Lotteries Commission (Instant Lottery) Rules 1996

The instrument revolves around a small set of operational concepts that determine eligibility, verification, and payment for instant lottery prizes. Those concepts and their operational consequences follow.

Ticket and instant prize: The rules define "ticket" as an instant lottery ticket and "instant prize" as the prize in the first stage that is ascertained when the holder removes the opaque covering to reveal symbols, figures, amounts or letters (rule 2). Structurally, the lottery can have a first stage (instant prize determined by scratching) and a second stage or "instant lottery promotion" involving draws or competitions (rule 2, rule 3(2)).

Security code and ticket identification number: The Commission may put a security code on a ticket for verification or counterfeit detection, but that code "is not part of the play instructions" and cannot be used to determine prize value or second stage eligibility (rule 4). Separately, the Commission may include a unique ticket identification number for digital entry purposes (rule 4A). Practically, this splits security/authentication (security code) from digital entry/indexing (ticket identification number).

Payout period and validation period: The payout period is the statutory window for claiming instant and second stage prizes and is defined by reference to the closure day for the instant lottery; the length varies with specific temporal triggers, including special extensions tied to the COVID emergency (rule 2). For instant prizes of $5,000 or more there is a defined validation period that begins at midnight on the day the claim is made and ends 14 days later at 5pm (rule 2). The validation period creates a short administrative window to perform further verification after claim.

Void tickets and discretionary voiding: The instrument provides a non‑exhaustive list of ticket defects that render a ticket void as of right (rule 6), such as missing "void if removed" numbers, misprints, counterfeits, theft and reconstitution. It also gives the Commission discretion to void tickets for damage or other defects (rule 7). However the Commission must not void a ticket solely because the opaque covering has been removed or a detachable portion has been separated where that is intended by the ticket design (rule 7(3)). The Commission’s remedy for a void ticket is limited to substituting a valid ticket (rule 8).

Digital entry and verification: A ticket may be entered into the second stage by digital entry via the Lotterywest website or as directed, by providing the ticket identification number (rule 9AA). If a digitally‑entered ticket is drawn, the holder must provide the physical ticket in the manner the Commission notifies for verification (rule 12(1A)).

Payment governance: The Commission determines the payment method and timing subject to constraints: an instant prize must be paid within the payout period and after any applicable validation period (rule 9A). The Commission can exercise absolute discretion to pay before the expiry of validation (rule 9A(2)). A ticket that has been marked "paid" or identified via a computer linked terminal as paid must not be paid again (rule 9A(4)). For second stage prizes, monetary prizes are paid as determined by the Commission, non‑monetary prizes may be convertible to their retail value if the permit specifies, and unclaimed prizes can be forfeited (rule 13B).

Evidence, declarations and disclosure: Prize claimants must present the ticket and, where a validation period applies, evidence of identity and bank details (rule 9). The Commission may require statutory declarations concerning identity and compliance with the Act and rules, and may refuse payment where a required statutory declaration is not provided (rule 17). The Commission may publish winners’ names and addresses unless the winner directs otherwise, but also has no obligation to release whether prizes remain or who has won (rules 16, 16A).

Supervision and administrative finality: Draws or selections for second stage prizes must be supervised by an officer from the department that assists in administering the Gaming and Wagering Commission Act 1987, unless the Commission deems that unnecessary and substitutes other supervision (rule 10). Decisions are final and binding on ticket holders and claimants (rule 18).

COVID‑era adaptations: During the declared emergency period, the Commission may accept copies or images of tickets and associated evidence for claims where presenting the physical ticket is not reasonably practicable, and payout periods for closure days within the emergency are extended to 24 months (rules 9AAA, 13A, and the payout period definition in rule 2).

These concepts set the incentive and administrative structure: tickets and their identifiers are the primary trust tokens; the Commission controls entry, verification and payment; claimants must supply identity and banking details when high value claims trigger validation; and administrative finality limits further litigation remedies under this instrument. The rules create administrative pathways for digital participation while preserving verification through physical ticket production for digitally entered claims.

Primary affected actors are the Lotteries Commission (the Commission), agents (retailers or appointed agents), ticket purchasers/claimants (players), and supervising public officers for second stage draws. Secondary affected parties include any third parties engaged in ticket production, digital entry infrastructure providers, and the department assisting the Gaming and Wagering Commission Act 1987.

