Local Government (Parking for People with Disabilities) Regulations 2014

The regulations revolve around a small set of defined legal concepts that determine who may use a marked bay and how that use is evidenced.

Defined terms (regulation 4)

• disability parking permit: a current document issued by National Disability Services Limited, consisting of (a) an Australian Disability Parking Permit and (b) an ACROD Parking Program Card (regulation 4).
• authorised vehicle: a vehicle that is both used by the holder of a disability parking permit and identified in accordance with regulation 6 (regulation 4).
• permit parking area: a single vehicle parking bay, either on a road or in a parking facility, that has been set aside for use by an authorised vehicle and identified in accordance with regulation 5 (regulation 4).

Identification of permit parking areas (regulation 5)

• Visual ground marking: the bay must have a people-with-disabilities symbol as depicted in the Road Traffic Code 2000 regulation 171(2) painted on the ground within the limits of the bay, with a height between 800 mm and 1 000 mm and a width of no more than 1 200 mm (regulation 5(a)).
• Signage: a parking control sign of the kind referred to in paragraphs (i) and (k) of the definition of that term in the Road Traffic Code 2000 regulation 3 must be erected on or near the bay (regulation 5(b)). The regulation therefore relies on the Road Traffic Code for the sign types and the pictogram depiction.

Identification of authorised vehicles (regulation 6)

• Holder display requirement: the disability parking permit must be displayed in a prominent position enabling the expiry date and permit number to be clearly visible from the front exterior of the vehicle (regulation 6(1)).
• Exclusivity of display: a person other than the holder of the disability parking permit must not identify or purport to identify a vehicle in accordance with regulation 6(1); contravention carries a statutory penalty (regulation 6(2)).

Prohibitions and penalties (regulations 7-9, Schedule 1)

• Standing or parking: only an authorised vehicle may stand or park in a permit parking area; contravention is an offence with a stated penalty and an associated modified penalty amount in Schedule 1 (regulation 7; Schedule 1).
• Unauthorised marking: a person may not identify or purport to identify a permit parking area in accordance with regulation 5 without the written authority of the local government (regulation 8).
• Infringement notices: certain offences in Schedule 1 are prescribed as infringement notice offences for the purposes of s 9.16(1) of the Local Government Act 1995 and have modified penalty amounts set in Schedule 1 (regulation 9 and Schedule 1).

Structural character

• The regulations are expressed to “apply as if they were local laws” (regulation 3), which integrates their operation into the regulatory framework under the Local Government Act 1995 and places primary responsibility for authorisation and local administration with local governments (see regulation 3 and the local-government written-authority requirement in regulation 8).

Transitional and repeal

• The 1988 regulations are repealed (regulation 10), and bays that existed as “parking bays” under the 1988 regulations are taken to be permit parking areas after commencement (regulation 11).

Directly affected persons and entities

• Holders of disability parking permits: People who hold a current disability parking permit issued by National Disability Services Limited are the class of persons the regulations enable to use permit parking areas via an authorised vehicle, provided identification rules in regulation 6 are satisfied (regulation 4, regulation 6(1)).
• Drivers or carers: The regulations limit who may identify a vehicle as authorised; regulation 6(2) explicitly prohibits anyone other than the permit holder from identifying a vehicle in accordance with regulation 6(1). That affects situations where a driver is not the permit holder but transports the permit holder, or where a third party displays a permit on behalf of the holder (regulation 6(2)).
• Vehicle owners and drivers generally: Any person who stands or parks a vehicle in a marked permit parking area without meeting the authorised-vehicle criteria will commit an offence under regulation 7 (regulation 7; Schedule 1).

Local government actors

• Local governments: The regulations apply as if they were local laws (regulation 3), meaning local governments are the statutory decision-makers for written authorisations for marking bays (regulation 8) and are the likely enforcing authority for infringement notices under the Local Government Act 1995 (regulation 9). Local governments must adopt and maintain the specified marking and signage for permit parking areas (regulation 5) and keep written records if they authorise markings by others (regulation 8).

Service providers and signage contractors

• Entities engaged to mark bays and erect signage must follow the technical specifications in regulation 5. They must ensure ground symbols and signs comply with the Road Traffic Code references and the specified dimensions (regulation 5).

