Local Government (Planning and Reporting) Regulations 2020

Several drafting and operational concepts structure these Regulations. They are concrete and repeated across Parts and Schedules:

• Standard form and incorporated models: The Local Government Model Financial Report and the Local Government Model Sector Performance Report are expressly adopted as the required formats for financial statements and the performance statement (reg 5(1), reg 7(1)(b), reg 11A, explanatory details). The Australian Accounting Standards are also incorporated for preparation of financial statements (reg 4 defn of AAS; explanatory details; Schedule table of applied matters). That means the Regulations do not themselves set all presentation rules; they rely on externally maintained model documents and standards that may change over time.

• Prescribed indicators and measures: Schedules 2, 3 and 4 set out prescribed indicators of service performance, financial performance and sustainable capacity performance, and the exact mathematical measures (for example, percentage formulas, numerators and denominators) that Councils must use (regs 9, 11, 12). Schedule 4 adds targeted indicators that must be included in budgets and annual reports (reg 8(4)(ea), reg 12(f)(i)-(ii)).

• Forward-looking and comparative disclosure: Many provisions require Councils to disclose not only results for the reporting year, but results for the preceding three financial years and forecasts/expected results for the subsequent three financial years after the budget year (reg 9(2)(a), reg 12(a), reg 12(g)). Budgets must include capital works statements for the budget year and subsequent three years (reg 7(1)(a), reg 7(2)).

• Asset expenditure typology and capital-works disclosure: The Regulations define "asset expenditure type" (asset renewal, new asset, upgrade, expansion) (reg 4) and require budgets and financial plans to break planned capital works down according to non-current asset classification and asset expenditure type, with detailed funding source breakdowns (reg 8(3)-(4)(a)-(b)).

• Human-resources statements with gender categories: The Financial Plan and Budget must include a statement of human resources, planned staff expenditure categorised by organisational structure, and planned FTEs, with classification separately by permanent full time and part time and by gender categories (women, men, persons of self-described gender) (reg 6; reg 8(4)(c)-(e)). The text was amended in later statutory rules to change or clarify related definitions (see Table of Amendments).

• Governance checklist and policy reporting: Schedule 1 is a governance and management checklist that must be included in the annual report (reg 9(2)(c)). It compels reporting whether a range of policies and plans exist and, if adopted, their adoption dates or reasons for non-adoption (e.g. Community engagement policy, Financial Plan, Asset Plan, Revenue and Rating Plan, Procurement Policy, Audit and Risk Committee, internal audit) (Schedule 1).

• Procurement and contract transparency: The Regulations require lists of contracts above the thresholds set in council Procurement Policies to be disclosed in the annual report, and for transitional and earlier financial years they require disclosure of contracts over the historical $100,000 thresholds tied to the s 186(1) threshold as in force before repeal (reg 10(c)-(d)). The disclosure regime is tied to each Council’s Procurement Policy and its thresholds.

• Certification and accountability: The Regulations specify both who must certify the performance statement and financial statements for inclusion in the annual report and provide model certification text that must be used (regs 13(1)-(2), 15(1)-(2)). The prescribed certifiers are the Chief Executive Officer and the Principal Accounting Officer, and the annual report's performance and financial statements require councillor sign-off as set out in the model wording.

• Transitional savings: The Regulations preserve the application of the 2014 Regulations to the 2020-21 financial year commencement on 1 July 2020 and preserve pre-2026 rules for the 2025-26 financial year where the 2025 Amendments otherwise changed content (regs 16-17). The instrument explicitly records amendment instruments and their commencement dates in the endnotes.

Each of these concepts modifies the information environment in which councils operate: adoption of models and AAS shifts technical compliance to external standards; the prescribed indicator lists standardise performance measurement; forward-looking disclosure creates planning transparency; and the governance checklist enforces policy adoption disclosure. The Regulations therefore operate by substitution of mandated forms, fixed indicators and defined measures, rather than by creating new substantive duties of service delivery in themselves. The enabling power for this prescription is s 325 of the Local Government Act 2020 (reg 2).

The primary entity affected by these Regulations is each Council established under the Local Government Act 2020. The text repeatedly frames obligations as “for the purposes of section [x] of the Act, the prescribed information” to be included in Financial Plans, Budgets, Revised Budgets, Annual Reports, performance statements and financial statements (see regs 5-8 and Part 4 generally). The following actors and stakeholders are concretely implicated:

• Councils (corporate entity and elected Council): Councils must prepare Financial Plans (s 91 of the Act) and Budgets (s 94), and include the specified content and formats prescribed by these Regulations (reg 5, reg 7, reg 8). Councils also must include the prescribed report of operations and performance statements within the annual report (Part 4, regs 9-15). The Regulations require Council adoption or a statement if a required plan or policy has not been adopted (Schedule 1).

