Magistrates Court (Fees) Regulations 2005

Fee catalogue and structure

• The core mechanism is a fee schedule in Schedule 1, organised into Division 1 (general), Division 2 (civil jurisdiction) and Division 3 (criminal jurisdiction). Each item in the Schedule specifies the matter and the dollar amount(s) for particular payer categories. The Schedule is authoritative for the numerical charges (Schedule 1).

Eligible individual and eligible entity

• Regulation 8 defines "eligible individual" categories that attract reduced fees (reg 8(2)). Eligible individuals include persons holding specified Centrelink or Department of Veterans’ Affairs cards, recipients of particular Commonwealth allowances (youth training, AUSTUDY, ABSTUDY), persons granted legal aid for the proceedings, and persons directed to be eligible by the Court or registrar under reg 9B(1). Eligible entities consist of entities granted legal aid or directed by the Court or registrar under reg 9B(2) (reg 8(3)).

Small business and non‑profit declaration

• Regulation 5A enables an entity that qualifies as a small business or a non‑profit association by the definition in reg 3 to lodge a declaration in the Schedule 2 Form 1; on lodgment the entity is charged as if it were an eligible entity (reg 5A(1)-(2)). The entity must immediately inform the Principal Registrar if it ceases to qualify (reg 5A(4)), with a penalty of $1,000 for failure to notify.

Mandatory and discretionary waivers

• The Regulations create mandatory waivers for certain family violence and violence restraining order procedural documents and transcripts in specified circumstances (reg 6A). They create discretionary waivers where the registrar is satisfied the court was at fault due to clerical error (reg 6B). Separate conditions apply where state authorities institute proceedings: prescribed fees are only payable upon conviction and recovery from the accused or after an order and recovery from the respondent (reg 6(3)).

Payment timing and pre‑payment rules

• For civil jurisdiction matters, reg 7 mandates that claims, applications and related documents must not be filed or otherwise dealt with unless the applicable fee has been paid. Allocation of hearing dates fees become payable immediately after the Court determines the number of allocated hearing days (reg 10). If a half daily hearing fee is payable, reconvening is not to occur until that fee is paid (reg 11).

Fee disputes, refunds and enforcement

• The Principal Registrar decides questions of applicable fees (reg 13(1)). Applications for determination use Form 3 and are free (reg 13(2)-(4)). Judicial officers or registrars can order refunds if the fee paid exceeds that which should have been charged (reg 9D). Unpaid fees are debts due to the State and may be recovered by court action (reg 14).

Exemptions and no‑fee items

• Regulation 5 lists specific fee exemptions, including family violence restraining order applications and certain statutory orders, and also provides that minors (under 18) and persons exempted by other written laws do not pay fees (reg 5).

Administrative and criminal sanctions

• Regulation 9C makes it an offence to make a false or misleading statement in a declaration or application under these regulations, punishable by a fine of $1,000, and authorises invalidation of declarations, revocation of directions and orders to pay differences plus enforcement measures (reg 9C(1)-(5)).

Interaction with other rules and Acts

• Definitions and cross‑references permeate the Regulations. Many terms are defined by reference to other statutes and instruments such as the Magistrates Court (Civil Proceedings) Act 2004, Criminal Procedure Act 2004, Restraining Orders Act 1997 and various Commonwealth statutes; these cross‑references determine the scope of applications, injunctions, and who counts as a claimant, respondent, or prosecution notice (reg 3 and multiple definitions).

Operational pricing nuances

• The Schedule contains time‑sensitive pricing for transcripts (different per‑page rates depending on delivery timeframe), kilometre rates for enforcement officers, different hourly supervision rates for managed audio/video viewing, an unusual high annual fee for provision of information by email to an approved recipient (Schedule 1 Division 1 item 5(b) $95,273), and percentage additions in certain items such as appointment to assess a bill of costs (Schedule 1 Division 2 item 8).

Taken together, these concepts set out who pays what, when they must pay it, who can get relief, the administrative steps to obtain relief, the sanctions for false claims, and the mechanisms for disputes, refunds and recovery.

Litigants and parties

• Individuals commencing or defending cases in the Magistrates Court face prescribed fees for filing, hearings, transcripts, copies of judgments, interlocutory applications and allocation of hearing dates. For civil jurisdiction matters, reg 7 makes the payment of those fees a precondition to filing or having the document dealt with in the Court, which directly affects access to process for claimants and respondents who are not exempt or eligible (reg 7(2)).

