Long Service Benefits Portability Regulations 2020

The Regulations operate by filling in statutory references and operational detail used by the Long Service Benefits Portability Act 2018. They revolve around a small number of recurring concepts and operational tests, each of which has implementation implications.

Required information and quarterly returns (regulation 6). The concept of “required information” in section 27(2) of the Act is given content by regulation 6. The Regulation lists each datum an employer must supply for each worker in quarterly returns: the type of long service benefit, whether it was granted or taken, payments made (including in lieu), date of payment, the service period covered, the name of any other fair work instrument that applies, and cessation dates for workers who left in the quarter. The Regulation therefore translates a statutory reporting obligation into a discrete checklist for operational reporting and record‑keeping.

Community service work (regulation 8). The Regulations define “community service work” by prescription, listing specified services (social work, home care in private residences, crisis counselling, emergency relief, custodial/supportive care, needs assessment, community development/education/advocacy, family support, youth services, homelessness services, family violence prevention/response, neighbourhood houses, drug and alcohol services, migrant/refugee support and management/supervision of those services) (regulation 8(1)(a)-(o)). It also captures NDIS‑funded activities and certain children’s services. This concept determines which workers and employers fall within Schedule 1 coverage under the Act and therefore who is eligible for portable long service benefits.

Employer and employee exclusions in the community services sector (regulations 9-10). The Regulations create negative definitions: they prescribe specific entities that are not employers for the community services sector (for example, aged care services operated by hospitals, and listed bush nursing centres and hospitals) and prescribe which individuals are not employees unless they are employed under specified awards (regulation 10 lists five awards). The Regulations emphasise award coverage over enterprise agreement coverage by taking an individual to be employed under an award even where an enterprise agreement or a Fair Work Transition Act transitional instrument applies (regulations 10(2), 13(2)). The concept of “employed under an award” is therefore operationalised by the Regulations in a way that reduces the effect of enterprise agreements on determining coverage.

No double‑dipping (regulation 12). The Regulations operationalise clause 15 of Schedule 1 to the Act. They exclude registered active workers (as referred to in clause 15(1) of Schedule 1 to the Act) from being treated as workers in a covered industry for the same service period where they already have entitlement under a fair work instrument, the Long Service Leave Act 2018 or a contract of employment. They also allow employers to recover payments made under those instruments from the Authority and make the Authority’s obligation to pay conditional on whether the worker has already taken an entitlement elsewhere (regulation 12(1)-(5)). The Regulations also specify that a fair work instrument includes a National Employment Standard or a Fair Work Transition Act transitional instrument (regulation 12(7)).

Exclusion by activity in contract cleaning and security industries (regulations 13-14). For contract cleaning, an individual is an excluded employee if they are employed under specified awards (manufacturing, vehicle repair, airline ground staff, waste management) or if the predominant activity of their substantive role is not the personal delivery of cleaning work (regulation 13). For security, the test is whether the predominant activity of the substantive role is not the personal delivery of security work (regulation 14). The “predominant activity of the substantive role” is the operational test the Authority will apply to exclude roles that are not front‑line cleaning or security duties.

Calculation of benefits on exit or death (regulation 11). The Regulations set a quantitative calculation: if a worker has at least seven years’ recognised service, the payable benefit is 1/60th of the worker’s total recognised service, less long service benefits already paid during that period, and assessed on the worker’s ordinary pay at the date of leaving or death. This prescribes both eligibility (seven years) and the arithmetic for the benefit.

Disclosure recipients and information sharing (regulation 7). By prescribing the ATO and the Labour Hire Licensing Authority as entities to which the Authority may disclose information under the Act the Regulations create explicit inter‑agency data flows, which will affect compliance monitoring and potential enforcement actions by those bodies.

Schedules of named entities (Schedules 1-2). The Regulations contain schedules listing bush nursing centres and bush nursing hospitals that are carved out from the community services sector employer definition. These schedules are the granular expressions of exclusions in regulation 9(b)-(c).

Other structural points. The Regulations repeal the Interim Regulations and commence as a full‑term instrument from 1 October 2020 and are subject to a sunset date ten years after making (endnotes). They also record amendments made by later statutory rules; several regulations were amended by S.R. No. 95/2021 and S.R. No. 26/2022 as noted in the table of amendments and in‑text amendment notes.

Each of these concepts is defined by reference to another instrument or statutory term (for example, “fair work instrument”, “the Act”, the Long Service Leave Act 2018, NDIS funding, and particular awards). The Regulations therefore function largely as cross‑references and detailed lists that turn statutory scaffolding in the Act into administrable rules.

The Regulations affect a number of identifiable actors by changing reporting obligations, determining coverage, and creating inter‑agency disclosure lines. The principal groups affected are employers, workers, the Authority established under the Act, and specified government entities.