• Chief Executive Officer and Principal Accounting Officer: These are the prescribed certifiers for performance statements and financial statements. Regs 13(1) and 15(1) prescribe those persons as the signatories, and regs 13(2) and 15(2) set out model certification wording. The requirement to certify creates direct compliance responsibility and potential reputational and administrative risk for those officers.

• Councillors: The model certification wording in regs 13(2) and 15(2) includes councillor signatures and dates as part of the certification of performance and financial statements. Councillors must therefore participate in final certification and are signposted as accountable parties in the model forms.

• Council staff and organisational units: The Regulations require internal councils’ staff structures and human-resource data to be reported in statements of human resources and statements of FTEs by organisational structure (reg 6; reg 8(4)(c),(d),(e); reg 10(l),(m)). This affects HR and payroll teams, and managers responsible for organisational reporting.

• External auditors and accounting professionals: Financial statements must be prepared in accordance with the AAS and the Local Government Model Financial Report (reg 14(2)(a); reg 4 defn of AAS and Local Government Model Financial Report). External auditors will need to audit statements prepared to those formats; the model certification text anticipates an audited performance and financial reporting process.

• Suppliers and contractors: Procurement transparency provisions (reg 10(c)-(d)) require Councils to list contracts above procurement thresholds and to disclose those which did not follow competitive processes where required. That will affect suppliers who enter contracts that later appear in Council annual reports, and it may influence procurement behaviour and supplier expectations.

• Community and service users: The schedules require publication of indicators that measure service usage and satisfaction (Schedules 2-4 include library loans per head of population, utilisation of aquatic facilities, infant enrolments in MCH service, kerbside bin misses per 10,000 lifts, community satisfaction ratings, etc.). The public receives standardised information across councils enabling comparisons.

• State Department and the Minister: The Model Financial Report and Model Sector Performance Report are published by the Department and are applied by reference (reg 4; reg 11A; explanatory details). The Department therefore influences form and presentation by updating these models over time.

• Other statutory frameworks and regulators: The Regulations interact with other Acts by referencing compliance obligations under them; for example, definitions and measures reference the Food Act 1984 (food premises and food sampling requirements in Schedule 2), the Public Health and Wellbeing Act 2008 (aquatic facilities inspections), and the Road Management Act 2004 (local roads) (Schedule 2 definitions and measures). Therefore, officers administering those functions must supply information that maps across statutory regimes.

Who pays: the immediate compliance cost is borne by Councils (staff time, systems, data collection and possibly external consultants). Indirectly, costs fall on ratepayers and taxpayers insofar as budgets and planned capital works disclosures may affect borrowing and rates decisions, and resource allocation. Who decides: Councils adopt the plans and budgets and determine procurement thresholds in Procurement Policies; CEOs and Principal Accounting Officers must certify. The Regulations do not independently allocate funds; they standardise reporting and disclosure.

The Regulations do not create freestanding criminal offences or penalties within their text. Instead, they prescribe mandatory content, forms and processes for the statutory planning and reporting obligations that are established by the Local Government Act 2020. Key duties and rights created or concretised by the Regulations are the following:

• Duty to use prescribed forms and incorporated models: Councils must prepare financial statements and performance statements “in the form set out” in the Local Government Model Financial Report and the Local Government Model Sector Performance Report (reg 5(1); reg 7(1)(b); reg 11A; reg 14(2)(a)). That is a duty to adopt standard templates and to prepare documents in accordance with external model reports incorporated by the Regulations.

• Duty to disclose specified items in Financial Plans and Budgets: The Regulations prescribe required statements and schedules , statements describing financial resources (reg 5), statements describing other resource requirements including human resources (reg 6), and for budgets the requirement to include a statement of capital works for the budget year and subsequent 3 years (reg 7(1)(a), reg 7(2)) and detailed lists of planned capital works and funding sources (reg 8(3)-(4)). These are mandatory inclusions in the documents councils must prepare under the Act.

