Lotteries Act 1964

The Act organises the law around a small number of legal and administrative concepts. Each concept has an operational definition and a set of legal consequences in the text.

• Lottery (s 5). The Act defines a lottery broadly as a scheme by which prizes are, or are represented as capable of being, determined by chance, dice, lot, or reference to an event or contingency depending on chance. The definition expressly covers both real and pretended schemes and includes prizes of money or goods or any other property, benefit or matter. A distribution scheme that is capable of fair apportionment among owners (and intended to be apportioned equally) is excluded from being a lottery (s 5(2)).
• When a lottery is conducted (s 3). The Act deems a lottery to be conducted from the first subscription until all prizes are distributed. That temporal definition determines when duties (for example record-keeping, audit exposure, supervisory powers) arise.
• Approved lottery and approval process (ss 7, 7A; Dictionary). Conduct of a lottery requires prior written approval from the commission unless an exemption applies (s 7(1), (2)). Approvals can be conditional (s 7(4)), and may be varied on application (s 7A). The Act makes a certificate by the commission about approval status admissible evidence in proceedings (s 7(6)).
• Exempt lottery (s 6; s 6A; Dictionary). Exempt lotteries are threefold under s 6(1)(a): (i) trade- or business-related promotional lotteries where prizes are rebates, discounts or refunds; (ii) lotteries where total prize value does not exceed an amount determined by the commission; (iii) private lotteries conducted within the tightly specified parameters in s 6(4). Exempt lotteries are nonetheless subject to conditions in s 6A; notably the commission can determine additional conditions for small-prize exempt lotteries (s 6A(3)). Determinations under s 6 are disallowable instruments (s 6(3)).
• Private lottery (s 6(4)). The statutory test for a private lottery is detailed and prescriptive: chances restricted to persons who are members of the same association or who work or reside in the same premises; conduct by an authorised member or a resident/worker; uniform price per chance and specified on ticket; no refunds of contributions; minimal advertising limited to notices at premises; tickets not sent through the post; proceeds used wholly and exclusively for prizes or association purposes (s 6(4)(a)-(g)). These elements are cumulative conditions to qualify for the private-lottery exemption.
• Audit, supervision and enforcement (ss 13, 18). The commission may require production of accounts and documents (s 13(1)-(2)), authorise persons to audit and to require information (s 13(3)), and authorise supervisors who may enter premises and direct persons involved in a lottery (s 18(1)-(2)). Non-compliance attracts criminal penalties (s 13(4); s 18(3)).
• Personal information protections (s 18AA). The Act requires collection of personal information only where necessary, limits use to compliance with the Act, and requires secure storage and disposal (s 18AA(1)).
• Prohibitions (ss 8-12). The Act makes a range of acts criminal where undertaken in relation to a non-approved or non-exempt lottery: conducting the lottery (s 8), advertising it (s 9), selling tickets or shares (s 10), printing tickets (s 11), forming or promoting syndicates for gain or advertising to receive money for tickets (s 12). Some offences carry imprisonment as well as monetary penalties.
• Instant lotteries and labelling (s 12A). The Act contains a specific interpretive provision that standardises certain expressions on instant lottery tickets , "match 3" or similar expressions are to be read as meaning "find 3 of the same" (s 12A(1)). Instant lotteries are approved lotteries where prizes are revealed by exposing panels on tickets (s 12A(2)).
• Delegated instruments (s 6(3), s 6A(4), s 18A(2), s 20). The commission or Minister may make determinations (disallowable instruments) and the Executive may make regulations (s 20), so operational detail and quantitative thresholds can be set by delegated instruments subject to parliamentary oversight.

These main concepts establish both the scope of regulated activity and the compliance machinery: who needs permission, what categories are exempt, which procedural and substantive conditions apply to exempt lotteries, and what powers the commission has to inspect, supervise and enforce. The Dictionary ties the commission to the gambling and racing commission and points to the Unlawful Gambling Act 2009 for the meaning of an unlawful game, which affects exclusions under s 6(1)(b).