Employers in covered industries. Employers who operate in industries covered by the Act are affected differently depending on sector. For general purposes the Regulations directly affect any employer required to supply “required information” about long service benefits when making quarterly returns under section 27(2)(c) of the Act: regulation 6 prescribes the precise fields to be reported for each worker. Employers in the community services sector are subject to further substance tests: the Regulations list which services count as community service work (regulation 8) and then exclude specified classes of persons and entities from being “employers” for that sector (regulation 9). Those listed exclusions include certain aged care services operated by hospitals, specified bush nursing centres and hospitals (Schedules 1-2), and particular health service classes; for‑profit approved children’s services are explicitly excluded from employer coverage in the community services sector (regulation 9(d)-(e)).

Workers in covered industries. Workers are affected in four ways. First, the data employers must report under regulation 6 is about individual workers and their benefit history, so individual workers’ entitlements and histories will be captured operationally. Second, the Regulations explicitly limit who counts as an “employee” for community services purposes to individuals employed under specified awards (regulation 10). This means workers may find their status for the portability scheme determined by award classification rather than by an enterprise agreement or contract (the Regulation treats an individual as employed under an award even if an enterprise agreement applies (regulation 10(2))). Third, workers who have entitlements under other instruments (a fair work instrument, the Long Service Leave Act 2018 or a contract of employment) and are registered active workers may be excluded from receiving duplicate payments under the portable scheme for the same service period (regulation 12). Fourth, the calculation of exit benefits for community services workers is specified (regulation 11): entitlements accrue to a 1/60th multiplier subject to a seven‑year threshold and reduction for benefits already paid.

The Authority and data recipients. The Authority administering the Act is affected because the Regulations set the content of data it will receive and the external bodies to which it may disclose information (regulation 7). The Australian Taxation Office and the Labour Hire Licensing Authority are prescribed disclosure recipients (regulation 7). That affects how the Authority will coordinate with tax compliance and labour hire licensing regimes.

Employers in contract cleaning and security industries. The Regulations alter coverage for these industries by prescribing excluded employees. In contract cleaning, employment under certain awards (manufacturing, vehicle repair, airline operations ground staff, waste management) excludes individuals from scheme coverage, and a role may also be excluded where the predominant activity is not the personal delivery of cleaning services (regulation 13). For security, the same “predominant activity” test applies (regulation 14). These exclusions will affect payroll and administrative obligations for employers with mixed‑duty staff.

For‑profit children’s services and certain health services. The Regulations carve out some providers from being “employers” in the community services sector (regulation 9(e) and 9(d)(i)-(iii)). This shifts who pays and who reports within family and children’s service markets and for small rural health providers listed in the schedules.

Personal representatives and deceased workers. Regulation 12(6) clarifies that references to registered active workers include personal representatives for the purposes of clause 11(2) of Schedule 1 to the Act, which affects estate administration and benefit claims after death.

Entities listed in the Schedules. The named bush nursing centres and hospitals in Schedules 1 and 2 are specifically affected because they are prescribed not to be employers for the community services sector (regulation 9(b)-(c)); that changes their obligations and the treatment of their workers under the portable scheme.

All affected parties must also be alert to the Regulations’ approach to instrument hierarchy. The Regulations treat a fair work instrument to include a National Employment Standard and transitional instruments under the Fair Work Transition Act (regulation 12(7)), and treat employment under an award as still applying even when an enterprise agreement or transitional instrument is in force (regulations 10(2), 13(2)). This can produce counterintuitive coverage outcomes for employer and worker parties who had relied on enterprise agreements to shape long service arrangements.

Lastly, the Regulations will affect administrative and compliance burdens: employers must hold and report precise benefit and service period information every quarter; the Authority will develop processes to check double‑entitlement issues and liaise with the ATO and the Labour Hire Licensing Authority; and employers in excluded classes must understand the carve‑outs to plan payroll and entitlements. The Regulations also have a sunset date recorded in the endnotes at the statutory instrument level, meaning all affected parties should be aware that the prescriptions expire in ten years unless renewed.

The Regulations convert statutory powers and definitions in the Act into operational duties for employers and rights for certain parties. The duties centre on reporting, record keeping, compliance with exclusion tests, and coordination where entitlements overlap.

Employer reporting duty (regulation 6). For the purposes of section 27(2)(c) of the Act, regulation 6 prescribes the exact content employers must provide in quarterly returns. That translates into a clear duty: employers must furnish, for each worker, details of any long service benefits given during the quarter (types of benefit, dates, service periods, name of other fair work instruments that confer entitlement), and for each worker who ceased employment during the quarter, the date of cessation (regulation 6(a)-(b)). While the Regulation does not itself state the sanction for failure to provide the information (penalties are a matter for the Act), it places an administrative duty on all employers who fall within the Act’s reporting regime to capture and transmit these data points.

Record‑keeping and calculation duty for community services exits (regulation 11). Employers in the community services sector have a duty to calculate and, where the Act requires, to pay,or account for,exit payments using the method set out by regulation 11: only workers with at least seven years’ recognised service are eligible, the amount equals 1/60th of total recognised service less any long service benefit already paid during that period, and it is to be calculated on ordinary pay at the date the worker left the sector or died. Employers therefore must maintain continuous records of recognised service, payments made, and ordinary pay rates at exit dates.

