Lotteries Act 2019

The Act pivots on a small set of statutory definitions and administrative mechanisms which structure rights, duties and regulatory discretion.

Definitions and categories

• Lottery: The statutory definition is a two-limb test. A lottery includes any scheme, competition, game or device for distributing property where entitlement to participate depends on payment or other valuable consideration and the distribution depends on an element of chance at any stage, even where skill is involved (s 6(1)(a)). It expressly covers trade promotion lotteries (s 6(1)(b)) and a residual class the regulations may prescribe (s 6(1)(c)). Some allotments and fair-apportionment distributions are excluded (s 6(2)).
• Trade promotion lottery: Defined in s 4 and captured within the main definition, with particular limits on free entry and caps on electronic or postal entry costs as prescribed by regulation (s 4 trade promotion lottery definition).
• Permitted lottery: Either a class declared by regulation as permitted without licence, or a lottery authorised under another South Australian Act (s 4).
• Licensed lottery: A lottery authorised under Part 3 (s 4).

Regulatory architecture

• Commissioner-centred administration: The Commissioner, defined by reference to the Gambling Administration Act 2019 (s 4; see s 5), is the primary decision-maker for licences, exemptions, prohibition notices, conditions and enforcement mechanisms (e.g. ss 15-17, 16(2), 7, 29).
• Licensing dual-track: Part 3 governs licences to conduct lotteries; Part 4 creates licences for suppliers of prescribed "lottery products" who sell or supply products for resale (ss 22-26).
• Exemptions and permitted lotteries: Regulations can declare classes of lotteries to be permitted (s 33(2)(a)), and the Commissioner can grant exemptions for specific lotteries or classes (s 29). These are the two main gateways for fundraising activities to avoid full licensing.
• Prohibited prizes: The Commissioner may prohibit specified goods or services from being prizes or inducements via Gazette notice, and may vary or revoke such notices (s 7).
• Regulation-making scope: Very broad, including prescribing classes of permitted lotteries, limiting lotteries for which licences may be granted, prescribing conditions and licence fees, and fixing fees by reference to percentages of proceeds or prize value (s 33(2), s 33(4)).

Enforcement and remedies

• Criminal offences: The Act criminalises conduct of and participation in unlawful lotteries, advertising, producing tickets, supplying tickets, and certain licence-condition failures, with specified maximum fines and expiation fees (Part 2; Parts 3-4).
• Dishonest conduct: Separate high-penalty offence for dishonest, deceptive or misleading conduct in connection with a lottery (s 30, up to $50,000 or 2 years imprisonment).
• Evidentiary aids: The Act eases proof in prosecutions by allowing allegations about licence status to be accepted unless rebutted and permitting secondary evidence for out-of-state conduct (s 32).

Structural points that affect interpretation

• Extraterritorial reach: The Act applies where persons resident in South Australia can participate, even if the scheme is conducted outside the State (s 9(1)). That raises compliance considerations for operators who sell tickets or run competitions with entrants in SA from other jurisdictions.
• Interaction with other gambling law: The Act is to be read together with the Gambling Administration Act 2019 (s 5), and Schedule 1 amends the older Lottery and Gaming Act 1936 by repealing many lottery-related provisions and migrating licences and inspectors under the new framework.
• Defences and procedural matters: There is an express "reasonable belief" defence if a defendant believed on reasonable grounds the lottery was licensed or permitted (s 14). For some licence-condition offences, there is an express defence where the defendant proves they took all reasonable steps to prevent contravention (ss 16(4), 29(10)).

These concepts fix the perimeter of regulated activity and indicate where regulatory discretion and subordinate rules will most influence outcomes: what counts as permitted lotteries under regulation, the scope of prohibited prizes, fee design and conditions attached to licences, and the exercise of the Commissioner’s gating functions when assessing fit and proper persons or suspending licences (ss 7, 15, 16, 29, 33).

The Act creates obligations and potential liabilities for a range of actors; the primary categories are:

• Conductors of lotteries and prospective organisers: Any natural person or entity proposing to run a lottery that would otherwise fall outside a permitted class must engage with the licensing regime in Part 3 and secure a licence from the Commissioner (s 15). The Commissioner may refuse on fitness grounds, regulatory conditions, inconsistency with the objects, or any other reasonable ground (s 15(3)). Organisers must notify changes in prescribed particulars within 14 days (s 21(1)) and comply with licence conditions (s 16).

