Local Government (Members Allowances and Benefits) Regulations 2025

The Regulations revolve around a narrow set of statutory concepts that determine eligibility, payment timing, approved expense types and record-keeping cadence. The drafters supply definitions and lists rather than open-ended standards.

• Eligible journey (reg 3). An "eligible journey" means travel in either direction between a member’s principal place of residence or a place of work and the place of a prescribed meeting. This notion ties reimbursement to trips that originate or terminate at private or work premises and reach a meeting defined as prescribed.

• Prescribed meeting (reg 3). A "prescribed meeting" includes: a meeting of council or council committee; an information or briefing session under section 90A of the Act; and any other discussion, workshop, briefing, or training course or similar activity that is directly or closely related to the performance or discharge of the member’s roles or duties. The concept therefore extends beyond formal council or committee meetings to training and other activities that are "directly or closely related" to the member’s duties.

• Allowances instalment timing (reg 4). For section 76 purposes an allowance may be paid in instalments up to three months in advance or three months in arrears of each month in respect of which the instalment is payable. The practical effect is a quarterly-style timing flexibility for allowance payments.

• Reimbursable expenses by right (reg 5(1)). The Regulations prescribe the kinds of expenses that are reimbursable under section 77(1)(a): travelling expenses actually and necessarily incurred for eligible journeys to prescribed meetings, provided the route is the shortest or most practicable; and costs of care for a member’s child or a dependant requiring full-time care, incurred because of attendance at a prescribed meeting.

• Limits and mechanics on reimbursable travel (reg 5(2) and 5(3)). If travel crosses the council boundary, only expenses attributable to the travel within the council area are reimbursable (reg 5(2)(a)(i)). Motor vehicle reimbursement is pegged to the relevant per-kilometre rate under Commonwealth income tax law (section 28.25 of the Income Tax Assessment Act 1997) (reg 5(2)(a)(ii)). Care provided by a person who ordinarily resides with the member is not reimbursable (reg 5(2)(b)). Councils may aggregate claims for multiple short journeys (those not exceeding 20 kilometres) and pay them monthly or quarterly (reg 5(3)).

• Expenses requiring council approval (reg 6). For section 77(1)(b), the Regulations prescribe a list of expenses that require council approval before reimbursement. These cover telecommunications, travel to council business functions not already covered by s77(1)(a), travel outside the council area, care costs related to functions and attendance at conferences/seminars/training directly or closely related to member duties. The regulation distinguishes routinely reimbursable items (s77(1)(a)) from those subject to prior council approval (s77(1)(b)).

• Register of Allowances and Benefits (reg 7). The CEO’s recording obligations under section 79 are operationalised by requiring entries or records of specified reimbursements, benefits and late-recorded items only on a quarterly basis. The Explanatory Note within the regulation explicitly states that reimbursements under section 77(1)(a) are not required to be recorded in the Register.

• Repeal (Schedule 1). The Regulations repeal the 2010 Regulations, replacing the prior subordinate framework.

These concepts create clear eligibility gates (origin/destination of journeys, type of meeting, route) and administrative levers (payment timing, apportionment of cross-boundary travel, aggregation option, quarterly recording). Several concepts contain qualitative or judgmental phrases , "shortest or most practicable route" and "directly or closely related" , which the Regulations leave to operational interpretation. The kilometre rate is explicitly tied to Commonwealth taxation law, thus making the monetary rate variable as that external provision changes.

The Regulations allocate costs, discretion and record‑keeping among three primary groups: members of councils (elected members), council organisations (council as payer and decision-maker), and the chief executive officer (the local government CEO) responsible for the Register entries.

• Members of council. The Regulations primarily affect members by defining when they can claim allowances and reimbursements and what supporting facts will determine entitlement. Members gain a right to reimbursement for travel to prescribed meetings if the journey meets the "eligible journey" criteria and is by the shortest or most practicable route (reg 5(1)(a)). Members can claim care expenses for a child or dependent for attendance at prescribed meetings (reg 5(1)(b)), subject to the prohibition against reimbursement where the carer ordinarily resides with the member (reg 5(2)(b)). Members who attend conferences, seminars or training directly or closely related to their duties may seek reimbursement but only where the council grants approval under section 77(1)(b) (reg 6(e)). Members also gain the flexibility for allowance instalments to be paid up to three months forward or backward (reg 4).

