25 Action to be commenced by claim

(1)  [Rule 25 Subrule (1) substituted by S.R. 2013, No. 69, Applied:04 Sep 2013] A proceeding that falls within a class of proceeding that is required under the Supreme Court Rules 2000 to be commenced by a writ is to be commenced by a claim.

(2)  A claim is to be filed in a registry.

(3)  A claim for a debt or liquidated sum is to contain a statement specifying –

(a) the amount claimed in the action; and

(b) [Rule 25 Subrule (3) amended by S.R. 2014, No. 42, Applied:12 Mar 2014] the amount claimed for costs; and

(c) [Rule 25 Subrule (3) amended by S.R. 2014, No. 42, Applied:12 Mar 2014] the amount claimed for service of the claim.

(4)  [Rule 25 Subrule (4) amended by S.R. 2014, No. 42, Applied:12 Mar 2014] The amount claimed for costs under subrule (3)(b) is to be in accordance with Part 3 of Schedule 1 .

(5)  [Rule 25 Subrule (5) inserted by S.R. 2014, No. 42, Applied:12 Mar 2014] The amount claimed for service of the claim under subrule (3)(c) is to be in accordance with item 14 of Part 1 of Schedule 1 .
