Local Nuisance and Litter Control Regulations 2017

The Regulations introduce a set of operational concepts to give effect to the Local Nuisance and Litter Control Act 2016. They are framed as “for the purposes of” particular Act provisions. The main concepts to understand, and the central mechanics they enable, are the following:

• Exempt person and responsible person, and the exemption application process (regulation 6). An “exempt person” is someone declared exempt under section 19(1) of the Act; regulation 6 prescribes how an application for that declaration must be lodged (in writing, by post/fax/email or delivered in person), the lodgement periods (minimum 2 weeks for activities under 24 hours; 4 weeks for activities of 24 hours or longer unless the council fixes a different period), the applicant details required, and the fee (if any) set by the council under the Local Government Act 1999 (regulation 6(1)(a)-(b)). Regulation 6(3) then sets out the detailed content that a site nuisance management plan must include where required by section 19(2)(a) of the Act: assessment of potentially affected premises, mapping, strategies to minimise nuisance, communications strategies (including a model notice), reporting and complaint recording processes.

• Guidelines and matters to be taken into account by councils and authorised officers (regulation 4). For section 7(3) of the Act, the Regulations prescribe that councils must follow either their own unreasonable complainant conduct guidelines or, if none, the New South Wales Ombudsman manual “Managing unreasonable conduct by a complainant” (March 2021) (regulation 4(1)(a)). They must also take into account specified factors when administering the Act in relation to local nuisance and in determining conditions of nuisance abatement notices, namely: sensitivity of affected premises, land use categories, avoidability of the nuisance, timing of activities relative to traffic/pedestrian convenience, reasonable measures taken at source premises, and whether an activity is carried out under a Development Act authorisation in accordance with that authorisation (regulation 4(1)(b)(i)-(vi)).

• Measurement and evidentiary procedures (regulation 7). The Regulations allow an authorised officer to form an opinion about the presence of local nuisance on the basis of the officer’s own senses in determining the presence of nuisance for the purposes of section 21(d) of the Act, subject to section 17(1) of the Act (regulation 7). That is an express endorsement of sensory observation as valid evidence in nuisance determinations.

• Litter definitions and exemptions (regulations 8-9). The Regulations specify that building or construction material (clay, concrete, rock, sand, soil or other mineralogical matter) dragged onto a road by a vehicle’s tyres after leaving a construction site constitutes “general litter” for littering offences (regulation 8). They also create a narrow exemption from section 22 for persons placing artificial reefs into waters where they have a Fisheries Management Act 2007 approval and a Development Act 1993 authorisation (regulation 9).

• Bill posting definition (regulation 10). A “bill” includes a moveable sign within the meaning of the Local Government Act 1999 that is placed or maintained on a road otherwise than as authorised under section 226 of the Local Government Act 1999. This ties the bill-posting offence to the Local Government Act’s regulation of moveable signs.

• Citizen’s notification forms and verification (regulation 11; Schedule 1). The Regulations prescribe the form content for citizen notifications for littering and bill posting and require verification by signature or as approved by the Minister. Schedules set out explicit data items to be collected (notifier identification, incident details, vehicle data if applicable, witness details, whether the notifier will attend court, and whether photographic/video/GPS evidence is available).

• EPA notifications (regulation 12). When a council notifies the Environment Protection Authority of actual or potential serious or material environmental harm, the Regulations prescribe the types of information councils should supply: investigation statements, copies of relevant evidence (images, video, transcripts, maps, analyses, certificates), limitation period details, and details of prescribed periods for seized items (regulation 12(a)-(c)).

• Remedies and enforcement mechanics: charges on land and costs recovery (regulation 13). The Regulations specify the interest rate applicable to recoverable amounts (cash advance debenture rate) and set out a formal Registrar‑General notation process that, when entered, creates a charge on land that may confer power of sale equivalent to a mortgagee in default in the case of a charge in favour of the Minister, or treatment comparable to a council charge under the Local Government Act in the case of a council charge (regulation 13(1)-(2)(d)-(f)). Importantly, the charge will have priority over any prior charge in favour of an associate of the landowner (regulation 13(2)(d)(ii)).

• Fee mechanics (regulations 15-17). The Minister or council may permit payment of fees by instalments and may add interest or an administrative fee, plus a default surcharge for late instalments ($300 or 5% per month, whichever is higher) (regulation 15). Fees may be waived or refunded (regulation 16), and may be recovered as a debt in court (regulation 17).

Taken together, these concepts shape how councils should exercise discretion under the Act, how event organisers and similar actors should prepare and communicate to avoid enforcement, and how private citizens can trigger enforcement through notifications that meet prescribed content and verification requirements. The Regulations therefore operationalise the Act’s enforcement architecture by setting relatively granular administrative and evidentiary standards.

The Regulations allocate duties, powers and compliance burdens across several distinct groups. The main affected parties are:

• Councils. Councils have multiple roles under the Regulations. They must follow the prescribed guidelines when managing unreasonable complainant conduct and when setting conditions for nuisance abatement notices (regulation 4). Councils must include specified data in their annual reports (regulation 5), receive and process applications for declarations under section 19 (regulation 6), decide whether to accept late applications (regulation 6(2)), notify the EPA of serious or material environmental harm with specific supporting materials (regulation 12), initiate recovery action and create notations with the Registrar‑General to register charges on land under regulation 13(2), and may set fees under the Local Government Act (regulation 6(1)(b)). Councils also have discretion to add interest or administrative fees when allowing instalment payments (regulation 15), and to waive or refund fees (regulation 16).