• Councils (as institutions). Councils are the payers and gatekeepers. They pay allowances (s 76 of the Act) in line with reg 4, reimburse expenses under s 77, and must approve the prescribed categories under section 77(1)(b) per reg 6. Councils have discretion in at least two places: they may aggregate small travel claims (reg 5(3)), and they decide whether to approve the categories of items listed in reg 6. Councils are also implicated in boundary apportionment: reimbursements for journeys partially outside the council area are limited to the portion within the area (reg 5(2)(a)(i)), implying councils must adopt or apply a method to attribute costs to the intra-area portion.

• Chief executive officer (CEO). Reg 7 prescribes a quarterly recording cadence for the CEO under section 79, limiting the frequency with which the CEO must enter details of reimbursements under section 77(1)(b) and other benefits paid or provided, and the timing for making records of previously unrecorded provisions. The note to reg 7 clarifies that section 77(1)(a) reimbursements need not be recorded in the Register.

• Carers and dependants. The Regulations affect who can be paid for care services indirectly. Care expenses are reimbursable only when care is provided by a person who does not ordinarily reside with the member (reg 5(2)(b)). Therefore, household members who ordinarily live with the councillor are excluded from reimbursement.

• External administrative actors. The Regulations reference Commonwealth income tax law for the motor vehicle kilometre rate (reg 5(2)(a)(ii)). That means national tax law indirectly affects local reimbursement rates. No other external agencies are assigned duties by the Regulations themselves.

• Time-bound effect. The Regulations come into operation on 1 September 2025 (reg 2). The 2010 Regulations are repealed by Schedule 1; any council operations still relying on the 2010 instrument must transition.

Who pays: the council pays allowances and reimbursements and funds any approved care, travel or conference expenses. Who decides: council approval is required for the reg 6 categories; the CEO records entries quarterly; councils decide whether to exercise aggregation powers under reg 5(3). Behaviour changes this produces include members retaining supporting evidence and timing claims to quarterly cycles, councils implementing apportionment and approval processes for the reg 6 categories, and CEOs batching register entries to a quarterly schedule.

The Regulations allocate a small set of rights to members and duties to councils and CEOs; they do not themselves create criminal or sanctioning provisions, but they shape entitlements and administrative obligations under sections of the Act they reference.

Rights of members

• Reimbursement for eligible travel. Members have the right to be reimbursed for travelling expenses actually and necessarily incurred for eligible journeys to prescribed meetings, provided the journey is by the shortest or most practicable route (reg 5(1)(a)). That right is limited where a journey crosses a council boundary; the member is entitled only to reimbursement of the portion attributable to travel within the council area (reg 5(2)(a)(i)).

• Reimbursement for care costs relating to prescribed meetings. Members can claim reimbursement for expenses actually and necessarily incurred for the care of their child or a dependant requiring full-time care that arise from attending a prescribed meeting, subject to the residential exclusion (reg 5(1)(b) and reg 5(2)(b)).

• Conference/training and other costs subject to council approval. Members may seek reimbursement for the categories listed at reg 6, but these are subject to council approval under section 77(1)(b) of the Act; the Regulation prescribes those categories but does not guarantee approval. The categories include telecommunications, travel to functions not covered by s77(1)(a), travel attributable to outside area travel, care for functions, and conference/training attendance (reg 6(a)-(e)).

• Timing of allowance payments. Members have a practical right to receive allowance instalments with up to three months forward or backward timing from the relevant month (reg 4).

Duties and decision obligations of councils and CEOs

• Council approval duty. Councils must follow the Act’s process for approving reimbursements under s77(1)(b); reg 6 prescribes the kinds of expenses that need such approval. The Regulation itself does not specify how councils must assess or record that approval, but it places the obligation on councils to approve any of the listed categories before payment under s77(1)(b).