• Commission: The Commission administers the rules, determines ticket features (security codes, ticket identification numbers), sets methods of payment, supervises draws or delegates supervision (rules 4, 4A, 9A, 10). It also exercises discretion to void tickets (rule 7), to accept alternate claim procedures during an emergency (rules 9AAA, 13A), and to publish or withhold winners’ details (rules 15, 16, 16A). The Commission is the decision‑maker; its determinations are final and binding on ticket holders (rule 18).

• Agents: Defined to include persons or Commission branches appointed as agents, agents receive and pay instant prizes depending on the amount and are the retail interface for ticket sales (definition of agent and rule 9). Agents must use any provided computer linked terminals to verify paid status (rule 2 definition; rule 9A(4)). Agents can continue to sell tickets even where a lot’s prizes have been exhausted (rule 5).

• Players / claimants: Individuals buying tickets are subject to multiple procedural obligations. To be eligible for second stage prizes they must have their name and address printed in the appropriate space and must sign the ticket (rule 11). Claimants of instant prizes must present the ticket within the payout period and, where a validation period applies, provide identity evidence and bank account details (rule 9; rule 2). For digitally entered tickets, claimants must provide the ticket identification number at entry (rule 9AA(3)) and later produce the ticket on request (rule 12(1A)). Winners may be required to make statutory declarations (rule 17).

• Supervising officers and departments: The draw or selection for second stage prizes must be supervised by an officer from the department principally assisting the Gaming and Wagering Commission Act 1987 unless the Commission decides otherwise (rule 10). This ties administrative oversight to another statutory regime and brings departmental personnel into the operational chain.

• Digital and verification infrastructure providers: Computer linked terminals and the Lotterywest website are specifically referenced. A computer linked terminal allows an agent to verify whether a ticket entitles the holder to an instant prize (rule 2 definition), and a ticket identification number is used for digital entry (rule 4A; rule 9AA).

• Third parties: Where non‑monetary second stage prizes exist and conversion into monetary value is specified in the permit, prize vendors or retailers could be affected by the conversion mechanism and its valuation (rule 13B(1)(b)).

Indirect impacts and distributional effects:

• Consumers buying in ignorance. Rule 5 allows continued sale of tickets from a lot even after all prizes have been claimed, and rule 16A expressly permits the Commission to withhold information on whether prizes remain. This combination affects purchasers because they may buy tickets unable to win top prizes without being informed (rules 5, 16A).
• Retailers/agents have operational burdens. Agents must handle verification, may be required to use computer terminals to prevent duplicate payments (rule 9A(4)), and must follow Commission directions on issuance (rule 5A) and sale.
• Data collection and privacy implications. The rules require the collection of name, address, identity evidence and bank details in specific circumstances (rules 2, 9, 17). The rules do not set privacy safeguards; that responsibility sits elsewhere but operationally the Commission and agents must collect and retain personal data.
• Final administrative decisions. Litigation options are narrowed in practice by the finality clause (rule 18), which affects the legal recourse available to disappointed winners.

In sum, the Commission holds primary decision authority and operational control, agents act as the distribution and verification points, and players bear practical requirements to preserve tickets, register identifying information and comply with digital entry mechanics. The rules allocate administrative burdens primarily to claimants and agents while concentrating adjudicative discretion in the Commission.

The rules impose duties on the Commission and agents, and on ticket holders as claimants. They also confer certain rights, such as the right to claim within prescribed periods and the Commission’s right to administer and publish information.

Duties of the Commission

• Maintain and publish rules. The Commission must keep a copy of these rules on the Lotterywest website and may publicise them otherwise (rule 15(1)-(2)). This is an operational duty of transparency about the rules themselves.
• Supervise second stage draws or ensure supervision. The Commission must ensure draws/selections are supervised by an officer from the department assisting the Gaming and Wagering Commission Act 1987, unless it determines that alternative supervision is adequate (rule 10(1)-(2)). The duty attaches to the Commission to select oversight and bear responsibility for that supervisory choice.
• Determine payment method and timing. The Commission must pay instant prizes within the payout period and after any validation period, unless it exercises its discretion to pay earlier (rule 9A(1)-(3)). It must ensure tickets marked "paid" or identified via terminals as paid are not paid twice (rule 9A(4)).
• Verify and check drawn tickets. Where a ticket is drawn/selected for a second stage prize, the Commission must check it is not void and is eligible (rule 12(1)). It must replace void or ineligible drawn tickets with replacements (rule 12(2)).
• Administer validation and evidence requirements. The Commission may require statutory declarations and identity evidence and may withhold payment for failure to comply (rules 9, 17).
• Issue and manage ticket features. The Commission may include security codes and ticket identification numbers and may nominate dates for ceasing issue of tickets to agents (rules 4, 4A, 5A).
• Decide on publication of winners and information disclosure. The Commission may publish winners’ names and addresses unless the winner objects, and may withhold information about prize pools or whether prizes remain (rules 16, 16A).