• Minister (state-level). The Minister retains overlapping powers with councils. The Minister can issue notices for civil penalties in the form prescribed (regulation 14; Schedule 2) and may create notations with the Registrar‑General resulting in a charge on land, where the Minister’s charge corresponds to a mortgage in favour of the Crown and confers powers of sale akin to a mortgagee under the Real Property Act 1886 (regulation 13(2)(d)(i)(A) and 13(2)(e)). The Minister also approves the manner of verification for citizen notifications where not signature-based (regulation 11).

• Authorised officers. The Regulations explicitly permit an authorised officer to form an opinion about presence of local nuisance based on the officer’s own senses for the purposes of section 21(d) (regulation 7). Authorised officers will therefore be the primary fact-finders in many nuisance determinations and are responsible for preparing investigation statements and collecting evidence that councils may forward to the EPA (regulation 12(a)(i)-(ii)).

• Applicants for exemptions (exempt persons) and event organisers. Persons seeking a declaration exempting an activity from section 18 must comply with specific formatting, timing and content requirements: written application, lodgement windows (2 or 4 weeks unless councilhas set another period), prescribed applicant contact details and information about the activity and exceptional circumstances, and payment of any fee set by the council (regulation 6(1)). If a site nuisance management plan is required by the council, it must include detailed assessments, mapping, communications strategies (including a proposed notice to affected persons), complaint recording processes, and responsible person nomination (regulation 6(3)). Construction or demolition projects may use Construction environmental management plans published by the EPA as the prescribed site nuisance management plan if accepted by the council (regulation 6(4)).

• Owners of land subject to enforcement action. If a council or the Minister takes action to recover a recoverable amount under a nuisance or litter abatement notice and registers a notation with the Registrar‑General, that creates a charge on land (regulation 13(2)(a)-(c)). Landowners will therefore be liable for the recoverable amount and associated costs; if the Minister holds the charge, the Minister will have powers of sale in default comparable to a mortgagee’s powers (regulation 13(2)(e)). Councils may recover costs of creating or cancelling such notations under the Local Government Act (regulation 13(3)).

• Individuals accused of littering or bill posting. The Regulations provide the data and form requirements for citizens to notify councils of suspected littering or bill posting (regulation 11; Schedule 1). Individuals who receive a notice of alleged contravention may elect to be prosecuted rather than face civil penalty proceedings, using the prescribed form and subject to a 21-day election period after service (Schedule 2). The civil penalty regime operates such that civil proceedings require contraventions to be proved on the balance of probabilities (Schedule 2, paragraph 2).

• Environment Protection Authority (EPA). The EPA receives notifications from councils about serious or material environmental harm and the Regulations prescribe the types of information that councils should include with such notifications (regulation 12). This makes the EPA a recipient of the investigative materials and places a downstream evidentiary burden on councils and authorised officers to gather and preserve material.

• Notifiers and witnesses. The citizen’s notification forms (Schedule 1) require personal details from notifiers, whether they are prepared to attend court, and whether they can supply photographic/video/GPS evidence. Notifiers therefore face verification and potential attendance obligations.

• Other statutory regimes and authorised persons. The Regulations intersect with other statutory licences and approvals. For instance, a person placing an artificial reef is exempt from section 22 if they have both Fisheries Management Act 2007 approval and a Development Act 1993 authorisation (regulation 9). Activities carried out under authorisation within the meaning of the Development Act 1993 are matters for councils to consider when deciding whether nuisance conditions comply with the authorisation (regulation 4(1)(b)(vi)).

Also defined within the Regulations are relational definitions that affect liability allocation. The interpretation provisions define “associate” by reference to partnerships, family relationships, trust relationships, directorships and shareholding thresholds (5% or more), related bodies corporate under the Corporations Act 2001, and chains of such relationships (regulation 3(2)). The associate definition is material to the priority of charges on land under regulation 13(2)(d)(ii) which gives priority over prior charges in favour of an associate of the owner.

In short, the Regulations impose administrative duties on councils and the Minister, procedural compliance requirements on applicants and event organisers, evidentiary standards for authorised officers, and practical obligations on notifiers and landowners facing enforcement. The mix of duties and rights yields specific allocation of enforcement costs and record-keeping responsibilities across these groups.

The Regulations convert several statutory powers into concrete duties and rights. Below are the principal ones, with textual references to the regulations that create them.

Duties on councils and the Minister

• Apply prescribed guidelines and consider specified factors when administering the Act in relation to local nuisance and when setting conditions on nuisance abatement notices (regulation 4(1)(a)-(b)). Councils must either use their own unreasonable complainant conduct guidelines or the NSW Ombudsman manual (regulation 4(1)(a)(i)-(ii)).
• Include specified data in annual reports: numbers of complaints, expiations and prosecutions, notices issued, civil penalties negotiated and applied for in court, and other functions performed under the Act (regulation 5).
• If a council receives notification of serious or material environmental harm, the council should include investigation statements, copies of evidence, limitation period details and details of prescribed periods for seized items when notifying the EPA (regulation 12).
• Process applications for declarations under s 19(2) of the Act according to the lodgement rules (regulation 6(1)(a)-(b)) and may refuse to consider applications not lodged in accordance with those rules (regulation 6(2)).
• Where a recoverable amount under an abatement notice is unpaid, apply the prescribed interest rate (cash advance debenture rate) and may create a registrable charge on land by sending a prescribed notice to the Registrar‑General; councils must recover costs of creating or cancelling the notation under s 144 of the Local Government Act 1999 (regulation 13(1)-(3)).
• Prescribe the process and form for notices of right to elect to be prosecuted under section 34(3)(a) of the Act (regulation 14; Schedule 2).