• Participants and purchasers: Individuals who participate in unlawful lotteries are criminalised (s 11(1)) and purchasing a ticket is specifically treated as participation (s 11(2)). The Act therefore affects consumer behaviour by making participation in unlicensed schemes an offence with a fine and expiation fee.

• Suppliers and businesses that sell lottery products: Part 4 requires businesses that supply prescribed "lottery products" for resale to hold a supplier licence (s 23). The Act criminalises carrying on that business without a licence (s 23(1)). Regulations define lottery products (s 22) and may exempt classes of suppliers (s 23(2)).

• Unincorporated organisations and fundraising groups: The Act addresses unincorporated organisers by requiring nomination of a responsible person for compliance with the licence (s 17), with the nominee needing Commissioner approval (s 17(2)). Transitional provisions preserve licences from the former Act for such groups (Schedule 1, cl 14).

• Trustees, directors, shareholders and beneficiaries: The statutory "position of authority" captures directors, people who exercise control or substantial influence, managers, shareholders of proprietary companies, trustees and beneficiaries (s 8(1)). Exceptions apply to minors and charitable organisations as beneficiaries (s 8(2)). This definition is used when assessing relevant persons in licence applications and fitness (s 15(5), s 24(5)).

• Children and their supervisors: Sale of lottery tickets by children under 15 is restricted; permitting a child under 15 to sell tickets without adult supervision is an offence (s 31). This imposes obligations on schools, clubs and retailers who use child volunteers.

• The Commissioner and relevant administrative staff: The Commissioner is given a central role in licensing, exemptions, rule-making by regulation, prohibition notices about prizes, and enforcement (ss 7, 15, 16, 20, 29, 33). The Gambling Administration Act 2019 contains the definition of Commissioner referenced by this Act (s 4 and s 5). The Commissioner’s decisions will shape who can lawfully run lotteries and on what terms.

• The Crown and public authorities: The Act binds the Crown in right of South Australia but does not subject the Crown to prosecution (s 9(2)-(3)). That means public entities may be subject to regulatory requirements, but criminal prosecution of the Crown itself is excluded.

Practical groups most affected include charitable and community fundraising organisations, commercial trade promoters, businesses supplying lottery ticket stock or other lottery products, and national or interstate operators who make their schemes accessible to South Australian residents. The combination of licensing for organisers and for suppliers means both the market for fundraising and the upstream supply chain are regulated, which influences who bears compliance costs: organisers need to secure licences and comply with conditions, while suppliers must either obtain supplier licences or rely on regulatory exemptions (ss 15, 23, 26).

The Act’s extraterritorial effect (s 9(1)) extends compliance obligations to operators outside the State if South Australian residents can participate. That may require interstate or overseas operators to engage with the Commissioner or to ensure SA residents are excluded, depending on business choices and regulatory risk appetite.

The Act imposes specific duties on licence-holders, suppliers, organisers, and persons involved in lotteries, and it confers regulatory rights to the Commissioner and to participants (limitedly). Key duties and rights, with statutory references, are:

Duties on organisers and licensees

• Licensing requirement: Conducting a lottery that is not a permitted lottery requires a licence under Part 3 (s 15 read with s 4 definition of licensed and permitted lotteries).
• Fit and proper obligations: Applicants and "relevant persons" (applicant, people in positions of authority, or nominated persons) must be fit and proper; the Commissioner may refuse on fitness grounds (s 15(3)(a), s 15(5); s 24(3), s 24(5)).
• Compliance with licence conditions: Licences can be subject to prescribed and discretionary conditions (s 16(1)). Contravention of a licence condition is an offence with penalties and an opportunity for a reasonable-steps defence in prosecutions (s 16(3)-(4)).
• Notification obligations: Licensees must notify the Commissioner of changes in prescribed particulars within 14 days (s 21(1)). Supplier licences have the same timeframe (s 28(1)).
• Directions on winding up and financial matters: On suspension, cancellation or surrender the Commissioner may direct winding up of a lottery, provision of financial statements, payment of fees or other matters; failing to comply is an offence (s 20(4)-(6)).

Duties on suppliers and retailers

• Supplier licensing: Businesses supplying prescribed lottery products for resale must be licensed under Part 4 (s 23(1)). Exemptions may be prescribed by regulation (s 23(2)).
• Licence renewal: Supplier licences run until the following 30 June but must be renewed, with the Commissioner required to renew for not less than one year when appropriate and fees paid (s 26(1)-(2)).