Small businesses and non‑profit associations

• Entities that meet the regulatory definition of small business or non‑profit association may lodge a declaration under reg 5A and thereafter be charged as if they were eligible entities (reg 5A(1)-(2)). The definition in reg 3 sets the quantitative threshold at fewer than 20 full‑time equivalent employees and contains subsidiary rules for co‑operatives and statutory corporations. The declaration process affects both the cost of bringing or defending proceedings and administrative obligations including the immediate duty to inform the Principal Registrar if the entity ceases to qualify (reg 5A(4)).

Recipients of Centrelink and similar concessions, students and legal aid clients

• Eligible individuals as defined in reg 8(2) , Centrelink card holders (health care card, pensioner concession card, Commonwealth seniors health card, health benefit card), recipients of youth training, AUSTUDY or ABSTUDY allowances, and persons granted legal aid in respect of the proceedings , pay reduced fees (reg 8(2)(a)-(e)). Eligible entities include those granted legal aid (reg 8(3)(a)).

State agencies and enforcement officers

• Where proceedings are instituted by police or by a public sector officer on behalf of a department, or where the State Solicitor’s Office acts for a board or other body, reg 6(3) alters the timing of liability: fees are payable only on conviction and recovery from the accused or on making of a restraining order and recovery from the respondent. Enforcement officers are also the subject of kilometre and attendance fees where they must travel or effect process (Schedule 1 Division 1 item 3; Division 2 item 9).

Approved recipients of Court information

• Entities or persons approved by the Attorney General to receive Court information by email are liable to an annual fee of $95,273 under Schedule 1 Division 1 item 5(b); per‑case fees are also charged under item 5(a) where information is not provided by email. Approval is an executive decision, with the annual fee payable on the date of approval and on each anniversary thereafter (Schedule 1, item 5 notes; reg 12).

Legal representatives and practitioners

• Legal practitioners acting for clients face the operational consequences of the pay‑before‑filing rule in civil matters and the need to advise clients about eligibility, declarations and refund/dispute procedures. For example, they may need to prepare and lodge Form 1 or Form 3 where appropriate (Schedule 2 Forms).

Court officers and registrars

• Registrars and the Principal Registrar have administrative functions and discretionary powers: to accept declarations under reg 5A; to receive applications and direct the Court under reg 9B; to waive specified fees under reg 6B in clerical error cases; to determine fee disputes under reg 13; and to order refunds under reg 9D. The Chief Magistrate must approve the form for applications under reg 9A(2).

Parties to family violence and violence restraining order proceedings

• Applicants and respondents in FVRO and VRO matters receive special treatment under reg 5 (exemption for FVRO/VRO applications in reg 5(1)(a)-(b)) and under reg 6A which requires registrars to waive specified copy and transcript fees in certain circumstances where no decision has been made, or an application was dismissed, or an interim order was made and remains in force (reg 6A(2)-(5)).

Entities that are sued or commence proceedings (corporations, partnerships)

• The Schedule distinguishes fees by type of payer. Entities that are not eligible entities pay the column B fee in applicable Schedule items, and this is often significantly higher than the fee for an eligible individual or eligible entity (see reg 4(2)(c) and Schedule columns). The Regulations therefore affect corporate access and cost allocation.

Persons making false declarations

• Persons who make false or misleading declarations or applications under the Regulations may face a fine of $1,000 and administrative consequences including invalidation of declarations or revocation of directions and orders to pay the difference (reg 9C).

The State (as recipient of fees)

• Unpaid fees are debts due to the State (reg 14). The State benefits from recovered sums and from the set fee schedule which funds particular court services or imposes the cost of service on users.

Collectively, the Regulations touch almost every participant in Magistrates Court processes in Western Australia by defining who bears what cost and by setting the procedural regimes for obtaining reduced fees, waivers and refunds.

Duties to pay and timing

• Duty to pay specified fees: the Schedule prescribes fees for specific matters; individuals and entities must pay the applicable fee when using the services listed in Schedule 1 (reg 4(1) and Schedule 1). For civil jurisdiction matters the Regulations impose a strict pre‑payment requirement: a claim or application must not be filed, issued or otherwise dealt with, and no matter is to be done in the Court unless the applicable fee has been paid (reg 7(2)). For allocation of hearing dates fees, payment is due immediately after the Court determines hearing days (reg 10). For half daily hearing fees, reconvening is not permitted until the fee (or the unwaived portion) has been paid (reg 11).

Duty to declare small business or non‑profit status and to update

• An entity that elects to be treated as a small business or non‑profit association by lodging Schedule 2 Form 1 has a continuing duty to inform the Principal Registrar immediately if it ceases to qualify (reg 5A(4)). That regulation creates an affirmative ongoing compliance obligation, with a specified penalty of $1,000 for failing to advise.