Duties and obligations of agents

• Verify tickets and use computer linked terminals where provided to check paid status (rule 2 definition; rule 9A(4)).
• Sell and distribute tickets in accordance with Commission directions, including continuing to sell tickets from a lot even if prizes have been claimed (rule 5).
• Act as a place of presentation for prize claims where appropriate depending on the amount (rule 9).

Duties and obligations of claimants / ticket holders

• Present a winning ticket to the Commission or an agent within the payout period to claim an instant prize (rule 9).
• Provide evidence of identity and bank account details where a validation period applies, particularly for instant prizes of $5,000 or more (rule 2 definition; rule 9).
• For second stage eligibility, have the name and address printed on the back of the ticket and sign the ticket (rule 11).
• If digitally entering a ticket, provide the ticket identification number at the time of entry and later provide the physical ticket to the Commission if the ticket is drawn (rules 9AA(2)-(3), 12(1A)).
• Complete statutory declarations on identity and compliance where required by the Commission; refusal may result in refusal to pay (rule 17).

Key rights created or recognised by the rules

• Claim right within payout period. Holders have the right to claim prizes within the payout period established for each instant lottery (rule 9; rule 13).
• Conversion right for non‑monetary second stage prizes: where permitted by the lottery permit, a non‑monetary prize may be converted into a monetary prize equal to retail value (rule 13B(1)(b)).
• Rights to notification/publication: winners may be published unless they have requested non‑publication (rule 16).

Administrative powers and limits

• Voiding and substitution. The Commission has a power to void tickets for listed defects (rule 6) and for other defects at its discretion (rule 7), but a restricted remedy for holders: limited to substituting a valid ticket, not broader compensation (rule 8).
• Finality of decisions. The Commission’s decisions are declared "final and binding" on ticket holders (rule 18), which curtails further internal administrative review; external legal remedies would be available only outside the instrument (the rules do not themselves create or describe external judicial review mechanisms).
• Emergency discretion. The Commission is empowered to alter claims procedures during an emergency (rules 9AAA, 13A) but only when it is satisfied presenting the physical ticket is not reasonably practicable.

The rules thus create a framework in which operational duties are concentrated in the Commission, evidentiary duties fall heavily on claimants, and agents act as delegated points of sale and first‑line verification. Remedies for claimants confronting voided tickets are constrained administratively.

The instrument primarily uses administrative enforcement mechanisms rather than criminal penalties or express monetary fines. Enforcement occurs through the Commission’s control over eligibility, verification, payment, and the substitution or forfeiture of prizes. Key enforcement features and penalties in practical effect are:

Administrative sanctions and refusals

• Refusal to pay. The Commission or an agent must not pay an instant prize if the ticket has already been marked "paid" or identified by terminal as paid (rule 9A(4)). The Commission may refuse to pay where a required statutory declaration is not provided (rule 17(3)). For second stage prizes, prizes are forfeited where not claimed in accordance with the rules and the instant lottery’s terms and conditions (rule 13B(2)).
• Voiding of tickets. A ticket may be declared void for listed defects (rule 6) or at the Commission’s discretion for damage or other defects (rule 7). A void determination removes eligibility to claim a prize. Where a ticket drawn or selected for a second stage prize is void or ineligible, the rules require drawing or selecting another ticket (rule 12(2)).
• Substitution. The only express monetary remedy for a void ticket is the substitution of a valid ticket (rule 8). The rules do not provide for compensation beyond substitution.

Final administrative determination

• Finality clause. Rule 18 expressly states that a decision or determination by the Commission in relation to an instant lottery is "final and binding" on holders of tickets and other persons claiming prizes. Operationally, this internal finality reduces the scope of remedial redress within the scheme and signals that disputes will be resolved administratively by the Commission unless external legal avenues are pursued.

Procedural verification measures supporting enforcement

• Validation periods and identity checks. For instant prizes of $5,000 or more, a validation period applies after claim (rule 2). The Commission may require claimants to provide identity evidence and bank account details as a condition of claiming (rule 9). These measures create detection opportunities for fraud and support enforcement of eligibility rules.
• Statutory declarations. The Commission can require statutory declarations that the claimant has not acted contrary to the Act or the rules (rule 17(2)). Refusal to provide the declaration is a ground for refusal to pay (rule 17(3)).
• Computer linked terminals. Agents may use terminals linked to central Commission processing to verify paid status and detect double payments or duplicate claims (rule 2 definition; rule 9A(4)).