Duties on the public and participants

• Prohibition on unlawful lotteries: It is an offence to conduct, assist, advertise or participate in an unlawful lottery (ss 10-13). Participation includes purchasing a ticket or otherwise obtaining a chance (s 11(2)).
• Restrictions on children: No person may permit a child under 15 to sell tickets unless supervised (s 31).

Commissioner’s powers (rights to act)

• Grant/refuse licences and impose conditions: The Commissioner may grant licences, impose conditions and add or vary conditions by notice (ss 15-16).
• Suspend or cancel licences: The Commissioner can suspend or cancel licences for improper grant, non-compliance, financial unviability or winding up of an association, with directions for wrap-up and compliance (s 20).
• Grant exemptions and vary or revoke exemptions: The Commissioner can grant exemptions on application or on initiative, subject to conditions and later variation or revocation (s 29).
• Prohibit goods/services as prizes: The Commissioner may issue Gazette notices prohibiting specified goods or services as prizes or inducements (s 7).
• Regulation proposals: While regulations are made by the Governor, the Act contemplates the Commissioner determining forms, manner and content of applications and may be given delegable discretions noted in the regulations (ss 15(1), 24(1), 29(2); s 33(2)(c),(e),(g),(i),(k)).

Rights and defences

• Reasonable belief defence: It is a defence to an offence under Part 2 if the defendant proves they believed on reasonable grounds the lottery was licensed or permitted (s 14).
• Reasonable steps defence for licence-condition offences: For contravention of a licence condition or exemption condition the defendant can rely on proving they took all reasonable steps to prevent the contravention (ss 16(4), 29(10)).
• Procedural protections absent: The Act does not codify detailed rights of review or merits appeal within the body of the text; rights of review would typically arise from administrative law remedies or from the Gambling Administration Act 2019 framework referenced in s 5.

Prescribed matters and regulatory delegation

• Many obligations and details are left to the regulations, including classes of permitted lotteries, fee schemes (which can be percentage-based on money paid or prize value), exemptions from fees, prescribed particulars to be notified, and rules for conduct of lotteries (s 33(2), s 33(4)). That creates a two-tier compliance landscape: statutory duties with regulatory specifics to be set later.

Those duties shift compliance costs onto organisers, suppliers and nominated persons in unincorporated groups. Rights of participants are essentially negative protections from misconduct (criminalisation of dishonest conduct s 30 and offences for false advertising s 12) and the general object of maintaining fair, transparent conduct (s 3). Administrative discretion lies with the Commissioner, who controls entry, continuing authorisation and remedial directions.

The Act creates a graded enforcement regime with fines, expiation fees, and an imprisonment option for serious dishonest conduct. Enforcement mechanisms combine statutory offences, evidentiary presumptions and administrative powers.

Key offences and prescribed penalties

• Conducting or assisting in an unlawful lottery: Maximum penalty $10,000 (s 10(1)). Agreement to pay money or provide goods/services in connection with an unlawful lottery: maximum $5,000, expiation fee $315 (s 10(2)).
• Participating in an unlawful lottery: Maximum penalty $2,500, expiation fee $210 (s 11(1)). Participation is explicitly defined to capture purchase of tickets, chances or shares (s 11(2)).
• Advertising/promoting unlawful lotteries: Maximum penalty $5,000, expiation fee $315 (s 12(1)). The Act defines "advertise" broadly to include publicising or encouraging participation (s 12(2)).
• Printing or publishing tickets for unlawful lotteries: Maximum penalty $5,000, expiation fee $315 (s 13(1)). Sale or supply of tickets: same maxima and expiation (s 13(2)).
• Contravening licence conditions: For licence-condition offences under Part 3 the maximum penalty is $5,000, expiation fee $315, with a defence available if reasonable steps were taken (s 16(3)-(4)). Supplier licence condition contravention also carries up to $5,000 and expiation $315 (s 25(3)).
• Suppliers carrying on business without licence: Maximum penalty $10,000 (s 23(1)).
• Failure to notify change of particulars: For licensees, maximum $2,500 and expiation $210 (s 21(1)); for supplier licensees same penalty and fee (s 28(1)).
• Failure to comply with Commissioner directions after surrender/cancellation/suspension: Maximum $2,500 and expiation $210 (s 20(5)-(6)).
• Restriction on child sellers: Maximum $5,000 and expiation $315 where a child under 15 sells tickets unsupervised (s 31).
• Dishonest, deceptive or misleading conduct: Maximum penalty $50,000 or 2 years imprisonment (s 30).