The Act assigns roles, obligations and exposures across a set of identifiable actors. The primary nodes are: persons conducting lotteries (organisers/promoters), the gambling and racing commission (the commission), the Minister and Executive for delegated instruments, subscribers (ticket-holders), printers and sellers of tickets, associations conducting private lotteries, auditors and authorised supervisors, and people who might form syndicates.

• Persons conducting lotteries. Anyone who organises, promotes, conducts or is otherwise "concerned in the conduct of a lottery" is on the regulatory hook. They must either secure an approval under s 7 or ensure the lottery falls squarely within an exemption in s 6 and comply with the specific exempt-lottery conditions in s 6A. The Act imposes substantive duties (for example record-keeping, delivery of prizes, equal chance for tickets, not charging winners fees, see s 6A) and exposes organisers to audit and supervision (ss 13, 18).
• The commission. The gambling and racing commission is the regulator: it receives written applications for approvals (s 7(1)), grants or refuses approvals (s 7(3)), imposes conditions (s 7(4)), notifies applicants (s 7(5)), issues certificates that are evidence in proceedings (s 7(6)), makes determinations about exempt lottery prize-value thresholds (s 6(3)), sets additional conditions for small-prize exempt lotteries (s 6A(3)), may require audits and take custody of documents (s 13), and authorises supervisors under s 18. The commission therefore decides who may lawfully conduct a lottery in the ACT and under what conditions.
• The Minister and the Executive. The Minister may determine fees under s 18A; the Executive may make regulations under s 20. Those instruments are disallowable (s 18A(2); s 6(3) and s 6A(4) for specific determinations), creating a parliamentary check.
• Subscribers. People with tickets or entries (subscribers) have limited statutory protections: the Act requires that winning tickets and, if available, identities be recorded (s 6A(1)(b)) and that results be made available to subscribers (s 6A(1)(c)). The Act bars charging winners fees on prize receipt (s 6A(1)(d)) and requires organisers to take reasonable steps to ensure entitled persons receive prizes (s 6A(1)(g)). Subscribers are also directly implicated by the prohibition on syndicate promotion for gain (s 12).
• Printers and sellers. Printing tickets for unauthorised lotteries is an offence (s 11). Selling tickets, shares or accepting money for tickets in unauthorised lotteries is an offence (s 10). Printers and sellers must verify that a lottery is approved or exempt before providing services or carrying out sales.
• Associations and private-lottery organisers. Associations may run private lotteries within the narrow s 6(4) template. The statutory template restricts advertising, imposes uniform ticket price requirements and dictates use of proceeds. Organisations that want to rely on a private-lottery exemption must ensure cumulative compliance with those criteria.
• Auditors and authorised supervisors. The commission may authorise persons to audit (s 13(2)) and to supervise draws (s 18(1)). Those authorised persons have statutory powers to enter premises, require information, and direct persons conducting lotteries (ss 13, 18).
• Parties to syndicates and syndicate promoters. The Act criminalises forming or promoting syndicates for gain and advertising to receive money for purchase of tickets (s 12). Individuals who organise syndicates for reward, or advertise receipt of money for ticket shares, face penalties.

Who pays and who decides. Operationally, the organiser bears compliance costs: applying for approvals, meeting recorded conditions, holding books for audit, securing secure storage of personal data, paying any fees determined by the Minister (s 18A), and potential fines or custodial consequences for non-compliance (ss 8, 13, 15-16). The commission is the central decision-maker for approvals and determinations (s 7; s 6(3)), and the Minister/Executive set fees and regulations (ss 18A, 20).

Who benefits. Subscribers benefit from statutory protections regarding equality of chance, notice of results and limits on fees to winners (s 6A). Associations running private lotteries retain a pathway for small-scale fundraising without needing full approvals, provided they meet the statutory template (s 6(4)).

The Act therefore reshapes incentives: organisers must internalise regulatory costs and enforcement risk; the commission gains discretionary control over market entry; participants obtain minimal statutory protections; ticket printers and sellers must perform compliance checks or risk offences.

