Machinery Act 1949

The Act revolves around a few tightly defined concepts, each with structural implications for regulatory design and enforcement.

• Machinery: The dictionary definition is deliberately expansive. It includes "any machine, boiler, pressure vessel, engine, motor or source of motive power, and any shaft, belt, gearing, pulley, flywheel, lift, crane, contrivance or appliance operated by machinery" (Dictionary). That language captures both prime movers and their ancillary transmission and lifting apparatus, and expressly contemplates contrivances and appliances operated by machinery. The practical effect is that the scope for subsequent regulation is broad; regulations can target plant, fixed power sources, portable machines and associated appliances.

• Chief Inspector and inspectors: The Act requires the work health and safety commissioner to appoint a public servant as the Chief Inspector of Machinery (s 3). The work health and safety commissioner also has power to appoint other inspectors (s 4(1)); the chief inspector is an inspector by operation of s 4(2). These appointments are subject to the general appointment rules in the Legislation Act (s 3 note 1; s 4 note 1), including that appointments may be by naming a person or nominating the occupant of a position (Legislation Act, s 207, as noted in the Act's notes). The appointing structure places operational responsibility for inspection and enforcement within the work health and safety administrative architecture.

• Fees and determinations: The Minister may determine fees "in writing" for the purposes of the Act (s 5(1)). The Act explicitly makes such a determination a disallowable instrument (s 5(2)). This creates an administrative route for revenue‑raising or cost‑recovery for regulation-driven services such as registrations, inspections or licences once the regulations specify such services.

• Regulatory delegation and offences: The Executive may make regulations covering a long list of topics relevant to machinery, including installation, operation, safety measures, registration, inspection and testing, licensing and certificates (including grant, suspension and cancellation), precautions for workers, inspectors' functions (including powers of entry) and age prohibitions (s 7(2)(a)-(g)). The regulations may prescribe offences and a maximum penalty of not more than 10 penalty units for those offences (s 7(3)). The Act therefore leaves the content of criminalised misconduct to subordinate legislation but caps the maximum penalty that regulations may prescribe.

• Interaction with Legislation Act: Multiple notes in the Act refer to the Legislation Act 2001 for procedures relating to appointments, disallowable instruments and definitions (see notes to ss 3, 4 and 5; Dictionary notes). The Act relies on the Legislation Act to place procedural and interpretive constraints around appointments, instruments and definitions.

Two broader structural implications follow. First, the Act is an enabling statute: practical obligations on businesses, inspectors' coercive powers and pecuniary sanctions will generally flow from regulations made under s 7 rather than from the Act itself. Second, the appointment and fee determination mechanisms create points of administrative discretion that will shape enforcement and compliance costs: the work health and safety commissioner and the Minister are the key decision makers identified in the Act (s 3; s 4; s 5).

The Act potentially affects a wide set of actors, though the precise contours of impact depend heavily on regulations made under s 7. The statutory text and dictionary identify categories of persons and entities that are within the Act's reach and who will bear duties and costs once regulations are made.

• Owners and occupiers of premises where "machinery" (as broadly defined) is installed or operated. The dictionary definition encompasses power sources, fixed plant, lifting gear and appliances operated by machinery. Owners or occupiers who install or use such plant will be within the regulatory ambit once regulations impose registration, inspection or licensing requirements (s 7(2)(a)-(c)).

• Employers and employees. The regulations can prescribe "precautions to be taken to secure the safety of people employed at or in relation to machinery" (s 7(2)(e)). This gives the Executive the power to impose duties on employers and potentially on employees in relation to training, safe systems of work, maintenance, guarding and other precautions. The Act also allows the Executive to prohibit employing persons under a prescribed age in relation to prescribed machinery (s 7(2)(g)), affecting labour practices and recruitment.

