What it does
This Act creates a statutory scheme that requires municipalities to remit part of ordinary local government rates and specified charges to eligible pensioners, and establishes the administrative and enforcement framework around that remission. Mechanically, the principal operative provision is section 4, which gives an eligible pensioner who is liable for rates or charges the right to apply to a municipality for a 30 per cent remission of those rates or charges for the financial year in which the application is made and for subsequent financial years while the person remains eligible (s 4(1), (1B)). The application must be made before 31 March in a financial year (s 4(1)). Eligibility is assessed by reference to the status of the applicant on 1 July in the financial year in which the application is made: the applicant must be an "eligible pensioner" (defined by regulation, s 3) and be occupying the property as his or her principal dwelling (s 4(1A)).
The Act limits the municipal remission by reference to a prescribed maximum per financial year (s 4(2)). It also permits backdating in limited form: where an eligible pensioner applies, the municipality must remit 30 per cent of rates or charges paid or payable in the immediately preceding financial year if the person met the 1 July eligibility tests in that preceding year (s 4(1D)). For persons in prescribed institutions who do not receive rental income, the Act treats them as occupying their property as principal dwelling for the 1 July snapshot (s 4(3), (3A), (3B)). That institutional arrangement is capped at two consecutive financial years for such occupants (s 4(3C)).
Administration and funding mechanics are also set out. A municipality that gives a remission may apply to the Treasurer for payment of an amount equal to the remission; if the Treasurer is satisfied the remission was given in accordance with s 4, the Treasurer must pay the municipality (s 5(1)). The Act appropriates those payments against the Public Account (s 5(2)). The Treasurer may issue directions about application, remission and reimbursement procedures (s 6). The Commissioner of State Revenue is given oversight and enforcement powers, including the power to require repayments where a person was not entitled to a remission (s 4B), powers to investigate, and an objections and appeal process culminating in review by the Magistrates Court (Administrative Appeals Division) (ss 4B-4F, 4H-4I).