The Act prescribes discrete duties for persons conducting lotteries and grants certain rights and administrative protections. The duties are operational; the rights are largely procedural and evidentiary.

Duties of organisers and persons concerned in conduct

• Secure approval or qualify for an exemption. A person must not conduct a lottery unless it is an approved lottery (s 7) or an exempt lottery (s 6). Conducting a non-approved, non-exempt lottery is an offence (s 8(1)).
• Comply with approval conditions. If approval is granted subject to conditions, the organiser must not contravene those conditions (s 8(2)). The commission may impose conditions it considers necessary to protect subscribers and ensure proper conduct (s 7(4)).
• Equal chance and drawing rules (exempt lotteries). Exempt lotteries are subject to the conditions in s 6A, which include that each ticket or entry must have an equal chance (s 6A(1)(a)); the major prize in multi-prize lotteries must be drawn first unless eligible for other prizes (s 6A(1)(f)); and redraws must occur if prizes are unclaimed within a reasonable period (s 6A(1)(h)).
• Record-keeping and disclosure. The person conducting a lottery must record the winning ticket and, if available, the identity of the person who holds it, and make results available to subscribers (s 6A(1)(b)-(c)). The commission may require a written statement of receipts and disbursements and production of books, documents and vouchers (s 13(1)).
• No fees to winners. A person who wins a prize in an exempt lottery must not be charged a fee when receiving the prize (s 6A(1)(d)).
• Ensure proper delivery of prizes. Organisers must "do everything reasonably necessary" to ensure an eligible person receives a prize (s 6A(1)(g)) and must take reasonable steps to identify the person who holds a winning ticket (s 6A(2)).
• Protect personal information. Organisers must ensure personal information about subscribers is only collected if necessary, used only in accordance with the Act, and stored and disposed of securely (s 18AA(1)).
• Cooperate with audits and supervision. Persons must comply with audit notices and supervisory directions. A notice under s 13 may require production of documents and answering questions; non-compliance is an offence (s 13(4)); supervisors authorised under s 18 may enter premises and give directions and persons must not obstruct or contravene those directions (s 18(2)-(3)).

Rights and administrative protections

• Procedural rights in approvals. Applicants have the right to be notified in writing whether approval has been granted or refused (s 7(5)). A person with approval may apply to vary conditions (s 7A).
• Evidentiary protection. A certificate issued by the commission specifying whether approval has been granted and the conditions attached is admissible evidence in proceedings (s 7(6)). This gives administrative determinations an evidentiary weight in court or tribunal processes.
• Statutory exemptions. Entities that fall within s 6’s exemptions (trade-promotional rebates, low-prize lotteries up to a threshold the commission sets, or private lotteries meeting s 6(4)’s template) can lawfully conduct lotteries without formal approvals, subject to s 6A.
• Disallowable instrument oversight. Determinations under s 6(1)(a)(ii) and conditions under s 6A(3), and fees under s 18A are disallowable instruments (s 6(3); s 6A(4); s 18A(2)). That means the Legislative Assembly has a vehicle to disallow these instruments, providing parliamentary scrutiny of quantitative thresholds and fees.

Operational duties with criminal consequences

• Criminal offences and penalties attach to core contraventions: conducting non-approved lotteries (s 8), refusing or failing to comply with audit requests (s 13(4)), misappropriating funds or prizes (s 15), fraudulent drawings (s 16), obstructing supervisors (s 18(3)). Many of these offences carry maximum penalties of 50 penalty units and up to 6 months’ imprisonment (see ss 8, 13, 15, 16, 18). The front matter states the penalty unit values as at the republication date ($160 individual, $810 corporate), which materially scales financial exposure.

Duties for third parties

• Printers and sellers must not print or sell tickets for unauthorised lotteries (ss 10-11). A person who prints a ticket for an unauthorised lottery faces a penalty (s 11).
• Syndicate promoters are prohibited from promoting syndicates for gain or advertising readiness to receive money for tickets (s 12).

