Local Government (Long Service Leave) Regulations 2021

The Regulations revolve around a few core statutory concepts: “member” (member of Council staff), “recognised service”, “ordinary pay”, the calculation units (months and fractions thereof), and the interaction between continuous and aggregated service periods (regulations 4, 10). Understanding these concepts is essential for correct application.

Recognised service is pivotal. Regulation 10 requires that a member’s period of recognised service be calculated in accordance with regulations 11-13. Regulation 11 prescribes inclusions: periods of long service leave, paid leave (personal, annual, parental, sick), specified unpaid sick leave limits, time on workers’ compensation, certain defence force service in a temporary capacity, service on temporary assignment with another Council or specified bodies, and periods where the Council acted to avoid leave obligations (regulation 11(1)(a)-(g)). Regulation 12 lists exclusions: general unpaid leave (except specified unpaid sick leave), service prior to retirement/termination where the member recommenced after more than 12 months, and service that preceded absences over 12 months (unless the absence was approved parental leave under the NES) (regulation 12(a)-(c)). Regulation 13 governs recognised service prior to current employment, including prior Council service post-1 March 1975, pre-1975 service if the person was employed on 1 March 1975, service with public service or special bodies to the extent previously counted by those employers, and service with other jurisdictions to the extent provided in agreements under regulation 20 (regulation 13(1)-(4)).

Accrual and quantum rules use fixed unit measures. The principal entitlements are expressed in months: an initial 3 months after an initial 10-year period, and accrual by “one‑tenth of 3 months” per additional completed year (regulation 5(1)). One‑tenth of 3 months equals 0.3 months per year; regulation 19(3) uses an equivalent monthly ratio (one‑fortieth of one month per completed month) to compute transfer payments. Regulation 5(2) provides early access mechanics: after 7 years a member may “access their long service leave entitlement” and accrues at the same one‑tenth of 3 months per year. Regulation 8 reduces the qualifying threshold to five years for payment on termination in specified circumstances and uses the same accrual metric.

Form of benefit: the Regulations allow leave to be taken (subject to mutual agreement, regulation 15), or in circumstances set out (termination, death), paid out as “pay instead of long service leave” at the ordinary pay rate (regulations 7-9). Regulation 16 permits an option to take twice the period of leave at half ordinary pay, if approved by the Council. Regulation 17 restricts other employment for members on long service leave unless Council approval is obtained.

Inter-organisational mechanics: regulation 18 requires Councils to provide information to other Councils on request for the purpose of these Regulations. Regulation 19 creates a statutory mechanism for transferring payments between Councils where the member transfers employment within 12 months. The timing obligations are precise: the new Council must inform the former Council within two months of commencement; the former Council must pay within two months of being informed; calculations are to be made on the basis of the member’s ordinary pay at cessation (regulation 19(2)-(4)). Regulation 19(5) contains refund mechanics where the receiving Council subsequently ceases to employ the member and certain conditions are met within 14 months.

Discretion and contractual overlay: regulation 20 permits Councils to contractually agree with authorities or persons responsible for offices to provide bespoke payment arrangements for transferring employees, and regulation 13(6) permits Councils, in particular cases, to include whole or parts of periods of service when approved. Regulation 22 preserves earlier entitlements under prior Acts to avoid reduction of benefits.

Finally, interpretative material in the Endnotes indicates the statutory rule is subject to interpretation norms in the Interpretation of Legislation Act 1984 (ILA) (for example headings and punctuation forming part of the rule) and that the Statutory Rule will sunset on 29 June 2031. Those interpretative matters affect how certain textual features are used in statutory interpretation, which can influence tight compliance and administrative reading of the Regulations.

The Regulations apply to “members” defined as members of Council staff (regulation 4). That means employees of Victorian Councils governed by the Local Government Act 2020 and their employers , the respective Councils , are the primary parties affected. The instrument also engages other bodies indirectly: public service bodies, special bodies, Authorities (as defined in other legislation), and bodies in other jurisdictions where agreements under regulation 20 are executed to recognise prior service (regulations 4, 13(3)-(4), 20).