Duty to provide accurate information

• Those who make declarations or applications under the Regulations, and who provide further information in response to a request under reg 9B(3), must not make statements that are false or misleading in a material particular. A breach is an offence carrying a fine of $1,000 and administrative consequences under reg 9C(1)-(5).

Right to fee relief and the process to obtain it

• Individuals and entities have a statutory entitlement to apply for recognition as an eligible individual or eligible entity under reg 9A. The Court or a registrar may direct that a person is an eligible individual or eligible entity for particular matters in Schedule 1 if satisfied the person should only be required to pay the reduced fee because of financial hardship or the interests of justice (reg 9B(1)-(2)). The application is made in a Chief Magistrate approved form and is itself not subject to a charge (reg 9A(2)-(3)).

Registrar and Court powers to grant or revoke directions

• Registrars and the Court have authority to direct eligibility under reg 9B and to require further information before making a determination (reg 9B(3)-(4)). They can also revoke directions and invalidate declarations if satisfied of material misrepresentation after affording the person an opportunity to make written submissions (reg 9C(2)-(3)).

Rights to mandatory waivers

• The Regulations impose mandatory waivers in specified family violence and violence restraining order contexts. A registrar must waive the fee for a copy of an application in certain circumstances where no decision has been made or the application was dismissed or an interim order was made and remains in force (reg 6A(2)-(3)). Similarly, a registrar must waive the fee for certain transcripts requested by an applicant or respondent in FVRO or VRO hearings when the conditions in reg 6A(4)-(5) are met.

Dispute and review rights

• If a question arises about fee applicability or amount, the Principal Registrar makes the initial determination (reg 13(1)). Any person affected by that determination may seek a summary review by the Court (reg 13(3)). An application under reg 13 is to use Form 3 and the determination and review are not subject to a fee (reg 13(2), (4)).

Refund rights

• Judicial officers or registrars presiding in proceedings may order refunds where a person paid a fee higher than the fee they were entitled to pay (reg 9D(1)). Registrars also have power to refund fees or parts of fees paid in error (reg 9D(2)).

Right to seek waiver in clerical error cases

• Registrars have a discretionary power to waive specified application fees where the failure to appear or to comply resulted from a clerical error by the Court, for applications under Criminal Procedure Act s 71(2)(a) or (b) and under the Magistrates Court (Civil Proceedings) Act s 19(3) applications (reg 6B).

State recovery powers

• For unpaid fees, the State may recover sums by legal action because unpaid fees are debts due to the State (reg 14). Where a declaration is found invalid or a direction revoked because of a false statement, the Court may order payment of the difference and make enforcement orders, including orders relating to future conduct of the matter until payment (reg 9C(4)-(5), reg 5A(5)-(6)).

Administrative duties relating to information provision

• Entities who receive Court information under the Magistrates Court (General) Rules 2005 rule 41A are liable to pay per‑case fees or a substantial annual fee if information is provided by email to an approved recipient (reg 12 and Schedule 1 item 5).

These duties and rights allocate the immediate costs of litigation and Court services, provide channels and tests for relief, and create administrative obligations (forms, disclosure, notice) that litigants and practitioners must manage.

Monetary penalties and civil recovery

• Regulation 9C(1) prescribes a criminal penalty for making a false or misleading statement or representation in a declaration or application under the Regulations. The penalty is a fine of $1,000. The same regulation authorises administrative consequences (invalidation of declarations and revocation of directions) where the Court or registrar is satisfied that a person has contravened reg 9C(1) and has been given an opportunity to make written submissions (reg 9C(2)-(3)).

Order to pay difference and enforcement measures

• If a declaration is invalidated or a direction revoked, the Court may order the person to pay the difference between the fee they paid and the fee they should have paid, and may make orders to enforce that payment. Enforcement orders may extend to directions relating to the future conduct of the proceedings or the effect of anything already done in respect of the proceedings until the sum is paid (reg 9C(4)-(5)). Regulation 5A(5) and (6) contain parallel provisions for entities who lodged a small business or non‑profit declaration and were charged reduced fees when they were not in fact eligible.

Debt recovery

• Unpaid fees are declared to be a debt due to the State and may be recovered by action in a court of competent jurisdiction (reg 14). The Regulations do not prescribe a specific recovery procedure beyond that rule; recovery will proceed in the usual civil enforcement channels available to the State.