• Duty of comparative and forward reporting: Councils must include results achieved in the preceding three financial years for service performance indicators, and must explain material variations (reg 9(2)(a)-(b), reg 12(a), reg 12(d)-(e)). They must also include forecast estimates from the budget or revised budget and expected results for the subsequent three financial years for certain indicators (reg 12(b), reg 12(f)-(g)). The duty is to gather and present both historical and forecast data in the specified formats.

• Duty to disclose governance policies and status: The Schedule 1 governance and management checklist requires councils to report whether particular policies and plans (e.g. Community engagement policy, Financial Plan, Procurement Policy, Audit and Risk Committee) are adopted and their dates of adoption or reasons for not adopting (Schedule 1). That compels councils to adopt or explain non-adoption publicly.

• Duty to list contracts and procurement exceptions: For specific financial years or for periods determined by whether a Council has adopted a Procurement Policy, councils must publish lists of contracts above procurement thresholds and any contracts entered without a competitive process that did not meet exceptions (reg 10(c)-(d)). This duty effectively requires councils to maintain procurement records mapped to policy thresholds and to publish exceptions.

• Duty of certification by senior officers and councillors: Performance statements and financial statements included in the annual report must be certified by the Chief Executive Officer and Principal Accounting Officer, and the performance statement model includes councillor signatures (regs 13(1)-(2), 15(1)-(2)). This is an accountability duty that attributes responsibility to named officers and councillors.

• Duty to prepare financial statements in accordance with AAS: Reg 15(2) and reg 4 refer to Australian Accounting Standards. Financial statements in the annual report must be “prepared in accordance with the Local Government Model Financial Report” and the AAS, so councils must follow professional accounting requirements.

Rights and procedural constraints:

• Councils retain the right to set their own Procurement Policy and thresholds under the Act, but those thresholds then determine what procurement information must be disclosed under reg 10. Thus a right to set thresholds exists but is linked to disclosure duties.
• The Regulations contain transitional savings that preserve prior obligations for certain financial years (regs 16-17), which rights Councils have to rely on the earlier 2014 Regulations for specified years (e.g. the 2020-21 and 2025-26 financial years as stated).
• The Regulations delegate no discretion to private parties; they are prescriptive for councils’ reporting content. For specific items (for example, a council’s decision on the renewal intervention level for sealed local roads in Schedule 3 Part 1, item 3(a)), councils themselves determine those parameters (the renewal intervention level), and then measure against them.

Where enforcement and sanctions sit: the Regulations specify certification and accounting procedures but do not themselves specify penalties or enforcement mechanisms within their text. The Regulations are made under s 325 of the Local Government Act 2020 (reg 2), and the Act contains the broader compliance and enforcement architecture. The Regulations therefore create duties that will interact with the Act’s sanctions and external audit/auditor-general processes; however, the text of these Regulations does not set out penalties.

In summary, the Regulations convert statutory planning and reporting obligations in the Act into tightly prescribed, standardised forms, indicator sets and certification processes and place the obligation to prepare, disclose and certify those outputs squarely on Councils, their CEOs, the Principal Accounting Officer and councillors.

The Regulations themselves do not create express penalty clauses or enforcement provisions. The instrument repeatedly phrases requirements as “for the purposes of section [x] of the Act, the prescribed information is …” (e.g. regs 5-8, 9-15). That construction signals that the Regulations supply mandatory content to be used where the Act requires plans, budgets and reports. The Regulations were made under section 325 of the Local Government Act 2020 (reg 2), so any legal obligations, enforcement powers and sanctions must be located in the Act itself or in other statutes or oversight regimes, rather than in these Regulations.

Concrete enforcement-related features in the Regulations include:

• Mandatory certification requirements: regs 13(1)-(2) and 15(1)-(2) prescribe the persons who must certify the performance statement and the financial statements (the Chief Executive Officer and the Principal Accounting Officer) and include model certification wording. These certification duties impose an administrative and reputational accountability mechanism: named officers and councillors must certify that the statements present fairly and comply with the Act and the Regulations. A certified statement that is misleading may give rise to further action under the Act, by auditors or other oversight bodies, but the Regulations themselves do not specify sanctions.

• Audit-related content: reg 14(2)(a) requires financial statements to be prepared “in accordance with the Local Government Model Financial Report,” and reg 15(2) requires compliance with the Australian Accounting Standards and other mandatory professional reporting requirements. The external auditing regime (not contained in the Regulations) will assess compliance with those standards. The Regulations therefore create inputs for auditors’ work but do not set the auditors’ powers.