Directly affected persons and entities:

• Employees (members) of Councils: they acquire statutory rights to long service leave on the terms set out (regulations 5-9). The Regulations affect calculation of entitlements, ability to take leave, rights on termination and death, and obligations while on leave (regulations 15-17). Specific groups within members are singled out: part‑time and casual members in post- and pre-1986 categories, with particular rules in regulation 21.
• Councils (as employers): Councils must compute entitlements, respond to written requests for pay instead of leave, transfer entitlements and payments where required, preserve earlier entitlements under prior Acts, provide information to other Councils on request, and exercise several administrative discretions (regulations 5-6, 7, 9, 13(6), 18-20, 22).
• Former Councils: when a member commences employment with another Council within 12 months of ceasing employment, the former Council has a payment obligation to the new Council, based on completed months of service and ordinary pay at cessation (regulation 19(1), (3)-(4)). Former Councils may also face refund obligations (regulation 19(5)).

Indirectly affected parties:

• Public service bodies and special bodies: members moving to these bodies trigger a payment obligation by the departing Council to the receiving public service or special body (regulation 7(5)(b)). Services performed earlier with those bodies may be counted as recognised service if the receiving body previously took such service into account (regulation 13(3)).
• Authorities and offices in other jurisdictions: a Council may include such prior service in recognised service subject to agreement under regulation 20; conversely, Councils may enter agreements for payments where staff move between jurisdictions (regulation 20).

Specific cohorts with unusual treatment:

• Members who worked part‑time or casually before 1 January 1986 and worked less than 24 hours per week are not entitled to pro rata accrual for that pre‑1986 work but the period must still be counted as recognised service for the purposes of later entitlements (regulation 21).
• Members whose employment is terminated for serious or wilful misconduct or poor performance but who have completed seven or more years are entitled to a statutory payout based on the accrual formula (regulation 8(5)-(6)), so that circumstance affects both members and Councils in disciplinary contexts.
• Legal personal representatives of deceased members are affected by the duty of Councils to pay out entitlements on death (regulation 9(2)).

Who decides:

• Councils decide on discretionary inclusions of service (regulation 13(6)), approval for double leave at half pay (regulation 16), approval for outside employment while on leave (regulation 17), and whether to defer leave or transfer entitlements when a member moves across employer types (regulation 7(4)-(5)). Councils also decide to enter agreements under regulation 20.

The Regulations therefore affect basic payroll obligations, HR decision-making, inter-Council administrative flows, and the legal rights of Council staff on termination or death. Compliance requires coordination between payroll, HR and legal/admissions functions within Councils, and between Councils and public bodies or Authorities where transfers occur.

The Regulations create a network of express duties on Councils and corresponding rights for members. Below are the principal duties and rights with their statutory citations and their operational consequences.

Entitlement rights for members:

• Right to leave and accrual: After an initial 10 years of recognised service, a member is entitled to 3 months long service leave at ordinary pay and to accrual thereafter at one‑tenth of 3 months per additional completed year (regulation 5(1)(a)-(b)). Separately, a member may “access” long service leave after an initial 7 years and accrues at one‑tenth of 3 months per year for that service (regulation 5(2)). This gives members a statutory right to either a lump quantum at 10 years or earlier pro rata access at 7 years.
• Access on termination: Members who voluntarily terminate after 7 or more years may request pay instead of leave and must be paid one‑tenth of 3 months ordinary pay for each completed year (regulation 7(1)-(3)). Members who cease employment in certain other circumstances (retirement because of age or ill‑health, termination except for serious/wilful misconduct or poor performance, voluntary termination due to impending parenthood or while on parental leave) with 5 or more years’ service have a right to pro rata long service leave at the one‑tenth of 3 months per year rate and may elect pay instead (regulation 8(1)-(4)). Members who die after 5 or more years are entitled to pay instead of leave (regulation 9(1)-(2)).
• Right to choose form and timing: Subject to mutual agreement with the Council, a member may take all or part of their leave at a mutually acceptable time (regulation 15). They may also, with Council approval, take leave at half pay for twice the period (regulation 16).