In short, the Act establishes compliance obligations focused on prior authorisation (or strict exemptions), transparency, fairness of draws, protection of winners and subscriber data, and cooperation with regulator audits and supervision. The commission controls access and imposes conditions; applicants have procedural rights and evidentiary clarity in s 7(6). Failure to observe duties carries criminal exposure and potential imprisonment alongside pecuniary penalties.

The Act couples a mix of financial penalties, custodial sanctions and regulatory enforcement tools to achieve compliance. Enforcement is structured around criminal offences with specified maximum penalties, audit powers, supervision and evidentiary devices.

Criminal penalties and their scale

• Conducting an unauthorised lottery: s 8(1) makes it an offence to conduct a lottery other than an approved or an exempt lottery. The maximum penalty is 50 penalty units, imprisonment for 6 months, or both. The front matter records the penalty unit at the republication date ($160 for individuals; $810 for corporations), so at that date the maximum pecuniary exposure for an individual would be 50 x $160 = $8,000; for a corporation 50 x $810 = $40,500, plus the alternative of imprisonment (s 8(1)).
• Contravention of approval conditions: s 8(2) provides a maximum penalty of 50 penalty units for breaching a condition attached to an approval.
• Advertising, sale and printing offences: advertising a non-approved/non-exempt lottery is punishable by up to 10 penalty units (s 9); selling or offering to sell tickets or accepting money for such tickets up to 10 penalty units (s 10); printing tickets up to 5 penalty units (s 11). These are lower-scale pecuniary penalties but can be applied to multiple acts and actors (advertisers, sellers, printers).
• Syndicates: promoting or participating in the formation of a syndicate for gain, or advertising to receive money for tickets, carries up to 10 penalty units (s 12).
• Audit non-compliance: failing to comply with an audit requirement under s 13(1)-(3) attracts a maximum penalty of 50 penalty units, imprisonment for 6 months, or both (s 13(4)).
• Misappropriation of funds or prizes: s 15 makes conversion of money subscribed or prizes an offence with a maximum penalty of 50 penalty units, imprisonment for 6 months, or both.
• Fraudulent drawing: s 16 creates a maximum penalty of 50 penalty units, imprisonment for 6 months, or both for conducting a draw so that chances are not equally favourable to ticket holders with intent to defraud.
• Obstruction of supervision: obstructing an authorised supervisor is punishable: for hindering or obstructing an authorised person, up to 50 penalty units and imprisonment for 6 months; contravening a direction carries up to 50 penalty units (s 18(3)).

Enforcement mechanisms

• Audit powers (s 13). The commission can require persons involved in a lottery to provide a written statement of receipts and disbursements and to produce books, documents and vouchers relating to the lottery (s 13(1)). The commission may keep those materials and have them audited by an authorised person (s 13(2)). Authorised auditors can require persons to provide further information and answer questions (s 13(3)). Compliance with such notices is mandatory (s 13(4)).
• Supervision and entry (s 18). The commission may authorise persons to supervise the conduct of a lottery if supervision is "desirable for the purpose of protecting the interests of subscribers" (s 18(1)). An authorised supervisor can enter any place where a lottery is being or is to be drawn and give directions necessary to protect subscribers (s 18(2)).
• Evidentiary certificate (s 7(6)). The commission’s written certificate as to whether an approval has been granted and the conditions attached is evidence of those matters in any proceeding. That provision streamlines enforcement by reducing evidentiary friction when establishing whether a lottery was lawfully approved.
• Confiscation of documentary materials (s 13(2)). The commission's power to keep statements, books, documents and vouchers and to have them audited gives it both investigative reach and the capacity to preserve evidence.
• Disallowable instruments and parliamentary oversight. Determinations (for prize thresholds, conditions, and fees) are disallowable instruments (s 6(3), s 6A(4), s 18A(2)). That procedural safeguard is not an enforcement tool per se, but it imposes a constraint on delegated rule-making since the Legislative Assembly may disallow such instruments.