What the rules do not prescribe

• No criminal penalties within the rules. The instrument does not create or specify criminal offences or financial penalties to be imposed under these rules for conduct such as fraud, counterfeiting, or theft; it lists outcomes such as voiding and forfeiture but not statutory fines or prosecutions. Any criminal enforcement would rely on other statutory provisions outside the instrument.
• No administrative monetary penalties. There are no express financial penalties or administrative fines set out in the rules for agents or players who breach the rules; the remedies are practical and administrative (void, refuse to pay, forfeiture, substitution).
• Limited scope for damages. The remedy for a void ticket is substitution (rule 8). There is no provision for broader compensation or damages within these rules.

Practical implications for enforcement

• Enforcement is operationally performed by the Commission and agents using ticket checking, terminal verification, statutory declarations and choice not to disclose prize pool information (rules 4, 9A, 17, 16A). The Commission’s finality clause concentrates adjudicative power and reduces scope for internal appeal. Where fraud, theft or counterfeiting is suspected, external criminal laws would likely be invoked, but such measures are outside the rules’ text.

In short, the rules rely on administrative determination, verification procedures and forfeiture/substitution as the primary enforcement tools, and do not themselves impose statutory penalties or detail criminal enforcement mechanisms.

These rules operate as subordinate rules under the Lotteries Commission Act 1990 and explicitly reference at least one other statutory regime. The instrument’s interactions with other laws are limited to the references contained in the text and the compilation table.

Primary statutory relationship

• Lotteries Commission Act 1990. These are the Lotteries Commission (Instant Lottery) Rules made under the Lotteries Commission Act 1990. The rules apply "in relation to all instant lotteries conducted by the Commission" subject to the Act (rule 3(1)). The Act supplies enabling authority and the overall statutory scheme in which these rules operate; any substantive legal rights beyond the rules will derive from the Act and other general law.

Cross‑reference to Gaming and Wagering administrative supervision

• Gaming and Wagering Commission Act 1987. Rule 10 requires that draws or selections of a potential winning ticket in the second stage must be supervised by "an officer from the department of the Public Service principally assisting in the administration of the Gaming and Wagering Commission Act 1987" unless the Commission decides alternative supervision is adequate. This cross‑reference brings departmental oversight from the administrative apparatus associated with the Gaming and Wagering Commission Act into the draw supervision regime and creates an institutional overlap for supervision.

Administrative and statutory instruments and permits

• Permits for instant lotteries. Rule 13B(1)(b) refers to the permit for an instant lottery permitting conversion of non‑monetary prizes to a monetary equivalent if the permit specifies conversion. Permits are therefore a separate regulatory document interacting with these rules and determine specific lottery terms such as conversion rights.
• Reprints Act and compilation history. The Notes and compilation table identify amendments and reprints and show that certain provisions (items 19 and 20) were omitted under the Reprints Act 1984 s.7(4)(f) and s.7(4)(e) respectively. This signals the technical interaction of the rules with reprint and compilation procedures under Western Australian legislative housekeeping statutes.

Privacy, consumer protection and criminal laws (external interaction)

• Data collection obligations and privacy. The rules require collection of name, address, identity evidence and bank account details for validation and payment (rule 2, rule 9, rule 17). These obligations interact with external privacy laws and data protection obligations (not set out in the rules). The rules do not specify privacy safeguards or data retention standards; operational compliance with privacy frameworks will fall to the Commission and agents under separate law.
• Criminal law and counterfeiting. Rule 6 explicitly lists counterfeit tickets, theft, and reconstitution as grounds for a ticket being void. While the rules treat these as causes for administrative voiding, criminal offences for theft or counterfeiting would exist under general criminal law and are not created by these rules.

Emergency period and public health measures

• Emergency period definitions and COVID‑era changes. The instrument contains COVID‑era rules (9AAA, 13A) and modified payout period definitions tied to closure days occurring during an "emergency period". The compilation table indicates these were added under SL 2020/52 , the rules therefore interact with any statutory declaration or instrument that establishes the emergency period in Western Australia and with the broader legal structure for emergency powers. The rules condition alternative claiming procedures on the Commission being satisfied of emergency circumstances (rules 9AAA(2), 13A(2)).

