT under the VCAT Act if the matter were heard by VCAT. This aligns financial treatment when jurisdiction shifts under s 57B.

Infringements Act 2006. Schedule 1 Part 1 includes fees for lodging the prescribed information under section 40(1)(a) of the Infringements Act 2006 to have infringement offences heard and determined by the Court (Schedule 1 items 1.3 and 1.4). The Regulations therefore set the Court fee element for matters that begin under the Infringements Act.

Road Safety Act 1986. Item 1.5 of Schedule 1 Part 1 sets a fee for filing applications or appeals under the Road Safety Act 1986, other than an application for an extension of time. That fee is aligned with criminal jurisdiction fees (Schedule 1 Part 1 item 1.5).

Judgment Debt Recovery Act 1984. Regulation 9 and Schedule 1 Part 2 item 2.7 address filings by judgment debtors or creditors under sections 6, 7 and 8 of the Judgment Debt Recovery Act 1984, integrating fee treatment with statutory debt recovery processes.

Prevention of Cruelty to Animals Act 1986. Regulation 7 exempts POCTA inspectors acting in the course of duty and persons authorised under s 24ZW to file certain charges from criminal jurisdiction fees, reflecting a policy choice to relieve enforcement officers and designated filers of fees in animal welfare contexts.

Business Licensing Authority Act 1998. Regulation 7 lists the Business Licensing Authority (established under Part 2 of the Business Licensing Authority Act 1998) among persons exempted from criminal jurisdiction fees, again aligning the fees regime with other statutory institutions.

Subordinate Legislation Act 1994. The Endnotes record that the fees regulations will sunset 10 years after making under s 5 of the Subordinate Legislation Act 1994. This places a statutory expiry on these Regulations unless re-made or extended according to the Subordinate Legislation Act (Endnotes).

Associations Incorporation Reform Act 2012. The Regulations rely on incorporated entities, naming the Federation of Community Legal Centres Vic, Justice Connect and the Victorian Bar as specific incorporated associations whose pro bono representation triggers waivers and exemptions (reg 5 definitions; regs 7, 18).

Other interactions. The fee definitions, waiver provisions and multiple-party rules intersect with tax, corporate, and social security arrangements indirectly through the definition of concession status (health care card under the Commonwealth Social Security Act 1991) and turnover thresholds for standard fee payer classification (reg 5). The Court’s application of fee units links to Treasurer actions under the Monetary Units Act, which have budgetary and fiscal policy implications.

The Regulations revoked the prior Magistrates' Court (Fees) Regulations 2012 upon commencement on 25 September 2022, replacing that earlier instrument (reg 4). The Endnotes record the making date as 13 September 2022 and the date of commencement as 25 September 2022 (Endnotes, General information). The Regulations are Version No. 001 as at 25 September 2022.

The Endnotes also state that there are no amendments made to the Magistrates' Court (Fees) Regulations 2022 by statutory rules, subordinate instruments or Acts subsequent to their making, as recorded in the Table of Amendments (Endnotes, Table of Amendments). In other words, at the version provided, the instrument shows no post-commencement amendments.

Sunset and review. The Endnotes note that the Regulations will sunset 10 years after the day of making, specifically on 13 September 2032, under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). This creates a statutory endpoint for the instrument, unless remade or otherwise extended in accordance with the Subordinate Legislation Act.

Transitional arrangements. Regulation 20 provides transitional treatment for fee calculation during the transitional period, defined in reg 20(3) as the period from the commencement date to the earlier of 31 March 2024 or a date specified by the Minister by Gazette notice. The transitional rules impose that for items in Part 2 of Schedule 1, the fee payable by corporate and concession fee payers is the standard fee payer amount for matters incurred in the transitional period (reg 20(1)). Regulation 20(2) modifies the concession fee for commencing an Industrial Division unpaid wages proceeding to 10 fee units if incurred in the transitional period. The Minister may end the transitional period earlier by Gazette notice (reg 20(4)).

Explanatory details. The Explanatory details in the Endnotes identify the prior instrument being revoked and provide references for definitions updated in relation to amendments to the Magistrates’ Court General Civil Procedure Rules 2020 (Endnotes, Explanatory details). They also restate the fee unit methodology and the requirement for public notice of future fee unit values by the Treasurer (Endnotes, Fee Units).

No recorded amendments to date. The instrument as supplied lists no subsequent statutory rules or Acts that have altered it. That means any changes to quantum of fees for future years will be effected operationally by changing the fee unit value under the Monetary Units Act 2004, or by explicit amendment of the Regulations which would appear in future Tables of Amendments.

The Regulations themselves, as provided, contain no referenced case law and the Endnotes state no amendments produced by statutory rules or Acts. The Table of Amendments indicates there are no amendments made to the Regulations by subsequent subordinate instruments or Acts, which implies there is no reported legislative amendment-based litigation history attached to this instrument in the source. The instrument does not cite any judicial decisions, and no litigation concerning these Regulations is recorded in the text supplied.