Preclusion of hearing reconvening

• Regulation 11 prescribes an operational enforcement mechanism for half daily hearing fees: hearings are not to be reconvened until the required fee (or so much of it as has not been waived under reg 6) is paid. This creates an immediate practical sanction for non‑payment in ongoing hearings.

Timing‑linked obligations

• For allocation of hearing dates, reg 10 requires payment of the allocation fee immediately after the Court determines the number of hearing days (Schedule 1 Division 2 item 5). Failure to pay can therefore impede allocated hearing schedules and prompt operational consequences.

Criminal and administrative offences related to declarations

• As noted, a failure to advise the Principal Registrar that an entity has ceased to be a small business or non‑profit is a statutory offence under reg 5A(4) with a fine of $1,000. That complements reg 9C’s penalty for false statements and creates a specific continuing duty with a penal sanction.

Refund powers and mitigation

• Judicial officers and registrars have powers to order refunds (reg 9D(1)-(2)) which can mitigate the financial impact of erroneous charges. The Regulations also allow the Principal Registrar to determine fee disputes and grant reviews by the Court (reg 13), which provides an administrative check on erroneous fee impositions before debt recovery is pursued.

Discretionary waivers

• Where a registrar is satisfied that failure to appear or to comply is due to a clerical error by the Court, the registrar may waive specified application fees (reg 6B). That discretionary power operates as a remedial tool against procedural errors by the Court rather than as a statutory penalty.

Operational notes on enforcement

• The Regulations provide that some fees are payable by State actors only if recovered from the accused or respondent (reg 6(3)). That shifts the timing and practical responsibility for fee payment away from the Government actor until such recovery is practicable, and thereby limits immediate State liability for those fees.

Collectively, the Regulations combine criminal fines for falsehoods, administrative invalidation and revocation powers, refund and waiver mechanisms, immediate operational sanctions (non‑reconvening of hearings), and conventional debt recovery for unpaid fees. The statute ensures administrative remedies are available while preserving the State’s ability to recover monetary obligations.

Cross‑referenced statutes and rules

• The Regulations are interlinked with a number of other Western Australian and Commonwealth statutes and with rules of court. Many definitions and procedural triggers in the Regulations are by reference to other legislation: the terms "case statement", "claim", "claimant", "counterclaim" and "minor cases procedure" are defined by the Magistrates Court (Civil Proceedings) Act 2004 s 3(1) and are therefore incorporated into the fee regime by reg 3. The terms "prosecution notice" and "respondent" are defined by the Criminal Procedure Act 2004 and the Restraining Orders Act 1997 respectively and are used to categorize applicable fees (reg 3; reg 6(2); Schedule 1 Division 3 item 1). Regulation 5(1) expressly exempts certain proceedings under other Acts from fees , family violence and violence restraining order applications under the Restraining Orders Act 1997, prohibited behaviour orders under the Prohibited Behaviour Orders Act 2010, disease test order applications under the Mandatory Testing (Infectious Diseases) Act 2014, and civil proceedings under the Criminal Law (Mental Impairment) Act 2023 (reg 5(1)(a)-(d)).

Legal aid schemes and eligibility

• The Regulations take legal aid schemes into account. Legal aid recipients are an express class of eligible individual and eligible entity (reg 8(2)(e); 8(3)(a)). Thus a person granted legal aid under the Legal Aid Commission Act 1976 or an equivalent scheme is entitled to the reduced fee status for the relevant proceedings.

Interaction with Corporations and other Commonwealth law

• The definition of "corporation" and references to subsidiary status rely on the Corporations Act 2001 (Commonwealth) and the Statutory Corporations (Liability of Directors) Act 1996, and the small business definition for corporate or cooperative entities cross‑refers to those statutes (reg 3). This means corporate structure and group status under Commonwealth company law informs whether a body meets the small business threshold for reduced fees.

Magistrates Court (General) Rules 2005

• Regulation 12 explicitly links fees for providing Court information to the Magistrates Court (General) Rules 2005 rule 41A, creating a charging regime for the information that is supplied under those rules and distinguishing fees by delivery method (paper per case or annual email subscription) (reg 12; Schedule 1 item 5).

Criminal Procedure Act and Magistrates Court (Civil Proceedings) Act processes

• The Regulations create waiver powers tied to procedural provisions in other Acts. Regulation 6B allows registrars to waive fees for applications to set aside decisions under Criminal Procedure Act s 71(2)(a) or (b) and for applications to set aside judgments under the Magistrates Court (Civil Proceedings) Act s 19(3) if the registrar is satisfied the failure was due to a clerical error by the Court (reg 6B). This cross‑reference imposes a remedial nexus between process errors in the criminal and civil procedure statutes and the fee schedule.