• Payment duty. Councils are responsible for paying allowances and reimbursements in accordance with the Act and these Regulations. For example, when reimbursing motor vehicle costs for eligible journeys, the council must apply the kilometre rate equal to the applicable rate in Commonwealth tax law (reg 5(2)(a)(ii)).

• Aggregation discretion. Councils may, but are not required to, aggregate claims for multiple journeys that do not exceed 20 kilometres and pay them monthly or quarterly (reg 5(3)). That is an express delegation of operational discretion.

• CEO recording duty. Under reg 7, the CEO’s duty to enter specified reimbursements and benefits in the Register under section 79 is limited to a quarterly cadence; the CEO must enter details of expenses reimbursed under s77(1)(b) and other benefits paid or provided (s79(1)(b) and s79(1)(c) respectively), or make records of previously unrecorded provisions under s79(2)(b), on a quarterly basis.

Operational consequences and documentation implications

• Evidence of routes and eligibility. Because reg 5(1)(a) requires travel to be by the "shortest or most practicable route", councils and members will need to record or justify route choices if reimbursement is later questioned. Reg 5(2)(a)(i) requires apportionment for cross-boundary travel; councils must adopt or apply a method for attributing intra-area travel costs.

• Motor vehicle rate linkage. Councils must monitor the relevant Commonwealth tax provision (section 28.25 of the Income Tax Assessment Act 1997) to apply the "appropriate rate per kilometre" when calculating motor vehicle reimbursements (reg 5(2)(a)(ii)). That creates an operational duty to track external statutory rates.

• Record-keeping schedule. The CEO’s quarterly entry requirement (reg 7) imposes a periodic duty to compile and record approved reimbursements and benefits. The Regulation’s explicit exclusion of s77(1)(a) reimbursements from the Register reduces the range of items that must be recorded in the Register, but councils will still require internal record-keeping for those payments for audit and budget purposes.

• Approval processes. For the categories in reg 6, councils must have internal procedures for considering and documenting approvals under s77(1)(b) (for example, minutes, resolution numbers, or delegated approval instruments), as the Regulation prescribes the categories but not the mechanism for approving them.

The Regulations therefore allocate precise entitlements and administrative duties , members may claim certain expenses, councils must approve some categories and pay in line with specified rules, and CEOs must record on a quarterly cycle , while leaving several implementation details to councils. Where the Regulations are silent, implementation practice will determine how rights are accessed and duties are performed.

The Regulations themselves do not introduce new monetary fines, penalties or criminal offences. They operate as subordinate rules within the Act’s framework and reference the Act for the substantive powers to pay allowances and reimburse expenses. The Regulations provide administrative rules about what is reimbursable, payment timing and recording cadence, but they do not specify enforcement instruments or sanction regimes.

What the Regulations do specify that bears on enforcement and accountability is record-keeping cadence and what must or need not be recorded in the Register of Allowances and Benefits (reg 7 and the accompanying note). Those recording requirements create a transparency mechanism that can be relied upon by auditors, council governance reviewers and the public under the Act’s disclosure processes, but the Regulations do not state a penalty for failure to enter information or for making inaccurate entries. Any sanction for non‑compliance with recording or payment obligations would therefore need to be traced to the Act itself (sections 76, 77 and 79 of the Act are the statutory hooks referenced in these Regulations). The Regulations implement, by prescribing timing and categories, the operational content of those sections; they do not change the Act’s enforcement structure in text.

Two practical enforcement-related features emerge from the Regulations:

• Reduced frequency for Register entries. Reg 7 makes the CEO’s recording obligation quarterly for specified items. That choice concentrates the timeliness of recorded disclosure into quarterly batches; if transparency or audit regimes rely on more frequent publication, the quarterly cycle could affect timeliness without creating a new sanctioning regime.

• Criteria and evidentiary triggers for entitlements. Reg 5(1)(a) and reg 5(1)(b) create entitlement conditions (eligible journey, shortest or most practicable route, care of a non-resident carer), and reg 5(2) imposes apportionment and rate rules (including a Commonwealth-based kilometre rate). Disputes over eligibility, route selection or apportionment would arise within existing Act-based governance or administrative review processes; the Regulations provide the operational standards that would be applied in such reviews, but they do not create new adjudicative bodies.