Duties and rights of applicants/exempt persons

• Lodge an application for a declaration in writing with specified applicant and responsible person details, reasons, nature of activity, anticipated nuisance sources and timings, within the prescribed lodgement period (2 or 4 weeks unless council specifies otherwise), and pay any council fee (regulation 6(1)(a)-(b)).
• Prepare a site nuisance management plan with the prescribed elements if required (regulation 6(3)); construction/demolition activities may rely on Construction environmental management plans published by the EPA if accepted by the council (regulation 6(4)).
• Designate a responsible person who must be present on the premises and receive and deal with complaints (regulation 6(5)).

Duties and rights of authorised officers and evidence gathering

• An authorised officer may form an opinion about nuisance based on their own senses when determining presence of local nuisance (regulation 7).
• Investigation statements and evidence gathered by authorised officers should be included in notifications to the EPA, as appropriate (regulation 12(a)(i)-(ii)).

Duties and rights of notifiers

• Citizen’s notifications for littering or bill posting must contain the prescribed information in Schedule 1 and be verified by signature or an approved method (regulation 11; Schedule 1). The forms specify required fields such as notifier identity, incident details, vehicle descriptions and evidence indicators.

Rights of alleged offenders

• When a civil penalty procedure is commenced, the Minister or council must give the prescribed notice of right to elect to be prosecuted; the alleged offender may elect prosecution by serving written notice within 21 days (Schedule 2). The Schedule explains that in civil penalty proceedings contraventions are proved on the balance of probabilities (Schedule 2, paragraph 2).

Fee-related duties and rights

• The Minister or council may allow payment by instalments and may add interest or administrative fees to instalments; if an instalment is late, the Minister or council may charge $300 or 5% of the instalment per month (regulation 15(1)-(2)(c)). The Minister or council may waive or refund fees if appropriate (regulation 16) and may recover fees by court action (regulation 17).

Enforcement rights and remedies

• The Minister or council may recover civil penalties in the form prescribed (regulation 14; Schedule 2) and may proceed to register charges on land to recover unpaid recoverable amounts (regulation 13(2)). The Minister, in the case of a Ministerial charge, has the same power of sale as a mortgagee under the Real Property Act 1886 (regulation 13(2)(e)).

Evidentiary and procedural rights

• The Regulations implicitly afford notifiers the right to have photographic/video/GPS evidence uploaded through official channels (Schedule 1 notes), and afford alleged offenders procedural rights to elect prosecution under the prescribed form and timelines (Schedule 2).

Operational obligations,records and communications

• Applicants and exempt persons must maintain and provide complaint recording processes and communication strategies, including a proposed notice for potentially affected persons (regulation 6(3)(d)-(h)(f)). Councils must include in annual reports the number and nature of enforcement actions taken under the Act (regulation 5).

These duties and rights interplay to create a structured compliance and enforcement environment: councils and the Minister have prescribed procedural obligations, authorised officers are given specified evidentiary leeway, applicants face particular plan and timing obligations, and alleged offenders retain a prescribed procedural election. The Regulations therefore reduce some uncertainty by standardising forms and processes, while introducing discretionary points (for example, the council’s choice to accept different lodgement periods and whether to waive fees).

The Regulations primarily elaborate enforcement mechanics rather than prescribe penalty quantum. They sit alongside the Act’s offence and penalty provisions (for example, section 22 on littering, section 23 on bill posting and section 34 on civil penalties). The Regulations set out forms and mechanisms that shape enforcement pathways.

Civil penalty procedures

• The Regulations require the Minister or council to use a prescribed form for a notice of right to elect to be prosecuted under section 34(3)(a) of the Act (regulation 14; Schedule 2). The Schedule sets out the content of the notice, specifies that the recipient may elect prosecution by written notice within 21 days, and explains that if no election is made the Minister or council may commence civil penalty proceedings in the Environment, Resources and Development Court. The Schedule notes that contraventions in civil penalty proceedings are proved on the balance of probabilities (Schedule 2, paragraph 2). That shifts the adjudicative standard relative to criminal prosecution.

Expiation and prosecution data

• The Regulations require councils’ annual reports to include details of the number and nature of offences under the Act that were expiated and prosecuted, nuisance and litter abatement notices issued, civil penalties negotiated and court applications for civil penalties under section 34 and the number of court orders made (regulation 5). This creates accountability and data traceability for enforcement actions.