Enforcement and Civil Judgments Enforcement Act

• "Enforcement officer" is defined by reference to the Civil Judgments Enforcement Act 2004 s 3, and the Schedule prescribes charges for enforcement officer travel and attendance in executing warrants and other process (reg 3; Schedule 1 Division 1 item 3; Division 2 item 9). This situates the cost of enforcement actions in the framework of that Act.

Other statutory fee exemptions and age limitations

• Regulation 5(2) provides that a person is not required to pay a fee if another written law exempts them or if they are under 18 at the time the fee would be payable. This provision creates a residual interaction with any other statutory fee‑exemption regime, allowing those other laws to operate in tandem.

Administrative law and Attorney General approval

• The annual fee for information provided by email is payable on approval by the Attorney General and on each anniversary of that approval (Schedule 1 item 5(b) note). The approval process sits with the executive branch and intersects administrative decision‑making with the statutory fee regime.

Transitional interaction with earlier procedural arrangements

• Regulation 15 contains transitional provisions setting when the new hearing allocation fees in Schedule 1 Division 2 items 5 and 6 do not apply to cases part heard or where days had already been allocated before the commencement day, linking the Regulations to pre‑existing case management arrangements (reg 15(2)).

In sum, the Regulations do not operate in isolation. They integrate definitions and procedural contingencies from other Western Australian statutes and Commonwealth laws, they rely on court rules for certain services, and they fold legal aid, executive approvals and enforcement mechanisms from other statutory frameworks into the pricing, waiver and recovery regime.

Frequency and nature of amendments

• The Regulations have been amended repeatedly since promulgation in 2005. The compilation table included in the instrument records successive amendments and reprints from 2006 through 2025. Amendments have been effected by variously titled instrument groups including Magistrates Court (Fees) Amendment Regulations and Attorney General Regulations Amendment (Fees and Charges) Regulations as well as targeted amendments for transcript fees, bailiff fees and fee relief (Compilation table).

Notable recurring amendment themes

• Fee adjustments and restructuring of fee items: many of the amendment instruments listed in the compilation table relate to altering numeric amounts in Schedule 1, adding or removing items, or reorganising divisions. For example, Attorney General Regulations Amendment (Transcript Fees) Regulations 2018 and 2019 indicate specific updates to transcript pricing and structure (Compilation table).
• Administrative and eligibility changes: amendments across 2016-2018 introduced the small business/non‑profit declaration route (reg 5A inserted 14 Jun 2016), updated eligible individual definitions, and added processes for recognition under regs 9A-9B (2016 insertion and later amendments). The 2017 Attorney General Regulations Amendment (Family Violence Restraining Orders) Regulations added family violence related fee adjustments (Compilation table).
• Fee relief and waiver mechanisms: targeted amendments created or refined waiver powers in 2018, 2022 and 2024 (for example Justice Regulations Amendment (Fee Relief) Regulations 2018; Attorney General Regulations Amendment (Fee Waiver) Regulations 2022; Court Fees Regulation Amendment Regulations 2024) and most recently reg 6A (mandatory waiver for certain FVRO/VRO application and transcript fees) was inserted by SL 2024/254 r 8.
• Structural updates: the Schedule headings and division structure appear to have been reworked multiple times, with a significant consolidated update as late as 2025, which reinserted or restructured Division headings and items (SL 2025/111 r. 21).

Key insertion and repeal events recorded in compilation table

• Reprints occurred periodically to consolidate amendments: Reprint 1 as at 13 Feb 2009; Reprint 2 as at 6 Apr 2012; Reprint 3 as at 3 Dec 2015. Substantial amendment packages followed each reprint, including targeted fee alteration instruments in 2016, 2017, 2018 and subsequent years (Compilation table).
• Addition of reg 5A (fees for small businesses and non‑profit associations) took effect on 14 Jun 2016 (Gazette 14 Jun 2016 p. 1911‑12) and was followed by consequential Schedule and form changes.
• The instrument record shows iterative amendments addressing practical issues such as transcript supply timing and pricing, bailiff and enforcement costs, and the introduction of an explicit fee relief mechanism for specified procedural failures by the Court.

Contemporary changes with operational impact

• The Schedule now includes an anomalously high annual fee for provision of information by email to an approved recipient (Schedule 1 Division 1 item 5(b) $95,273), which appears in the latest Schedule structure and is linked to Attorney General approval (Schedule 1 item 5 note and reg 12 insertion 22 Aug 2008 with later amendments noted in the compilation table). The updated Schedule as at 2025 has reorganised Division 1 and inserted Division 2 and 3 entries under SL 2025/111 r. 21.