• Transparency as an enforcement mechanism: the Regulations require Councils to publish detailed breakdowns (capital works, grants by class and source, contract lists above procurement thresholds, governance and management checklist, three‑year comparative results for indicators and explanations of material variations) (regs 8, 9, 10, 12, 14; Schedules 1-4). Public disclosure itself is an enforcement and accountability mechanism because it enables ministerial, media, community and other scrutiny. Again, the Regulations specify what must be disclosed; any remedial or sanctioning steps would arise from other laws, political oversight or audit findings outside the Regulations.

• Transitional savings: regs 16-17 preserve the application of earlier Regulations for specific financial years. Those transitional provisions can affect enforcement and compliance expectations for those years because different content requirements applied; compliance expectations therefore vary according to the transitional rule.

Absent from the Regulations are:

• Any express monetary administrative penalties, infringement notices, or criminal offences attached to failure to include particular items, or to inaccurate reporting. The instrument does not prescribe fines or penalty units.

• Detailed inspection or enforcement powers vested in named inspectors or agencies; instead, the Regulations rely on certification, external auditing standards (AAS), and public disclosure as compliance mechanisms.

For a practitioner or compliance adviser, this analysis points to two practical consequences: first, legal exposure from non-compliance will arise through the Act’s enforcement mechanisms, audit findings, reputational consequences and political oversight rather than from fines located in the Regulations; and second, the certification model (CEO and Principal Accounting Officer and councillor signatures) concentrates risk on named officers and requires internal controls and audit-ready documentation to mitigate that risk. Where a Council’s certified statements are found wanting, the likely responses will be audit reports, ministerial scrutiny, or the Act’s compliance mechanisms rather than a penalty applied directly from these Regulations.

The Regulations are tightly tied to the Local Government Act 2020 in both form and substance. They function as the implementing rules that give content to multiple sections of the Act: Financial Plans (s 91), Budgets and Revised Budgets (ss 94-96), Annual Reports (s 98), certification (s 99) and related reporting duties. The Regulations repeatedly state that particular prescribed information is “for the purposes of” specific sections of the Act (regs 5-8, 9-15). Therefore, the primary legal interaction is with the Act: the Regulations operationalise Part 4 obligations by specifying formats, indicators, and certification text.

The Regulations also reference and integrate provisions from other statutes and regulatory regimes when defining indicators and measures:

• Food Act 1984: Schedule 2 and Schedule 3 definitions and measures for food safety indicators reference notifications under s 19N(3) or (4) of the Food Act 1984 and declarations under s 32A related to required numbers of food samples (Schedule 2 Part 1 definitions). Councils must therefore reconcile reporting under these Regulations with statutory obligations in the Food Act and its regulations.

• Public Health and Wellbeing Act 2008 and Public Health and Wellbeing Regulations 2019: certain measures (e.g. inspections of registered category 1 aquatic facilities) adopt terminology from public health legislation and regulations (Schedule 2 definitions and measures).

• Road Management Act 2004: the definition of “local road” and measures for road-related indicators reference the Road Management Act 2004 (reg 4, Schedule references). Councils must coordinate engineering and asset data collected under road management responsibilities with reporting under these Regulations.

• Planning and Environment Act 1987: Schedule 2 references the “relevant required time” for planning applications as defined in regulations under the Planning and Environment Act 1987, integrating planning-decision timeframes with reporting on statutory planning performance.

• Australian Accounting Standards: The Regulations require financial statements to be prepared in accordance with AAS, specifically referencing AASB 101 in the explanatory details and Schedule 3 definitions (reg 4 defn of AAS; explanatory table of applied matter). This anchors the Regulations to nationally recognised accounting standards and therefore to other statutory obligations and professional reporting frameworks.

• Local Government Act 1989 legacy provisions: The Explanatory Details show that the Local Government Model Financial Report was continued under Part 6 of the Local Government Act 1989 “as if that Part had not been repealed,” and reg 8(4)(i)-(j) refer to rates and municipal charge basis under section 157-159 of the Local Government Act 1989 where relevant. The Regulations incorporate transitional references to the now-repealed provisions for particular reporting elements (reg 8(4)(i)-(j), explanatory details).

• Subordinate Legislation Act 1994 and the Subordinate Legislation Regulations 2014: the instrument is subject to rules for adopted material and style; the endnotes and explanatory tables record the applied, adopted or incorporated documents in accordance with the Subordinate Legislation Regulations 2014. The Regulations’ sunset date is recorded pursuant to the Subordinate Legislation Act 1994 (Endnotes).