Enforcement of abatement notices: recovery and land charge

• If an owner fails to comply with a nuisance abatement or litter abatement notice and the recoverable amount is not paid, regulation 13 prescribes interest and a scheme for creating a registrable charge on land:
  • The prescribed rate of interest is the cash advance debenture rate for the financial year in which the payment period expires (regulation 13(1)).
  • The Minister or council may give the Registrar‑General a notice in a form determined by the Minister or council requesting notation to create a charge on the specified land and setting out the amount recoverable (regulation 13(2)(a)).
  • On receipt, the Registrar‑General must enter an appropriate notation in the Register Book or General Registry Office, and that entry creates a charge over the real property (regulation 13(2)(b)-(c)).
  • The charge, if in favour of the Minister, corresponds to a Crown mortgage that ranks ahead of any mortgage, encumbrance or charge registered after the charge is noted; if in favour of a council, it is the same as a charge created under section 177 of the Local Government Act 1999 (regulation 13(2)(d)(i)(A)-(B)).
  • The charge will have priority over any prior charge imposed on the land that operates in favour of a person who is an associate of the owner (regulation 13(2)(d)(ii)). That is a specific subordination rule that can affect pre-existing third-party interests where the prior interest is held by an associate.
  • For a Ministerial charge, the Minister has the same powers of sale as a mortgagee under the Real Property Act 1886 and a sale by the Minister is to be treated as a mortgagee’s sale (regulation 13(2)(e)). For a council charge, recovery may proceed as if it were a rate constituting a charge on land under the Local Government Act 1999 (regulation 13(2)(f)).
  • If the amount is paid, the Minister or council must give a further notice to the Registrar‑General to cancel the charge (regulation 13(2)(g)). Councils may recover any costs or expenses incurred in creating or cancelling the charge from the owner under s 144 of the Local Government Act 1999 (regulation 13(3)).

Monetary penalties and default fees

• The Regulations specify default surcharge amounts for unpaid instalments when the Minister or council allows payment by instalments: $300 or 5% of the instalment, whichever is higher, for each month or part-month of default (regulation 15(2)(c)). They also provide for interest or administrative fees to be added to each instalment at the discretion of the Minister or council (regulation 15(1)). The total payable therefore becomes the sum of the fee, instalment interest/admin fees, and any default surcharges (regulation 15(2)(a)-(c)).

Interaction with criminal and civil proceedings

• The Regulations preserve the elected choice between civil penalty proceedings and prosecution provided by section 34 of the Act. The Schedule 2 notice form under regulation 14 makes the election mechanism explicit and specifies procedural detail such as service particulars and the 21-day timeframe to elect prosecution (Schedule 2).

Evidentiary and procedural features affecting enforcement

• The citizen’s notification forms (Schedule 1) collect detailed incident and evidence indicators and require verification by signature or a Minister-approved method (regulation 11). That influences the evidentiary quality of citizen-initiated reports and the likelihood a council or the Minister will proceed to expiation, civil remedy or prosecution.
• Regulation 7 allows an authorised officer to rely on their own senses to form opinions about nuisance presence. That expands the practical available proof types in nuisance determinations; however, it also imports subjectivity into initial determinations, which may be relevant in subsequent contested proceedings.

Exemptions and narrow carve-outs

• The Regulations provide a narrow statutory exemption from the littering provision (section 22) for persons placing artificial reefs where both Fisheries Management Act 2007 approval and Development Act 1993 authorisation are present (regulation 9). This reduces enforcement exposure for those particular activities but places evidentiary onus on showing the approvals and authorisations exist.

Costs recovery and administrative charges

• Councils may charge fees fixed under the Local Government Act 1999 for applications (regulation 6(1)(b)); the Minister or council may impose interest or administrative fees on instalment payments (regulation 15(1)); and councils may recover costs of creating or cancelling land charges under s 144 of the Local Government Act 1999 (regulation 13(3)). These mechanisms shift enforcement costs onto the regulated parties when enforcement action and administrative processes are engaged.

In summary, the Regulations do not themselves set maximum fines for offences (those remain in the Act) but provide the operational apparatus that determines how enforcement is initiated, how recoverable amounts are enforced by land charges, what evidence citizens must supply to trigger action, and the interest and surcharge regime for unpaid fees. The combination of procedural notice forms, registrable charges, instalment and default fee rules, and evidentiary prescriptions shape the real-world enforcement incentives for councils, the Minister and regulated parties.

The Regulations are full of express cross-references to other South Australian and Commonwealth statutes and administrative documents. These interactions are both permissive (allowing reliance on other regimes) and prescriptive (making other statutes operative in the context of the Act). The principal intersections are as follows, with the relevant regulation references:

Local Government Act 1999

• Fee-setting for applications: the fee for an application for a declaration under section 19 of the Act is the fee (if any) fixed by the relevant council in accordance with section 188(1)(g) of the Local Government Act 1999 (regulation 6(1)(b)).
• Moveable signs and bill posting: regulation 10 declares a moveable sign within the meaning of the Local Government Act 1999 that is placed or maintained on a road other than in a manner authorised under section 226 of the Local Government Act 1999 is a “bill” for the purposes of the Act (regulation 10). That ties the bill-posting offence to existing Local Government Act provisions about moveable signs.
• Charge treatment for a council: a charge created by a council under the notation scheme corresponds to the same as a charge created under section 177 of the Local Government Act 1999 and may be recovered as if it were a rate constituting a charge on land under section 144(2) of the Local Government Act 1999 (regulation 13(2)(d)(i)(B); regulation 13(2)(f); regulation 13(3) cites s 144).
• Cash advance debenture rate: the prescribed rate of interest for unpaid recoverable amounts is the cash advance debenture rate, which is defined by reference to the Local Government Act 1999 (regulation 13(1); regulation 13(4) states the phrase has the same meaning as in the Local Government Act 1999).