Documentation and amendment trail as evidence of administrative intent

• The compilation table provides an explicit trace of amendments, including the instrument title, Gazette publication pages and commencement dates. This demonstrates an ongoing policy process of fee adjustment and rule‑making within the Attorney General’s and Court’s administration. Users should consult the compilation table entries for precise amendment dates when assessing the legal effect of a particular Schedule item or regulation.

Practical consequence of amendment history

• Frequent amendments mean practitioners must check the current, compiled Regulations and the Schedule in force on the relevant date of the transaction or filing. Changes affecting eligibility categories, waiver powers, and specific dollar amounts have been implemented on multiple occasions, so reliance on out‑of‑date fee tables risks incorrect filings or payment shortfalls with operational consequences such as non‑acceptance of documents under reg 7 or application of recovery measures under reg 14.

Instrument content and absence of named cases

• The Regulations themselves do not record case law or decisions applying them. The text provided does not list any judicial decisions or reported cases that interpret or challenge the Regulations. No cases are mentioned in the text of the Regulations or the Schedule.

Nature of likely litigation topics given the Regulations

• Although the instrument does not record litigation, the content points to categories of disputes that commonly arise and may result in litigation or judicial review:
  • Disputes about whether a person qualifies as an eligible individual or eligible entity and the adequacy of the evidence supplied to the Court or registrar under regs 9A-9B.
  • Disputes over whether the Principal Registrar correctly determined the applicable fee under reg 13, or over the correctness of a registrar’s decision to grant a waiver under reg 6B or to direct eligibility under reg 9B.
  • Challenges concerning whether fees were correctly charged or refunded under reg 9D and whether the Court properly exercised its refund or enforcement powers.
  • Procedural disputes arising from reg 7 (pay‑before‑filing), such as whether a filing should have been accepted without payment because of an exemption under reg 5, or whether the refusal to accept was an error.
  • Contentions over whether a declaration under reg 5A was invalid due to material misrepresentation and the legal effect of subsequent enforcement orders under reg 5A(5)-(6) and reg 9C(4)-(5).

Administrative review avenues

• The Regulations provide an administrative path for disputing fees via the Principal Registrar with a right to summary review by the Court (reg 13). This structure suggests that many fee disputes may be resolved administratively rather than escalating to full‑blown litigation. The use of Form 3 is mandated for such applications (Schedule 2).

Evidence of practical disputes in administrative record

• The Regulations’ inclusion of dispute and review processes indicates administration has anticipated contested determinations. The statutory availability of refunds under reg 9D and the Principal Registrar’s determinations under reg 13 are designed to limit the need for protracted litigation, though the Regulations do not preclude parties from seeking further relief where appropriate.

Recommendation for practitioners (procedural)

• Given the absence of recorded litigation in the instrument, practitioners should search case law databases and court records for decisions that have applied the Regulations when facing contentious or novel applications. For the purposes of these Regulations themselves, the statutory administrative dispute channels are the starting point (reg 13). The Regulations provide the Form and process for fee disputes; use of Form 3 triggers the Principal Registrar’s involvement followed by possible Court review.

Pay‑before‑filing rule in civil jurisdiction

• Regulation 7(2) forbids filing, issuing or otherwise dealing with a claim, application or other document in the Court’s civil jurisdiction unless the applicable fee has been paid. That rule is absolute subject to other provisions in the Regulations. Practitioners and litigants relying on an anticipated exemption, a pending application for eligible status under reg 9A, or late confirmation of legal aid must take care: although reg 9A(3) specifies the application to be recognised is not charged, there is no provision that the filing of the substantive claim will be accepted prior to an eligibility direction being made. If the direction is refused, the filer will have to pay the full fee retrospectively or face procedural consequences.

Narrow scope of reg 4(2)

• Regulation 4(2) expressly applies to matters in Schedule 1 Division 1 or Division 3. Division 2 (civil jurisdiction) contains a different set of items and fee structures. Reading across columns without observing reg 4(2)’s limited application may cause mischarging. Practitioners should check whether a Schedule item is in Division 1, 2 or 3 and apply reg 4(2) only where authorised.