Judicial review and external legal remedies

• Finality clause and judicial review. Rule 18 makes Commission decisions "final and binding" as to the instant lottery. That is an internal finality. It does not, in the text of the rules, extinguish external avenues such as judicial review on public law grounds or contractual or tort claims in the courts under other legislation. The instrument does not comment on judicial oversight, and any interaction with courts will be governed by the general law and the enabling Act.

In summary, these rules are designed to operate within a wider statutory and administrative matrix: the Lotteries Commission Act 1990 provides authority; permit conditions and the Gaming and Wagering Commission Act 1987 supply supervision and lottery‑specific conditions; privacy, criminal and emergency laws interact operationally but are external to the rules. Practitioners should read the rules alongside the enabling Act, the relevant permits for particular instant lotteries, any declared emergency instruments and the general law areas that govern data, criminal conduct and administrative law.

The rules include a compilation table documenting the original instrument and subsequent amendments up to and including COVID‑era amendments. The compilation table is part of the instrument and records the provenance and commencement dates of amendments. The key entries and their mechanical effects are:

Original instrument

• Lotteries Commission (Instant Lottery) Rules 1996: Gazetted 23 July 1996, commenced 23 July 1996. These established the base regulatory framework for instant lotteries.

Subsequent amendments recorded in the compilation table

• 1998 amendment: Lotteries Commission (Instant Lottery) Amendment Rules 1998, Gazette 20 March 1998, commencement 29 March 1998 (see rule 2). This suggests an early amendment but details are not specified in the text extract other than the compilation entry.
• 2000 amendment: Lotteries Commission (Instant Lottery) Amendment Rules 2000, Gazette 21 July 2000, commenced 21 July 2000. The compilation table records this and a Reprint as at 10 Oct 2003 incorporating the above changes.
• 2019/2020 amendments: Lotteries Commission (Instant Lottery) Amendment Rules 2019, Gazette 7 Jan 2020 (rules other than r.1 and r.2 commenced 8 Jan 2020). These amendments introduced, among other changes, rules numbered and amended in the body (for example the addition of rule 4A, rule 5A, and expanded definitions) as indicated by marginal amendment notes in the rules (see e.g. rules 4A, 5A and multiple amendment notes citing Gazette 7 Jan 2020 p. 11-14).
• 2020 COVID response: Lotteries Commission Rules Amendment (COVID‑19 Response) Rules 2020 Pt. 3, SL 2020/52, gazetted 5 May 2020, commenced 6 May 2020. These are the legislative vehicle that inserted COVID‑era contingency provisions (rules 9AAA, 13A) and amended the payout period definition to expand the payout period for closure days in the emergency period (see amendment notes and inserted rules 9AAA and 13A).

Textual amendment notes in the rules show specific provisions amended with Gazette dates. For example:

• Rule 2 (definitions) shows amendments: Gazette 20 Mar 1998 p. 1533; 7 Jan 2020 p. 11; SL 2020/52 r. 8.
• Rule 4 was amended as noted by Gazette 7 Jan 2020 p. 11 and SL 2020/52 r. 9.
• Rules 6 and 7 also show amendments with Gazette 7 Jan 2020 and SL 2020/52 references for 2020 changes (rule 6 amended Gazette 7 Jan 2020 p. 12; SL 2020/52 r. 10).
• Rules 9, 9A, 13, 13B and others were inserted or amended by SL 2020/52 r. 12-13, which corresponds to the COVID response rules.

Reprint housekeeping

• The Notes show that Reprint 1 compiled the instrument "as at 10 Oct 2003" including the 1998 and 2000 amendments.
• Items 19 and 20 are omitted under the Reprints Act 1984 s. 7(4)(f) and s. 7(4)(e) respectively, a technical matter indicating certain provisions were omitted in the reprint process in accordance with the Reprints Act.

Practical takeaway from the amendment history

• The instrument has been periodically updated to accommodate administrative and technological change: the 2019/2020 amendments introduced digital entry features (ticket identification number, digital entry rules) and additional administrative mechanics (rule 5A allowing nomination of a date to cease issue of tickets to agents), while the 2020 COVID‑response amendments created emergency‑period claiming options and extended payout periods tied to closure days in the emergency.
• The COVID‑era changes were implemented by way of a separate instrument (SL 2020/52) in May 2020 and are integrated into these rules by reference and textual insertion.
• Practitioners should consult the cited Gazette and SL entries for precise amendment drafting history, and check the Lotterywest website for the current consolidated text as required by rule 15(1).

The compilation table and in‑rule amendment notes provide the statutory trail and show that the Commission’s instant lottery rules have evolved to address digital entry, online processes, and emergency contingencies.