Regulatory issuers

• National Disability Services Limited: Identified as the issuing body for the disability parking permit document (regulation 4). The regulation treats the two-part permit (Australian Disability Parking Permit and ACROD Parking Program Card) as the recognised permit for authorised vehicle identification.

Enforcement and compliance bodies

• Officials administering the Local Government Act 1995 infringement system: The regulation prescribes certain offences as infringement notice offences for the purposes of s 9.16(1) of the Act; those bodies or officers authorised under the Act to issue infringement notices will operate within that infringement regime when enforcing these regulations (regulation 9).

Indirectly affected groups and practical implications

• Building owners, shopping centres, and private parking facility operators: If they operate parking facilities, the rule that permit parking areas must be identified in a specified manner and that such identification requires local government written authority (regulations 5 and 8) means their existing bays may need formal authorisation and compliance with marking and signage standards. The transitional provision (regulation 11) treats previously existing bays under the 1988 regulations as permit parking areas, so operators should verify the status of existing bays.

Geographical and temporal scope

• Western Australia: the regulations were made under the Local Government Act 1995 and apply within the jurisdiction of Western Australia, with two commencement dates specified and a later amendment in 2020 noted in the compilation table (regulation 2; Compilation table).

Duties imposed on permit holders and other persons

• Display duty (holders): The holder of a disability parking permit must display the permit in a prominent position so that both the expiry date and the permit number are clearly visible from the front exterior of the vehicle (regulation 6(1)). This is a mandatory, conditions-of-use requirement for an authorised vehicle.
• Exclusivity of display (third parties): A person who is not the permit holder must not identify or purport to identify a vehicle in accordance with the display requirement in regulation 6(1) (regulation 6(2)). The duty is framed as a prohibition on third-party identification.
• Parking restriction duty (everyone): A person must not stand or park a vehicle in a permit parking area unless the vehicle is an authorised vehicle (regulation 7). This is a per-bay prohibition that protects the exclusive use of marked bays for authorised vehicles.
• Signage-authority duty (third parties): A person must not identify or purport to identify a permit parking area in the manner specified in regulation 5 unless they have the written authority of the local government (regulation 8). This places a gatekeeping function on local governments for the establishment of marked bays.

Rights conferred by the instrument

• Exclusive access right for authorised vehicles: An authorised vehicle , i.e., one used by a holder of a disability parking permit and properly identified , has the statutory right to park or stand in a permit parking area designated under regulation 5 (regulations 4, 5 and 7 read together). The right is conditioned on proper identification per regulation 6.
• Local government discretion to authorise markings: Local governments have the authority to permit identification of permit parking areas by written authorisation (regulation 8). That is a decision right that local governments exercise administratively.

Enforcement and remedial mechanisms

• Criminal penalties and infringement notices: The regulations create offences with stated penalties (regulations 6(2), 7 and 8 each state a fine of $5 000). Regulation 9 prescribes certain offences as infringement notice offences under s 9.16(1) of the Local Government Act 1995 and fixes modified penalty amounts in Schedule 1 (regulation 9; Schedule 1). The legal mechanism is therefore dual: offences may attract statutory fines if prosecuted in the relevant court or be dealt with administratively via infringement notices with a modified penalty.
• Repeal and transitional continuity: The repeal of the 1988 regulations and the transitional provision ensure continuity of status for bays that were parking bays under the earlier instrument; such bays are taken to be permit parking areas on and after commencement (regulations 10-11).

Prescriptive technical duties on local governments and sign installers

• Specification compliance: Local governments or contractors must ensure the ground symbol conforms to the Road Traffic Code depiction and the dimensional limits in regulation 5(a) and erect the specified parking control signs referenced in the Road Traffic Code (regulation 5). Failure to apply the specified markings could render a bay non-compliant and expose the installer or the authorising body to the prohibition in regulation 8 if done without written authority.

Interplay between offences and infringement regime

• The regulations create offences with maximum penalties but simultaneously prescribe certain offences as infringement notice offences with lower modified penalty amounts in Schedule 1 (regulation 9 and Schedule 1). The existence of both the court penalty and the infringement notice mechanism means authorised enforcement officers may issue infringement notices in lieu of prosecution, consistent with s 9.16(1) of the Local Government Act 1995.