What the Regulations do do is reference other statutory regimes and procedural instruments that may themselves be the subject of litigation, for example the Magistrates' Court General Civil Procedure Rules 2020 and the VCAT Act s 57B mechanism. Litigants may contest fee allocation, waiver entitlement, or the Court's exercise of discretion under these Regulations in the course of proceedings, but the Regulations themselves do not list reported cases or interpretative guidance from courts.

Administrative review pathways and dispute resolution. The Regulations create administrative obligations on court officials to determine fee status and permit reinstatement of fees where incorrect classification has occurred (reg 19). Disputes about fee liability in practice would generally be raised before the Court as it has the power to order who pays (reg 13(2)) and to exercise other procedural controls. Any challenge to application of the Regulations would proceed by standard legal processes, but none are recorded in the instrument's endnotes.

Practical effect on litigation. Although there is no litigation history cited, several provisions have direct litigation-stage implications that may be litigated in practice, such as the Court's decision to reinstate fees (reg 19(4)), classification of payer status under reg 5, or the application of VCAT-equivalent fees under reg 11. The instrument leaves interpretative questions to Court officials and the Court, and those operational decisions could, in principle, be the subject of judicial review or appeal under general administrative law principles if contested, but the Regulations themselves contain no litigation record.

The Regulations contain several operational and technical features that can produce surprising or counterintuitive outcomes for practitioners and parties unless carefully managed. The following points are mechanical consequences grounded in the text.

Classification traps. The definition of standard fee payer is a composite test that includes natural persons (excluding statutory office holders), certain not-for-profit organisations meeting specific distribution and purpose tests, entities with turnover under $200,000 in the previous financial year, and executors or administrators of estates (reg 5). Practitioners should not assume an entity is standard simply because it is small in one measure; turnover is explicitly the prior financial year figure, and a not-for-profit must meet the distribution test as described. Conversely, a concession fee payer is narrowly defined by possession of a Commonwealth health care card at the time the fee is payable. If status is misclassified, reg 19(4) permits a court official to reinstate the correct fee and require payment of the difference, creating after-the-fact liabilities.

Multiple parties, single fee, and the corporate override. Regulation 16 provides that where multiple parties jointly request a filing, a single fee is payable and the applicable fee is the highest-applicable classification among those parties. Practically, if one co-plaintiff is a corporate fee payer and another a concession fee payer, the corporate fee rate applies for the single fee. This can increase costs unpredictably when parties do not coordinate fee classifications.

Non-linear concession treatment for large claims. Schedule 1 Part 2 item 2.4 (claims exceeding $40,000) lists the concession fee as 16.2 fee units while the corporate fee is 97.2 fee units and the standard fee is 48.6 fee units. That means concession fee payers pay substantially less for high-value matters than standard fee payers, producing a significant step-change between categories. This is a mechanical feature of the schedule and will affect clients who qualify for concession status. The concession category by statute requires a health care card, which may not align with other measures of means.

VCAT fee substitution. For matters heard or determined by the Court under s 57B of the VCAT Act, reg 11 substitutes the VCAT fee schedule in place of Schedule 1 for commencement and related administrative tasks. That produces a cross-instrument fee calculation and requires practitioners to check VCAT fees rather than the Magistrates' Court Schedule when handling s 57B matters. Regulation 11(1)-(3) emphasise that the Court fee is the fee that would be payable to VCAT if the matter were heard by VCAT.

Transitional single-rate rule. Regulation 20 makes all parties pay the standard fee payer rate for Part 2 items during the transitional period unless the Minister specifies an earlier end date. This is an operational simplification for the transitional period but can be a surprise because corporate rates are suspended temporarily in favour of the standard rate. The transitional period may end earlier by Gazette notice, so practitioners must track any Ministerial notice.

Industrial Division anomaly in transitional period. Regulation 12(2) sets the commencement fee for unpaid wages claims in the Industrial Division at 10 fee units for a standard fee payer and 5 fee units for a concession fee payer. Regulation 20(2) then overrides this for concession fee payers during the transitional period, making their fee 10 fee units. Practitioners should note that during the transitional period concession claimants in the Industrial Division will pay more than the permanent concession rate otherwise specified in reg 12(2).

Waiver administrative burden. Regulation 18 waives Part 2 fees for parties represented pro bono by listed organisations or granted legal aid, and for detainees and minors. However, regulation 19 imposes an evidentiary duty to provide information or evidence to a court official when requested. Practically, parties seeking waivers must be prepared with documentary proof at the point of filing, or risk having the lower rate reversed under reg 19(4).

Court official discretion over timing. Regulation 17 allows a court official who is requested by a party to file a document or render a service to require payment before filing or rendering the service. This can affect clients who expect retrospective billing or who are awaiting fund transfers. Always be prepared to pay at point of request.

Photocopying is charged per page in dollars. Schedule 1 item 3.5 sets photocopying or printing at 60 cents per page, rather than in fee units. For voluminous disclosures or large bundles, this can be material. The fee is not subject to fee unit annual adjustment unless the Regulations are amended, although rounding rules for fee-unit derived amounts do not apply to per-page charges.