Operational consequences of these interactions:

• Data flows and systems must map across multiple statutory domains: public health, food safety, road management, planning, and accounting standards. A Council’s compliance requires coordination across these service areas to produce consistent reports for the annual report and budgets (see Schedules 2-4 and regs 8, 9, 14).

• The Model Financial Report and Model Sector Performance Report are incorporated and updated by the Department “from time to time” (reg 4 defns; explanatory details). That means compliance is dynamic: Councils must track changes in department-published model documents and in AAS to remain compliant.

• Procurement and contract-reporting requirements are determined by a Council’s own Procurement Policy thresholds, but the Regulations condition disclosure obligations on whether the Council has adopted a Procurement Policy under s 108 of the Act; transitional arrangements reference the old s 186 thresholds under the 1989 Act for specific periods (reg 10(c)-(d)).

• External audit processes and professional accounting obligations are implicated; auditors will test compliance against both the Regulations (form and content) and AAS (substance, valuation, disclosure).

In short, the Regulations are an implementation layer for the Local Government Act 2020 and a nexus point connecting local government reporting with other legislative domains and nationally recognised accounting standards. They are not isolated rules; they require Councils to align operational data and governance practices across other statutory obligations.

The instrument records two amendment Statutory Rules since its making in 2020. The endnotes and table of amendments summarise the changes and commencement timings; multiple provisions in the body are annotated as amended or inserted by S.R. No. 126/2022 and S.R. No. 146/2025. The key amendment milestones recorded in the text are:

• Original making and commencement: Local Government (Planning and Reporting) Regulations 2020, S.R. No. 117/2020 were made on 20 October 2020 and came into operation on 24 October 2020 (reg 3; endnotes).

• Local Government (Planning and Reporting) Amendment Regulations 2022, S.R. No. 126/2022 (made 25 October 2022): this instrument made several changes with staged commencement dates. The Table of Amendments in the endnotes notes that regs 7 and 13 commenced on 1 January 2023, while regs 5, 6, and 8-12 commenced on 1 July 2023. The 2022 amendments inserted the definition of the Local Government Model Sector Performance Report (reg 4), introduced reg 11A (form of performance statement) and inserted new performance targets and the requirement to include certain targeted indicators in budgets and performance statements (see reg 8(4)(ea), reg 11A, reg 12(f)-(g)). Schedule 2 and parts of Schedule 3 were amended by S.R. No. 126/2022 reg 11 and reg 12 as indicated.

• Local Government (Planning and Reporting) Amendment Regulations 2025, S.R. No. 146/2025 (made 16 December 2025, commenced 1 January 2026): this instrument made further amendments and substitutions. The text indicates multiple substitutions and insertions: substitution of definitions (e.g. defn of MCH service (maternal and child health service) in reg 4), changes to reg 9(1), reg 11(1)-(3) (some paragraphs revoked), reg 11A substitution and insertion of the Local Government Model Sector Performance Report as the required form, changes to Schedule 1 headings and entries, and substitution/amendment of Schedules 2-4 (see notation “Sch. 1 (Heading) substituted by S.R. No. 146/2025 reg. 13(1)” and other annotations through the Schedules). The 2025 amendments also included a specific transitional provision preserving the pre-1 January 2026 version for the 2025-26 financial year (reg 17). The Explanatory Details record that regulation 14 inserted the definition of “current liability” in Part 1 of Schedule 2 as AASB 101.

• Transitional provisions: The Regulations explicitly provide that the 2014 Regulations continue to apply to the 2020-21 financial year despite revocation (reg 16). Reg 17 preserves the version of these Regulations in force immediately before 1 January 2026 for the financial year commencing 1 July 2025. These transitional provisions are expressed in the Regulations themselves and are also annotated in the Table of Amendments.

• Applied, adopted and incorporated matter: The Explanatory Details include tables listing documents that are applied, adopted or incorporated by reference (AAS, Local Government Model Financial Report, Local Government Model Sector Performance Report, ABS SEIFA index). The explanatory tables record which statutory rule provisions adopt which external documents and which parts are incorporated (endnotes “Table of Applied, Adopted or Incorporated Matter”).

For users and advisers, the amendment history demonstrates two important implementation features:

1. The Regulations are actively maintained and have been altered to introduce new reporting templates, indicator mixes and definitions; and
2. The Regulations incorporate external model documents and accounting standards; consequential amendments often involve changing the incorporated material or the interface between the Regulations and the adopted models.