• Operators, installers, testers and inspectors of machinery. The regulations may require licences or certificates for installation, use, operation, inspection or testing, including rules for granting, suspending and cancelling those licences or certificates (s 7(2)(d)). That means tradespeople, maintenance contractors, testing companies and in‑house operators may need to hold particular credentials when the regulations are enacted.

• Persons subject to inspection or enforcement. The chief inspector and inspectors, appointed by the work health and safety commissioner (s 3; s 4), will exercise functions and powers set out in regulations, including powers of entry (s 7(2)(f)). Businesses and individuals who own or control premises with machinery can expect to be subject to inspection regimes and to administrative processes such as notices and directions when regulations provide for them.

• The ACT public service and ministerial actors. The work health and safety commissioner appoints the chief inspector and may appoint inspectors (s 3; s 4). The Minister determines fees (s 5). The Executive makes regulations (s 7). These points of discretion mean public service staff and Ministers administer the regime and decide on the content, timing and implementation of regulatory obligations.

• General public and property interests. The regulations may be framed to "secure the safety of people and property from injury or damage" arising from machinery (s 7(2)(b)). That potential scope reaches beyond workplace safety to public safety in premises or with public equipment.

Who pays: the Act expressly contemplates fees determined by the Minister (s 5). Those fees would be payable by the regulated parties specified in regulations, for example owners registering plant, licence applicants, or operators requiring statutory testing. The republication notice gives the penalty unit monetary values in force at that date ($160 individual; $810 corporation), which sets the dollar scale of any fines created by regulations. Who decides: key decisions lie with the work health and safety commissioner (appointments), the Minister (fees) and the Executive (regulations), backed by the Legislative Assembly’s disallowance and notification processes as required by the Legislation Act.

Because the Act delegates most substantive obligations to regulations, many of the affected parties will be determined only when those regulations are made. Until then, the Act primarily affects administrative actors who will draft and implement the subordinate instruments.

The Machinery Act 1949 sets out limited direct duties and more significantly enables the imposition of duties and the granting of rights through subordinate instruments.

Direct duties and rights in the Act

• Appointment obligations on the work health and safety commissioner: the work health and safety commissioner must appoint a public servant as Chief Inspector of Machinery (s 3). The commissioner may appoint other inspectors (s 4(1)); the chief inspector is also an inspector (s 4(2)). These are mandatory administrative duties on the relevant statutory officeholder.

• Fee determination power: the Minister may, in writing, determine fees for the Act (s 5(1)). The Act treats that determination as a disallowable instrument (s 5(2)). The statutory right here is an administrative power to set fees; the corresponding legal constraint is that the determination is subject to parliamentary disallowance and to notification requirements under the Legislation Act.

• Enabling power for regulations: the Executive may make regulations dealing with a broad list of topics (s 7(1)-(2)), and regulations may prescribe offences and a maximum penalty of not more than 10 penalty units for contraventions (s 7(3)). The Act therefore creates the legal structure under which duties and sanctions are to be issued; the Act itself imposes no specific operational duties such as maintenance regimes or inspection intervals.

Delegated duties and rights likely to be created by regulations

• Registration and inspection obligations: s 7(2)(c) and (b) permit regulations to require registration of machinery and to secure safety of people and property through inspection and other measures. When regulations are made they may require mandatory registration of certain classes of plant, periodic inspection, certification, testing regimes and record keeping.

• Licensing and certification regimes: s 7(2)(d) authorises regulations to require licences or certificates for "the installation, use, operation, inspection or testing of machinery" and to provide for the grant, suspension and cancellation of such licences and certificates. Those delegations commonly produce duties to hold qualifications, comply with standards and pay licensing fees.

• Precautionary duties: s 7(2)(e) allows the Executive to prescribe "the precautions to be taken to secure the safety of people employed at or in relation to machinery". This clause authorises duties typical of occupational health and safety regulation: safe systems of work, guarding, training, maintenance, and emergency procedures.

