### 33 Lighting of private ways and courts
> > (1) A corporation may, by written notice served on the owner of a private way or court to which the public ordinarily has access, require him to light it in accordance with the directions contained in the notice.

> > (2) Nothing may be required under this section better than exists in the highway giving access to the private way or court to which the requirement relates.

> > (3) *\[Section 33 Subsection (3) amended by No. 43 of 1991, s. 5 and Sched. 1 \]*A person on whom a notice is served under this section who fails to ensure that the requirements of the notice are complied with during all times in the night at which the way or court is left open to the public is guilty of an offence and is liable on summary conviction to a fine not exceeding 5 penalty units and, in the case of a continuing offence, to a daily fine not exceeding 0·5 penalty unit for each day during which the offence continues.