Duties on Councils:

• Non-duplication: Councils must not grant long service leave or pay for any recognised service period for which a member has already taken leave or been paid (regulation 6). This duty prevents double benefit.
• Procedural duties on voluntary termination: If a member requests pay instead of leave, the Council must make the payment at the statutory rate (regulation 7(2)-(3)). The Council must also, in defined scenarios, effect transfer of entitlements or payment to another Council or public service/special body if the member elects to defer (regulation 7(4)-(5)); the specific transfer calculation for Councils is governed by regulation 19.
• Payment on termination for various grounds: Where members cease in circumstances described in regulation 8, the Council must either allow election of pay or pay out entitlements if leave is untaken at cessation (regulation 8(2)-(4)). For cases of serious or wilful misconduct or poor performance, a Council must pay the pro rata amount where the member has 7 or more years (regulation 8(5)-(6)).
• Payment on death: Councils must pay any elected pay and pay instead of any leave to legal personal representatives where a member dies before taking or being fully paid for leave (regulation 9(2)).
• Calculation and transfer mechanics: Councils must compute recognised service per regulations 11-13 (regulation 10). Where a member transfers between Councils within 12 months, the former Council must pay the new Council one‑fortieth of one month’s pay for each completed month of the member’s service with the former Council and any other relevant bodies referenced in regulation 13(4); the payment is to be based on the ordinary pay at the time they ceased with the former Council (regulation 19(1)-(4)). The receiving Council must inform the former Council within two months of commencement (regulation 19(2)); the former Council must pay within two months of being informed (regulation 19(3)). The former Council must refund under detailed conditions if the receiving Council no longer employs the member and other conditions are met within 14 months (regulation 19(5)).
• Information sharing obligation: A Council must provide information in its possession at the request of another Council that may be required for the purposes of these Regulations (regulation 18).
• Agreement-making: Councils may enter agreements under regulation 20 to provide for bespoke transfer payment arrangements with authorities and offices referenced in regulation 13(4).

Discretions and conditional duties:

• Inclusion of prior service in special cases: Councils may, “to the extent determined by the Council in each particular case”, include whole or part periods of service when the member was absent with prior or subsequent approval (regulation 13(6)). The Council thus has a discretion to be exercised on a case-by-case basis.
• Agreements for cross-jurisdictional service: Councils decide whether to enter into the regulation 20 agreements and their content; these agreements determine whether service in other jurisdictions is recognised and whether payments accompany transfers.

Other rights/duties:

• Public holiday treatment: If a public holiday occurs during long service leave, it is not counted as part of the leave and the Council must grant a day off instead, to be taken by agreement at the conclusion or at a mutually convenient time (regulation 14).
• Restrictions on other employment: Councils must police the restriction that a member on long service leave must not take employment for hire or reward unless prior approval is given (regulation 17).

Finally, regulation 22 protects earlier accrued rights and benefits so that no provision of these Regulations may reduce or adversely affect a person’s position under the Local Government Act 1958 or the Local Government Act 1989 as those Acts existed at specified historical points. Councils therefore must determine a person’s position under the earlier statutory regimes where applicable (regulation 22(1)-(3)).

Together these duties and rights define both payroll and administrative obligations for Councils and concrete entitlements and choices available to members.

The Regulations themselves do not prescribe specific criminal penalties or infringement fines for non-compliance with their substantive requirements. The text contains mandatory duties and timeframes (for example, notification and payment time limits in regulation 19). Enforcement of those mandatory duties will depend on the broader legal context: statutory rights under these Regulations can be vindicated by members through civil remedies, industrial instruments or dispute resolution procedures applicable to employment law, and Councils may face liabilities for failing to observe payment and transfer obligations. The Regulations do not create a specific enforcement agency or dedicated penalty scheme within their text.