• Enforcement rights and powers: s 7(2)(f) expressly contemplates that regulations may prescribe the functions of the chief inspector and inspectors, "including powers of entry". If regulations confer powers of entry, inspectors will hold statutory powers to enter premises (subject to any limits in the regulations or other legislation) for inspection and enforcement. The Act does not define the scope of those powers; the regulations will do so.

Procedural and legal constraints

• Disallowable instruments and legislative oversight: the Act requires determinations of fees to be disallowable instruments (s 5(2)). Notes to ss 3, 4 and 5 refer to the Legislation Act for appointment and instrument‑making procedure, which brings instruments and regulations within the Legislative Assembly’s scrutiny and disallowance processes as set out in that Act.

• Penalty ceiling for regulations: s 7(3) caps the maximum penalty that regulations may prescribe for contraventions at 10 penalty units. The republication notice records the penalty unit monetary values at that date; practical fines will be the product of the penalty unit value current at the time a regulatory offence is imposed.

Rights for regulated parties

• Procedural protections deriving from the Legislation Act: because fee determinations are disallowable instruments and regulations require notification and presentation under the Legislation Act (s 5(2); s 7(1) note), regulated parties may rely on the procedural channels for parliamentary review of subordinate instruments.

• Administrative review via licensing processes: s 7(2)(d) contemplates regulatory regimes for granting, suspending and cancelling licences, which typically include procedural rights and internal review mechanisms under the administrative law framework, though the Act itself does not specify those processes. Practical rights will flow from the design of the regulations.

In short, the Act creates the architecture to impose duties and grant rights, but leaves the substantive content to regulations and Ministerial instruments. Practitioners should therefore look to the regulations made under s 7 and to fee determinations under s 5 to identify the concrete duties, sanctions and procedural protections that apply in practice.

The Machinery Act 1949 provides the enabling framework for enforcement and penalties but contains limited substantive enforcement mechanics in the text itself. Enforcement and penalties are primarily to be specified in regulations made under s 7. The statute contains the following enforcement‑related provisions and procedural points:

• Power to prescribe offences and penalties in regulations: s 7(3) expressly allows regulations made under the Act to prescribe offences for contraventions and to set maximum penalties of not more than 10 penalty units for offences against the regulations. The Act therefore authorises criminal‑style penalties for regulatory breaches, but it caps the maximum penalty per offence that regulations may prescribe.

• Monetary value of penalty units: the republication notice attached to this edition of the Act records the penalty unit values that applied at the republication date: $160 for an individual and $810 for a corporation (see "Penalties" note at the front). Those monetary values determine the dollar amount of fines where an offence is expressed in penalty units; they are not fixed by the Machinery Act itself but are prescribed under the Legislation Act 2001 (see notes). Practitioners must check the current penalty unit value in force at the time of an offence because the dollar amounts in effect may have changed since the republication.

• Inspectors' functions and powers: s 7(2)(f) permits regulations to make provision for the functions of the chief inspector and inspectors, including powers of entry. The Act itself does not set out specific coercive powers such as seizure, issuing infringement notices or requiring production of documents; those powers must be conferred by regulation. The note to s 7(2)(f) confirms that the regulation‑making power extends to entry powers, signalling that enforcement will depend heavily on the content of subordinate instruments.

• Appointment of inspectors: s 3 and s 4 create the appointing mechanism for the chief inspector and inspectors. The work health and safety commissioner must appoint a public servant as Chief Inspector of Machinery (s 3) and may appoint other inspectors (s 4(1)); s 4(2) makes the chief inspector an inspector. The chain of appointments is therefore internal to the work health and safety administrative structure; this is the body responsible for carrying out enforcement functions once vested by regulation.

• Procedural conformity with the Legislation Act: notes to ss 3, 4 and 5 remind that appointments and disallowable instruments are subject to the Legislation Act appointment and notification processes. The requirement that fee determinations are disallowable (s 5(2)) offers a parliamentary check on fee‑setting decisions. Regulations themselves must be notified and presented to the Assembly (s 7(1) note), which provides a statutory visibility and parliamentary oversight mechanism, though not immediate judicial review.