The Act excludes pool betting schemes and competitions under the Pool Betting Act 1964 (s 4), and defines "unlawful game" by reference to the Unlawful Gambling Act 2009 (dictionary). Practical enforcement consequences

• Multi-actor exposure. Enforcement reaches organisers, sellers, printers and auditors. The Act creates overlapping obligations and offences that can be applied to multiple actors in a lottery chain.
• Custodial risk. Several offences carry imprisonment up to 6 months where the fault element is significant (for example intent to defraud s 16, or non-compliance with audit requests s 13). The availability of imprisonment alongside pecuniary penalties increases the regulatory stakes.
• Variable penalty unit exposure. Because the Act records penalty unit values in the republication front matter, pecuniary exposure can be materially different for corporate actors versus individuals (the Act records differing penalty unit scales: $160 individual, $810 corporation). The maximum monetary penalty thus scales strongly depending on the offender’s legal character.
• Administrative enforcement. The combination of audit and supervision powers, plus admissible commission certificates, facilitates administrative enforcement without protracted evidentiary processes. The regulator’s ability to retain documents and commission audits also creates compliance costs and detection capacity.

In short, enforcement under the Act combines criminal sanctions of varying severity with administrative investigatory powers. The regulator is equipped to detect non-compliance and to pursue both pecuniary and custodial sanctions where statutory thresholds are crossed.

The Act is drafted as a focused statutory regime for lotteries but expressly interfaces with other statutes and administrative instruments. The republished text embeds cross-references and delegates where detail is to be provided by other laws, the commission, the Minister or the Executive.

Explicit statutory cross-references

• Pool Betting Act 1964 (s 4). Section 4 disapplies the Lotteries Act where the activity concerns a pool betting scheme or a pool betting competition within the meaning of the Pool Betting Act 1964. That exclusion allocates regulatory responsibility for pool betting to the discrete legislative regime under the Pool Betting Act.
• Unlawful Gambling Act 2009 (Dictionary). The Dictionary defines "unlawful game" by reference to the Unlawful Gambling Act 2009, s 7. That linkage matters because s 6(1)(b) excludes from exempt lotteries those where prizes are capable of being won by playing an unlawful game. The definition therefore imports the Unlawful Gambling Act’s legal framework into exemption assessments.
• Legislation Act 2001. The republished front matter and notes reference the Legislation Act 2001 for matters such as the legal status of notes (s 2A note), disallowable instruments (Legislation Act definitions), and editorial amendments authorised under part 11.3 of the Legislation Act. Overlap and boundary issues

• Private lotteries and association law. The private-lottery exemption in s 6(4) references associations. The Dictionary defines "association" broadly (organisation, club, society or other body of persons) but excludes bodies established primarily to conduct lotteries or gaming. The interplay with corporate or incorporated association law may be relevant where an entity purports to rely on the private-lottery exemption but is structured for fundraising by lottery.
• Criminal law and fraud offences. Offences such as fraudulent drawing (s 16) and misappropriation (s 15) may overlap with general criminal provisions in the Criminal Code or territory criminal statutes (for theft, fraud and related offences). The amendment history notes that criminal-code amendments have previously interacted with this Act (see Legislation history referencing Criminal Code amendments A2004-15).
• Data protection and privacy. Section 18AA contains minimum obligations about collection, use, storage and disposal of personal information. That provision interacts with any ACT or Commonwealth privacy law (for example, the Privacy Act 1988 if applicable to the organiser) and with regulatory expectations about secure handling of personally identifying information. The Act, however, sets its own baseline standard for lottery conductors.
• Unlawful gambling regimes. The Act’s cross-reference to unlawful games in the Unlawful Gambling Act 2009 means that activities that might otherwise appear to be lotteries could be routed into the unlawful gambling regime, with potentially different offences and enforcement pathways.