The text of the Lotteries Commission (Instant Lottery) Rules 1996, as provided here, contains no case citations and records no litigation history. The instrument itself makes several statements relevant to dispute resolution and administrative finality but does not catalogue judicial proceedings. Specifically:

• Finality of Commission decisions. Rule 18 declares that "a decision or determination by the Commission in relation to an instant lottery is final and binding upon the holders of tickets, and any other persons claiming prizes, in respect of the lottery." This is an internal finality provision which signals that disputes are to be resolved administratively by the Commission. The rules do not themselves remove or address external judicial remedies such as judicial review or private law causes of action; they merely state a contractual/administrative finality within the scheme.
• No litigation record in this instrument. There are no sections that provide historical litigation outcomes, case references, or examples of how the rules have been applied in court. The compilation table and notes provide legislative history but not judicial history.
• Potential avenues outside the rules. Because the instrument contains administrative determinations and actions (voiding tickets, refusing payment, requiring statutory declarations), affected parties might seek remedies outside the instrument under general law: judicial review of administrative action, contract or tort claims, or criminal prosecutions where theft, counterfeiting or fraud is alleged. The rules do not discuss or limit such external remedies; they do not include an ouster of courts or a privative clause beyond internal finality. Any such litigation would be governed by principles of public and private law, not by material contained in the rules.

Risk areas that could generate litigation (identified from the text)

• Void and discretionary determinations. Rule 7 permits the Commission to void tickets at its discretion if damaged or defective. Disagreement over facts or application of that discretion could generate disputes if a claimant alleges wrongful or unreasonable voiding, particularly as the statutory remedy for a void ticket is limited (rule 8).
• Claims handling and validation. The validation period for instant prizes of $5,000 or more (rule 2) and the Commission’s ability to require statutory declarations (rule 17) could give rise to disputes over timing, sufficiency of evidence and delay in payment.
• Information asymmetry and sale of exhausted lots. Rule 5 permits continued sale of tickets from a lot even if all prizes have been won, and rule 16A allows the Commission to refuse to disclose whether prizes remain. These rules could produce consumer complaints or class claims where purchasers allege misleading conduct under consumer protection legislation, though any such claim would lie outside the instant lottery rules.
• Digital entry and verification. The digital entry regime (rule 9AA) coupled with subsequent physical verification requirements (rule 12(1A)) creates potential for disputes where a ticket was digitally entered successfully but later found void. Questions may arise over whether digital entry conferred a de facto right to the second stage entry prior to physical verification.

What the rules show about litigation likelihood

• The rules centralise administrative adjudication and provide procedural steps for verification, which may decrease the frequency of litigation by resolving disputes administratively. The Commission’s finality clause indicates a legislative intent to make the Commission the final arbiter of contestable matters within the scheme.
• The rules also leave several areas open to external legal challenge because they do not (and cannot) override general laws on administrative review, consumer protection, criminal matters or data privacy. The absence of express privative clauses or complete ouster of judicial review in the text suggests litigation remains a theoretical possibility, but the instrument itself records no litigation history.

Practitioners should therefore treat the rules as setting administrative procedural expectations while recognising that external remedies could be engaged in particular fact patterns, even though none are recorded in the instrument text.

This section highlights operational traps and practical risks that arise directly from the text of the rules. Each "gotcha" references the specific rule and explains the mechanism by which risk or compliance difficulty arises.

1. Continued sale of tickets after prizes exhausted (rule 5) combined with no obligation to disclose prize status (rule 16A)

   • Mechanism: Rule 5 permits selling tickets from a lot even if "all the instant prizes (including the top prize) for that lot of tickets have already been won or claimed." Rule 16A explicitly states the Commission has no obligation to release information about whether prizes remain.
   • Practical risk: Consumers may purchase tickets believing prizes remain. Agents may continue selling without obligation to advise. This creates information asymmetry and reputational risk. Compliance teams should consider disclosure practices even if not mandated.

2. Ticket voiding discretion and limited remedy (rules 6, 7, 8)

   • Mechanism: Some defects render tickets void automatically (rule 6). Other defects allow the Commission to void at its discretion (rule 7). The remedy for a void ticket is limited to substitution of a valid ticket (rule 8).
   • Practical risk: Holders whose tickets are declared void may have limited recourse and no express statutory right to compensation beyond substitution. The Commission’s discretion under rule 7 can be broad; claimants should preserve tickets and evidence of how damage occurred.