No internal penalties for non-payment. These Regulations do not create express penalties such as fines or imprisonment for failure to pay fees. Enforcement of unpaid fees is administrative and relational through the Court processes, reinstatement of fees, and Court orders. Practitioners should therefore not look to this instrument for penalty mechanisms, but rather to the Court’s broader procedural powers and external enforcement options.

Fee unit volatility. The Endnotes instruct that the value of the fee unit is fixed each year by the Treasurer under the Monetary Units Act 2004 and must be published by 1 June in the previous year. As fee amounts are expressed in fee units, annual Treasurer determinations can materially change dollar amounts without amendment to these Regulations. Practitioners must check the current fee unit value rather than assuming the dollar figures remain constant.

Compliance with the Regulations is mainly administrative and procedural. The following practical steps, grounded in the Regulations, set out what a practitioner or client should do at intake and at each filing or hearing event.

1. Determine payer classification before filing. Establish whether the client is a concession fee payer (hold a current Commonwealth health care card), a standard fee payer (natural person, qualifying not-for-profit, entity with turnover under $200,000 in the prior financial year, or executor/administrator), or a corporate fee payer (reg 5). Record the basis for classification because reg 19 requires producing evidence when requested and reg 19(4) permits reinstatement of fees where the lower rate was incorrectly applied.

2. Check the relevant Schedule item for the action you intend to take. Use Schedule 1 Parts 1-3 to identify the correct item number and the number of fee units or dollar charge that applies to the transaction, for example commencement fees (Schedule 1 Part 2 items 2.1-2.4), hearing fees (item 2.12), or administrative supplies such as subpoenas and copies (Part 3 items 3.1-3.5).

3. Convert fee units to dollars using the current fee unit value. The Endnotes show $15.29 for the 2022-23 financial year. Confirm the Treasurer’s published fee unit for the current financial year, then multiply the fee-unit count by the fee unit value and apply rounding to the nearest 10 cents, as required by the Monetary Units Act and the Endnotes.

4. Prepare documentary evidence to establish fee status where relevant. If claiming concession status or an entitlement to a waiver (for example representation under a specified pro bono scheme or legal aid grant), have the relevant documentary proof ready at the point of filing so a court official can be satisfied under reg 19(2)-(3).

5. Be ready to pay at the point of request. Regulation 17 allows a court official to require payment before filing or rendering a service. Ensure funds are available or payment arrangements are agreed in advance to avoid filing delays.

6. Coordinate among multiple parties. If a document is to be filed on behalf of multiple parties, determine whether any party is a corporate fee payer because that will trigger the corporate fee under reg 16. Obtain agreement on who will pay the single fee and document it in joint instructions to avoid post-filing disputes or reinstatement risks.

7. For hearings and mediations, identify the fee-bearing party. Hearing fees are payable by the party seeking the hearing (reg 14), and mediation fees are payable by the party which commenced the proceeding (reg 15). When preparing interlocutory applications or requesting hearing dates, factor the fee into client estimates and billing.

8. For VCAT s 57B matters, liaise with VCAT fee schedules. Regulation 11 requires that fees for matters under s 57B be the relevant VCAT fee rather than Schedule 1 fees. Confirm the VCAT fee that would apply and pay that amount to the Court where appropriate.

9. For Industrial Division unpaid wages claims, apply the reduced commencement fees and observe transitional variations. Regulation 12 sets commencement fees for employees, including former employees, and reg 20 may adjust concession rates during the transitional period. Confirm whether the filing date falls within the transitional period.

10. Monitor the transitional period and Ministerial notices. Regulation 20 defines the transitional period and allows the Minister to end it earlier by Gazette notice. Track the Government Gazette and Treasurer publications for changes to fee unit values and any Ministerial notice terminating the transitional arrangements early.

11. Be proactive about fee disputes. If a court official reinstates a fee under reg 19(4), seek an immediate explanation and, if appropriate, apply to the Court for an order reallocating fee liability under reg 13(2). Keep records of fee receipts and evidence produced to support fee classification.

12. Budget for photocopying and search fees. Photocopying is charged at 60 cents per page (Schedule 1 item 3.5), and database search, retrieval and inspection requests are charged in fee units (item 3.4). For large-volume documents or discovery, estimate these charges and advise clients accordingly.

13. Record client instructions regarding payment of fees. Given that fees are generally payable by the party requesting the service, obtain express client instructions and document who will bear costs. Where you anticipate seeking costs orders later, do not assume fee payment can be deferred without checking with the Court.

14. Keep up-to-date with fee unit announcements. The Treasurer’s annual fee unit declaration changes dollar amounts without amending the Regulations. Confirm the then-current fee unit value before each fee calculation.

15. Train practice staff and registry contacts. Ensure court-facing staff and registry officers understand the multiple-party rule, the evidence requirements under reg 19 and the Court’s ability to require payment at the time of request under reg 17. This reduces filing delays and the risk of post-filing liabilities.

Following these practical steps will align filings and fee payments with the Regulations’ mechanical requirements. Where ambiguity arises, rely on Court officials for immediate determinations under reg 19(3), and where necessary, seek orders from the Court under the discretion contained in reg 13(2) and other procedural powers.