Exclusion assessments and classification duties (regulations 9-10, 13-14). Employers have a duty to determine whether they are an “employer” within the community services sector definition or an excluded employer, and whether individuals are employees for the scheme. Regulation 9 prescribes classes of persons that are not employers in the community services sector (for example, certain hospital‑operated aged care services and listed bush nursing entities). Regulation 10 prescribes that an individual is not an employee for the community services sector unless employed under one of five named awards; the Regulation explicitly states that an individual is taken to be employed under an award even if an enterprise agreement or transitional instrument applies (regulation 10(2)). For contract cleaning and security industries, employers must assess whether an individual’s substantive role has as its predominant activity the personal delivery of cleaning or security work (regulations 13(3) and 14). These are duties of classification: employers must apply the prescribed tests in practice and maintain the evidence base for any classification decisions.

No double‑dipping and recovery rights (regulation 12). The Regulations create rights and duties in overlapping entitlement situations. If a registered active worker already has entitlement to long service leave under another instrument for the same service period, the Authority is not required to pay a duplicate long service benefit (regulation 12(4)). Conversely, where an employer is required to pay the worker under a fair work instrument, the Long Service Leave Act 2018 or a contract of employment in relation to the same service period, the employer has the right to recover and be reimbursed by the Authority any amount paid under those instruments for the worker (regulation 12(5)). Those rules impose duties on employers to keep records of such payments and to pursue reimbursement from the Authority when appropriate.

Information disclosure and inter‑agency rights (regulation 7). The Regulations give the Authority power to share Act‑related information with prescribed entities: the ATO (as a Commonwealth government entity) and the Labour Hire Licensing Authority (as a Victorian government entity) (regulation 7). This creates disclosure rights for those entities to receive information from the Authority under the Act’s information‑sharing scheme. Affected parties should therefore expect administrative interactions between the Authority and those agencies.

Treatment of enterprise agreements and transitional instruments (regulations 10(2), 13(2), 12(7)). The Regulations treat persons as employed under an award even if an enterprise agreement or agreement‑based transitional instrument applies. This has the practical effect of limiting the capacity of enterprise agreements to displace award‑based characterisation for the purposes of coverage under Schedule 1 and Schedule 2 to the Act. It imposes a duty on employers to characterise employment under the tests the Regulations prescribe rather than relying on enterprise agreement wording alone.

Statutory timelines and revocation (regulations 3-4 and endnotes). The Regulations commenced on 1 October 2020 and revoked the Interim Regulations, meaning duties created by the Interim Regulations were replaced on that date (regulations 3-4). The endnotes record the sunset ten years after making. Parties therefore have a temporal duty to observe the Regulation’s prescriptions while they are in force.

What the Regulations do not do (express absence of duties). The Regulations do not themselves prescribe civil or criminal penalties, nor do they set out detailed enforcement procedures; they are primarily definitional and reporting instruments. Where enforcement, penalties and compliance mechanisms lie will be as provided in the parent Act. Practitioners should therefore consult the Act for enforcement rights and duties not spelled out in these Regulations.

The Regulations do not themselves create a detailed enforcement regime or specify separate penalties; instead they operate by prescribing reporting, definitional and procedural obligations that link into the enforcement and compliance mechanisms of the Long Service Benefits Portability Act 2018. The text of the Regulations that is provided makes this division clear.

Silence on specific penalties. Nowhere in the Regulations is a fine, offence, or administrative penalty provision inserted or amended. The principal compliance obligations in the Regulations are prescriptive (for example, the content of quarterly returns in regulation 6) but the instrument does not attach monetary penalties or specify enforcement procedures for breaches. Accordingly, enforcement and sanctioning are a function of the Act under which these Regulations are made; practitioners must consult the parent Act for offences, penalties, defect‑rectification powers and appeal processes.

Operational enforcement tools created by the Regulations. Although the Regulations do not set penalties, they create operational levers that can be used in enforcement and compliance activity:

• Information requirements under regulation 6 create an evidentiary base. By prescribing the exact fields employers must provide in quarterly returns, regulation 6 furnishes the Authority with detailed transaction‑level data (dates of payments, service periods, names of other fair work instruments, etc.). That data can be used for audits, compliance checks and to trigger follow‑up inquiries under powers in the Act.

• Inter‑agency disclosure in regulation 7 prescribes two disclosure recipients,the Australian Taxation Office and the Labour Hire Licensing Authority. Those bodies have their own compliance powers. The Regulations explicitly permit the Authority to disclose information to those agencies (regulation 7(1)-(2)), enabling cross‑agency action such as tax audits or checks against labour hire licences. That creates an enforcement multiplier: non‑compliance may be referred into other regimes without separate statutory gateways.