Expiation framework

• The Act provides specific expiation fees for numerous offences (s 10(2), s 11, s 12, s 13, s 16(3), s 25(3), s 31, s 20(5)-(6), s 21(1), s 28(1)). The regulations may also set expiation fees up to $750 for regulatory contraventions (s 33(2)(k)).

Enforcement powers and administrative remedies

• Commissioner decision-making: The Commissioner can cancel, suspend, impose conditions, accept surrender, and give directions relating to winding up, return of funds or financial statements (s 20). Suspension renders the licence holder unlicensed during the suspension period (s 20(7)).
• Exemptions and variations: Exemptions and licence conditions can be varied or revoked by the Commissioner, including by Gazette notice where the exemption pertains to a class (s 29(6)-(8)). Prohibition notices for prizes are Gazette notices (s 7(1)-(2)).
• Evidentiary aids to prosecution: The Act permits allegations about licence status, whether a lottery was licensed or permitted, or whether licences were subject to conditions, to be accepted as proved in the absence of contrary proof (s 32(1)). For out-of-state lotteries, the court may receive secondary evidence (s 32(2)). Those evidentiary devices make enforcement administratively easier.

Enforcement implications and burdens

• The structure creates both criminal and administrative levers. Criminal penalties and expiation fees provide quick enforcement options, whereas suspension, cancellation and directions give administrative remedies to control licensed conduct and to address non-compliant winding-up by associations.
• The highest statutory sanction is for dishonest or misleading conduct (s 30), which carries an imprisonment term and therefore could be the focus of serious criminal enforcement in cases of fraud or misrepresentation.
• The Commissioner’s broad powers to impose and later vary conditions, revoke exemptions and prohibit prizes inject uncertainty for operators; non-compliance with directions can produce further offences (s 20(5)-(6)).

Practical enforcement risk areas

• Advertising and online promotion are explicitly covered (s 12(2), s 13(3) definition of publish), which creates exposure for digital marketing that targets South Australian residents.
• Supplier businesses that distribute pre-printed tickets or other prescribed lottery products are exposed to criminal penalties if unlicensed (s 23(1)).
• The Act’s extraterritorial reach and evidentiary provisions make it practicable to pursue operators outside SA where SA residents can participate (s 9(1), s 32(2)).

In sum, enforcement combines criminal sanctions and administrative controls with statutory defences that allow for reasonableness-based mitigation. The Commissioner’s administrative machinery and the regulation-making powers will determine the intensity and form of enforcement in practice.

The Act expressly situates itself within the broader regulatory architecture for gambling in South Australia and removes overlapping or redundant provisions from older legislation.

Interaction with the Gambling Administration Act 2019

• Section 5 requires this Act and the Gambling Administration Act 2019 to be read together as a single Act where relevant, and references to "this Act" are taken to include the Gambling Administration Act 2019. The Commissioner is defined by reference to that Act (s 4). Practically, licensing processes, administrative powers, officer appointments and inspector roles may be governed or supplemented by the Gambling Administration Act 2019.

Amendments to Lottery and Gaming Act 1936

• Schedule 1 makes specific changes to the Lottery and Gaming Act 1936, deleting or amending many lottery-related provisions (cls 2-11 of Schedule 1). Clauses 6 and following repeal Parts 2, 2A, 3 and 4 of the old Act, and transitional provisions carry over licences and inspectors to the new system (Schedule 1, cls 6, 13-15). This indicates the 2019 Act is intended to replace the old legislative framework for lotteries while converting certain institutions and licences into the new regime.

Overlap and exclusion

• The definition of permitted lottery includes a lottery authorised under another Act or law of the State (s 4). That creates a carve-out where other statute-based authorisations govern particular lotteries; operators should check sectoral Acts for specific authorisations that avoid the Part 3 licensing requirement.
• The Act binds the Crown in right of South Australia but does not render the Crown prosecutable (s 9(2)-(3)), preserving the typical immunity for the Crown while still subjecting public bodies to regulatory duties insofar as the Crown can be bound.