• Limits on maximum penalties in regulations: s 7(3) sets a numerical limit on the maximum penalty regulations can prescribe for offences, namely 10 penalty units. The practical effect in dollar terms depends on the then‑current penalty unit value. The Act does not cap penalties for any offences created by other Acts that may apply to machinery; s 7(3) limits only what regulations under this Act may set.

Enforcement therefore operates by administrative appointment and delegated regulation. The Act gives the Executive and the Minister the tools to build a regulatory enforcement regime, inspectors with entry powers, offences with monetary penalties and fee regimes, but leaves the design of enforcement tools and procedures to regulations and instruments subject to the Legislation Act’s disallowance and notification procedures. The absence in the Act of specific enforcement modalities such as infringement notices, seizure powers, or administrative monetary penalties means such mechanisms will exist only if and when the Executive incorporates them into regulations.

The Machinery Act 1949 is tightly interconnected with other statutory instruments and the broader administrative law framework by design. The Act repeatedly cross‑refers to and relies on the Legislation Act 2001 for appointment, instrument and definitional matters, and it sits within the ACT's occupational safety and regulatory architecture. The principal interactions recorded in the republished law are as follows:

• Reliance on the Legislation Act 2001: multiple notes in the Machinery Act direct readers to the Legislation Act for the legal context and procedural requirements for appointments (notes to ss 3 and 4 refer to the Legislation Act, pt 19.3 and s 207), for the legal status of notes (s 2A notes refer to Legislation Act, s 127) and for disallowable instrument rules and notification requirements (notes to ss 5 and 7 refer to the Legislation Act). The Legislation Act supplies definitions (for example, "Minister", "Executive", "work health and safety commissioner") and sets out instrument, regulation and appointment procedures that bind how the Machinery Act will operate in practice (Dictionary note 1).

• Work health and safety (WHS) institutional architecture: the Act requires the work health and safety commissioner to make the appointment of the Chief Inspector of Machinery (s 3) and gives the commissioner power to appoint inspectors (s 4). The Act therefore integrates the machinery inspection regime into the WHS administrative structure. The Act's legislative history records a Work Health and Safety Amendment Act 2019 (A2019‑38) in the chain of amendments and commencement dates (endnotes), showing that the Machinery Act has been adapted to fit within the WHS reforms and the WHS administrative architecture.

• Relationship with subordinate ACT instruments: the Act is an enabling statute that expects regulations to set out the substantive obligations. Section 7(2) lists the categories of matters the regulations may address, including registration, inspection, licences, and powers of entry. Consequently, the practical legal obligations affecting operators will be found in regulations under this Act and potentially in related subordinate instruments such as fee determinations under s 5, which are disallowable instruments.

• Historical conversion from Commonwealth ordinance to ACT enactment: the legislation history shows that the Machinery Act began as a Commonwealth ordinance (Machinery Ordinance 1949 No 11 (Cwlth)) and was converted into an ACT enactment on self‑government day, 11 May 1989, under the Australian Capital Territory (Self‑Government) Act 1988 (Cwlth), s 34(4) (endnotes). This conversion places the Act within the ACT legislative corpus rather than Commonwealth law, and the history notes subsequent amendments and renaming by the Self‑Government (Citation of Laws) Act 1989 (endnotes).

• Interaction with other ACT Acts that have amended or revised the Machinery Act: the endnotes list amendments across decades, including the Statute Law Revision (Penalties) Act 1994, Statutory Offices (Miscellaneous Provisions) Act 1994, and various revision acts (endnotes). Those amendments alter the machinery of the Act , for example, defining the chief inspector and inspector in the Dictionary, inserting and later omitting provisions such as s 6 (approved forms) (amendment history) , and reflect the Act’s integration into broader statutory housekeeping and revision programs.