Development Act 1993

• Regulation 4(1)(b)(vi) requires councils and authorised officers, when administering or enforcing the Act in relation to local nuisance, to consider whether local nuisance generated by an activity carried out under a Development Act authorisation is being carried out in accordance with that authorisation. Regulation 6(4) allows a Construction environmental management plan (2016) published by the Environment Protection Authority to operate as a site nuisance management plan for construction/demolition if the relevant council accepts it , that native link explicitly imports Development Act regulatory materials into the nuisance exemptions regime.

Fisheries Management Act 2007

• Regulation 9 creates an exemption from section 22 of the Act for persons placing artificial reefs into waters where they have both approval from the Minister administering the Fisheries Management Act 2007 and a Development Act 1993 authorisation. That requires cross-agency approvals to be in place to attract the exemption.

Real Property Act 1886

• The notation and charge scheme references the powers of sale under the Real Property Act 1886. Specifically, where the Minister holds the charge, the Minister will have the same powers of sale of the relevant land as are given by the Real Property Act 1886 to a mortgagee in default (regulation 13(2)(e)). A sale by the Minister is to be treated as a mortgagee’s sale for the purposes of that Act.

Corporations Act 2001 (Commonwealth)

• The Regulations’ definition of “associate” in regulation 3(2) includes “related bodies corporate within the meaning of the Corporations Act 2001” and shareholding thresholds to determine associational status, which is material to the priority rules for charges on land (regulation 3(2)(f); regulation 3(2)(e); regulation 13(2)(d)(ii)). Thus, corporate structures governed by the Corporations Act may determine priority outcomes for the registry scheme.

Environment Protection Act and EPA instruments

• Regulation 12 prescribes what councils should include when notifying the Environment Protection Authority of serious or material environmental harm. It also references certificates under section 50 of the Act (presumably of the Local Nuisance and Litter Control Act, though the regulation names the certificates generically as under section 50 of the Act) as relevant evidence to attach. Regulation 6(4) expressly allows EPA publications (Construction environmental management plans (2016)) to serve as site nuisance management plans for construction/demolition activities.

Family Relationships Act 1975

• Regulation 3(1) defines “domestic partner” as a person who is a domestic partner within the meaning of the Family Relationships Act 1975. This definition is part of the relational definitions underpinning “associate” in regulation 3(2), which matters for priority of charges.

Other cross-jurisdictional or administrative instruments

• Regulation 4(1)(a)(ii) prescribes the use of a New South Wales Ombudsman manual “Managing unreasonable conduct by a complainant. A manual for frontline staff, supervisors and senior managers” (March 2021). That is an explicit importation of an interstate administrative guideline into South Australian regulatory practice and is likely to affect councils’ complaint management processes.

Practical implications of these interactions

• The Regulations bind councils and applicants to administrative regimes under other Acts, e.g., fees under the Local Government Act, reliance on Development Act authorisations when assessing nuisance, priority and sale powers under the Real Property Act, and associational rules drawn from the Corporations Act. This creates both integration benefits, leveraging established mechanisms, and potential complexity, since compliance may require navigating multiple statutory schemes and their administrative practices.
• The rank and priority of charges, and the specific exclusion of prior associate charges, will force attention to corporate and family relationships when land is encumbered; registrars will have to apply the associate definition (regulation 3(2)) when entering notations under regulation 13.
• The use of an interstate ombudsman manual as the default guideline where councils lack their own policies may raise questions about contextual fit and local administrative practice.

Overall, the Regulations deliberately knit together the Local Nuisance and Litter Control Act with a set of related statutes and administrative instruments, making compliance a multi-statute exercise for councils, regulated parties and land registrars.

The Regulations include a legislative history section that lists the principal regulations and variations, their Gazette references, and commencement dates. The entries provide the timeline for when the Regulations and subsequent amendments came into effect.

Principal regulations and variations

• Principal regulations: Local Nuisance and Litter Control Regulations 2017, Gazetted 19 January 2017, commenced 1 February 2017 (r 2) (Legislative history entries indicate Gazette reference 19.1.2017 p80, commencement 1.2.2017: r 2).
• Subsequent variations recorded:
  • 2023, No. 100, Gazette 5 October 2023 p3409, commenced 5 October 2023 (r 2). The legislative history notes that r 2 was omitted under the Legislation Revision and Publication Act 2002 (entry shows r 2 omitted 5.10.2023). Regulation 4(1) was amended by 100/2023 r 3 on 5.10.2023 (this amends r 4(1)).
  • 2026, No. 9, Gazette 5 February 2026 p199, with commencement recorded as 18 June 2026: r 2. The legislative history includes this entry, signalling a 2026 variation, but the text of the Regulations provided at the time of this note appears to incorporate the effects up to the recorded date(s).

Notational and editorial entries

• The legislative history contains notes that variations of this version that are uncommenced are not incorporated into the text. The history directs readers to the Index of South Australian Statutes or www.legislation.sa.gov.au for further information relating to the Act and subordinate legislation.

Specific amendments recorded in the regulator text

• The legislative history indicates r 4 had amendments effected by the 2023 instrument (100/2023 r 3). The printed text of regulation 4 in Part 2 reflects those amendments (the NSW Ombudsman manual citation appears in reg 4(1)(a)(ii), which likely was introduced or adjusted by the 2023 variation).