• Recovery and reimbursement rights (regulation 12(5)). The Regulations enable employers to recover from and be reimbursed by the Authority amounts they have paid under a fair work instrument, the Long Service Leave Act 2018 or a contract of employment in relation to the same service period. Although framed as an entitlement to reimbursement rather than a sanction, in practical terms this creates a mechanism to correct double payments and can deter under‑reporting or incorrect allocation of payments.

Matters that commonly attract disputes but are not procedural penalties in the Regulations. Several regulatory features are likely to be the subject of compliance checks and disputes:

• Classification disputes. Whether an employer or worker falls within an excluded class (regulation 9), whether an individual is “employed under an award” for community services purposes (regulation 10), or whether the predominant activity of a substantive role is the personal delivery of cleaning or security services (regulations 13 and 14) are factual questions that affect entitlement and reporting duties. These classification issues are natural points for audits and potential contestation.

• Calculation disputes. Regulation 11 prescribes the arithmetic for community services exit benefits (1/60th of total recognised service less benefits already paid). Disagreement about what counts as recognised service, the correct ordinary pay to use at exit, or the identification of amounts “paid during that period” may lead to claims against employers or the Authority.

• Interaction with other instruments. Regulation 12’s “no double‑dipping” provisions require coordination across multiple instruments. Determining whether a worker’s entitlement exists under a fair work instrument, the Long Service Leave Act 2018, a contract of employment or the Act for the same service period is a question that could trigger enforcement action if mischaracterised.

Administrative relief and cure. The Regulations themselves do not specify administrative remedies (for example, rectification windows, amendment rights for quarterly returns, or late lodgement penalties). Those procedural mechanisms will be found in the Act or in administrative practice of the Authority. Because the Regulations tie reporting to quarterly returns, the Authority’s internal compliance processes and the Act’s investigative powers are the likely enforcement instruments.

Practical enforcement consequences. For practitioners advising clients the immediate enforcement‑related consequences flow from the interplay between the Regulations’ reporting duties, classification rules, and the Authority’s capacity to share information with the ATO and Labour Hire Licensing Authority. Non‑compliance with reporting obligations or misclassification can lead to cross‑checks with tax and labour‑hire regimes and, through those channels, to further regulatory scrutiny. The Regulations thus increase the granularity of data available for enforcement, while deferring the allocation of sanctions to the parent Act and other statutory regimes.

The Regulations expressly interact with and cross‑reference multiple Commonwealth and Victorian instruments. Those cross‑references define coverage boundaries, reporting interfaces, and how entitlements under other statutes or instruments are treated.

Fair work instruments and the Fair Work Transition Act. The Regulations repeatedly reference “a fair work instrument”. Regulation 12(7) explicitly states that “a fair work instrument includes a National Employment Standard within the meaning of the Fair Work Act; or a transitional instrument under the Fair Work Transition Act.” Regulation 10(2) and regulation 13(2) also make clear that an individual is taken to be employed under an award even if an enterprise agreement or an agreement‑based transitional instrument under the Fair Work Transition Act applies to the individual’s workplace. These cross‑references establish that the Regulations operate in the context of Fair Work Act constructs and that transitional instruments under the Fair Work Transition Act are treated as fair work instruments for the purposes of exclusion and double‑dipping rules.

Long Service Leave Act 2018. Regulation 12 treats entitlements under the Long Service Leave Act 2018 as one of the alternative entitlement sources which, if they apply to a worker for a service period, will prevent duplication under the portability Act. Employers and the Authority therefore must assess whether long service leave is already available under that Act for the same service period before paying or claiming benefits under the portability scheme.

Labour Hire Licensing Act 2018. Regulation 7(2) prescribes the Labour Hire Licensing Authority, established by section 50 of the Labour Hire Licensing Act 2018, as a Victorian government entity for the purposes of section 51(3) of the Act. That creates a statutory disclosure channel between the Authority and the Labour Hire Licensing Authority, enabling labour hire licensing regulators to receive portability scheme information. This intersects licensing compliance regimes and may affect labour hire operators under the licensing Act.

National Disability Insurance Scheme Act 2013 (NDIS). Regulation 8(2) prescribes that NDIS‑funded activities are community service work for the purposes of Schedule 1 to the Act. This places NDIS‑funded providers and workers within the community services coverage of the portability scheme, subject to other exclusions in the Regulations.

Children’s Services Act 1996 and the Education and Care Services National Law (Victoria). Regulation 8(3) prescribes services provided by entities that are approved children’s services under the Children’s Services Act 1996 or approved providers under the Education and Care Services National Law (Victoria) as community service work, with an express exclusion for entities that are registered schools under the Education and Training Reform Act 2006 (regulation 8(3)). Regulation 9(e) then prescribes for‑profit approved children’s services as not being employers for the purposes of the community services sector. This creates a cross‑over with children’s services regulation and draws careful lines between non‑profit and for‑profit providers for scheme coverage.