• Limits relative to other safety and criminal regimes: the Machinery Act’s regulation‑making power and penalty cap (s 7(3)) do not prevent the application of other ACT or Commonwealth offences or regulatory schemes that might apply to machinery (for example, general WHS offences under other Acts). The Act is a specialist enabling instrument; practitioners must map the Machinery Act’s delegated instruments against the general WHS and criminal regimes to identify overlaps, duplication or higher‑penalty alternatives.

• Parliamentary oversight mechanisms: the designation of fee determinations as disallowable instruments (s 5(2)) and the requirement to notify and present regulations (s 7(1) note) tie the Machinery Act’s delegated regulation and fee instruments into the Legislative Assembly’s oversight processes as established by the Legislation Act. That connection provides a statutory route for parliamentary scrutiny and potential disallowance of subordinate instruments.

In sum, the Machinery Act sits as a specialist enabling statute within the ACT legislative framework, dependent on the Legislation Act for procedural rules and linked to the WHS administrative architecture for appointments, inspection and enforcement. The Act’s practical effect is realised only when regulations and determinations under it are made, and these subordinate instruments interact with the broader suite of WHS and administrative laws.

The republished Act contains a detailed amendment history in its endnotes that records the law’s origin as a Commonwealth ordinance and its evolution since 1949. The key amendment and conversion milestones recorded in the republished text are as follows:

• Origination and early enactment: the Machinery Act started life as the Machinery Ordinance 1949 No 11 (Cwlth), notified and commenced 13 October 1949 (endnotes). Its initial operation was as an ordinance under Commonwealth administration.

• Conversion to ACT enactment on self‑government: the Australian Capital Territory (Self‑Government) Act 1988 (Cwlth), s 34(4) converted most former Commonwealth ordinances in the ACT into ACT enactments. The Machinery Act was converted into an ACT enactment on 11 May 1989 (the "self‑government day") and its name was changed from "Ordinance" to "Act" by the Self‑Government (Citation of Laws) Act 1989 (endnotes).

• Statute Law Revision and structural amendments: across the 1990s and 2000s the Act underwent a sequence of revision and amendment acts that modernised and repositioned provisions. Notable entries in the endnotes include the Acts Revision (Position of Crown) Act 1993 (A1993‑44), Statute Law Revision (Penalties) Act 1994 (A1994‑81), Statutory Offices (Miscellaneous Provisions) Act 1994 (A1994‑97), and Statute Law Revision Act 1995 (A1995‑46). These Acts, among other things, inserted or relocated definitions and updated statutory office arrangements (endnotes; amendment history).

• Insertions and later omissions: the amendment history records that provisions such as s 6 (Approved forms), s 4A (Power of Minister to determine fees) and s 4B (Fees payable) were inserted or amended at points in time and subsequently removed or relocated. For example, s 6 was inserted by A2001‑44, amended by A2007‑3 and then omitted by A2021‑12 (amendment history). The current republished Act no longer contains s 6.

• Recent integration with WHS administrative structure: the Work Health and Safety Amendment Act 2019 (A2019‑38) appears in the legislation history and amendment history, with parts commencing in 2019 and 2020 (endnotes). Those changes reflect the integration of the Machinery Act's appointment functions (chief inspector and inspectors) into the WHS commissioner’s remit (see s 3 and s 4 as republished). The Administrative (One ACT Public Service Miscellaneous Amendments) Act 2011 (A2011‑22) and Justice and Community Safety Legislation Amendment Act 2009 (No 2) (A2009‑19) also appear in the sequence, recording assorted administrative amendments (endnotes).

• Latest republication and amendment: the republished text is effective as at 23 June 2021 and includes amendments made by Statute Law Amendment Act 2021 (A2021‑12) with parts commencing on 23 June 2021 (endnotes). That 2021 amending Act omitted s 6 and effected other editorial and structural amendments noted in the amendment history.

