### 118 Occupier preventing owner from complying with Act
> > (1) If the occupier of any land prevents the owner of it from complying with a requirement imposed by or under this Act, a justice to whom application is made for that purpose shall, by written order, require that occupier to permit the carrying out of such works as the justice is satisfied should be carried out in order to comply with the requirement.

> > (2) If, after the expiration of 48 hours from the service on him of an order under [subsection (1)](#GS118@Gs1@EN) , an occupier fails to comply with its requirements, he is guilty of an offence and is liable on summary conviction to a daily fine not exceeding 2 penalty units.

> > (3) Where an owner is prevented from complying with a requirement referred to in [subsection (1)](#GS118@Gs1@EN) , he is not subject to a penalty for failing to comply.