Statutory penalties in the regulations

• Maximum fines stated in the body of the regulations: Regulation 6(2) prescribes a penalty of a fine of $5 000 for a person other than the holder who identifies or purports to identify a vehicle in accordance with regulation 6(1). Regulation 7 prescribes a fine of $5 000 for parking or standing a vehicle in a permit parking area contrary to the rule that only authorised vehicles may do so. Regulation 8 prescribes a fine of $5 000 for identifying or purporting to identify a permit parking area without the local government’s written authority (regulations 6(2), 7 and 8).
• Modified penalties in Schedule 1: Regulation 9(2) fixes the modified penalties for specified infringement notice offences set out in Schedule 1. Schedule 1 lists the relevant descriptions of offence and a $500 modified penalty amount for each listed offence: identifying or purporting to identify a vehicle contrary to regulation 6(2), standing a vehicle contrary to regulation 7, parking a vehicle contrary to regulation 7, and identifying or purporting to identify a permit parking area contrary to regulation 8 (regulation 9; Schedule 1).

Enforcement mechanism

• Infringement notices: The regulations prescribe certain offences as “infringement notice offences” for the purposes of section 9.16(1) of the Local Government Act 1995 (regulation 9(1)). That section of the Act (not reproduced here) governs the form, issue and effect of infringement notices. By prescription, the regulations enable the administrative pathway of issuing an infringement notice with the modified penalty in lieu of pursuing formal prosecution.
• Court prosecutions: The offences retain statutory maximum fines (the $5 000 amounts) and thus remain prosecutable in court. If a matter is not resolved by payment of an infringement notice, the prosecuting authority may elect to bring the matter before a court where the full statutory penalty may be imposed if the court finds the offence proven (regulations 6(2), 7 and 8).

Who enforces

• Local government officers authorised under the Local Government Act’s infringement notice regime will be the usual enforcement agents because the regulations are prescribed to operate “as if they were local laws” (regulation 3) and because the infringement mechanism is invoked by reference to s 9.16(1) of the Local Government Act 1995 (regulation 9(1)). The regulations do not themselves list specific enforcement officer designations; enforcement depends on the local government’s implementation of the Act’s enforcement architecture.

Practical enforcement details implicit in the text

• Evidence of authorisation and identification: Enforcement involves assessing whether a permit display meets the regulation 6(1) visibility requirement (permit displayed prominently, expiry date and permit number clearly visible from the front exterior) and whether the person displaying is the holder. It also involves assessing if a bay is an authorised permit parking area by reference to the ground-marked symbol and the parking control sign described in regulation 5 and whether any marking was undertaken with written authority from the local government (regulations 5-6, 8).
• Discretion on issuing infringement notices: Regulation 9(2) sets the modified penalties that an infringement notice must specify. The actual decision to issue an infringement notice, and any discretion to accept payment or pursue prosecution, falls within the procedural framework of the Local Government Act 1995 and local government enforcement policies.

Dual penalty structure and enforcement choices

• The instrument creates a dual-structured enforcement regime: an administrative option with a $500 modified penalty for listed offences (Schedule 1) and a prosecutorial option with a statutory $5 000 fine in the regulations themselves. The practical effect is that many matters will be dealt with by infringement notices at the fixed lower amount, but the higher statutory penalty remains available if matters proceed to court.

Integration with the Local Government Act 1995

• The regulations are made under, and expressly operate “as if they were local laws” (regulation 3). They also prescribe certain offences as infringement notice offences for the purposes of section 9.16(1) of the Local Government Act 1995 (regulation 9(1)). Consequently, procedural and enforcement provisions in the Local Government Act , in particular the infringement notice framework under s 9.16(1) , govern the administrative enforcement of these regulations. The regulations do not reproduce that framework; they rely on the Act for the issuance, form, and effect of infringement notices.

Reference to the Road Traffic Code 2000

• Regulation 5 incorporates two elements of the Road Traffic Code 2000 by reference: the depiction of the people-with-disabilities symbol in regulation 171(2) of the Road Traffic Code and the definition of parking control sign in regulation 3 (regulation 5(a)-(b)). That reliance means the visual depiction and the permitted sign types are determined by the Road Traffic Code 2000. Compliance and interpretation therefore require cross-reference to that Code.