Regulatory delegation and subordinate instruments

• The regulation-making power in s 33 is expansive. Regulations may declare permitted lotteries, limit lotteries for which licences may be granted, prescribe classes of licence and persons to whom licences may be granted, create detailed rules for conduct and advertisement, impose or exempt fees, and fix fees by reference to percentages of turnover or prize value (s 33(2)(a)-(i); s 33(4)). This means the Act sets out the architecture, while regulations will determine interactional detail with taxation, consumer protection, trade promotion rules, postal and telecommunications law and other regulatory regimes.

Criminal law interaction

• The Act creates criminal offences which operate alongside general criminal law. The dishonest conduct offence (s 30) with imprisonment interacts with general fraud and deceptive conduct statutes, but Schedule 1 amends the Lottery and Gaming Act 1936 to delete overlapping definitions and provisions (Schedule 1, cl 10). Practitioners must map overlapping offences against state criminal law and consumer protection laws to assess duplications or cumulative exposure.

Administrative law and review

• The Act confers discretionary powers on the Commissioner to grant or refuse licences, impose or vary conditions, and grant or revoke exemptions (ss 15, 16, 29). Those administrative decisions will be subject to judicial review principles unless otherwise ousted. The Act itself does not specify a bespoke merits appeal mechanism; remedies therefore will typically sit in administrative law (e.g. merits review if provided elsewhere, or judicial review on legality grounds).

Evidence and interstate enforcement

• The Act’s evidentiary provisions facilitate prosecution for lotteries conducted outside SA where SA residents participate (s 32(2)). That interacts with interstate cooperation mechanisms and potentially Commonwealth laws where cross-border conduct is concerned.

In practice, compliance and enforcement will require operators and advisers to consider the Act alongside the Gambling Administration Act 2019, the regulations to be made under s 33, the amended Lottery and Gaming Act 1936 (to the extent leftover provisions remain), consumer protection and misleading conduct regimes, and any sectoral statutes that authorise particular lotteries. The Act envisages interplay between statute, regulation and administrative discretion rather than self-contained detailed rules.

The source contains a Schedule (Schedule 1) setting out related amendments to the Lottery and Gaming Act 1936 and transitional arrangements. The legislative history included in the source records assent and commencement details. The Act’s own commencement date is proclamation-based (s 2), and the legislative history shows key dates.

Principal legislative facts from the source

• Lotteries Act 2019 was assented to on 12 December 2019 and commenced on 10 December 2021 by Gazette notice (Legislative history at end). The Act’s commencement is by proclamation according to s 2; the Gazette date confirms a declared commencement.
• Schedule 1 Part 2 amends the Lottery and Gaming Act 1936 by deleting lottery-related definitions and Parts, amending the long title and short title, repealing sections and otherwise removing prior lottery provisions (Schedule 1, cls 2-11). This demonstrates that the 2019 Act was intended to displace the earlier statutory regime.

Transitional provisions

• Schedule 1 Part 3 contains transitional provisions:
  • Existing notices under the older regulations regarding prohibited goods and services continue as if issued under the new s 7 (Schedule 1, cl 13).
  • Licences under the former Act that were in force immediately before the repeal continue as licences under the corresponding Parts of the new Act: licences to conduct lotteries convert to Part 3 licences (Schedule 1, cl 14(1)); supplier licences convert to Part 4 licences (Schedule 1, cl 14(2)).
  • Inspectors appointed under the repealed Act are taken to be inspectors authorised under the Gambling Administration Act 2019 for the purposes of this Act (Schedule 1, cl 15). This preserves enforcement personnel and continuity.

Specific deletions and amendments

• Long title and short title of the Lottery and Gaming Act 1936 are altered by deleting references to "lotteries" given the new Act’s displacement of lottery regulation (Schedule 1, cls 2-3).
• Multiple definitions in the Lottery and Gaming Act 1936 (authorised lottery, exempted lottery, instant lottery ticket, lottery, lottery inspector, sweepstakes, trade-promotion lottery) are deleted (Schedule 1, cl 5). Parts 2, 2A, 3 and 4 of the older Act are repealed in their entirety (Schedule 1, cl 6).
• The Schedule also removes certain older exemptions and sections no longer appropriate once the new scheme operates (cls 7-11).

