What it does
The Long Service Leave Act 1981 (NT) establishes a statutory entitlement to long service leave for employees who are employed in the Northern Territory and are not covered by another long service leave law or award. The Act provides that an employee who has completed at least 10 years of continuous service with an employer is entitled to long service leave on pay at the rate of 1.3 weeks for each completed year of that continuous service. Once the initial 10-year threshold is reached, the employee becomes entitled to take a further period of leave upon the completion of each subsequent 5-year period of continuous service, again at 1.3 weeks per completed year of that 5-year period. The Act also creates a limited pro-rata entitlement for employees who have completed between 7 and 10 years of continuous service and cease employment in specified circumstances: retirement at or after the eligible age, termination by the employer for a reason other than serious misconduct, or cessation on account of illness, incapacity, or domestic or other pressing necessity. An employer must pay the employee for the accrued leave credit when employment ceases, except that in cases of serious misconduct the payment is confined to completed blocks of 10 years or 5 years of service. The Act sets out detailed rules for calculating the amount payable based on the employee’s rate of pay and hours of work per week, excluding overtime and certain allowances. It requires employers to keep and retain records of employees’ service, hours, and leave credits, and empowers the Minister to authorise investigations. An employer may be exempted from the Act if the Minister is satisfied that the employee receives long service leave benefits under a scheme that is not less favourable. The Act overrides employment agreements that confer less advantageous rights on the employee, and it contains offence provisions for non-compliance. The Act applies both to employment before and after its commencement, subject to transitional savings for prior grants of leave.
