22 Exemptions

(1) Rateable land is exempt from an animal health rate for a year if the annual return lodged in the preceding year indicates that fewer than the prescribed number of stock units were kept on the land on 30 June of that year.

(2) The part of a holding occupied by either of the following is exempt from the operation of the Act, Part 5—

(a) Local Land Services,

(b) if the part is used for a purpose other than agriculture—a local authority.

(3) The part of a holding used for a caravan park, cemetery, golf course, hotel or motel accommodation, industry, racecourse or showground is exempt from the operation of the Act, Part 5.

(4) The part of a holding used for the following purposes is exempt from the operation of the Act, Part 5, other than the Act, section 58—

(a) growing sugar cane,

(b) a rifle range, including ancillary buildings.

(5) In this section—

caravan park, cemetery, hotel or motel accommodation and industry have the same meanings as in the Standard Instrument—Principal Local Environmental Plan prescribed by the Standard Instrument (Local Environmental Plans) Order 2006.

prescribed number means—

(a) for horses—100, or

(b) otherwise—50.

racecourse has the same meaning as in the Betting and Racing Act 1998.