3. Digital entry does not obviate later physical verification (rules 9AA, 12(1A))

   • Mechanism: A ticket can be digitally entered by providing the ticket identification number (rule 9AA). But if a digitally entered ticket is drawn, the holder must still provide the physical ticket in the manner notified (rule 12(1A)).
   • Practical risk: Reliance on digital proof alone is insufficient. If a ticket ID is captured but the physical ticket is lost or damaged, the claimant may be ineligible. Ticket holders should retain tickets intact after digital entry until verification is complete.

4. Complexity of payout and validation windows (rule 2, rule 9A)

   • Mechanism: The payout period varies depending on the closure day and emergency periods; special transitional dates apply for closure days between specified dates (rule 2). Validation periods for prizes ≥ $5,000 run from midnight on the day the prize is claimed until 5 pm 14 days later (rule 2).
   • Practical risk: Miscalculating deadlines can forfeit claims. Claimants and agents must track closure dates and whether an emergency period applies. The Commission may also exercise discretion to pay before validation ends (rule 9A(2)), adding variability.

5. Statutory declarations may be required and refusal can block payment (rule 17)

   • Mechanism: The Commission may require statutory declarations of identity and compliance; refusal or failure to provide may lead to refusal to pay (rule 17).
   • Practical risk: Claimants who refuse to make statutory declarations for privacy or other reasons risk non‑payment. Organisations assisting claimants should anticipate statutory declaration requirements.

6. Payment prevention by terminal marking or "paid" marking (rule 9A(4))

   • Mechanism: If a ticket has been marked "paid" or identified by a computer linked terminal as paid, the Commission or agent must not pay the instant prize (rule 9A(4)).
   • Practical risk: Human or system errors in marking could block legitimate payment. Agents must use care with terminal operations and record corrections promptly with the Commission.

7. Name and address and signature requirements for second stage eligibility (rule 11)

   • Mechanism: Tickets lacking the clearly printed name and address, or signature, are ineligible for second stage prizes (rule 11).
   • Practical risk: Casual purchasers may not realise they must sign and provide address to be eligible for second stage prizes. Agents and the Commission should consider client education and ticket design to reduce inadvertent ineligibility.

8. Commission decisions are final and binding (rule 18)

   • Mechanism: Rule 18 states decisions by the Commission are "final and binding" upon ticket holders and claimants.
   • Practical risk: While external remedies likely remain, litigating against a declared Commission decision may face procedural obstacles and higher transaction costs. Parties should seek early engagement with the Commission to resolve disputes administratively.

9. Conversion of non‑monetary prizes depends on permit wording (rule 13B(1)(b))

   • Mechanism: Non‑monetary second stage prizes "may be converted into a monetary prize... if the conversion is specified in the permit for the instant lottery" (rule 13B(1)(b)).
   • Practical risk: Where the permit does not provide for conversion, winners of non‑monetary prizes may be unable to obtain a cash equivalent. Lawyers and accountants advising prize designers must ensure permit drafting addresses conversion and valuation.

10. Emergency period discretion and threshold for alternate claiming (rules 9AAA, 13A)

    • Mechanism: During the emergency period, the Commission may accept copies or images of tickets if it is satisfied that presenting the physical ticket is not reasonably practicable (rules 9AAA(2), 13A(2)).
    • Practical risk: The Commission’s satisfaction is a threshold determination, not an automatic entitlement. Claimants should not assume alternate claiming will be accepted and should obtain Commission confirmation.

These "gotchas" highlight the interaction between administrative discretion, claimant evidentiary obligations, and limited remedial rights. For agents, retailers and compliance teams, the core mitigation steps are robust ticket retention policies, clear consumer-facing instructions on signature/name/address requirements, careful operation of terminals and recordkeeping, and early engagement with the Commission when tickets are damaged, lost or disputed.

This section sets out practical, source‑grounded compliance steps for the Commission, agents (retailers), and ticket holders, derived directly from the rules and designed to reduce dispute risk.