Practically, compliance requires tracking both statutory amendments to the Regulations themselves and changes made by the Department or accounting standards boards to the incorporated model documents and AAS. Reg 17’s transitional saving is an explicit example of the instrument adjusting compliance expectations for a specific financial year to manage the transition to amended requirements.

The text of these Regulations, as provided, does not record any litigation history. There are no cases or judicial decisions cited within the instrument itself. The endnotes, explanatory details and tables of amendments are administrative materials and do not include references to litigation against the Regulations or their provisions.

Because the instrument prescribes reporting formats, measurement formulas and certification requirements, typical sources of litigation or legal challenge (outside the scope of this document) could in theory include judicial review of a ministerial or departmental decision to vary model documents, disputes about the interpretation of a prescribed indicator formula in a particular factual context, or challenges to a council’s compliance with statutory reporting obligations under the Act. None of those are contained or referenced in this statutory instrument.

For practitioners seeking precedent or dispute guidance, this instrument must be read alongside the Local Government Act 2020 and any relevant administrative law, auditor-general reports, tribunal findings or judicial decisions that post‑date or interpret the Act or these Regulations. The Regulations themselves do not supply case law or litigation record.

If litigation or dispute arises over the meaning or application of a specific prescribed measure (for instance, whether a particular planning decision falls within the “relevant required time” from the Planning and Environment Act 1987 for the purposes of an indicator), the relevant statutory cross‑references (the Planning and Environment Act 1987, Food Act 1984, Public Health and Wellbeing Act 2008, AAS) will be the starting point; the Regulations’ exact mathematical measure and definitions in Schedules 2-4 will be authoritative in determining the reporting requirement. Any judicial interpretation would therefore likely focus on textual construction of the measure, the underlying statutory cross-reference and whether the form required was followed in substance. Again, none of this instrument’s text records any such decisions.

The Regulations create several practical compliance traps and operational risks that are visible on the face of the instrument. These are specific, concrete issues that advisers and councils should consider when implementing the Regulations.

1. Reliance on external, living documents: The Local Government Model Financial Report, Local Government Model Sector Performance Report and AAS are adopted or incorporated by reference and are updated “from time to time” (reg 4 definitions; reg 5(1); reg 11A; explanatory details). That means the precise format and required disclosures can change outside the Statutory Rule itself. Councils must track Department updates and accounting-standard changes to remain compliant; failure to do so is a compliance risk because the Regulations require using the current model/report form.

2. Exact formulae and comparators: Schedules 2-4 specify precise numerators and denominators for each indicator (for example, “Number of planning application decisions made within the relevant required time × 100 ÷ Number of planning application decisions made”). Small differences in counting rules (e.g. what constitutes a "decision" or a "planning application") can materially change reported percentages. Councils must have clear internal definitions and data extraction rules that map to the Schedules’ formulas. Ambiguities in local data systems (e.g. whether a refused application constitutes a “decision”) must be resolved in accordance with the cross-referenced legislation (e.g. Planning and Environment Act 1987).

3. Gender and privacy reporting: The human-resources statements and summaries require breakdowns by “women; men; persons of self-described gender” for both permanent full time and permanent part time staff (reg 6(b)(i)-(ii), reg 8(4)(d)-(e), reg 8(4)(c)-(e), reg 10(l)). For small councils or small teams, these categories may result in small-cell disclosure that triggers privacy sensitivities or identifiability concerns. Councils must reconcile these public transparency obligations with privacy laws and policies and consider safe-aggregation or consent mechanisms, recognising that the Regulations themselves require the classifications and the public statement (Schedule and regs).

4. Procurement disclosure tied to local policy thresholds: Disclosure obligations for contracts above certain values are tied to the Council’s adopted Procurement Policy thresholds (reg 10(c)-(d)). Councils who set higher thresholds will correspondingly publish lists that begin at higher contract values; conversely, Councils with lower thresholds will publish more contracts. There is an operational interplay between the right to set thresholds and the duty to disclose. Also, transitional rules require disclosure tied to the old s 186(1) thresholds (historical $100,000) for certain reporting periods. Councils must ensure procurement records are kept in a way that maps to both historical and current thresholds.

5. Detailed capital works and funding reporting: Budgets and financial plans must list planned capital works by non-current asset classification and asset expenditure type and must provide funding source breakdowns (grants, contributions, Council cash, borrowings) (reg 8(3), reg 8(4)(a)-(b)). That requires project-level data including funding source allocations and accurate classification of works as renewal, upgrade, expansion or new asset. Misclassification can distort performance indicators (e.g. asset renewal vs. upgrade) and affect the “asset renewal and upgrade compared to depreciation” indicators in Schedule 3.