Health Services Act 1988 and Safe Patient Care (Nurse to Patient and Midwife to Patient Ratios) Act 2015. Regulation 9(d) excludes certain health or related services from being employers for the community services sector except for registered community health centres and women’s health services and other disability‑related services specified in the Health Services Act 1988. Regulation 9(a) also excludes an aged care service operated by a hospital within the meaning of the Safe Patient Care Act 2015. These references tie the portability scheme’s community services employer definition into the statutory architecture governing public and private health services in Victoria.

Tax law and ATO interface. Regulation 7(1) prescribes the Australian Taxation Office as a Commonwealth government entity for the purposes of section 51(3) of the Act. This enables the Authority to share information with the ATO and creates an explicit link between portability scheme data and tax administration. That interaction may intersect PAYG, superannuation and fringe benefits compliance activities, depending on the ATO’s use of the data.

Fair work instruments, enterprise agreements, and transitional instruments. The Regulations’ method of treating employees as employed under the named awards even where enterprise agreements apply creates an internal hierarchy that can affect how enterprise agreements and awards interact with the portability scheme (regulations 10(2), 13(2)). Practically, employers who rely on enterprise‑level terms to alter long service arrangements cannot assume those terms will displace award‑based characterisation for portability‑scheme coverage where the Regulations prescribe otherwise.

Subordinate Legislation Act 1994 and sunset. The endnotes state that the Regulations will sunset ten years after the day of making (the Subordinate Legislation Act 1994 is cited). This procedural interaction matters to lawyers advising clients on the continuity of obligations: the instrument is temporary in effect unless re‑made or extended pursuant to the Subordinate Legislation Act provisions.

Overlap and potential friction. The Regulations create overlaps that require operational coordination: entitlements under the Long Service Leave Act 2018, fair work instruments, contracts of employment and the portability Act must be reconciled for the same service periods (regulation 12). Employers and the Authority will need processes to identify overlapping entitlements and trigger reimbursements under regulation 12(5). The Regulations’ cross‑references therefore integrate the portability scheme with workplace, health, children's services, NDIS, labour hire licensing and tax regulatory regimes.

The instrument includes recorded amendments and notes on revocation and commencement that are relevant for practitioners tracking the Regulations’ evolution.

Initial making and commencement. The Regulations were made by the Governor in Council under section 79 of the Long Service Benefits Portability Act 2018 (regulation 2) and came into operation on 1 October 2020 (regulation 3). The Regulations also explicitly revoke the Long Service Benefits Portability Interim Regulations 2019 (regulation 4). The explanatory endnotes reiterate the date of making (1 September 2020) and the commencement date (1 October 2020).

Sunset. The endnotes record that the Regulations will sunset ten years after the day of making in accordance with the Subordinate Legislation Act 1994; that means, on the published information, the Regulations will sunset on 1 September 2030. Practitioners should note the sunset provision because it affects long‑term compliance planning and whether the definitions and exclusions are expected to be permanent or re‑evaluated.

Statutory rule amendments recorded in the table of amendments. The endnotes include a table of amendments showing two subsequent Statutory Rules:

• Long Service Benefits Portability Amendment Regulations 2021, S.R. No. 95/2021, made 3 August 2021 and commenced on 3 August 2021. The in‑text notes identify that regulation 12 was amended by S.R. No. 95/2021 (see the marginal amendments notes in regulation 12). Specifically, the text records “Reg. 12(2) amended by S.R. No. 95/2021 reg. 4(1)”, “Reg. 12(3) amended by S.R. No. 95/2021 reg. 4(2)”, “Reg. 12(4) amended by S.R. No. 95/2021 reg. 4(3)”, and “Reg. 12(5) amended by S.R. No. 95/2021 reg. 4(4)”. Those annotations show that the no double‑dipping provisions were adjusted in 2021.

• Long Service Benefits Portability Amendment (Schedules) Regulations 2022, S.R. No. 26/2022, made 10 May 2022 and commenced on 10 May 2022. The in‑text notes indicate amendment to regulation 13 (heading and subregulations) and regulation 14. The instrument records “Reg. 13 (Heading) amended by S.R. No. 26/2022 reg. 4(1)”, “Reg. 13(1) amended by S.R. No. 26/2022 reg. 4(2)”, “Reg. 13(3) amended by S.R. No. 26/2022 reg. 4(2)”, and “Reg. 14 (Heading) amended by S.R. No. 26/2022 reg. 5(1)” and “Reg. 14 amended by S.R. No. 26/2022 reg. 5(2)”. Those amendments adjusted excluded employee definitions and the schedules.

Revocation of interim Regulations. Regulation 4 revokes the Long Service Benefits Portability Interim Regulations 2019 (the endnotes show that instrument as S.R. No. 110/2019). That revocation replaced an interim framework with the present Regulations as at 1 October 2020.

In‑text amendment markers. Several regulations carry amendment notes (for example regulation 12’s subparts and regulation 13’s subparts). The presence of these marginal notes in the published text identifies specific subregulations altered by later statutory rules. Those amendment markers are part of the official republication and should be relied on to trace which parts were substantively changed.