Operationally, enforcement mechanisms and consequences likely to be relevant include:

• Civil claims for unpaid wages or entitlements: The Regulations create a statutory entitlement to pay instead of long service leave in many circumstances (regulations 7-9). Failure to make such payments when due will put a Council at risk of a claim in court or relevant tribunal for unpaid wages or contractual remedies. The Regulations do not specify a particular forum; normal jurisdictional routes for employment, contractual or statutory recovery would be engaged.
• Industrial or administrative processes: For Councils as employers, breaches of statutory entitlement obligations may intersect with enterprise agreements, awards or bargaining instruments. While the Regulations are a statutory minimum framework, employers and employees may have alternative dispute resolution processes under industrial instruments or agency oversight (though none are specified in the Regulations).
• Contractual enforcement of transfer agreements: Regulation 20 permits Councils to enter agreements with other authorities in respect of transfer payments. Breach of those agreements would give rise to ordinary contractual remedies.
• Internal remedies and reputational costs: Councils failing to provide timely information under regulation 18, or to meet regulation 19 notification and payment windows, may encounter complaints and administrative disputes from other Councils or employees that could require mediation or litigation.

Timing and administrative obligations that have consequence:

• Notification and payment windows in regulation 19: the receiving Council must inform the former Council of employment within two months. The former Council must pay within two months of being informed. These are mandatory timeframes that, if not met, will typically generate an enforceable obligation to pay with potential accrual of interest or other remedies under general law, though the Regulations themselves do not set an interest rate or express late penalty.
• Refund obligation in regulation 19(5) contains precise conditions that, if met, require the receiving Council to refund an amount received. Incorrect application of the refund provision may generate a restitutionary or debt claim.

Interpretative and saving provisions:

• Regulation 22 preserves prior entitlements under earlier local government Acts. If a Council attempts to apply these Regulations so as to reduce a person’s position relative to earlier Acts, that application is void to the extent of the reduction; enforcement in such cases would involve asserting rights under the earlier Act as preserved by regulation 22.

In short, enforcement under the Regulations depends on the ordinary civil, contractual and employment law mechanisms rather than on fines created by the instrument. Councils should therefore treat the Regulations as creating legally enforceable payroll liabilities and administrative obligations with typical legal remedies for breach (recovery of unpaid sums, contractual remedies, potential orders for specific performance or restitution), while noting that no bespoke penalty schedule is provided in the Regulations themselves.

The Regulations are explicitly made under section 325 of the Local Government Act 2020 (regulation 2). They operate alongside and interact with several other statutory instruments and legal regimes, as the text itself recognises and preserves. These interactions affect qualification, calculation, recognition of prior service, dispute resolution and preservation of historical entitlements.

Key statutory relationships and interactions:

• Local Government Act 2020: The Regulations are subordinate legislation made under the Local Government Act 2020. The Act provides the parent legislative authority under which these detailed long service leave rules are established (regulation 2). The Regulations implement and operationalise long service leave rights for Council staff within the regulatory scheme authorised by that Act.

• Earlier Local Government Acts: Regulation 22 preserves entitlements under the Local Government Act 1958 and the Local Government Act 1989 where these Regulations would otherwise have the effect of reducing someone’s position or level of benefits that applied under those earlier Acts. Regulation 22 requires applying the previous Acts as if they were still in force for the affected person(s) or class(es). Practically, this means Councils must be able to identify employees with entitlements rooted in earlier legislation and apply those older entitlements where they are more favourable, adding an overlay of historical statutory complexity.

• Fair Work Act 2009 (Commonwealth): Regulation 12(c) expressly references the National Employment Standards under section 76 of the Fair Work Act 2009 when discussing parental leave exceptions to the 12‑month exclusion rule for service interrupted by leave. The Regulations therefore interact with the NES in that approved parental leave under the NES will preserve continuity for long service leave calculation where otherwise an absence exceeding 12 months would break continuity (regulation 12(c) and cross-reference in regulation 13(5)). Employers must therefore coordinate long service calculations with federal parental leave entitlements under the Fair Work Act.