Small business declaration obligations and penalties

• Under reg 5A, an entity may lodge Schedule 2 Form 1 to be charged as an eligible entity. However, reg 5A(4) creates an immediate obligation to inform the Principal Registrar if the entity ceases to be a small business or non‑profit, with a penalty of $1,000. Failure to do so exposes the entity to retroactive orders to pay the difference plus enforcement orders under reg 5A(5)-(6). The declarant must be careful to ensure eligibility criteria in reg 3 are genuinely met when the declaration is lodged.

False statements offence and administrative consequences

• Reg 9C(1) imposes a $1,000 fine for making materially false or misleading statements in declarations or applications under these regulations. Beyond the fine, the Court or registrar can invalidate declarations or revoke directions and order payment of differences under reg 9C(2)-(5). Falsehoods therefore carry both criminal and civil administrative consequences.

Large and unusual annual fee for Court information

• Schedule 1 Division 1 item 5(b) prescribes an annual fee of $95,273 for receiving Court information by email to an approved recipient. That is a concentrated, high cost associated with an Attorney General approval decision. The fee is payable on approval and each anniversary, which creates a recurring fiscal commitment for the approved recipient. The approval process and the connection to the Attorney General create an executive gatekeeping point.

Mandatory waivers for FVRO/VRO matters are context dependent

• Regulation 6A requires registrars to waive specified application and transcript fees in a limited range of FVRO/VRO circumstances. The waiver applies only where the listed conditions are met, for example where no decision has been made, the application was dismissed, or an interim order was made and remains in force (reg 6A(2)-(5)). Misunderstanding the precise triggering facts can lead to unnecessary fee payments.

Timing trap for allocation and hearing fees

• The fee for allocation of hearing dates under Schedule 1 Division 2 item 5 is payable immediately after the Court determines the number of days to be allocated for the hearing (reg 10). Similarly, reconvening is prohibited under reg 11 if the half daily hearing fee in Schedule 1 Division 2 item 6 has not been paid. If parties do not plan for these payments, court scheduling and continuations may be adversely affected.

Variation in transcript pricing by speed and payer category

• Schedule 1 Division 1 item 8 sets different per‑page rates depending on how quickly a transcript is required, and rates differ by payer category (individual/eligible entity, entity, eligible individual). Electronic and paper copy pricing also differs if a transcript has already been provided. Practitioners ordering transcripts should ensure they select the correct timeframe and payer category to avoid unexpected charge levels.

Unclear interface between legal aid and eligible status

• While reg 8 expressly includes persons granted legal aid as eligible individuals or entities, nuances may arise about the scope of the grant , whether it covers the precise proceedings and whether the legal aid decision is in place at the time the fee is payable. Practitioners should confirm the legal aid grant covers the relevant matter before relying on reduced fees.

Refund and dispute timing

• Refunds under reg 9D and determinations under reg 13 exist but may take time to process. Where a fee must be paid before filing under reg 7, the availability of a later refund does not prevent the immediate cashflow impact on a litigant. The absence of a fee for the dispute process (reg 13(4)) reduces a barrier to challenge but does not accelerate refunds.

Ambiguity in Schedule column labelling

• The Schedule headers in the instrument show Column A captioned as "Fee for individual or eligible entity", which can be misleading when read against reg 4(2) that allocates column positions differently for certain Divisions. Users should cross‑check reg 4(2) and the Schedule division in question to ensure correct application.

Enforcement officer and kilometre charges

• Schedule 1 Division 1 item 3 charges enforcement officer travel on a 1‑way kilometre basis and caps combined charges when multiple processes are executed in the same trip. Misunderstanding the per‑trip cap can produce double counting errors. Note also that item 3 distinguishes metropolitan and non‑metropolitan kilometre rates.

In sum, the main practical pitfalls are timing and pre‑payment rules, the scope of reduced fee eligibility, the penal consequences of incorrect declarations, procedural nuances for waivers, and potentially surprising high costs such as the annual email information fee.

Checklist approach for filings and fee regime

1. Identify the correct Schedule item and division before preparing a filing. Confirm whether the matter sits in Division 1 (general), Division 2 (civil) or Division 3 (criminal) of Schedule 1 and note the applicable payer column (Schedule 1; reg 4(2)).
2. Establish payer status. Determine whether the filer is an individual, an eligible individual (see reg 8(2)), an entity, an eligible entity (see reg 8(3)), a small business or non‑profit able to use Form 1 under reg 5A, or a State actor whose fee liability is subject to reg 6(3).
3. Satisfy pre‑payment requirements for civil matters. For civil jurisdiction filings, ensure the applicable fee is paid before the claim, application or document is filed, issued or otherwise dealt with by the Court as required by reg 7(2).
4. For hearing allocations and reconvening, observe payment timing. Pay the allocation fee immediately after the Court determines hearing days (reg 10). Ensure half daily hearing fees required under Schedule 1 Division 2 item 6 are paid before reconvening (reg 11).