If a user of the Regulations requires detail on sanctions or the processes for challenging decisions, the Act should be consulted for enforcement and review mechanisms. The Regulations themselves confine their role to defining which items are reimbursable, how payments can be timed, what needs council approval, and how often the CEO must record entries in the Register.

The Regulations are expressly subordinate to and implement parts of the Local Government Act 1999. They frequently reference specific sections of the Act and one provision in Commonwealth taxation law. The interactions are narrow and procedural.

• Local Government Act 1999. The Regulations repeatedly operate "for the purposes of" particular sections of the Act. Reg 4 implements section 76 of the Act in relation to allowances. Regs 5 and 6 implement section 77 of the Act in relation to reimbursement of expenses under subsections 77(1)(a) and 77(1)(b) respectively. Reg 7 implements subsections (1) and (2) of section 79 of the Act relating to the Register of Allowances and Benefits. The Regulations do not alter the substantive provisions of the Act; they operationalise the Act’s discretion by listing categories of reimbursable expenses, payment timing and recording frequency.

• Income Tax Assessment Act 1997 (Commonwealth). Reg 5(2)(a)(ii) ties the rate of reimbursement for motor vehicle costs to "the appropriate rate per kilometre determined for the purposes of calculating deductions for car expenses under section 28.25 of the Income Tax Assessment Act 1997 of the Commonwealth." That creates a direct legal linkage where the monetary rate applied in council reimbursement must reflect the rate determined under Commonwealth tax law. Operationally, councils must monitor that Commonwealth statutory rate and apply it for reimbursements; any change at the Commonwealth level will alter the reimbursement quantum without further amendment to these Regulations.

• Council area boundaries and jurisdictional apportionment. Reg 5(2)(a)(i) restricts reimbursement for journeys that cross a council’s boundary to the portion attributable to travel within the council area. That creates an interaction with the legal and geographical boundaries determined under the Act or under other instruments that define a council’s area. The Regulations do not prescribe the method of attribution, leaving councils to determine an apportionment method consistent with the requirement that only the intra-area portion be reimbursed.

• Register and public transparency regimes under the Act. Reg 7 prescribes the CEO’s recording cadence for the Register under section 79 of the Act. The broader disclosure, access, and audit regimes that apply to the Register are governed by the Act; the Regulations modify the frequency and scope of entries required, but they do not change how third parties may obtain or challenge those records under applicable parts of the Act.

• Repeal of prior subordinate instrument. Schedule 1 repeals the Local Government (Members Allowances and Benefits) Regulations 2010. That repeal interacts with transitional administrative practice; councils operating under the 2010 Regulations up to the commencement date must implement the 2025 Regulations from 1 September 2025.

Matters not addressed by the Regulations that may implicate other laws

• Taxation, employment and procurement law implications of payments. The Regulations instruct councils to use a Commonwealth tax rate for kilometre reimbursement but do not elaborate on withholding, payroll tax, superannuation or other tax or employment law consequences of allowances and reimbursements. Those interactions remain governed by Commonwealth and State tax and employment law and are therefore relevant to how councils administer payments.

• Privacy and record-keeping law. Reg 7 creates a quarterly recording obligation but does not address the privacy or retention requirements for records. Councils will need to apply applicable State privacy, records management and archival laws when storing and publishing Register information.

Overall, the Regulations link local reimbursement practice to the Act’s statutory framework and to a specific Commonwealth taxation provision. They leave several detailed interactions , apportionment methods, tax treatment and privacy handling , to councils and to other statutory regimes.

The Regulations are a new instrument dated 2025 and carry an explicit repeal of the earlier subordinate regulation. The information in the instrument itself sets out the immediate amendment/repeal context.

• Commencement and citation. The Regulations are titled the Local Government (Members Allowances and Benefits) Regulations 2025 (reg 1). They commence on 1 September 2025 (reg 2).