• Public Administration Act 2004 and special body definitions: The Regulations adopt definitions from the Public Administration Act 2004 (regulation 4). Also, regulation 13(3) treats prior service with a public service body or special body as recognised service where that prior body would have taken it into account previously. This creates a reciprocal recognition with the public sector statutory employment regime, subject to prior employer practice and agreement.

• Workers’ compensation legislation: Regulation 11(1)(f) includes periods of injury for which weekly payments or compensation are payable under the Accident Compensation Act 1985 or the Workplace Injury Rehabilitation and Compensation Act 2013 as part of recognised service. Councils therefore must treat certain workers’ compensation absences as continuous service for accrual purposes, aligning long service leave calculation with the operation of compensation legislation.

• Defence forces service: Regulation 11(1)(d) includes temporary service in the defence forces of the Commonwealth as recognised service, except where service is as a permanent defence forces member while also employed by the Council. That aligns the Regulations with Commonwealth defence service rules.

• Statutory interpretation: The Endnotes reference the Interpretation of Legislation Act 1984 (ILA) and the style rules that affect headings, punctuation and other features that form part of the Statutory Rule (Endnotes 1). That influences how particular phrases and structures in the Regulations are to be read and may affect disputes over interpretation or scope.

• Agreements and contractual frameworks: Regulation 20 allows Councils to enter agreements with authorities or persons responsible for an office to provide for payment arrangements when staff transfer. Such agreements will interact with contract law, and may also interact with industrial instruments (enterprise agreements, awards) if those instruments cover particular employees, although the Regulations themselves take primacy for the matters within their scope unless the earlier Acts preserved by regulation 22 yield a superior entitlement.

Practical cross‑jurisdictional effects:

• Transfers between Councils and other Commonwealth or interstate local government bodies may be governed by bespoke agreements under regulation 20; otherwise regulation 19 creates a statutory transfer payment regime where a member commences with another Victorian Council within 12 months. For service with bodies outside Victoria, the inclusion of service depends on agreement under regulation 20 (regulation 13(4) and regulation 20).

Overall, the Regulations must be applied with an eye to federal entitlements (Fair Work parental leave), workers’ compensation regimes, historical local government Acts, and any applicable enterprise agreements or contractual terms. Councils therefore need to coordinate long service leave administration across multiple statutory regimes and record-keeping systems to ensure consistent application.

The Regulations, as published, show no amendments at the date of the version provided. The published Version No. 001 is “as at 1 July 2021” and the Endnotes explicitly state there are no amendments made to the Local Government (Long Service Leave) Regulations 2021 by statutory rules, subordinate instruments or Acts (Endnotes, Table of Amendments). The Endnotes also state that this version does not contain amendments that are not yet in operation.

Key publication and lifecycle points recorded in the instrument:

• Date made and commencement: The Regulations were made on 29 June 2021 by the Governor in Council under section 325 of the Local Government Act 2020 and came into operation on 1 July 2021 (Endnotes: general information and regulation 3).
• Sunset provision: The Endnotes state that the Statutory Rule will sunset 10 years after the day of making , 29 June 2031 , pursuant to section 5 of the Subordinate Legislation Act 1994. That sunset date is a statutory termination unless the instrument is remade or extended per the Subordinate Legislation Act’s processes (Endnotes: general information).

No legislative or subordinate law amendments or historical varied versions are recorded in the printed Table of Amendments for this Version No. 001. The Endnotes confirm there are no entries in the Explanatory details at the date of publication and that the instrument as provided contains no later-in-operation amendments to include.

Consequences of the current amendment status:

• As of the Version No. 001, any subsequent policy or drafting changes affecting long service leave for Council staff would require a formal amendment to the Statutory Rule or replacement instrument. Until such a change occurs, the Regulations as printed are the operative law.
• Because the instrument contains saving provisions for earlier Acts (regulation 22), any historical entitlements established under the 1958 or 1989 Acts remain operative as preserved, regardless of whether the Regulations themselves change; amendments to the Regulations cannot reduce those preserved entitlements for affected persons (regulation 22(1)-(3)).

