### 159 Litigants Fund > > (1)  The Administrator is to establish an interest-bearing account with a bank, building society or credit union. > > > (2)  The account is to be known as the Magistrates Court (Civil Division) Litigants Fund. > > > (3)  Each district registrar is a signatory to the account. > > > (4)  Money received by a district registrar as payment into Court or as security is to be paid into the Litigants Fund unless the Court orders otherwise. > > > (5)  A district registrar may only pay money out of the account in accordance with – > > > > > > (a) an order of the Court; or > > > > > > > (b) the terms of consent of the parties.