• Editorial amendments and republication protocol: the Parliamentary Counsel’s Office prepared this republication, which incorporates editorial amendments authorised by the Legislation Act 2001, part 11.3. The front matter explains that editorial changes do not alter the legal effect of the law but take effect as if made by an Act commencing on the republication date (Legislation Act, ss 115 and 117) and that not all editorial amendments are annotated in the amendment history (republication note).

The amendment history shows that the Act has been principally modernised through relocations of definitions into the Dictionary, removal of redundant provisions, and administrative integration with the WHS institutional framework. Practitioners should consult the endnotes when tracing the provenance of particular provisions or when checking whether a provision was historically present and has since been omitted or relocated.

The Machinery Act 1949 republished text and its endnotes do not cite or summarise any judicial decisions, nor does the republished law record any specific litigation or judicial interpretation arising under the Act. The endnotes provide legislative history, amendment history and information about republications, but they do not include case law or litigation annotations.

Practical implications for practitioners:

• absence of reported authorities in the republished Act: because the republished text does not record any cases, the statute alone gives no guidance about judicial interpretation of its provisions, such as the scope of "machinery", the limits of inspectors' powers, or the application of fee determinations. That silence in the republished law does not mean there are no cases; it means the republication does not reproduce case law.

• standard research requirement: practitioners must search external legal databases and ACT court and tribunal reports to locate any cases that interpret or apply the Machinery Act or any regulations made under it. Because the Act is primarily enabling and the regulations (and fee determinations) supply most substantive obligations, a case law search should include decisions that construe relevant regulations and decisions that address inspectors' powers or procedural fairness in licensing or enforcement actions.

• likely small body of direct adjudication: given the Act’s function as an enabling statute and its integration with the WHS framework, significant litigation will more commonly arise under the regulations made under the Act, or under more modern WHS statutes that overlap with machinery safety obligations. Practitioners should therefore treat the Machinery Act as a statutory base and focus litigation searches on subordinate instruments and the general WHS jurisdiction when looking for judicial authority.

• when no published cases are found: where there is an absence of authoritative judicial interpretation, regulators, inspectors and regulated entities should treat the text of the Act and its delegated instruments as the primary legal source and be attentive to administrative law principles (natural justice, reasonableness, jurisdictional error) that apply to any decision‑making under the Act or its regulations.

In short, the republished Act does not supply litigation history. To establish how the Act or its delegated instruments have been applied and interpreted, practitioners must consult case law databases and tribunal decisions covering the ACT jurisdiction and related WHS and administrative law authorities.

This short enabling Act contains several features and historical quirks that can produce practical pitfalls for practitioners and regulated entities. Below are concrete "gotchas" grounded in the republished text and amendment history:

• the Act is an enabling, not substantive, statute: the Machinery Act itself does not set technical or procedural standards. If a client assumes the Act contains specific duties (for example, mandatory inspection intervals, required qualifications for operators, or automatic powers of entry), they will be mistaken. Those matters must be located in regulations made under s 7. Until regulations are made, obligations are uncertain. Practitioners must check the current subordinate legislation and fee determinations rather than relying on the Act text alone.

• broad definition of "machinery": the Dictionary’s definition of "machinery" is wide and covers prime movers, pressure vessels, lifts, cranes, and "any... contrivance or appliance operated by machinery" (Dictionary). That breadth means that items that might be viewed as peripheral to mechanical plant could be captured once regulations are drafted. Do not assume exclusion because equipment is not a large fixed asset; the word "appliance" and "contrivance" are expansive.

• appointment architecture may be non‑ministerial: the Chief Inspector and inspectors are appointed by the work health and safety commissioner (s 3; s 4), not directly by the Minister. Regulatory practice and enforcement will therefore be operationally managed through the WHS commissioner’s office. Clients should not assume ministerial direct control over inspector appointments or day‑to‑day enforcement priorities.