For practitioners advising clients or Councils: at the date of this version there is a single consolidating instrument to apply, and any research into amendments or variations should look for later statutory rules, orders or repeal/replacement activity up to the present to check whether the 2031 sunset has been altered or whether interim amendments have been made after the version date.

The text of the Regulations, the Table of Amendments and the Endnotes provided contain no statement of case law or judicial decisions interpreting these Regulations. There are no cases named in the instrument, and the Endnotes do not list any litigation history. As a consequence:

• There is no recorded appellate or lower‑court authority cited in the instrument that construes the Regulations.
• No reported litigation history is embedded in the text to clarify ambiguous terms, interpret “recognised service”, or resolve disputes over the application of transfer formulas, time limits or the interplay with earlier local government Acts.

Practically, that means the Regulations are likely to present open questions that will need judicial or tribunal interpretation if contested. Areas likely to generate litigation or formal disputes (based on how the provisions are framed) include:

• Calculation disputes: disagreements about the correct computation of “ordinary pay” for the purposes of regulation 19(4) and the pay-in-lieu calculations required by regulations 7-9. The Regulations tie the transfer payment to the member’s ordinary pay at the time of cessation (regulation 19(4)), but ordinary pay can be litigated where bonuses, allowances, or variable pay components are involved.
• Recognition of prior service and exclusions: disputes over whether particular absences are counted as recognised service (regulation 11 and regulation 12), especially where an absence involves contested characterization (for example, whether an unpaid absence qualifies as parental leave under the NES).
• Application of the 12-month rule: cases where a member ceases employment and recommences more than 12 months later and whether any exceptions or special inclusions apply under regulation 13(5) and regulation 12(b).
• Council discretion and approvals: litigation could arise over a Council’s exercise (or refusal) of discretion to include particular periods of service under regulation 13(6), to approve double leave at half pay (regulation 16), or to approve outside employment (regulation 17).
• Refund and timing disputes: disputes about whether the receiving Council satisfied the conditions in regulation 19(5) that would require it to refund a payment, or failure by either Council to comply with the strict timeframes in regulation 19(2)-(3).

Because the Regulations are recent (version as at 1 July 2021) and there is no recorded litigation history in the instrument, practitioners should expect that unsettled points may require case law development or reliance on general principles of employment and administrative law to resolve. For now, absent case law, the text of the Regulations and cross‑referenced federal and state statutes will frame legal arguments.

The Regulations include detailed language that can generate practical traps for both Councils and members if overlooked. The following are concrete operational “gotchas” grounded in the statutory text.

1. Multiple qualifying thresholds and how they interact (regulation 5):

• The Regulations provide different access points: 10 years yields a 3‑month base entitlement plus additional accrual; 7 years allows access and accrual at one‑tenth of 3 months per year; and certain terminations at 5 years attract pro rata pay. Failure to correctly identify which threshold applies to a member’s specific situation will lead to underpayment or misapplication. These are not merely optional alternatives; the Regulations set parallel rules that depend on the factual setting (regulation 5(1)-(2); regulation 8(1)).

2. Calculation units and equivalence (regulations 5, 19):

• The accrual metric is expressed in odd units: “one‑tenth of 3 months” per year (regulation 5), which equals 0.3 months per year. Regulation 19 uses “one‑fortieth of one month’s pay for each completed month” , a monthly equivalent calculation consistent with the annual formula (regulation 19(3)). Mistakes in unit conversion can produce systematic payroll errors.

3. Ordinary pay basis for transfer payments (regulation 19(4)):

• The transfer payment by a former Council is to be calculated on the member’s ordinary pay at the time they ceased employment with the former Council. Determining “ordinary pay” can be contentious where variable allowances, overtime, or non-guaranteed bonuses exist. Councils should have a consistent, documented definition for payroll calculation.