Interpretive implications

• The Regulations record both the principal commencement in 2017 and later variations in 2023 and 2026. Where the legislative history notes omissions under the Legislation Revision and Publication Act 2002 (for example, r 2 omitted 5.10.2023), that is an editorial action common to statutory revision exercises and does not on its own change substantive obligations, but readers should consult the official consolidated version on the State legislation website to confirm the current operative text.
• The presence of a 2026 Gazette entry with a 2026 commencement date indicates subsequent amendments were made after the original 2017 instrument and the 2023 variation; the Regulations text incorporated here appears to reflect at least some of those changes (for example, the amended wording in reg 4(1)). Users must verify the effective dates of specific amendments against the Gazette and the official consolidated statute to determine the applicable obligations at any given time.

Limitations of the available history in this instrument

• The legislative history lists variations but does not detail the specific textual changes made by each variation beyond noting that r 4 was amended in 2023. For precise amendment texts and the policy intent accompanying them, one must consult the amending instruments (Gazette notices) and any associated explanatory material. The Regulation’s own notes caution that uncommenced variations are not incorporated into the text.

In practice, the amendment history shows iterative refinement of the regulatory details governing councils’ functions and administrative procedures. Because the Regulations implement operational rules like forms and lodgement periods, amendments typically reflect administrative adjustments, clarifications or policy shifts at the state level. Users should check the consolidated on‑line version and Gazette notices when advising on compliance for specific time periods.

The Regulations themselves do not report any litigation. There are no cases cited within the text, nor is there a schedule recording judicial decisions. The instrument functions as subordinate legislation prescribing procedural and administrative detail for the operation of the Local Nuisance and Litter Control Act 2016 rather than as a primary source of legal doctrine.

What the Regulations indicate about potential litigation paths

• The Regulations create and formalise several mechanisms likely to generate disputes that could reach court, particularly the Environment, Resources and Development Court, as the Schedule 2 notice explicitly contemplates civil penalty proceedings being commenced in that court (Schedule 2, paragraph 2). Potential categories of dispute include:
  • Challenges to councils’ refusal to consider late applications for a declaration (regulation 6(2)).
  • Disputes over whether a particular activity qualifies for an exemption from section 18 under a council-granted declaration, or whether a site nuisance management plan meets prescribed requirements (regulation 6(3)-(4)).
  • Adjudication of nuisance determinations where an authorised officer’s sensory-based opinion (regulation 7) is contested in court.
  • Disputes over whether building or construction material deposited by vehicle tyres onto a road constitutes “general litter” under regulation 8 and the Act.
  • Disputes concerning priority and creation/cancellation of charges on land following enforcement action (regulation 13), especially where the “associate” definition (regulation 3(2)) is engaged and prior encumbrances may be subordinated.
  • Civil penalty proceedings under section 34 of the Act where the defendant elects civil proceedings or does not elect prosecution under Schedule 2.
• The Schedule 2 notice clarifies procedural rights and the civil standard of proof for civil penalty proceedings (balance of probabilities), which will shape litigation strategy and evidentiary standards in any proceedings that arise.

Absence of recorded decisions in the Regulations

• Since the Regulations are subordinate legislation, the absence of litigation history in the instrument is not unusual. Any litigation that relies upon or challenges the Regulations will be recorded in court reports and indexes (not in the Regulations themselves). Practitioners must search case law databases and the Environment, Resources and Development Court records to find relevant judicial consideration of these Regulations or the related Act.

Implications for practitioners

• Because the Regulations prescribe administrative forms and evidentiary practices (for example, citizen notification forms and the sensory basis for nuisance finding), litigated disputes will likely focus on whether councils and authorised officers followed those prescribed procedures and whether the evidence meets the civil standard. Parties challenging enforcement may test the adequacy or fairness of council decisions shaped by the prescribed guidelines (for instance whether use of an interstate Ombudsman manual is appropriate).
• The land-charge scheme in regulation 13 provides a clear statutory route for recovering unpaid amounts by creating registrable charges. Litigation is likely where there are competing registrations, claims by creditors, or contests about associational priority. The Regulations’ precise wording on priority over prior associate charges (regulation 13(2)(d)(ii)) could generate complex disputes about associational relationships that require analysis of Corporations Act constructs, trust relationships, family relationships and shareholdings.

Conclusion on litigation history

• The instrument itself contains no litigation history. The Regulations, however, set up several procedural and evidentiary constructs likely to be litigated in the Environment, Resources and Development Court or other relevant courts. Practitioners should monitor court decisions for judicial interpretation of sensory-based nuisance determinations, the sufficiency of site nuisance management plans, the scope of exemptions (e.g., artificial reefs), and disputes about creation and priority of registrable charges under regulation 13.

The Regulations are precise in many places but also contain elements that create practical traps for councils, applicants, private parties and advisers. The following are concrete “gotchas” that flow directly from the text and that practitioners should watch for:

Strict lodgement windows and refusal power

• An application for a declaration in relation to an activity must be lodged within prescribed minimum lodgement periods (2 weeks for activities under 24 hours; 4 weeks for activities 24 hours or longer), unless the relevant council has fixed its own lodgement period (regulation 6(1)(a)(ii)). Importantly, regulation 6(2) allows the council to refuse to consider an application that is not lodged as required. Practically, a late application risks outright refusal and loss of any negotiated mitigation; procuring council-set shorter lodgement windows could complicate event planning. The regulation therefore imposes a tight timing discipline.