Schedules updated by amendments. The 2022 Amendment Regulations are titled “Amendment (Schedules) Regulations” indicating that schedules,specifically the lists of named bush nursing centres and bush nursing hospitals,were the focus of the 2022 instrument. Practitioners should check the Schedules for additions or removals reflected in S.R. No. 26/2022.

Practical implication for compliance. The amendment history shows that the no double‑dipping provisions and the excluded employee tests for contract cleaning and security were considered and amended after initial commencement. That indicates the Authority and the Legislature expect to refine the scheme’s operational boundaries post‑commencement. Parties should therefore build processes that accommodate future rule adjustments, and they should consult the consolidated instrument or the statutory rule history when advising clients.

Record keeping of amendment references. Each change is recorded in the instrument’s endnotes and table of amendments. For authoritative legal advice or compliance checks, practitioners should consult the consolidated version of the Regulations incorporating S.R. No. 95/2021 and S.R. No. 26/2022 as indicated in the version statement at the head of the text.

The Regulation text and the endnotes as provided do not identify any litigation arising under these Regulations, and they do not cite judicial decisions. There are no cases named in the instrument, and the endnotes do not record any court or tribunal proceedings. Consequently there is no statutory litigation history contained within this instrument to summarise.

Although the Regulations themselves are silent as to litigation outcomes, the text identifies points that are likely to generate disputes and therefore litigation or tribunal determinations over time. Those issues include the following topics, all of which are anchored in the Regulations’ text and have clear dispute potential:

• Classification disputes. The question whether an employer is excluded for the community services sector because it is a listed bush nursing centre or hospital (Schedules 1-2 and regulation 9), whether a person is an employer for the sector, and whether an individual is an employee for the community services sector because they are employed “under one of the following awards” (regulation 10) are factual and legal issues likely to produce disputes. Regulators, employers and workers may differ on whether particular work arrangements fall within the award categories or whether enterprise agreement terms displace award characterisation. Regulation 10(2) requires that an individual is taken to be employed under an award even if an enterprise agreement or a Fair Work Transition Act transitional instrument applies, which itself could be a locus of contention.

• “Predominant activity of the substantive role” tests. The contract cleaning (regulation 13(3)) and security (regulation 14) exclusions rely on whether the predominant activity of a role is the personal delivery of cleaning or security services. The Regulations do not define “predominant activity” or “substantive role,” leaving room for disputes about the proper factual test and evidence. Cases, if litigated, would likely hinge on evidentiary demonstrations of role duties and time allocation.

• Calculation and service recognition. Regulation 11 prescribes the calculation of benefits for leaving the community services sector, but leaves open questions about what counts as “recognised service,” how to treat breaks, casual engagements, or transfers between covered and excluded employers, and how to calculate “ordinary pay” at exit. Disagreements on these matters tend to be litigated under underlying statutes or industrial instruments.

• Double‑entitlement and reimbursement. Regulation 12’s interaction between the portability scheme and other entitlements (fair work instrument, Long Service Leave Act 2018, or contract of employment) will create factual disputes over whether the same service period is covered elsewhere, and whether the Authority must reimburse an employer pursuant to regulation 12(5). That provision could give rise to claims about the Authority’s reimbursements and administrative decisions about eligibility.

• Information disclosure and privacy. Regulation 7 prescribes disclosure to the ATO and the Labour Hire Licensing Authority. Although the Regulations do not address privacy regimes directly, disputes could arise if parties allege improper disclosure, misuse of data, or procedural failures in information sharing. Any litigation here would likely involve data‑protection or administrative law grounds.

Because the Regulations do not themselves set out enforcement sanctions, litigation that arises is more likely to be about the correct application of the Regulations in specific factual circumstances and about procedural fairness and administrative decisions made by the Authority under the Act. As there is no litigation history recorded in the instrument, tracking emerging case law will require monitoring administrative decisions and tribunals or courts where disputes concerning classification, calculation, and reimbursement of benefits are argued.

Practitioners preparing advice should therefore anticipate that disputes will centre on factual characterisations (what classifies as community services work; whether a role’s predominant activity is personal delivery), evidentiary issues about service records and payments made, and the proper application of the Regulations’ cross‑references to awards and other statutory instruments. Until and unless litigation develops, the Regulations themselves stand as an administrable framework without reported judicial interpretation in the provided text.

The Regulations contain specific drafting choices that produce practical traps for employers, workers, and advisers. The following are concrete risks drawn from the text, with the precise regulatory source noted.

Quarterly returns are detailed and prescriptive (regulation 6). Employers must report, for each worker, the type of long service benefit, dates, service periods, and the name of any other fair work instrument that confers entitlement (regulation 6(a)). These are transaction‑level data requirements. Employers who have not kept contemporaneous records of dates of benefits, service periods, or the name of the other fair work instrument will face compliance gaps. The duty applies to each worker and to any worker who ceased employment during the quarter (regulation 6(b)), so staff turnover increases the reporting burden. Non‑technical payroll systems or ad hoc record‑keeping will not be sufficient.