Applying for eligible status or small business/non‑profit treatment 5. If a person believes they qualify as an eligible individual or eligible entity, lodge an application under reg 9A in the Chief Magistrate approved form, specifying the matter for which the reduced fee is sought (reg 9A(1)-(2)). There is no fee for the application (reg 9A(3)). 6. For entities that meet the small business or non‑profit definitions in reg 3, use Schedule 2 Form 1 to declare small business or non‑profit status (reg 5A(1); Schedule 2 Form 1). On lodgment the entity is to be charged as if it were an eligible entity (reg 5A(2)). Immediately notify the Principal Registrar if the entity ceases to meet the qualifying criteria (reg 5A(4)). Maintain employment records and any relevant corporate group evidence to substantiate eligibility.

Preparing and supporting applications for relief 7. When applying for a direction under reg 9B, be prepared to satisfy one of the statutory reasons: financial hardship or the interests of justice (reg 9B(1)-(2)). Where requested, provide further information orally or in writing as the registrar or Court directs (reg 9B(3)-(4)). Keep documentary evidence of income, benefits, legal aid grants, or other circumstances that support the claimed ground.

Handling exemptions and mandatory waivers 8. Check for statutory exemptions under reg 5(1): FVRO and VRO applications under the Restraining Orders Act 1997, prohibited behaviour orders, disease test orders and civil proceedings under the Criminal Law (Mental Impairment) Act 2023 may be exempt from fees in specified ways (reg 5(1)). If an FVRO/VRO application or transcript situation falls within reg 6A conditions, request a mandatory waiver for the copy of the application or the transcript from the registrar as the regulation requires (reg 6A(3) and (5)).

Ordering transcripts and evidence copies 9. When ordering transcripts, select the appropriate delivery timeframe and understand per‑page and base charges in Schedule 1 Division 1 item 8. Confirm payer category because rates differ between entity, eligible individual and other columns. If a transcript has already been provided and a copy is needed, choose the correct electronic or paper option to apply the correct fee (Schedule 1 item 8(b)).

Using the dispute and refund routes 10. If there is a dispute about the fee payable, complete Schedule 2 Form 3 and apply to the Principal Registrar for a determination under reg 13(1)-(2). If dissatisfied, seek summary review by the Court as allowed under reg 13(3). There is no fee for either the determination or review (reg 13(4)). 11. If an overpayment has been made, apply for a refund under reg 9D. A judicial officer or registrar presiding in proceedings can order a refund of the difference (reg 9D(1)); registrars can refund amounts paid in error (reg 9D(2)). Keep records and receipts to support refund claims.

Avoiding penalties and recordkeeping 12. Avoid false statements. Ensure any declaration or application under these Regulations is factually accurate and supported by documentation. A false or misleading statement in a material particular is an offence attracting a $1,000 fine and potential invalidation or revocation of directions (reg 9C(1)-(3)). Keep copies of Centrelink or DVA cards, legal aid letters, payroll evidence and other supporting documents. 13. Maintain clear records of small business employee counts and corporate group relationships to substantiate small business declarations under reg 3 and Form 1. If the entity’s status changes, inform the Principal Registrar immediately as required by reg 5A(4).

Practical steps for entities seeking Court information 14. If an entity seeks Court information under the Magistrates Court (General) Rules rule 41A, confirm whether the information will be provided per case or by annual email subscription. If seeking approval for the annual email subscription, be aware that Attorney General approval triggers the annual fee schedule item 5(b) and the fee is payable on approval and each anniversary (reg 12; Schedule 1 item 5 note).

Operational coordination with state actors and enforcement officers 15. If proceedings are instituted by police or a department, confirm whether the fees are subject to reg 6(3) and therefore payable only on conviction and recovery. Coordinate with enforcement officers to estimate kilometre and attendance charges under Schedule 1 item 3 and item 6(b) when the officer is required to attend out of the Court building.

When in doubt, use the dispute mechanism first 16. Where fee applicability is uncertain, make a reg 13 application to the Principal Registrar using Form 3 to get an administrative determination before proceeding. The determination is free and is reviewable by the Court (reg 13(1)-(4)).

These steps reduce the risk of rejected filings, extraneous payments, penalties for false declarations and avoidable delays. They also leverage the Regulations’ administrative remedies such as fee dispute mechanism and refund powers.