• fee determinations are political instruments: s 5 makes fee determinations a disallowable instrument (s 5(2)). That means fees are administratively set by the Minister but are subject to parliamentary disallowance under the Legislation Act. Fee payers may be exposed to variability in fees and to political scrutiny and change. Reliance on stable fee settings for commercial planning is risky until fee determinations are made and settled.

• penalties are capped at 10 penalty units in regulations: s 7(3) limits the maximum penalty that regulations can prescribe to 10 penalty units. Practitioners should ensure they know whether related or overlapping offences under other Acts carry higher penalties; where a breach could attract multiple statutory regimes, the available sanction may differ considerably depending on the legal basis relied on by an enforcement agency.

• penalty unit dollar values differ between individuals and corporations: the republication notice records differing penalty unit dollar values for individuals and corporations ($160 and $810 respectively as at the republication date). If regulations specify penalties in penalty units, the actual monetary fines will vary with the entity type. Always check the current penalty unit values in the Legislation Act to compute contemporary dollar amounts.

• previously present provisions may have been removed: the amendment history shows provisions such as s 6 (Approved forms) were inserted in earlier revisions and later omitted by A2021‑12 (amendment history). Relying on historical practice based on obsolete provisions or forms risks compliance failure. Practitioners must confirm whether any administrative forms or processes are currently authorised in regulations or alternative instruments.

• enforcement powers depend on regulations: the Act contemplates that functions and powers of inspectors, "including powers of entry", will be provided in regulations (s 7(2)(f)). If the relevant regulations are silent or narrowly drafted, inspectors’ statutory powers may be constrained. Conversely, broad regulatory drafting can give inspectors significant intrusive powers. Before consenting to site entry or regulatory inspections, clients should review the exact extent of powers in the regulations and in any other ACT enforcement legislation.

• overlapping regulation with WHS frameworks: the Act is tied into the WHS administrative structure and recent amendments incorporate aspects of the WHS reforms (endnotes). This creates potential overlap or duplication with the general WHS Act and associated regulations. Entities should map their obligations across the Machinery Act’s subordinate instruments and the wider WHS regime to avoid confusion and double compliance.

• instrument‑making and legislative oversight timelines: regulations and fee determinations are subject to notification and presentation requirements under the Legislation Act. There may be timing lags between regulatory drafting, notification, commencement and the potential for Parliamentary disallowance. Entities planning compliance programmes or capital expenditure tied to regulatory requirements should account for these timing and uncertainty factors.

These "gotchas" are concrete implementation and compliance risks traceable to express provisions in the Act and its amendment history. Practitioners should verify the current state of regulations, fee determinations and any relevant WHS instruments, and should not infer operational detail from the Act alone.

Because the Machinery Act is an enabling statute, compliance is principally about monitoring and acting on the instruments made under it: regulations, fee determinations and any ancillary subordinate instruments. Below is a practical, source‑grounded compliance checklist and recommended actions, framed to help lawyers, compliance officers, accountants and operators meet likely statutory requirements once subordinate instruments are in force.

1. Identify whether the equipment falls within the Act’s definition of "machinery".

   • consult the Act’s Dictionary: "machinery includes any machine, boiler, pressure vessel, engine, motor or source of motive power, and any shaft, belt, gearing, pulley, flywheel, lift, crane, contrivance or appliance operated by machinery" (Dictionary).
   • where there is doubt about whether a device is a "contrivance or appliance operated by machinery", treat it as in‑scope for planning purposes until regulations clarify exclusions.

2. Monitor and obtain the relevant regulations and fee determinations.

   • s 7 allows the Executive to make regulations covering the substantive obligations; s 5 allows the Minister to determine fees as disallowable instruments.
   • subscribe to the ACT legislation register and the official Gazette to receive notifications when regulations or determinations under the Act are made, since the Act itself does not announce substantive rules.