6. Comparison and forecasting burden: The Regulations require three-year historical comparatives for most indicators and budget forecasts or expected results for subsequent three years for selected indicators (reg 9(2)(a), reg 12(a), reg 12(g)). Councils must maintain historical datasets and produce forward projections. Small councils may lack historical data systems or forecasting capacity, creating an administrative burden or the need to procure external expertise.

7. Certification exposure: The model certification text in regs 13(2) and 15(2) contains affirmative language: certifiers state the statements “present fairly” and are not, to their knowledge, misleading or inaccurate. That imposes exposure on the Principal Accounting Officer, CEO and councillors. Boards and officers should ensure internal controls, audit trails and sign-off procedures before certification to avoid post-certification findings of misleading statements.

8. Interdependence with other statutory regimes: Several indicators rely on definitions and timeframes from other Acts (e.g. Planning and Environment Act 1987 for “relevant required time”; Food Act 1984 for required food sampling). Differences in interpretation or timing across regimes create operational complexity. Councils must ensure that data recorded for compliance under other Acts can be mapped to the indicator formulas in these Regulations.

9. Transitional complexity: The Regulations preserve earlier rules for specific financial years (regs 16-17). Councils should be careful to apply the correct version (pre-amendment or amended) for a given reporting year; the transitional saving in reg 17 confirms that the 2025 amendments do not automatically apply to the 2025-26 financial year. Failure to apply the correct version may lead to incorrect disclosures or audit comments.

10. Publication expectations and timing: While the Regulations set content, the timetable for adoption and presentation (for example, adoption dates for budgets and presentation of annual report at Council meetings) are located in the Act rather than the Regulations. Councils must coordinate the Act’s timing obligations with the content obligations in these Regulations. The Regulations’ content is often detailed enough that last-minute adoption without sufficient preparation risks non-compliance.

These “gotchas” are concrete implementation risks: data governance and data systems, privacy and small numbers, cross-legislative data mapping, procurement threshold strategy, and the need for clear internal sign-off processes. Each arises directly from the prescriptive form, indicator formulas and external model dependencies set out in the Regulations.

Below is a practical, source-grounded checklist and implementation approach a Council (or adviser) should follow to meet the obligations established by these Regulations. Each step references the relevant provisions in the instrument.

1. Adopt and use the required model forms and standards

   • Use the Local Government Model Financial Report for the Financial Plan, Budget financial statements and annual-report financial statements as required (reg 5(1), reg 7(1)(b), reg 14(2)(a); explanatory details show the Model Financial Report is incorporated). Monitor Department updates to the Model Financial Report because it is adopted “from time to time” (reg 4 defns; explanatory details).
   • Use the Local Government Model Sector Performance Report for the performance statement form as required by reg 11A. Track Department updates to that model report.

2. Prepare Financial Plan content to the prescribed form

   • Include the statements describing financial resources in the form set out in the Local Government Model Financial Report (reg 5(1)).
   • Include a statement of capital works covering the relevant financial years aligned with the statements describing financial resources (reg 5(2)).
   • Include a statement of human resources and summaries of planned expenditure and planned FTEs categorised by organisational structure and by gender and employment type, per reg 6 and reg 8(4)(c)-(e).

3. Prepare Budgets and Revised Budgets per the Regulations

   • Ensure the budget financial statements include a statement of capital works for the budget year plus the subsequent three years and conform to the Local Government Model Financial Report format (reg 7(1)(a)-(b); reg 7(2)).
   • In the budget or revised budget include: total new borrowings (other than refinancing) for the budget year compared with the previous financial year; detailed lists of planned capital works by non‑current asset classification and asset expenditure type; funding source breakdowns (grants, contributions, Council cash, borrowings); the human resources statement and planned expenditure and FTE summaries; and the performance indicators specified in reg 8(4)(ea) where required (reg 8(1)-(5)).

4. Data systems and indicator definitions

   • Map internal data systems to the exact formulas set out in Schedules 2-4. For each indicator, document the numerator and denominator definitions, the data source, and the process for extracting and validating the data (Schedules 2-4; reg 9; reg 11; reg 12).
   • Ensure interoperability with other statutory data sources (planning systems for “relevant required time” under the Planning and Environment Act 1987; food safety notifications per the Food Act 1984; aquatic facility inspections under the Public Health and Wellbeing Act and regulations).