4. Time-limited transfer regime and refund triggers (regulation 19(1)-(5)):

• The receiving Council must inform the former Council within two months of commencement (regulation 19(2)); the former Council then has two months to pay (regulation 19(3)). If the receiving Council ceases to employ the member and certain conditions exist within 14 months, it must refund the payment (regulation 19(5)). Missing these windows or failing to comply with refund conditions invites disputes and necessitates careful record-keeping.

5. Pre‑1986 part‑time/casual work exception (regulation 21):

• Work performed before 1 January 1986 for less than 24 hours per week does not attract pro rata accrual but must still be included as recognised service. Practically, an employer must still count those periods for qualifying thresholds, but not for pro rata calculation , a trap for payroll systems that assume pro rata accrual merely because service is recognised.

6. Unpaid leave exclusions and the parental leave carve-out (regulations 11 and 12):

• General unpaid leave is excluded from recognised service except for some unpaid sick leave limited by time (regulation 11(1)(e)) and parental leave approved under the NES (regulation 12(c)). Mischaracterising unpaid leave (e.g. unpaid career break, leave without pay) risks breaking the continuity of recognised service for long service leave calculation. Counsel will need to cross-check with Fair Work NES approvals.

7. Council discretion and lack of standard criteria (regulation 13(6) and regulation 20):

• The Regulations give Councils the discretion to include certain periods of service to “the extent determined by the Council in each particular case” and to enter agreements concerning transfers. The absence of prescribed criteria may lead to inconsistent treatment between Councils and potential claims of unfairness where similar employees are treated differently. Councils should document reasons when exercising these discretions.

8. Restriction on other employment during leave (regulation 17):

• Members on long service leave must not engage in employment for hire or reward unless approved. Enforcement of that restriction is practically difficult, and failing to obtain prior approval could expose employees to disciplinary action and create tense payroll litigation regarding whether benefits should be rescinded or payments reclaimed.

9. Saving provisions that preserve older entitlements (regulation 22):

• Regulation 22 prevents any reduction in position or level of benefit compared with the Local Government Act 1958 and the Local Government Act 1989 as those Acts existed at particular points. Identifying employees whose entitlements are governed by those earlier Acts requires historical record searches, and failure to apply the saving provisions may produce liability.

10. No express penalty provisions (Penalties and enforcement section):

• There are mandatory duties with strict timeframes (for example, regulation 19) but no express statutory fines or penalties. Remedies will be civil or contractual. Councils may therefore under-appreciate exposure if they expect a statutory penalty regime to apply.

11. Public holiday replacement mechanics (regulation 14):

• If a public holiday falls during leave, the Regulations mandate that the public holiday is not to be regarded as part of long service leave and that the Council must grant a day off instead, to be taken by agreement (regulation 14). Payroll systems must ensure proper recording and the delivery of the substitute day off.

12. Interaction with workers’ compensation and defence service rules (regulation 11):

• Periods with compensation payments or temporary defence service are included as recognised service; again, Councils must have processes to capture these periods accurately.

Each of these points is rooted in the text of the Regulations and represents an operational hazard. Councils and advisers should adopt checklists and written processes to avoid these common missteps, ensure consistent exercise of discretion, and reduce the risk of pay disputes.

For Councils (employers), a compliance checklist flowing directly from the Regulations is essential. The following practical steps map to the relevant regulatory provisions.

1. Record-keeping and data systems

• Maintain a central register of each member’s recognised service with date‑stamped records of commencement, termination, absences (paid and unpaid), periods on workers’ compensation, periods of temporary assignment to another Council, defence service, parental leave details (including NES approval), and any periods pre‑1 March 1975 where relevant (regulations 10-13, 11(1)(d)-(g), 12(c), 13(1)-(6)).
• Record the ordinary pay at cessation date for each employee, and maintain documentation of how “ordinary pay” is computed, specifically noting whether allowances, penalties and bonuses are included for the purposes of regulation 19(4).