For the Commission

• Publish and maintain the rules online. Rule 15(1) mandates keeping and maintaining a copy of these rules on the Lotterywest website. Ensure the website contains the current consolidated text, amendment history and operational guidance.
• Set and publicise digital entry processes. Implement ticket identification number issuance (rule 4A) and ensure the Lotterywest website supports the digital entry process in accordance with rule 9AA. Provide clear instruction on how ticket identification numbers are recorded and how digital entry is acknowledged.
• Define and publicise payout, closure and validation periods. Record closure days and ensure payout periods are calculated correctly in line with rule 2, including special extensions tied to the emergency period. Publish guidance for claimants on how to calculate the payout window.
• Maintain secure verification systems and clear terminal processes. Ensure computer linked terminals reliably record payment status to prevent double payment as required by rule 9A(4). Maintain logs and audit trails for terminal transactions.
• Provide clear instructions for digital entrants about later production of the physical ticket. Under rule 12(1A) a digitally entered ticket must later be produced if it is drawn. Publish the manner and deadlines for physical submission and make this explicit at the time of digital entry.
• Train staff on voiding criteria and discretionary determinations. Apply the specific automatic void criteria of rule 6 consistently and document discretionary voiding decisions under rule 7 with reasons. Maintain processes for substitution (rule 8) and for replacing void drawn tickets (rule 12(2)).
• Operationalise emergency claiming procedures. Create templates and approval processes for accepting copies or images of tickets and statutory statement forms for emergency claims (rules 9AAA, 13A). Implement criteria to exercise the Commission’s satisfaction threshold consistently.
• Manage publication preferences and disclosure policy. Implement opt‑out mechanisms for winners who do not wish publication under rule 16 and document decisions not to disclose information under rule 16A.

For agents / retailers

• Use computer linked terminals correctly. Before paying prizes, verify with the terminal that a ticket has not been marked "paid" and follow Commission protocol for terminal error correction (rule 9A(4)). Keep operational procedures for terminal outages.
• Preserve ticket integrity at point of sale. Do not remove opaque coverings or separate detachable parts that are intended to be part of original tickets except as permitted by ticket design. Advise customers of signature/name/address requirements to protect second stage eligibility (rule 11).
• Ensure accurate recording and stamping of "paid" status. When paying instant prizes, mark tickets "paid" according to Commission instructions to prevent duplicate claims (rule 9A(4)).
• Comply with Commission directions on ticket issue and stock handling. Follow any Commission directions regarding cessation of ticket issue to agents on nominated dates (rule 5A) and retain records of distribution.
• Train front‑line staff on void grounds and claimant requirements. Agents should know the automatic void criteria (rule 6) and be prepared to forward high value claims to the Commission.

For players / claimants

• Retain physical tickets intact. Keep the ticket whole, retain the opaque covering if the ticket design contemplates it, and do not reconstitute or join parts of multiple tickets (rule 6(g), rule 7). For digitally entered tickets, retain the ticket until physical verification if drawn (rule 12(1A)).
• Sign and complete name and address for second stage eligibility. Write the surname, initials and residential address and postcode and sign the ticket in the space provided to preserve second stage eligibility (rule 11; rule 2 definition of name and address).
• Be prompt and calculate the payout period correctly. Claim prizes within the payout period defined by rule 2. Account for special emergency period extensions where applicable.
• Prepare identity and banking evidence for high value claims. For instant prizes of $5,000 or more, be ready to provide identity evidence and bank account details and understand the validation period timing (rule 2; rule 9).
• Comply with statutory declaration requirements where requested. If required by the Commission, complete statutory declarations confirming identity and compliance with the Act and rules (rule 17). Refusal may result in non‑payment (rule 17(3)).
• Understand digital entry limitations. If you use digital entry (rule 9AA), record and preserve the ticket identification number and be prepared to produce the physical ticket if the ticket is drawn (rule 12(1A)).

Recordkeeping and audit

• Keep records sufficient to reconstruct ticket issuance, sale and claim flows. For agents and the Commission, maintain sales logs, terminal verification logs, digital entry records (ticket identification numbers and timestamps) and statutory declaration files for a period consistent with other regulatory and archival obligations. The rules themselves do not specify retention periods, but records support compliance with payout and validation timelines and defend against claims.

Privacy and data protection

• Treat identity and bank details as personal information. The rules require collection of name, address, identity evidence and bank details (rules 2, 9, 17). Ensure compliance with applicable privacy laws in collecting, storing and disclosing such information, even though privacy safeguards are not specified in the rules.

Dispute handling

• Establish internal complaint and review channels. Given rule 18’s finality clause for Commission determinations, provide a clear and documented internal process for promptly handling disputes and appeals to the Commission, with records of decision rationales to reduce escalation to external remedies.

Testing and controls

• Test digital entry and terminal systems for reliability and reconciliation. Run periodic reconciliation exercises to ensure ticket identification numbers, digital entries and terminal payments reconcile against physical tickets and sales records.

By operationalising these steps, the Commission, agents and claimants reduce the risk of disputes, ensure compliance with the rules’ evidence and timing requirements, and protect against double payments, fraud and inadvertent forfeiture. Where the rules leave open discretion (voiding, emergency acceptance), document decision‑making to demonstrate consistency and good governance.