Regulatory design flexibility and future amendments

• The Act itself enables broad regulation-making powers (s 33), including fee design referenced to percentages of proceeds or prize value (s 33(4)). That creates a pathway for future subordinate-law changes affecting costs and licence structures without primary-legislation amendment.
• The Commissioner is empowered under ss 15 and 24 to require further information and verification when considering licence applications. This administrative flexibility can be tightened or broadened by later regulations.

Documented legislative history

• The source’s legislative history section at the end confirms the principal Act (Year 2019 No 41) and notes assent and commencement (assent 12.12.2019; commencement 10.12.2021, Gazette 28.10.2021 p3851). There is no further amendment history in the source; any subsequent amendments would need to be checked in the consolidated legislation or Gazette.

In sum, the 2019 Act replaced and modernised lottery regulation previously found in the Lottery and Gaming Act 1936, provided transitional continuity for licences and inspectors and created an administrative regime reliant on the Gambling Administration Act 2019 and subordinate regulations. The Act’s own amendment history in the source is limited to its enactment, commencement and the Schedule effecting transition from the prior statute.

The source provided is the text of the Lotteries Act 2019 and its Schedule; it does not list any cases or judicial interpretations. Therefore there are no reported decisions, judicial constructions or litigation outcomes contained in the material provided. That absence shapes practical advice: much of the statute will be shaped in operation and through administrative decisions rather than existing judicial precedents.

Predictable litigation and enforcement axes (no cases cited)

• Licence refusals, conditions and cancellations: Given the Commissioner’s broad discretion to refuse licences on fitness or "any other reasonable ground" (s 15(3)) and to vary conditions (s 16(2)), disputes are most likely to arise from licence refusals or cancellations. Challenges are likely to proceed by judicial review on legality grounds or, where available, merits review in administrative tribunals under other South Australian law. The Act does not itself state an internal appeal mechanism for merit review in licensing decisions.
• Dishonesty and misleading conduct: The high-penalty offence for dishonest, deceptive or misleading conduct (s 30) lends itself to criminal prosecutions in severe misconduct cases. Defendants in such prosecutions will require robust factual records; prosecutions may intersect with general criminal fraud provisions and consumer protection laws.
• Extraterritorial enforcement and evidentiary questions: The Act applies where South Australian residents can participate even if the lottery is conducted outside the State (s 9(1)). Prosecutions for out-of-state conduct are assisted by s 32(2), which permits secondary evidence. Courts will eventually need to resolve evidentiary sufficiency and jurisdictional issues in such cases.
• Advertising and online promotion: s 12 criminalises advertising or promotion of unlawful lotteries and defines "advertise" broadly. Dispute examples could involve operators arguing that a promotion targeted outside SA did not amount to advertising to SA residents, or that a scheme fell within a permitted class declared under regulation.

Defences that may be litigated

• Reasonable belief defence: s 14 provides a defence if the defendant proves they believed on reasonable grounds the lottery was licensed or permitted. Litigation may test the outer limits of "reasonable grounds" , whether reliance on a person, an exemption, or a misinterpretation of regulatory declarations was reasonable.
• Reasonable steps defence for licence-condition offences: For contraventions of licence or exemption conditions (ss 16(4), 29(10)), a defendant may be able to avoid penalty by proving they took all reasonable steps. Courts would be asked to assess what processes or compliance systems constituted "reasonable steps".

Evidence and procedural aids

• s 32(1) creates a presumption that an allegation in the information about licence status is accepted unless disproved. That evidentiary reversal will affect prosecutorial strategy and defence burdens, and courts will determine the limits of the presumption where documentary or extrinsic evidence contradicts an allegation.

No existing judicial record in source

• The source contains no named cases or litigation history. Anyone relying on case law should search South Australian court records and consolidated legislation databases for judicial decisions interpreting the Lotteries Act 2019 and the application of the Commissioner’s powers, especially in licensing and prohibition contexts.

In short, the Act’s litigation history in the source is nil. The most likely future litigation themes are licensing decisions, the boundary of permitted lotteries under regulation, extraterritorial enforcement, the reasonableness of defences, and prosecutions under the dishonest conduct offence. Practitioners should monitor administrative decisions and tribunal litigation for the first wave of authoritative interpretations.

The Act contains several practical traps and sources of regulatory and commercial risk that operators, promoters and advisers should note. Each "gotcha" is tied to specific provisions in the text.