Award‑centric employee test in community services (regulation 10). Regulation 10 prescribes that an individual is not an employee for the community services sector unless they are employed under one of five named awards, and that the individual is taken to be employed under an award even if an enterprise agreement or a Fair Work Transition Act transitional instrument applies (regulation 10(2)). Employers and employees who assume enterprise agreement coverage displaces award characterisation may be mistaken. The Regulation flips the usual operational expectation that enterprise agreements can shape entitlements; here, the Regulations make award coverage decisive for scheme inclusion.

Exclusions can be counter‑intuitive (regulation 9). Several provider types are explicitly not employers for the purposes of the community services sector: aged care services operated by hospitals, bush nursing centres and hospitals listed in Schedules 1-2, and some health or related services (regulation 9(a)-(c) and (d)). For example, a small rural health service that matches the definition in the Health Services Act could be excluded unless it is a registered community health centre or women’s health service (regulation 9(d)(i)-(ii)). Practitioners should not assume that all organisations delivering the listed community service work are treated the same for the portability scheme.

For‑profit children’s services excluded as employers (regulation 9(e)). An entity for profit that is an approved children’s service is prescribed not to be an employer for the community services sector. That has immediate implications for contributions, reporting obligations and entitlements for workers in some childcare settings. Employers must check their profit status and registration status carefully.

Predominant activity test for cleaning and security (regulations 13(3) and 14). The Regulations exclude employees whose predominant activity is not the personal delivery of cleaning or security work. They do not define “predominant” or “personal delivery,” which are factual tests. That vagueness will lead to disputes, particularly for roles that blend administrative tasks with occasional cleaning or security duties. Employers should document time allocation and role descriptions.

Interaction with other entitlements and reimbursement mechanics (regulation 12). The no double‑dipping rules in regulation 12 are favourable to preventing duplication, but they require careful co‑ordination. If an employer pays long service leave under a fair work instrument for a service period that would otherwise be covered by the portable scheme, the employer may recover from the Authority amounts paid (regulation 12(5)). The “may recover” formulation is permissive and creates a procedural obligation on employers to claim reimbursement; employers who pay without timely pursuing recovery may bear costs unnecessarily. Conversely, employees should ensure they do not unwittingly exhaust entitlements under one instrument without understanding their rights under the portability scheme.

Calculation timing and ordinary pay at exit (regulation 11). The exit calculation uses the worker’s ordinary pay at the date the worker left the sector or died. Employers must preserve accurate records of pay rates at exit dates. Disputes can arise if ordinary pay is ambiguous (for example, where pay rates change in the exit notice period or where ordinary pay includes allowances whose treatment is contested).

Schedules are specific and binding (Schedules 1-2). Entities listed in the Schedules are specifically prescribed not to be employers for the community services sector. Employers operating at similar locations should not assume that an entity not listed is outside the Regulation’s exclusions. Conversely, if an entity is listed, it is explicitly carved out. The 2022 Amendment (Schedules) Regulations suggests these lists were subject to change, so relying on a static schedule without checking the consolidated instrument is risky.

Information sharing with ATO and Labour Hire Licensing Authority (regulation 7). The Authority may disclose information to the ATO and the Labour Hire Licensing Authority. Employers should be aware that their quarterly returns could be shared with taxation and labour‑hire regulators, possibly triggering separate compliance audits. Privacy and data governance considerations are therefore operationally relevant.

No penalties are stated in the Regulations. The instrument itself does not detail penalties or enforcement steps. Practitioners should not assume the Regulations confer immunity or contain safe harbours. Instead, enforcement and penalties will be governed by the Act and by other regulatory regimes that may receive information under regulation 7. Failing to consult the Act for enforcement provisions is a common oversight.

Sunset and future amendments. The Regulations will sunset in ten years unless re‑made (endnotes). Subsequent amendments (2021 and 2022) have already altered key provisions. Employers and advisers should not assume permanence: classification rules, definitions, and schedules may be revisited.

Taken together, these “gotchas” show that the scheme creates precise reporting duties and that coverage and entitlement depend on award classifications, activity‑based tests, and cross‑referencing with other statutes. Practical compliance requires disciplined payroll records, clear role descriptions, and active monitoring of regulatory changes.

Compliance with the Regulations requires a combination of record‑keeping, classification decisions, reporting processes and inter‑agency coordination. Below are actionable steps mapped to specific regulatory provisions.

1. Update payroll and HR systems to capture required quarterly fields (regulation 6). Employers who must lodge quarterly returns under section 27(2)(c) of the Act should ensure their systems store, for each worker and for each quarter:

• types of long service benefits given (long service leave granted/taken; payments for or in lieu of long service leave; any other long service benefits) (regulation 6(a)(i)-(iii));
• the date on which benefits were paid or given (regulation 6(a)(iv));
• the service period to which the benefits relate (regulation 6(a)(v));
• the name of any other fair work instrument that provides for a long service leave entitlement applying to the worker (regulation 6(a)(vi));
• for workers who ceased employment during the quarter, the date the worker ceased employment (regulation 6(b)).