Prescribed plan content and council discretion

• The site nuisance management plan elements in regulation 6(3) are detailed and prescriptive. Failure to include required elements (mapping, communication strategy, complaint recording process, designated responsible person) risks rejection or conditional exemptions. Councils retain discretion over the precise additional requirements and whether to accept alternative plans (e.g., EPA Construction environmental management plans per reg 6(4)). Event organisers who assume a generic plan will suffice risk non-compliance.

Subjectivity in nuisance determinations

• Regulation 7 permits an authorised officer to form an opinion about the presence of local nuisance based on the officer’s own senses. This is practical for on-the-spot enforcement but introduces subjectivity into determinations that may be challenged by evidence-based defences. In contested proceedings, reliance on sensory impressions may be attacked for lack of objective measurement.

Evidence requirements of citizen notifications

• Citizen’s notifications must include prescribed details and be verified by signature or a Minister-approved manner (regulation 11 and Schedule 1). Notifiers who do not provide required details, or fail to sign or use an approved verification method, may find their notifications disregarded or non-actionable. Councils may be inundated with incomplete notifications that require triage.

Uploads and evidentiary preservation

• Schedule 1 notes the possibility of uploading photographic/video/GPS evidence via the citizen’s notification website or app, and that such evidence should be provided to the Minister or council. However, the Regulations do not specify retention periods or chain-of-custody requirements. Parties relying on digital evidence must preserve originals and ensure metadata is preserved; otherwise the evidence may be less persuasive in court.

Priority quirks for land charges and associates

• Regulation 13(2)(d)(ii) states the charge created by notation will have priority over any prior charge imposed on the land that operates in favour of a person who is an associate of the owner. That creates a potentially surprising result: a prior encumbrance in favour of an associate can be subordinated to the newly created Minister or council charge. Determining whether someone is an “associate” requires analysis under regulation 3(2), which refers to family relationships, trusteeship, directorship, and a 5% shareholding threshold. Parties acquiring or lending against land with complex family or corporate links need to scrutinise associational status carefully.

Ministerial sale powers akin to mortgagee

• If the Minister registers a charge, the Minister has the same powers of sale as a mortgagee under the Real Property Act 1886 (regulation 13(2)(e)). That creates an enforcement path that can lead to sale of land for unpaid recoverable amounts. Landowners and lenders must be aware that default on an abatement notice, followed by registration, may put the land at risk of sale.

Default instalment penalties are substantial and automatic

• Where fees are paid by instalments and an instalment is not paid by the date for payment, the Regulations prescribe a default penalty of $300 or 5% of the instalment, whichever is higher, for each month or part of a month of default (regulation 15(2)(c)). The combination of instalment interest/admin fees at council/Minister discretion (regulation 15(1)) and the automatic default surcharge can inflate the total payable significantly.

Interstate guideline prescriptive by default

• Regulation 4(1)(a)(ii) prescribes that, in the absence of a council’s own unreasonable complainant conduct guidelines, councils must follow the NSW Ombudsman manual. That is a cross‑jurisdictional reliance which could create practical misfits: the NSW manual may not align perfectly with South Australian administrative practice, yet the Regulations make it the default. Councils lacking local policy must adopt or familiarise themselves with an external document.

Narrow exemptions are evidence-dependent

• The exemption for artificial reefs (regulation 9) requires both Ministerial Fisheries approval and a Development Act authorisation. A failure to have either approval in place exposes the reef placer to littering liability. The exemption is thus conditional and rests on documentary proof.

Ambiguity in the reference to “certificates under section 50 of the Act”

• Regulation 12(a)(ii) lists “any certificates under section 50 of the Act” among evidentiary materials. The Regulations do not reprint section 50, so practitioners must consult the Act to understand what those certificates are and their evidential effect. It is a common practical issue when subordinate legislation references provisions of the parent Act without repeating their content.

Administrative burden on councils: annual reporting detail

• Regulation 5 lists a number of discrete reporting items that councils must include in their annual reports (complaint numbers, expiations, prosecutions, notices issued, civil penalties negotiated and applied for, and court orders made). Councils not already tracking these items in a consistent way must upgrade recordkeeping systems to avoid gaps or inaccuracies.

No quantum of civil penalties in the Regulations

• The Regulations do not specify penalty amounts for offences; those remain in the Act. Practitioners must refer to the Act for maximum fines and penalty unit calculations. The Schedule 2 states civil proceedings use the balance of probabilities standard, but does not list monetary limits.

In summary, several provisions create procedural traps and require active attention to timelines, forms, associational analyses and evidence preservation. Parties should not treat the Regulations as mere guidance; they are prescriptive and operate as binding administrative rules that feed into enforcement actions with potential financial and property consequences.

This section provides a practical compliance checklist tied to the Regulations’ text. The objective is to minimise enforcement exposure, ensure administrative completeness and preserve evidence should disputes arise.

