What it does
This instrument is the Lord Howe Island Local Environmental Plan 2010 (the Plan), establishing land‑use zones, development controls, heritage protections and procedural requirements that apply to Lord Howe Island (cl 1; cl 3). Mechanically, it does the following.
- Establishes the Board as the primary consent authority for development on the Island, subject to the Act (cl 6).
- Creates a zoning regime (Zones 1, 2, 5, 6, 7, 8 and 9) and describes permitted, consent and prohibited development in each zone (cl 12; Part 2; cl 13-19).
- Sets specific development standards and thresholds (for example, dwelling floor areas, minimum allotment areas, landscaping percentages and setback and height limits) that are conditions precedent to consent (cl 20-33; cl 29; cl 32).
- Provides a Schedule of exempt development and the standards that must be met for development to be exempt (cl 9; Schedule 1).
- Imposes cap‑style limits: a cap on total tourist accommodation capacity (no more than 400 persons, excluding children under 5) (cl 22(4)) and quantitative limits on dwellings (a Board/Director‑General approved total per period, but never more than 25 dwellings in any 20 year period from 28 October 2005) (cl 26).
- Carves out requirements for environmental assessment: certain development must be accompanied by an environmental report addressing detailed matters set out in Schedule 3 (cl 42; Schedule 3), and a species impact statement may substitute for an environmental report in specified limited circumstances (cl 42(4)(b)).
- Protects heritage and relics via a heritage‑development consent overlay that requires consent for alteration, demolition or excavation likely to disturb relics and sets out required assessment content and the potential need for a conservation management plan (Division 3, cl 38-40; Schedule 2).