Design data fields to allow export to the Authority’s return format, and retain underlying documentation (payroll slips, orders for payment, leave records) for audit purposes.

2. Determine employer coverage in the community services sector (regulations 8-9 and Schedules). Conduct a legal classification review:

• Map services provided against the list in regulation 8(1)(a)-(o) and check NDIS funding eligibility under regulation 8(2) and children’s services status under regulation 8(3).
• Check whether the organisation is expressly excluded as an employer by regulation 9(a)-(e) or by appearing in Schedule 1 or Schedule 2. For small health providers, confirm whether the entity is a registered community health centre or women’s health service (regulation 9(d)(i)-(ii)).

Document the legal basis for your classification and keep it with HR files.

3. Classify workers as employees for scheme purposes (regulation 10). For community services sector purposes, only individuals employed under the listed awards are treated as employees under regulation 10(1). Take the following steps:

• Identify which operational award applies to each role (Social, Community, Home Care and Disability Services Award 2010; Children’s Services Award 2010; Educational Services (Teachers) Award 2010; Labour Market Assistance Industry Award 2020; Supported Employment Services Award 2020).
• Where an enterprise agreement or a Fair Work Transition Act transitional instrument applies, record why the employee is nevertheless treated as employed under the award for portability purposes (regulation 10(2)).
• For contract cleaning and security, apply the “predominant activity” test and keep role descriptions and time allocation evidence to justify classification (regulations 13(3) and 14).

4. Implement exit benefit calculation procedures for community services workers (regulation 11). Maintain continuous service records to determine recognised service. For eligible workers (at least seven years’ recognised service), use the formula in regulation 11:

• Compute 1/60th of the worker’s total period of recognised service.
• Subtract any long service benefit paid during that recognised service period.
• Use the worker’s ordinary pay at the date the worker left the sector or died as the basis for calculation.

Retain payroll records, pay rate histories, and proof of prior long service benefit payments.

5. Establish processes to identify and manage overlapping entitlements (regulation 12). To operationalise the no double‑dipping rules:

• Before making or accepting claims for payment under the Act, check whether the worker has existing entitlements to long service leave under a fair work instrument, the Long Service Leave Act 2018, or a contract of employment for the same service period.
• If the employer has paid under another instrument, prepare and submit a reimbursement claim to the Authority under regulation 12(5), ensuring records of payment and the basis of the other entitlement are kept.
• If a worker chooses to take leave under another instrument, document the worker’s choice so that the employer is only required to pay under that other instrument (regulation 12(3)), and alert the Authority if necessary.

6. Prepare for inter‑agency disclosure (regulation 7). Because regulation 7 prescribes the ATO and the Labour Hire Licensing Authority as disclosure recipients, be ready for the following:

• Ensure that the quarterly return data is consistent with tax reporting (PAYG, superannuation) to minimise mismatches that might trigger ATO inquiries.
• For labour hire operators, ensure labour hire licences and reporting are up to date; the Labour Hire Licensing Authority may request or receive portability scheme data.

7. Maintain compliance calendars and monitor amendments. The Regulations have been amended since commencement (S.R. No. 95/2021; S.R. No. 26/2022). Establish a regulatory watch to:

• Monitor statutory rules and consolidated versions of the Regulations.
• Update HR policies and reporting templates when changes are made.
• Note the sunsetting date in the Subordinate Legislation Act‑based endnote and plan for potential re‑enactment or replacement of the Rules before 1 September 2030.

8. Document classification rationales and maintain evidence. Because the Regulations use factual tests (for example, “predominant activity”), retain:

• role descriptions, duty statements and time allocation logs;
• award coverage analyses and enterprise agreement comparisons;
• payroll records showing ordinary pay at relevant dates;
• copies of any payments made under other instruments and the legal basis for them.

This evidence will be needed to support reimbursement claims to the Authority and to defend against audits.

9. Engage with the Authority and seek clarifications where necessary. Where the Regulations leave room for operational discretion (for example, what constitutes “predominant activity” or how “recognised service” is calculated in complex employment histories), seek formal guidance from the Authority, request written rulings where possible, or negotiate administrative arrangements, documenting all contacts and responses.

10. Train HR and payroll staff. Ensure personnel responsible for leave, payroll and compliance understand the specific data items in regulation 6, the classification rules in regulations 9-14, and the calculation method in regulation 11. Embed the processes into onboarding, offboarding, and payroll change workflows.

By combining robust record‑keeping, carefully documented classification decisions, proactive reporting systems, and an active regulatory watch, employers and advisers can reduce compliance risk under these Regulations. Where uncertainties remain, consult the parent Act for enforcement details and obtain specific legal advice on contested factual classifications or disputed benefit calculations.