5. Governance and policy documentation

   • Adopt or review and, if necessary, implement the policies and plans listed in Schedule 1 (Community engagement policy, Financial Plan, Asset Plan, Revenue and Rating Plan, Procurement Policy, Risk and Fraud policies, Audit and Risk Committee arrangements, internal audit) and record adoption dates or reasons for non-adoption, as required for the governance and management checklist in Schedule 1 (reg 9(2)(c); Schedule 1).
   • Ensure the Audit and Risk Committee and internal audit arrangements are documented and meet section 53/54 expectations under the Act as referenced in Schedule 1.

6. Procurement records and threshold alignment

   • Review and, if necessary, update the Procurement Policy and threshold levels under s 108 of the Act because reg 10 ties required reporting of contracts and procurement exceptions to those thresholds (reg 10(c)-(d)).
   • Maintain a procurement register that captures contracts above the relevant threshold, whether a competitive process was used, and exceptions relied upon; prepare the contract lists for annual-report publication accordingly.

7. Human-resources reporting and privacy

   • Prepare statements of human resources and planned FTEs by organisational structure and by gender categories (women, men, persons of self-described gender) and by employment type (permanent full time, permanent part time) (reg 6; reg 8(4)(c)-(e); reg 10(l)-(m)). Consult privacy officers/legal advisors on data aggregation and small‑cell suppression to address identifiability concerns where small numbers may disclose personal information.

8. Capital works classification and funding breakdown

   • Classify capital works into asset renewal, asset upgrade, asset expansion and new asset per the definitions in reg 4. Record funding sources for each item (grants, contributions, Council cash, borrowings) to meet the detailed list requirement in reg 8(4)(a)-(b).

9. Prepare Annual Report and Performance Statement

   • Compile the report of operations content (service performance indicators, three-year results, assessment of governance and management using Schedule 1) as required by reg 9(1)-(2).
   • Prepare the performance statement in the form set out in the Local Government Model Sector Performance Report (reg 11A) and include the prescribed service, financial and sustainable-capacity indicators and measures (reg 11; Schedule 3 and 4).
   • Provide the results achieved in the preceding three financial years, the budget forecasts and expected results, and targets required under reg 12(f)-(g).

10. Certification process

    • Build an internal certification process to support the Principal Accounting Officer and Chief Executive Officer’s certification obligations under regs 13(1) and 15(1). Ensure documentation, audit trails and reconciliations are available prior to the sign-off dates. Use the model wording in regs 13(2) and 15(2) for certifying statements.

11. External audit and professional accounting compliance

    • Ensure financial statements are prepared in accordance with the AAS and the Local Government Model Financial Report (reg 14(2)(a); reg 15(2)). Coordinate with external auditors early to ensure audit evidence is available for both model‑format statements and AAS compliance.

12. Transitional application and version tracking

    • Confirm which version of the Regulations applies to the relevant financial year (see regs 16-17). For example, the 2014 Regulations continue to apply to the financial year commencing 1 July 2020 (reg 16); the 2025 amendments do not apply to the financial year commencing 1 July 2025, per reg 17.

13. Reporting timetable and presentation

    • Align the timing of budget adoption, revised budgets and annual report presentation to Council with the timing provisions in the Local Government Act 2020 (the Regulations specify content but the Act sets adoption and presentation timing). Ensure the annual report containing the certified performance and financial statements is presented at a Council meeting in accordance with the Act (Schedule 1 item 21 refers to presentation at a Council meeting in accordance with s 100 of the Act).

14. Documentation for audit and transparency

    • Keep an audit-ready folder that includes the model templates used, data extracts and reconciliations for indicators, governance checklist documentation, procurement registers, capital works classification and funding evidence, and the certification sign-off pages with dates and names as required by regs 13(2) and 15(2).

15. Monitor amendments and department publications

    • Assign responsibility (Legal/Policy/Finance team) to monitor statutory rule amendments (S.R. Nos) and Department publications of the Local Government Model Financial Report and Local Government Model Sector Performance Report. The Explanatory Details identify that the Department publishes and revises these documents (Explanatory table).

Following these steps will align a Council with the specific content and procedural duties in the Regulations (regs 5-15 and Schedules 1-4). The two overarching compliance imperatives are (1) adopt and use the prescribed models and AAS for statement preparation, and (2) ensure internal data governance and documentation support the precise formulas and comparative/forecast requirements in Schedules 2-4.