Interaction with earlier regulations

• The instrument repeals the Local Government (Parking for Disabled Persons) Regulations 1988 (regulation 10) and includes a transitional provision treating any road portion or bay that immediately before commencement was a “parking bay” under the 1988 regulations as a permit parking area on and after commencement (regulation 11). This creates continuity and avoids gaps for existing bays.

Delegation and local law relationships

• By applying “as if they were local laws” (regulation 3), the regulations sit alongside or within the local government regulatory environment. Local governments retain the power to authorise the identification of permit parking areas by written authority (regulation 8). That creates an interface where local government policies, records and delegations determine how the written-authority function is exercised. The regulations do not themselves spell out local government processes for issuing written authority; those processes will be governed by the Local Government Act and local government practice.

Infringement regime linkage

• The designation of specific offences as infringement notice offences under s 9.16(1) of the Local Government Act (regulation 9) binds these regulations to the Act’s infringement apparatus. The mechanism by which infringement notices are issued, the identity of authorised officers and the consequences of non-payment invoke the Act rather than the regulations themselves.

Permits issued by a third-party body

• The regulations designate National Disability Services Limited as the issuer of the specified disability parking permit documents (regulation 4). The regulations therefore interact with the administrative practice and record-keeping of that private not-for-profit issuer for the core eligibility and issuance process, though the regulations do not regulate the issuance procedure itself.

Court enforcement and criminal law

• While the instrument provides for administrative resolution via infringement notices, the offences remain prosecutable with specified fines in the regulations themselves (regulations 6(2), 7 and 8). If prosecuted, matters would proceed under the usual criminal or quasi-criminal procedures in the Western Australian courts, subject to the Local Government Act and general criminal procedure law. The regulations do not displace general criminal procedure; they create offences enforceable by the courts.

Compilation and amendment chronology in the source

• Original instrument: The Local Government (Parking for People with Disabilities) Regulations 2014 were published on 10 October 2014 and, except for the citation and commencement provisions, came into operation on 1 December 2014 (regulation 2; Compilation table).
• Amendment instrument: The Local Government (Parking for People with Disabilities) Amendment Regulations 2020 (SL 2020/50) were made and published on 24 April 2020. The citation and commencement provisions of that amendment took effect on 24 April 2020, and the remainder of the amendment instrument took effect on 25 April 2020 (Compilation table).

Express amendment notations in the text

• Certain regulations bear amendment annotations indicating they were amended by SL 2020/50: regulation 4 has an amendment note "[Regulation 4 amended: SL 2020/50 r. 4.]", regulation 6 shows "[Regulation 6 amended: SL 2020/50 r. 5.]", regulation 7 shows "[Regulation 7 amended: SL 2020/50 r. 6.]", regulation 8 shows "[Regulation 8 amended: SL 2020/50 r. 7.]" and Schedule 1 shows "[Schedule 1 amended: SL 2020/50 r. 8.]" (see the body text).

What the compilation table records and what it does not

• The compilation table records the dates of publication and commencement for both the 2014 regulations and the 2020 amendment instrument. It does not reproduce the amending text of SL 2020/50; it records only that amendments occurred and which parts of the instrument were affected. The source text shows the current consolidated wording of the regulations and notes where particular provisions have been amended (see regulation footnotes and Schedule 1 amendment note).

Transitional treatment on repeal of the 1988 regulations

• Regulation 10 repeals the 1988 instrument, and regulation 11 provides an express transitional provision that converts parking bays defined under the 1988 regulations into permit parking areas under the 2014 instrument on and after commencement. The compilation table records the 2014 commencement dates; any details of transitional administration or the specific content of the 1988 regulations are not reproduced here.

Practical consequence of amendment history

• The 2020 amendment instrument is recorded as having amended multiple provisions and Schedule 1. The consolidated regulation text displayed in this source is therefore the post‑2020 text. The compilation table is the authoritative record of when those changes took effect. The regulations themselves include the amendment annotations so readers can identify which provisions were affected by the 2020 amending instrument.