1. Broad definition of lottery and capture of mixed skill/chance products (s 6(1)(a))

• The definition treats a scheme as a lottery if any stage depends on an element of chance, even where other stages involve genuine skill. Operators of competitions that combine purchase and a skill element should not assume escape from regulation. The Act also expressly includes trade promotion lotteries (s 6(1)(b)). Mischaracterising a promotion risks creating an "unlawful lottery" exposure under Part 2.

2. Extraterritorial application (s 9(1))

• The Act applies to any lottery in which persons resident in South Australia can participate, whether conducted inside or outside the State. National or international promoters who make schemes accessible to SA residents may fall within SA law and cannot assume compliance with another jurisdiction alone removes SA exposure.

3. Commissioner discretion and after‑the‑fact condition variation (ss 15(3), 16(2))

• The Commissioner can impose conditions or vary/remove them after the licence grant. Licence-holders can find operational parameters changing mid-course. The Act provides for contravention penalties (s 16(3)), albeit with a reasonable steps defence (s 16(4)). Operational planning must allow for regulatory volatility.

4. Fee design as percentage of proceeds or prize value (s 33(4))

• Regulations may fix licence fees by reference to a percentage of money paid for participation, total prize value or total face value of tickets. That structure could substantially increase costs for high-turnover or high-prize-value fundraisers and trade promotions. Fundraising organisations should track regulations closely to understand effective cost rates.

5. Suppliers and the upstream chain (ss 22-23)

• The supplier-licensing track imposes a licensing requirement on businesses that sell or supply prescribed lottery products for resale. Retailers or wholesalers of tickets, ticket books, or other products may need supplier licences. The exact scope depends on regulations prescribing "lottery product" (s 22). Non-compliance can attract $10,000 penalties (s 23(1)).

6. Prohibition notices on prizes (s 7)

• The Commissioner can prohibit specified goods or services as prizes or inducements by Gazette notice. Fundraisers offering certain prizes could be prohibited without primary legislation amendment. Because such notices may be varied or revoked (s 7(2)), prize-based planning should confirm current Gazette notices.

7. Transition and legacy licences (Schedule 1)

• Licences under the former Act continue, but they may now be subject to new licence conditions and the Commissioner’s powers. Organisations that relied on prior exemptions (e.g. sweepstakes carve-outs) should confirm transitional continuities and any changes created by the Schedule (Schedule 1, cls 13-15).

8. Evidentiary presumptions in prosecutions (s 32(1))

• Allegations about licence status and whether a lottery was licensed or permitted are accepted as proved absent contrary proof. This places an evidentiary burden on defendants; keeping documentary proof of authorisations, exemptions and communications with the Commissioner is essential.

9. Children selling tickets (s 31)

• Permitting unsupervised sales by children under 15 is an offence. Schools, sporting clubs and community groups using youth volunteers must ensure adult supervision at all times.

10. Serious criminal exposure for dishonest conduct (s 30)

• The maximum penalty of $50,000 or 2 years imprisonment for dishonest, deceptive or misleading conduct is substantial. Operational misstatements, false promises of prize awards, or systematic misrepresentation could attract criminal prosecution rather than only regulatory enforcement.

11. Unclear internal appeal/remedy route

• The Act confers substantial discretion on the Commissioner but does not set out detailed merits review or appeal processes in its text. Affected parties should assume they will need to rely on administrative law remedies and any tribunal mechanisms available under the Gambling Administration Act 2019 or other statutes.

12. Hybrid fundraising and "permitted lottery" reliance on regulations (s 4, s 33(2)(a))

• Operators who rely on a lottery being "permitted" because of regulation must monitor regulation text closely. The regulations can declare classes permitted or set conditions for permitted status. Reliance on informal advice or previous norms is risky.

Each of these "gotchas" creates a compliance or business risk. The precise operational impact will depend on the content of the regulations and on how the Commissioner exercises the powers conferred by the Act.

Practical compliance requires documenting decisions, early engagement with the Commissioner, robust record-keeping and an operational compliance program. The steps below are drawn from the Act’s prescriptions and the regulatory levers it provides.

1. Initial legal characterisation

• Determine whether the activity is a lottery under s 6. Check (a) is participation contingent on payment or valuable consideration, and (b) whether any stage of the distribution depends on chance. If either limb applies, the activity is a lottery unless it is a permitted lottery or authorised by another Act (s 4, s 6).