Administrative and evidentiary interactions

• Commission certificates in s 7(6) are evidence in proceedings, streamlining enforcement and prosecution where approval status is in issue. That dovetails with administrative law principles and reduces the burden on prosecutors to prove the facts underlying approval status.
• Determinations and regulation-making powers create a layered rule environment: primary Act sets principles and prohibitions; commission determinations, ministerial fee determinations and regulations provide operational detail. Practitioners must therefore consult subordinate instruments for thresholds, fees and procedural requirements.

In practical terms, legal advisers, compliance officers and organisers need to map the Act against: (1) the current subordinate instruments on the legislation register (fee determinations, commission determinations about thresholds, regulations); (2) the Unlawful Gambling Act and Pool Betting Act to assess whether the activity is excluded or falls under another regulatory regime; and (3) applicable privacy or criminal law frameworks. The Act is therefore a central node in a network of legislative instruments governing gambling, fundraising and related consumer protections in the ACT.

The republished Act includes an annotated legislative history and amendment history in the endnotes. The Act began as a Commonwealth Ordinance and underwent multiple amendments and transfers of competence as administrative structures changed. The key mechanistic amendments and insertions recorded in the endnotes are:

• Origin and conversion to ACT enactment. The Lotteries Act 1964 began as the Lotteries Ordinance 1964 No 13 (Cwlth), notified 21 August 1964 and commenced 1 September 1964. Under the Australian Capital Territory (Self-Government) Act 1988 s 34(4), most Commonwealth ordinances in force in the ACT were converted into ACT enactments on 11 May 1989; the name change from Ordinance to Act followed the Self-Government (Citation of Laws) Act 1989 A1989-21 (see Legislation history, endnote 3).
• Multiple 1960s-1980s amendments. The Act was amended several times in the 1960s-1980s (Ordinances Revision (Decimal Currency) Ordinance 1966; Lotteries (Amendment) Ordinance 1981-1984). The amendment history lists specifics such as Ord1982-17 and Ord1983-44 among early changes (endnote 3 and 4).
• 1990s consolidation and changes. Substantial amendments were effected by the Lotteries (Amendment) Act 1994 A1994-36 and Lotteries (Amendment) Act 1996 A1996-60. The revenue and gambling regulatory environment was adjusted around that period, and the endnotes record multiple amendments across 1994-1999 (endnote 3).
• 1999-2001 consequential and structural changes. The Revenue Legislation Amendment Act 1999 A1999-38 (pt 3), Gambling and Racing Control (Consequential Provisions) Act 1999 A1999-47, and the Legislation (Consequential Amendments) Act 2001 A2001-44 effected consequential and structural changes, including the insertion or alteration of definitions and powers. Statute Law Amendment Acts 2007 (No 2 and No 3) and the Unlawful Gambling Act 2009 A2009-39 (which came into force in 2010 for parts relevant to the Act) appear in the chronology. The Unlawful Gambling Act 2009 introduced an explicit cross-reference for unlawful games and reconfigured the broader gambling statutory landscape (endnote 3).
• 2015 Lotteries (Approvals) Amendment Act. The Lotteries (Approvals) Amendment Act 2015 A2015-41 (notified LR 4 November 2015) made consequential structural insertions; importantly, s 6A (exempt lotteries,conditions) and s 18AA (protection of personal information) were inserted as part of reforms arising in that period (endnotes 3 and 4 note these insertions: s 6A ins A2015-41 s 6; s 18AA ins A2015-41 s 9).
• 2021 and 2022 amendments. The Justice and Community Safety Legislation Amendment Act 2021 A2021-3 (pt 12) and the Statute Law Amendment Act 2022 A2022-14 (sch 3 pt 3.27) made further textual updates to the Act (endnote 3 and 4). • 2025 amendments. Most recently, the Act lists amendments by the Statute Law Amendment Act 2025 A2025-29 (sch 4 pt 4.120), notified 6 November 2025 and commencing 26 December 2025 (endnote 3). The republication includes those amendments. The amendment history (endnote 4) records multiple technical amendments, renumberings and the insertion, amendment or omission of provisions across the decades up to 2025.
• Specific insertions and modernisations.