• Repeal of 2010 Regulations. Schedule 1 repeals the Local Government (Members Allowances and Benefits) Regulations 2010 in full. The Schedule effect is direct; the 2010 instrument ceases to have effect when the new Regulations commence.

• Principal regulations reference. The Legislative history notes the instrument as "Principal regulations Year 2025 No 74", Gazette 31.7.2025 p2901 and confirms commencement by reference to reg 2. No other amending instruments are listed in the text provided.

• No transitional or savings provisions recorded. The Regulations, as presented in the source, do not include transitional provisions, savings clauses or explicit directions about how existing claims or registers prepared under the 2010 Regulations are to be migrated. The repeal in Schedule 1 is absolute in form within the Schedule; absent transitional provisions in these Regulations, councils should assume the 2010 instrument ceases to govern from the commencement date and that the 2025 Regulations apply thereafter.

• No subsequent amendments within the instrument. There is no internal amendment history recorded in this text; the instrument appears to be the principal and current regulation for the subject matter as at its commencement.

For practitioners, the immediate practical consequence is that councils and members must adopt the 2025 Regulations’ operational rules from 1 September 2025 and no longer rely on the 2010 Regulations. Because the instrument contains no transitional provisions, councils should identify any ongoing claims, payment cycles or register entries that straddle the commencement date and make administrative arrangements to align with the new definitions, payment timing (three months advance/arrears), reimbursable categories and quarterly recording cadence.

The text supplied contains no litigation history concerning these Regulations. The Legislative history section at the end of the instrument records publication details (Principal regulations 2025 No 74, Gazette 31.7.2025 p2901; commencement 1.9.2025: r 2) but does not mention any judicial proceedings, appeals or judicial review matters related to the Regulations.

Because the Regulations are subordinate rules implementing sections 76, 77 and 79 of the Local Government Act 1999, any litigation that might arise in future would likely be about application of those statutory provisions as operationalised by these Regulations , for example, disputes over whether a journey is an "eligible journey", whether a route taken was the "shortest or most practicable route", whether care was provided by a person who "ordinarily resides" with the member, or whether apportionment of cross-boundary travel was correctly calculated. The Regulations themselves provide the operational tests that a court or tribunal would apply; however, the source text contains no cases or past decisions to cite.

Practitioners seeking precedent should therefore note that this instrument is new and that any case law will post‑date its commencement. Until courts or tribunals have considered these Regulations in the factual matrix of specific disputes, interpretive questions will be resolved by applying the text’s definitions and operational rules alongside the Act’s governance and review mechanisms.

The Regulations are concise, but several features can produce operational ambiguity, compliance risk or unintended administrative costs because the instrument leaves specific implementation details to local practice.

1. "Shortest or most practicable route" (reg 5(1)(a)). The Regulations require that eligible journeys be "by the shortest or most practicable route". That phrase is qualitative and fact-specific. The instrument does not specify how to measure "shortest" (distance, time, or usual route), what "most practicable" means where the shortest route is impractical (for safety, accessibility, traffic or public transport considerations), or what evidence suffices to justify a non-shortest route. Councils and members will need to adopt and document a policy for route justification and record-keeping to avoid disputes.

2. Cross-boundary apportionment (reg 5(2)(a)(i)). When an eligible journey crosses a council boundary, only the portion attributable to travel within the council’s area is reimbursable. The Regulations do not prescribe an apportionment methodology (for example, by distance, by time, or by start/end segmentation). Councils must adopt a consistent and auditable method to calculate the intra-area portion; absent such a method, members and auditors may have diverging views about entitlement.

3. "Ordinarily resides" exclusion for carers (reg 5(2)(b)). Reimbursement for care is excluded if the care is provided by a person who "ordinarily resides with the member". The Regulations do not define "ordinarily resides". That may create uncertainty for members whose household arrangements are non-standard (e.g. shifting residences, shared custody, or part-time co-residence). Policies will need to define evidence and the temporal threshold for "ordinary residence".