2. Accrual and calculation processes

• Implement payroll processes to calculate accrual at the precise statutory rates: 3 months after 10 years plus one‑tenth of 3 months per additional completed year (regulation 5(1)); pro rata accrual at one‑tenth of 3 months per year from 7 years if accessed earlier (regulation 5(2)); and pro rata accrual for certain termination scenarios from 5 years (regulation 8(1)).
• Translate annual accrual into monthly calculation where transfers arise: one‑fortieth of one month’s pay per completed month (regulation 19(3)), and ensure unit conversion is consistent across systems.

3. Policies and written procedures

• Develop written policies on:
  • Requests for pay instead of leave, and the required written request procedure (regulation 7(2)).
  • Deferral elections when a member is moving to another Council or to a public service body, specifying the mechanics for transfer payments and for the Council to pay to the public service/special body where required (regulation 7(4)-(5)).
  • Exercise of discretion under regulation 13(6): adopt clear criteria for including whole or parts of absences in recognised service and require a documented decision for each case.
  • Approval processes for double leave at half pay (regulation 16) and for outside employment while on leave (regulation 17).
  • Handling and documentation of public holiday substitution during leave (regulation 14).

4. Transfer and notification workflows

• For incoming employees who commenced within 12 months of ceasing prior Council employment: ensure the receiving Council informs the former Council within two months of the commencement date (regulation 19(2)). Build this notification into onboarding checklists.
• Require proof of prior Council service and ordinary pay at cessation for accurate calculation by the former Council.
• Track payment by the former Council and reconcile within two months of being informed (regulation 19(3)). If a receiving Council later ceases to employ the person, track the 14‑month refund window and conditions under regulation 19(5).

5. Agreements with other bodies

• Where cross-jurisdictional service is relevant or where bespoke arrangements would be beneficial, negotiate and document regulation 20 agreements with authorities, persons responsible for offices or Authorities to provide explicit treatment of service recognition and payment transfers (regulation 20).

6. Training and inter-departmental coordination

• Provide training for HR, payroll and finance on the precise calculation rules, inclusive/exclusive categories of recognised service and the timelines for notifications and payments.
• Coordinate between HR, payroll and legal teams when a member’s termination, death, or movement between employers occurs to ensure consistent application of regulations 7-9, 19 and 9(2).

7. Communication to employees

• Issue clear employee notices describing accrual rates, access points (7, 10 and 5 years options), the process to request pay instead of leave, the implications of moving to another Council or public service body, and conditions for approval of outside employment during leave (regulations 5, 7, 16-17, 19).

8. Special situations and review processes

• For pre-1986 part‑time/casual employees: record hours worked and apply regulation 21’s special rule that less than 24 hours per week before 1 January 1986 does not accrue pro rata but is to be counted as recognised service (regulation 21).
• Establish an internal review process for contested determinations about recognised service inclusions or exclusions (regulations 11-13). Given the Regulations give Councils discretionary power in some cases (regulation 13(6)), ensure reasoned written decisions are recorded to support defensible administrative action.

9. Legal compliance and audit

• Periodically audit payroll calculations and notifications for compliance with regulation 19 timelines and refund mechanics, and ensure that any enterprise agreements or awards do not provide a more favourable entitlement that must be honoured.
• Verify that Regulation 22 saving provisions are applied where earlier Acts may apply. Maintain archival records to determine whether an employee’s entitlements stem from earlier Local Government Acts.

10. Handling deaths and serious terminations

• For deaths, ensure legal personal representatives are identified and that pay instead of leave is provided promptly (regulation 9(2)). For terminations due to serious misconduct or poor performance involving employees with seven or more years, prepare to calculate and pay the statutory pro rata amount (regulation 8(5)-(6)).

By following these specific steps, Councils can reduce the principal compliance risks identified in the Regulations , miscalculation of amounts, missed notification or payment deadlines, inconsistent discretion exercise, and failures to apply the saving provisions for earlier Acts. Members (employees) should be advised to keep records of prior employment dates and pay rates, provide written requests where required, and obtain written Council approvals for any deferred elections or outside employment while on leave.