No judicial decisions or litigation records are included in this compilation

• The legislation text provided contains no reported cases, judicial commentary or recorded litigation history arising under these regulations. The compilation and notes do not list any court decisions or precedent related to the regulations.

Potential areas for litigation or dispute (text‑based analysis)

• While the source contains no litigation history, the text of the regulations identifies possible dispute vectors that could give rise to enforcement challenges or contested court proceedings:
  • compliance with the display requirement in regulation 6(1): whether a particular display meets the requirement that expiry date and permit number be “clearly visible from the front exterior of the vehicle” could be litigated if a person receives an infringement notice or is prosecuted and asserts the display was compliant;
  • identity of the permit holder under regulation 6(2): whether the person who displayed the permit was “the holder” or was a permitted agent, or whether a third party “purported to identify” a vehicle, may be factually contested;
  • validity and sufficiency of the marking under regulation 5: disputes over whether a ground symbol complies with the Road Traffic Code depiction and dimensional limits, or whether an erected sign matches the Road Traffic Code’s parking control sign types, could produce contested factual and legal questions;
  • written authority under regulation 8: whether written authority was granted by the local government, and what constitutes valid written authority, may be the subject of contested proceedings if a person is prosecuted for unauthorised identification of a permit parking area;
  • transitional status of bays under regulation 11: while regulation 11 declares that bays defined as parking bays under the 1988 instrument are taken to be permit parking areas on and after commencement, disputes could arise about the contemporary status of particular bays or records of their prior status.

Enforcement pathway that could lead to court proceedings

• The regulations create offences with specified fines and simultaneously prescribe infringement notice treatment for certain offences (regulation 9 and Schedule 1). Matters that are not resolved by payment of infringement notices, or that involve contested factual issues, could proceed to prosecution in a court, creating the potential for litigation. The source does not identify case law or outcomes from such prosecutions.

Recordkeeping and evidentiary issues

• Enforcement actions will likely generate evidentiary questions suitable for litigation: photographic evidence showing the location and appearance of the ground symbol and sign (regulation 5), images showing the permit display as seen from the front exterior (regulation 6(1)), and documentary proof of local government written authority (regulation 8). The regulations themselves do not supply evidentiary rules or burdens; those would follow general statutory and procedural requirements in enforcement or court proceedings.

Absence of judicial interpretation in the source

• Because the provided source includes no reported cases or judicial interpretation, there is no text-derived precedent to guide interpretation of ambiguous phrases in the regulations. Practical application and disputes will rely on enforcement practice, administrative records and, if litigated, judicial determinations under the Local Government Act and general statutory interpretation principles.

Dimensions and depiction obligations are strict

• Regulation 5(a) prescribes precise dimensional limits for the people-with-disabilities ground symbol: a height between 800 mm and 1 000 mm and a width of no more than 1 200 mm. Practitioners should not treat these as permissive guidelines. The symbol must be “as depicted in the Road Traffic Code 2000 regulation 171(2)” and located “within the limits of the permit parking area” (regulation 5(a)). A marking that deviates from the depiction or dimensions may be non‑compliant and could affect the legal status of the bay or expose the sign‑installer or authorising body to enforcement consequences under regulation 8 if the marking lacks written authority.

Signage linkage to the Road Traffic Code

• Regulation 5(b) requires a parking control sign of the kinds referred to in paragraphs (i) and (k) of the definition of parking control sign in Road Traffic Code 2000 regulation 3. That means compliance requires consulting the Road Traffic Code for exact sign forms and permitted content. Failure to use the specified sign type may render the bay non‑compliant even if the ground symbol is correct.

Who may display the permit

• Regulation 6(2) makes it an offence for a person other than the holder of a disability parking permit to identify or purport to identify a vehicle in accordance with regulation 6(1). That creates a concrete operational issue: if a carer, family member or employer drives a vehicle on behalf of the holder and displays the holder’s permit, the regulation’s plain wording prohibits that practice unless the driver is also the holder. The definition of authorised vehicle requires the vehicle be “used by the holder of a disability parking permit” and identified in accordance with regulation 6 (regulation 4). Practitioners should note this mechanism when advising clients about shared vehicles, pooled cars or transport services for permit-holders.