3. Assess licensing, registration and certification requirements.

   • regulations may require licences or certificates for installation, use, operation, inspection or testing (s 7(2)(d)) and may provide for grant, suspension and cancellation.
   • if you operate or contract to operate, inspect, test or install machinery, verify whether personnel and contractors need licences and whether existing certifications will be grandfathered or replaced.

4. Prepare for inspection regimes and powers of entry.

   • s 7(2)(f) contemplates that regulations will prescribe inspectors’ functions and "including powers of entry".
   • maintain ready access to maintenance records, test certificates and safety documentation; adopt documented safety systems and training records to present at inspections.

5. Budget for fees and potential fines.

   • the Minister may set fees under s 5, and any financial penalties in regulations will be expressed in penalty units subject to the cap in s 7(3). The republication records penalty unit dollar values current to 23 June 2021; check the current values before calculating exposure.
   • factor potential registration, licence, inspection and testing fees into operating budgets; consider the disallowable nature of fee determinations and the political possibility of fee changes.

6. Check age and employment restrictions.

   • regulations may prohibit employing anyone younger than the prescribed age in relation to prescribed machinery (s 7(2)(g)). Human resources policies and site work allocation should be reviewed against any such regulatory prohibitions.

7. Align workplace safety and compliance programmes with regulatory content.

   • s 7(2)(e) allows regulations to prescribe precautions to secure the safety of people employed at or in relation to machinery. Implement practical measures now: risk assessments, isolation procedures, guarding, maintenance schedules, lockout/tagout procedures and training, while waiting for regulations to detail minimum standards.

8. Ensure procedural fairness and administrative review pathways.

   • licensing and disciplinary regimes for grant, suspension and cancellation under s 7(2)(d) are likely to involve administrative decision‑making. Prepare internal records, licences and responses in case of compliance actions, and be ready to pursue merits review or judicial review where statutory avenues exist.

9. Contractual and procurement due diligence.

   • when procuring equipment, contracting installation or maintenance, include express warranties and compliance obligations with ACT regulations. Require contractors to hold any required licences and to indemnify for breaches attributable to their work.

10. Liaise with inspectors and the WHS commissioner when appropriate.

    • appointments are made by the work health and safety commissioner (s 3; s 4). Early engagement with WHS officials can clarify expectations, inspection routines and transitional arrangements when new regulations come into force.

11. Maintain a record of instruments and amendments.

    • given the Act’s long amendment history and the omission of earlier provisions (for example, s 6 was omitted by A2021‑12), keep an auditable record of the current regulations, fee determinations and any instrument changes. This is essential for compliance, audit and potential dispute resolution.

12. Legal review and risk mapping.

    • commission a legal review that maps the Machinery Act’s subordinate instruments to other applicable WHS and ACT laws to identify overlaps, possible double jeopardy, or superior penalty regimes under other legislation.

13. Contingency for non‑compliance.

    • since regulations may create offences (s 7(3)) and inspectors may be given entry powers (s 7(2)(f)), ensure incident response plans, legal counsel contacts and insurance coverage are in place. Training for site managers on how to engage with inspectors is prudent.

14. Corporate governance measures.

    • Boards and senior management should receive reports on compliance risk tied to new regulations and fee determinations. Where fees or licensing costs are material, accountants should reflect them in budgeting and financial forecasts.

15. Parliamentary and political risk monitoring.

    • because fee determinations are disallowable (s 5(2)) and regulations are subject to notification under the Legislation Act (s 7(1) note), monitor parliamentary processes that may alter or disallow instruments that affect compliance and cost.

Implementing the checklist requires close tracking of subordinate instruments and active administrative and legal engagement. The Act’s enabling nature makes the regulations the primary compliance source, so once the relevant regulations and fee determinations are published, update compliance plans and contractual arrangements to reflect the detailed obligations they impose.