4. "Directly or closely related" and "prescribed meeting" scope (reg 3). The definition of "prescribed meeting" extends beyond formal council meetings to "any other discussion, workshop or briefing, or a training course or similar activity, that is directly or closely related to the performance or discharge of the roles or duties of the member." This opens room for interpretation about whether a particular training or external event is sufficiently connected to member duties to qualify. Councils should provide guidance and approval pathways, particularly because some of these activities will require council approval under reg 6(e) if they fall outside s77(1)(a).

5. Aggregation discretion and payment timing (reg 5(3) and reg 4). Councils "may" aggregate claims for journeys that do not exceed 20 kilometres and pay them monthly or quarterly. That is permissive rather than mandatory. Councils must decide whether to operate aggregation schemes, and if they do, define aggregation rules. The allowance instalment timing (reg 4) allows up to three months advance or arrears, which can interact with aggregation to create varying cashflow impacts on members depending on the council’s chosen payment cadence.

6. Register recording cadence (reg 7). The CEO is required to enter or record specified reimbursements and other benefits quarterly. Reg 7 also clarifies that s77(1)(a) reimbursements are not required in the Register. That gap between payments and public Register entries could create transparency timing issues. Members and councils must maintain internal records for non-Register items to ensure auditability, but the public Register will only capture a subset of reimbursed items and only on a quarterly basis.

7. Linkage to Commonwealth tax law (reg 5(2)(a)(ii)). The motor vehicle per-kilometre rate is tied to a Commonwealth provision. That introduces an external dependence: when the Commonwealth rate changes, the council’s reimbursement quantum must adjust. Councils need procedures to update rates and communicate changes to members. The Regulations do not define the administrative process to capture changes.

8. No penalties or detailed enforcement provisions within the Regulations. The instrument prescribes entitlements and recording intervals but does not specify sanctions for non-compliance with recording or payment rules. Enforcement and review rely on the Act’s broader governance mechanisms. Practitioners should therefore link compliance to the Act’s provisions and internal governance policies to create enforceable processes.

9. Repeal without transitional provisions (Schedule 1). The 2010 Regulations are repealed but the instrument contains no transitional instructions. Councils must plan for operational transition by the commencement date to avoid gaps or conflicting processes.

10. Approval mechanism for reg 6 categories unspecified. Reg 6 prescribes expense categories requiring council approval under section 77(1)(b). The Regulations do not specify whether approval must be by resolution of council, by delegated authority, or via budgeted policy , that procedural detail remains to be established by each council.

These "gotchas" arise from the Regulations’ reliance on qualitative standards, discretionary language, cross-jurisdictional linkages and omission of procedural detail. Practical risk mitigation requires councils to issue policies defining route evidence, apportionment methods, definitions for residence, approval procedures, and aggregation processes before the commencement date.

This section translates the Regulations into an actionable compliance checklist for councils, CEOs and members. Each item refers directly to the relevant regulation.

For councils (governing body and administration)

1. Adopt an expenses and travel policy reflecting the Regulations. Ensure the policy:

   • Adopts the definitions from reg 3 for "eligible journey" and "prescribed meeting" and applies them to routine cases.
   • Specifies how "shortest or most practicable route" will be determined and what supporting evidence members must supply (e.g. odometer readings, mapping output, route explanation).
   • Sets an apportionment methodology for journeys crossing council boundaries (distance-based apportionment by GPS mapping is typical), documenting the method in council policy to ensure auditability as required by reg 5(2)(a)(i).
   • Defines "ordinarily resides" for purposes of reg 5(2)(b) and the types of evidence required (e.g. electoral roll, tenancy agreements, household bills) where care expenses are claimed.

2. Implement payment and aggregation procedures.

   • Update payroll or accounts payable systems to permit allowance instalments up to three months in advance or arrears in line with reg 4.
   • Decide whether to exercise the permissive aggregation power in reg 5(3) for journeys not exceeding 20 kilometres. If aggregating, set aggregation thresholds, claim cut-offs, and monthly or quarterly payment schedules.