2. Establish whether the lottery is permitted or requires a licence

• Review regulations to see whether the lottery fits within a permitted class declared under regulation (s 4 definition of permitted lottery; s 33(2)(a)). If not permitted, plan to apply for a licence under Part 3 (s 15).

3. Licence application and fit and proper checks

• Make application to the Commissioner in the manner and form determined by the Commissioner and pay any prescribed fee (s 15(1)). Provide full particulars of the applicant and "relevant persons" (s 15(5)). Prepare to demonstrate that each relevant person is a fit and proper person, including directors, trustees, beneficiaries who hold positions of authority as defined in s 8(1). Include identity verification, financial records and governance documents where relevant.

4. For unincorporated groups, nominate responsible persons

• If an unincorporated organisation or group applies, nominate and secure the Commissioner’s approval for the person(s) responsible for compliance (s 17). Obtain written approval documents and keep them on file, as the nominee becomes the legal reference for licence obligations (s 17(3)).

5. Supplier licensing and supply chain

• If your business supplies prescribed "lottery products" for resale, either obtain a supplier licence under Part 4 or ensure you fall within a regulatory exemption (s 22, s 23). Monitor regulations defining "lottery product" and exemptions closely.

6. Document compliance systems and controls

• Because contraventions of licence conditions attract penalties but a "reasonable steps" defence is available (ss 16(4), 29(10)), implement compliance policies, training, supervision and record-keeping showing the steps taken to comply with licence conditions and regulatory obligations.

7. Monitor and manage prohibited prizes

• Before offering prizes, check for Gazette notices issued under s 7 prohibiting specified goods or services. Keep a current register of prize eligibility and any notices to ensure a prize is not proscribed.

8. Plan for fees and financial reporting

• Anticipate fee structures potentially set by regulation as percentages of money paid, prize value or face value of tickets (s 33(4)). Budget for possible percentage-based fees and for providing financial statements or security for performance of licence conditions if required by regulation (s 33(2)(i), s 20(4)).

9. Advertising and promotional compliance

• Develop marketing scripts and channels that avoid promoting an unlawful lottery. Advertising or promotion of an unlawful scheme is an offence (s 12), and publication through internet, radio or print is explicitly captured (s 13(3)). For trade promotions, ensure free-entry options, telephone/SMS/post costs comply with any regulatory caps in the trade promotion lottery definition (s 4).

10. Child sales supervision

• If children under 15 are involved in selling tickets, ensure an adult supervises them at all times (s 31). Maintain written supervision protocols and training records for volunteers.

11. Keep licences, permits and exemption documentation accessible

• The evidentiary provision in s 32(1) makes licence status an element that prosecutors can treat as proved unless rebutted. Keep current copies of licences, exemption notices, gazette notices and correspondence with the Commissioner to rebut any assertion.

12. Prepare for suspension, cancellation and winding-up directions

• Maintain governance arrangements such that, if a licence is surrendered or cancelled, the organisation can comply with Commissioner directions on winding up, financial statements and payment of fees within the timelines specified (s 20(4)-(6)). Ensure the treasurer or equivalent retains capacity to comply in the event of organisational dissolution.

13. Use exemptions strategically

• Consider applying for an exemption under s 29 when a lottery would otherwise attract regulatory obligations but meets the objects in s 3 and will not breach a s 7 notice. Exemptions can be conditional and reversible; treat them as administratively fragile and document compliance with conditions.

14. Engage legal and regulatory advisers early

• Given the Commissioner’s discretionary powers and the potential costs of non-compliance, obtain legal advice on whether a scheme is a lottery, whether a permitted class applies, and on application material to establish fitness of relevant persons. For cross-border operators, also consult on extraterritorial risks (s 9(1), s 32(2)).

15. Record retention and audit readiness

• Maintain clear records of ticket sales, entrant lists, prize draws and distribution, accounting for funds and prize fulfilment to show transparency and accountability consistent with the objects (s 3) and to be able to comply with possible directions or audits by the Commissioner.

16. Monitor regulatory changes and Gazette notices

• Because many operational details are delegated to regulation and Gazette notices under s 7 and s 29, establish a compliance calendar to track regulatory updates, fee changes, declared permitted lotteries and prohibition notices.

Following these steps will align a lottery organiser or supplier with the statutory duties laid down by the Lotteries Act 2019, reduce exposure to criminal or administrative action and position an operator to rely on statutory defences where applicable.