Front‑exterior visibility requirement

• The permit must be displayed so expiry date and permit number are “clearly visible from the front exterior of the vehicle” (regulation 6(1)). Rear-window displays or internal placements that obscure those elements from a front‑of‑vehicle viewpoint risk non‑compliance. This is a technical visibility standard that matters for enforcement, especially where photographs are taken by local government officers from the front of vehicles.

Single‑vehicle parking bay limitation

• A permit parking area is defined as a “single vehicle parking bay” (regulation 4). Some facilities have extended bays or areas reserved for accessible drop-off where a single vehicle bay model may not map neatly. The definition limits the regulation’s built‑in conception of a bay to single‑vehicle bays. Where a premises seeks to reserve larger areas or multiple contiguous spaces, the instrument’s definition may not directly support that configuration without careful implementation that treats each bay individually.

Local government written authority is required

• Regulation 8 requires written authority from the local government to “identify or purport to identify a permit parking area in accordance with regulation 5.” That is an explicit gatekeeping step. Private property owners, facilities managers or contractors who mark bays without written authority may commit an offence (regulation 8) even if the marking otherwise conforms to regulation 5. The transition provision (regulation 11) converts older bays, but any new marking requires written authority.

Mismatch between statutory fines and modified penalties

• The body of the regulations states a penalty of $5 000 for certain offences (regulations 6(2), 7 and 8), but Schedule 1 fixes a $500 modified penalty for those same offences when dealt with by infringement notice (regulation 9; Schedule 1). The practical implication is that although the infringement notice pathway will often resolve matters at $500, a prosecution in court can expose accused persons to the higher $5 000 penalty.

Transitional status may conceal record gaps

• Regulation 11 declares that portions of road or parking facilities that immediately before commencement were “parking bays” under the 1988 regulations are to be taken to be permit parking areas on and after commencement. For local governments or facility operators, this means older bays may have the status of permit parking areas even if documentary records are sparse; however, proving the prior status of a particular bay may create administrative complications if records are incomplete.

Permit composition and issuer

• The disability parking permit is defined as consisting of two documents: an Australian Disability Parking Permit and an ACROD Parking Program Card issued by National Disability Services Limited (regulation 4). Practitioners should ensure that the permit presented meets that composition requirement; partial or alternative documents may not qualify as a “disability parking permit” within the meaning of the regulations.

Ambiguity around “used by the holder”

• The authorised vehicle definition requires the vehicle to be “used by the holder” of a disability parking permit (regulation 4). The phrase leaves room for factual disputes about whether a vehicle is being used by the holder at a particular time. Enforcement and defence arguments may turn on the meaning of “used by” in context, an issue that could cause operational confusion without established administrative guidance or case law.

Enforcement evidence standard

• Because the infringement framework operates by issuing notices under s 9.16(1) of the Local Government Act 1995 (regulation 9(1)), enforcement often depends on photographic and administrative evidence gathered by a local government officer. Those photographs will typically need to show the ground symbol, the sign, and the permit display from the front exterior; poor-quality images or incomplete administrative records can complicate enforcement or contestation.

For local governments and parking facility operators

• Obtain written authority where required: Before identifying a permit parking area in the manner described in regulation 5, ensure you have written authority from the local government if you are not the local government (regulation 8). Maintain records of written authorisations to evidence lawful marking.
• Follow the marking and signage specifications precisely: For each permit parking area, paint the people-with-disabilities symbol “as depicted in the Road Traffic Code 2000 regulation 171(2)” within the bay limits, with a height between 800 mm and 1 000 mm and a width no more than 1 200 mm (regulation 5(a)). Erect the appropriate parking control sign as described by the Road Traffic Code 2000 regulation 3(paragraphs (i) and (k)) on or near the bay (regulation 5(b)). Consult the Road Traffic Code for the exact pictogram and sign types before procurement and installation.
• Treat each bay as a single-vehicle bay: The definition of “permit parking area” is a single vehicle parking bay (regulation 4). Lay out bays so each authorised space conforms to the single-bay model; if you intend to reserve contiguous spaces, treat them as separate bays for the purposes of marking and enforcement.
• Audit existing bays after amendment and transition: Review bays that existed as “parking bays” under the repealed 1988 regulations to confirm they meet the current visual and signage standards, and update markings and signage where necessary (regulation 11).
• Set enforcement policies consistent with the Local Government Act: Adopt clear internal procedures for issuing infringement notices authorised by s 9.16(1) of the Local Government Act 1995, including designated issuing officers, photographic and administrative evidence standards, and internal review or dispute-handling practices (regulation 9).