3. Establish approval processes for reg 6 categories.

   • Design a standard approval workflow for expenses requiring council approval under reg 6: determine which committee or officer has delegated authority, the documentation required for approval (agenda item, motion or delegated decision), and disclosure requirements.
   • Track and record approvals in a manner compatible with later CEO Register entries under reg 7.

4. Update vehicle reimbursement processes.

   • Implement a mechanism to apply the kilometre rate stipulated in reg 5(2)(a)(ii) by referencing and updating the rate from section 28.25 of the Income Tax Assessment Act 1997 (Commonwealth) whenever it changes.
   • Ensure calculations are auditable and accessible in payment records.

5. Prepare for the Register cadence under reg 7.

   • Create an internal schedule to compile items requiring CEO entry on a quarterly basis: expenses reimbursed under s77(1)(b) and other benefits paid or provided, plus any reimbursements or benefits not previously recorded (s79(2)(b) as referenced by reg 7). Note that s77(1)(a) reimbursements need not be entered in the Register per the Note to reg 7.
   • Ensure the CEO or delegated officer compiles and files the quarterly entries on time and maintains copies for audit.

6. Transition from the 2010 Regulations.

   • Identify practices, forms and systems used under the repealed 2010 Regulations and replace them with processes that comply with the 2025 Regulations before 1 September 2025.

For the chief executive officer (CEO) and records officers

1. Maintain a quarterly Register process.

   • Ensure that entries required by reg 7 are recorded quarterly: expenses reimbursed under s77(1)(b), other benefits paid or provided (s79(1)(c) context), and records of previously unrecorded reimbursements or benefits (s79(2)(b) context).
   • Retain internal supporting documentation for reimbursements that are not required to be listed in the Register (s77(1)(a) items) to support audits and financial controls.

2. Implement quality control and internal audit.

   • Periodically sample travel and care claims to ensure they meet reg 5 criteria (eligible journey, shortest/most practicable route, non‑resident carer, intra-area apportionment).
   • Reconcile payments against approved budgets and council resolutions for reg 6 categories.

For members of council

1. Document claims thoroughly.

   • For travel claims meeting reg 5(1)(a), supply evidence of start and end points, distance or route taken, and a statement explaining why the route is the shortest or most practicable if not intuitively obvious.
   • For care claims under reg 5(1)(b), provide invoices or receipts specifying the carer and confirmation that the carer does not ordinarily reside with the member if required by council policy aligned to reg 5(2)(b).

2. Seek pre-approval where required.

   • For categories in reg 6 (telecommunications costs, travel to council business functions not covered by s77(1)(a), travel outside the area, care costs for functions, and conferences/training), obtain council approval before incurring expenses where practicable, and retain written evidence of that approval.

3. Understand payment timing.

   • Expect allowance instalments to be payable up to three months in advance or arrears under reg 4; plan personal cashflow accordingly.

Practical checklists and templates to adopt before commencement

• Claim form template. Include fields for trip origin, destination, purpose (link to prescribed meeting), date/time, kilometres, route justification, invoice/receipt attachments, carer details and residency confirmation, and a checklist to determine whether the item is a reg 5(1)(a) reimbursement (no Register entry required) or a reg 6 item (council approval and later Register entry).

• Approval resolution template. Draft a standard council resolution or delegated authority form to approve reg 6 expense categories with required documentation and budget allocation references.

• Register compilation schedule. Set quarterly dates for the CEO to compile Register entries, specify responsible officers, and create a checklist of items to include in each quarter’s Register publication.

• Policy for apportionment. Adopt a distance-based apportionment technique for cross-boundary journeys (for example, total journey kilometres and kilometres within council area calculated by mapping software), document the calculation method, and record the calculation with each claim.

• Communication plan. Notify members and staff of the new rules and provide training on the definition of "prescribed meeting" and the distinction between s77(1)(a) reimbursements and s77(1)(b) items needing approval.

By aligning internal rules and operational processes to the Regulations’ text , adopting definitions from reg 3, payment rules from reg 4, reimbursable categories from regs 5 and 6, and Register timing from reg 7 , councils and members can create auditable, consistent practices that meet the instrument’s requirements from 1 September 2025.