For councils

• Adopt or confirm unreasonable complainant conduct guidelines. If the council does not have its own guidelines, adopt and publicise the NSW Ombudsman manual cited in regulation 4(1)(a)(ii). Ensure frontline staff and authorised officers are trained on whichever guidance is in force so that complaint handling is consistent with reg 4(1)(a).
• Update annual reporting templates to capture every item required by regulation 5: number of complaints received; number and nature of offences expiated and prosecuted; notices issued; civil penalties negotiated and applied for and court orders made; and any other functions performed under the Act. Maintain data fields that allow year-on-year comparison.
• Create standard forms and checklists for processing applications for declarations under section 19. Ensure the council publicly specifies any alternative lodgement periods (regulation 6(1)(a)(ii)) and communicates that in permit guidance.
• Establish a review checklist for site nuisance management plans to ensure they include all prescriptive elements in regulation 6(3): assessment of potentially affected persons, maps, name and contact of responsible person, mitigation and monitoring strategies, communication strategies (including the notice to be given to affected persons), council communications strategy including reporting, and a complaints recording process with detailed entries.
• Set procedures for accepting EPA Construction environmental management plans as site nuisance management plans for construction and demolition activities only if they meet local requirements (regulation 6(4)). Clarify these criteria in policy.
• Prepare a standard procedure for registering notations with the Registrar‑General under regulation 13(2), including template notices, verification steps and systems to calculate the cash advance debenture rate (regulation 13(1)). Clarify internal sign-off for creating a charge and for cancelling the charge on payment (regulation 13(2)(g)).
• Ensure councils have processes to collect and preserve evidence for EPA notifications as enumerated in regulation 12(a)-(c). This includes standardised templates for investigation statements, evidence management protocols and retention policies.
• For instalment fees, produce a schedule explaining interest/administrative fees and the default surcharge ($300 or 5% per month) to members of the public requesting instalments (regulation 15).

For event organisers, construction companies and applicants (exempt persons)

• Lodge applications for declarations in writing and adhere to the timing windows: at least 2 weeks for short activities (<24 hours) and 4 weeks for longer activities, unless a council publicises a different lodgement period (regulation 6(1)(a)(ii)). Do not rely on informal waivers.
• When preparing a site nuisance management plan, follow regulation 6(3) exactly. Include maps, the full communications strategy and the exact form of the proposed notice to be given to potentially affected persons, and designate a responsible person with contact details and authority to receive complaints (regulation 6(3)(a)-(h); regulation 6(5)).
• If in construction or demolition, check whether the EPA Construction environmental management plans (2016) can be used as the site nuisance management plan under regulation 6(4). If so, ensure the council explicitly accepts that plan in writing.
• Maintain complaint logs in the format required by regulation 6(3)(h): contact details for complainants, date/time, description, nature of the activity, and actions taken to resolve complaints. Be ready to provide these records to the council.
• For any activity that could be construed as littering by virtue of vehicle-transported construction material, implement wheel and vehicle cleaning protocols to prevent building material being dragged onto roads (regulation 8).

For individuals and businesses that may be accused of littering or bill posting

• Understand that citizen’s notifications require detailed information and verification (regulation 11; Schedule 1). If you are a notifier, provide as much detail as possible, preserve photographic/video/GPS evidence and indicate whether you will attend court.
• If you receive a notice of alleged contravention with the right to elect to be prosecuted (Schedule 2), consider the election carefully: electing prosecution removes the civil penalty negotiation pathway and moves the matter to criminal/prosecutorial processes. Note the 21-day election period and the prescribed form for election (Schedule 2).
• If paying a fee by instalment, check whether the Minister or council will add interest or an administrative fee and be aware of the default surcharge mechanics: $300 or 5% per month per defaulted instalment (regulation 15(1)-(2)(c)).

For landowners and lenders

• Be aware that a notation under regulation 13 can create a charge that may be registrable and that, where the Minister is the chargee, the Minister has mortgagee-like powers of sale under the Real Property Act 1886 (regulation 13(2)(e)). Consider monitoring for notices, and ensure searches of the Register Book or General Registry Office are included in busy conveyancing or lending practices.
• Where land is encumbered and related parties may be associates (family members, trusts, companies with cross-directorships or ≥5% shareholders), check the “associate” definition in regulation 3(2) before relying on the priority of existing securities. The Regulation’s associate definition will affect priority findings under regulation 13(2)(d)(ii).

For authorised officers and investigators

• When forming nuisance opinions, document sensory observations carefully, as regulation 7 allows reliance on the officer’s senses. Include contemporaneous notes linking sensory impressions with corroborative evidence (photographs, timestamps, witness statements) to strengthen findings in case of challenge.
• For EPA notifications, collate investigation statements, exhibit records, transcripts and data identified in regulation 12(a)-(c). Preserve chain-of-custody for physical exhibits and metadata for digital evidence.

Record-keeping and data integrity

• Councils and regulated parties should implement standardised data capture templates mirroring Schedule 1 and Schedule 2. For citizens’ evidence uploaded via apps or websites, preserve originals and metadata.
• Retain copies of all correspondence with the Registrar‑General regarding notations and cancellations under regulation 13 and document costs associated with creating or cancelling charges, as these costs are recoverable under regulation 13(3).

Legal review and risk assessment

• Before relying on the artificial reef exemption under regulation 9, obtain and preserve written evidence of Fisheries Minister approval and Development Act authorisation.
• If enforcement is threatened or a civil penalty notice is served, consult early on whether to elect prosecution within the 21-day window and on defence strategy given the civil standard applies to civil penalty proceedings (Schedule 2).

By following these documentary, procedural and record-keeping controls tied to the specific regulatory text, parties can materially reduce enforcement risk, support defensible decision-making and be prepared for dispute resolution where necessary.