For permit holders

• Carry and present the correct permit documents: Ensure you have the two documents that constitute the disability parking permit under regulation 4 , the Australian Disability Parking Permit and the ACROD Parking Program Card issued by National Disability Services Limited , and ensure they are current (regulation 4).
• Display the permit correctly: When using an authorised vehicle, display the disability parking permit in a prominent position so that the expiry date and the permit number are clearly visible from the front exterior of the vehicle (regulation 6(1)). Test visibility from the front of the vehicle and replace or adjust holders or mounts that obscure those details.
• Retain the permit holder’s control over identification: Regulation 6(2) prohibits anyone other than the holder from identifying a vehicle in accordance with regulation 6(1). If someone else regularly drives the vehicle on the holder’s behalf, consider whether that driver is the holder or whether alternative arrangements (for example, the holder being present when the permit is displayed) are required to comply with the regulations.

For drivers and operators who transport permit holders

• Confirm the driver’s status relative to the permit: If you transport a permit holder but are not the permit holder yourself, you must not display the permit in a way that represents you as doing so under regulation 6(1) because regulation 6(2) prohibits non-holders from identifying a vehicle under that regulation. Organisations operating fleet vehicles should put administrative controls in place to ensure permits are displayed only in accordance with the holder’s presence or applicable operational arrangements.
• Ensure visibility practices: Place the permit so it is clearly visible from the front; avoid rear-window-only placement or internal mounting that obscures the expiry date or permit number from a front viewpoint (regulation 6(1)).

For private property owners and facility managers

• Seek local government written authority before marking bays: If you propose to create or mark permit parking areas on private land that is in public use, obtain written authority from the relevant local government to identify the permit parking area in the manner required by regulation 5 (regulation 8). Keep written records of the authorisation.
• Conform signs to the Road Traffic Code: Use the sign types specified in the Road Traffic Code 2000 regulation 3 (paragraphs (i) and (k)) and ensure correct positioning and legibility (regulation 5(b)).

For enforcement officers and compliance staff

• Use the infringement notice pathway where appropriate: Regulation 9(1) prescribes certain offences as infringement notice offences under s 9.16(1) of the Local Government Act 1995. Issue infringement notices with the modified penalty amounts fixed in Schedule 1 when matters fall within those prescribed offences (regulation 9 and Schedule 1).
• Collect robust evidence: Photographic evidence should show the ground symbol with its dimensions relative to the bay, the parking control sign, the permit display from the front exterior with expiry date and permit number legible, and documentation of written authority where relevant (regulations 5-6, 8).
• Be aware of dual penalty exposure: Understand that the act of issuing an infringement notice for a prescribed offence provides an administrative resolution at the modified penalty level; failure to resolve may lead to prosecution where the court could impose the higher statutory fines stated in the body of the regulations (regulations 6(2), 7, 8 and Schedule 1).

Recordkeeping and administrative controls

• Maintain records of all written authorisations, signage specifications and installation certificates to demonstrate compliance with regulation 5 and to defend any challenge under regulation 8.
• Keep registers or logs of infringement notices issued under the Local Government Act 1995 and retain photographic evidence and officer statements to support decisions, consistent with administrative and evidentiary best practice.

Concluding compliance checklist (short)

• Confirm the permit documents are current and complete (regulation 4).
• Display the permit frontwards with expiry date and permit number visible from the front exterior (regulation 6(1)).
• Do not allow non-holder persons to display the permit (regulation 6(2)).
• Obtain local government written authority before marking or signing bays (regulation 8).
• Mark bays to the dimensional and pictogram standards in regulation 5 and use the Road Traffic Code sign types (regulation 5).
• Use the Local Government Act infringement notice mechanism with the modified penalties in Schedule 1 where appropriate (regulation 9 and Schedule 1).
