Local Government Grants Act 1978

Several core concepts structure the Act and frame how allocations move from Commonwealth to local government.

Commission. The Commission is the legal entity created by s 4. Its operational duties are set largely in Part III: it must recommend allocations for each financial year (s 10), receive submissions (s 13), investigate and take evidence (s 12), and prepare an annual report (s 16C). The Commission determines its own procedure to the extent not prescribed (s 8(7)) and may hold hearings ordinarily in public (s 12(3)). Acts of the Commission are validated despite vacancies or appointment defects (s 17).

Commonwealth funds and Commonwealth Act. The statute uses defined terms. "Commonwealth funds" means funds made available to the State by the Commonwealth under the Commonwealth Local Government (Financial Assistance) Act 1986 (s 3). The Commission’s recommendations must accord with the Commonwealth Act and any allocation principles approved under it (s 11). The Minister must advise the Commission of the amount of Commonwealth funds as soon as the State is advised by the Commonwealth (s 9). The State must report to the Commonwealth Treasurer after the financial year with an Auditor‑General’s certificate (s 16A).

Allocation process. The Commission produces recommendations for how the Commonwealth funds should be allocated among local governments (s 10). The Minister may approve those recommendations or refer them back with reasons, and if referred back the Commission must reconsider and resubmit, after which the Minister shall approve (s 14). Before public release, the Minister must inform the Commonwealth Minister of the allocations (s 15(1)), and then cause each local government to be informed of its allocation (s 15(2)).

Distribution and timing. When Commonwealth funds are paid to the State, the State must, without undue delay, make unconditional payments to local governments in accordance with the approved allocation (s 16). The Act does not define timelines or establish a sanction for delay, but links the pass‑through obligation directly to receipt of Commonwealth funds.

Information and hearings. The Commission may require a local government to supply such financial and other information as it specifies and the local government must comply (s 12(4)). The Commission may inspect, conduct hearings and take evidence as it thinks necessary (s 12(1)). Hearings are ordinarily public (s 12(3)). The Commission must give local governments and WALGA an opportunity to make written submissions (s 13).

Accountability and oversight. The Minister has an approval role and may request reports from the Commission on any matter related to local government finance (s 16B). The Commission must provide an annual report to the Minister by 1 September each year covering the preceding 12 months, and the Minister must lay that report before both Houses of Parliament (s 16C). The Commonwealth Treasurer receives a statement of payments plus an Auditor‑General’s certificate after year‑end (s 16A).

Membership and appointment sources. Membership composition is prescribed: a Chairman nominated by the Minister, a Deputy Chairman who is an officer of the Department nominated by the Department chief executive officer and approved by the Minister, and three members nominated via WALGA panels representing metropolitan, shire non‑metropolitan, and city/town non‑metropolitan local government districts (s 5). The panels must contain at least three names each and the Minister may appoint other eligible persons if no panel is submitted (s 5(2), (2a)). Terms are for up to five years, and members are eligible for reappointment (s 6(1)).

Statutory protections and administrative details. Members have immunity for acts or omissions in good faith while exercising their functions (s 18). The Governor may make regulations (s 19). The Minister must review the Act every five years, starting after 1 January 1991, considering the Commission’s effectiveness and the need for its functions (s 20).

Interpreting definitions. Several defined terms cross‑refer to other statutes: "Department" is defined by s 1.4 of the Local Government Act 1995 (s 3); metropolitan/shires/city/town meanings are those in the Local Government Act 1995 (s 5(1a)); bankruptcy/disqualification references rely on the Interpretation Act 1984 (s 6(2)(d)).

Together, these concepts construct a procedural, state‑level mechanism to allocate Commonwealth funds consistently with the Commonwealth framework, with defined reporting channels, investigatory powers and Ministerial oversight, and with input channels for the local government sector via WALGA.

Primary recipients and principal actors under the Act are clearly specified.

Local governments in Western Australia. The statutory focus is the allocation of Commonwealth funds among local governments (s 10). Local governments are obliged to supply financial and other information to the Commission when required (s 12(4)). They are entitled to be informed by the Minister of allocations (s 15(2)) and to receive unconditional payments from the State when Commonwealth funds are paid (s 16). The Act therefore directly affects local government finance, budgeting and reporting practices.

The Western Australian Local Government Grants Commission. The Commission is the statutory body tasked with recommending allocations, conducting investigations, holding hearings, receiving submissions and preparing annual reports (s 4; s 10; s 12; s 13; s 16C). The membership composition and operational rules affect who exercises those functions (s 5; s 6; s 8).

Western Australian State Minister and Executive. The Minister has several formal roles: nominating the Chairman, approving the Department nominee for Deputy Chair (s 5(1)(a)‑(b)), advising the Commission of the Commonwealth funds amount once the State is advised (s 9), receiving and approving or referring back the Commission’s recommendations with reasons (s 14), informing the Commonwealth Minister before allocations are publicised (s 15(1)), providing the Commonwealth Treasurer with year‑end statements and Auditor‑General certificates (s 16A), laying the Commission’s annual report before Parliament (s 16C), and requesting reports from the Commission on related matters (s 16B). The Minister controls key decision points in the allocation pipeline and certain appointment inputs.

Commonwealth government. The Act is explicitly a conduit for Commonwealth funds distributed under the Commonwealth Local Government (Financial Assistance) Act 1986. The Commonwealth determines the quantum that flows to the State; the State is required to advise the Commission when so advised by the Commonwealth (s 9). The Minister must inform the Commonwealth Minister of allocation particulars before public release (s 15(1)). The Commonwealth Treasurer receives a certified statement of payments (s 16A). Thus Commonwealth audiences have reporting, timing and certification interests.

Western Australian Audit and Departments. The Auditor‑General must certify the statement of payments to the Commonwealth Treasurer (s 16A(b)). The Department is referenced as the Department for local government functions as defined in the Local Government Act 1995; the Department chief executive nominates the Deputy Chair candidate (s 3; s 5(1)(b)). Public sector employees who are members are subject to remuneration approval from the Public Sector Commissioner under s 7(2).

Western Australian Local Government Association (WALGA). WALGA is given a specific role as a nominating channel, being required to submit panels of at least three candidates for three member slots representing metropolitan, shire non‑metropolitan and city/town non‑metropolitan districts (s 5(1)(c); s 5(2)). The Commission must offer WALGA the opportunity to make written submissions on allocations (s 13).

Ratepayers, auditors and public. While not named as a statutory actor, ratepayers are indirect stakeholders because allocations affect local government budgets and service capacity. The Act's transparency measures , public hearings ordinarily, annual report laid before Parliament, Commonwealth reporting , create information flows that affect auditors, journalists and researchers.

Persons appointed as members and deputies. Persons appointed as members, including deputies appointed under s 5(3), are subject to the terms, vacating events and immunities set out in s 6, s 7 and s 18. Deputies may act in members’ stead for meetings and during vacancies, with some limitations for the Deputy Chairman’s deputy (s 5(3)‑(7)).

Entities not explicitly empowered. The Act does not create enforcement bodies to compel local councils to comply with Commission requests beyond the statutory requirement to do so (s 12(4)), nor does it create new criminal offences. Any enforcement therefore must rely on administrative levers, Ministerial oversight and the political consequences of public reporting.

In sum, the Act directly affects the State executive (Minister), the Commission and its members, the Department for local government, WALGA as a nominating and consultative channel, local governments as recipients and data providers, and the Commonwealth in its reporting and auditing functions. The effect on private actors is mediated through changes to local government revenue outcomes that are determined by the allocation and distribution process established by the Act.

The Act establishes a set of statutory duties and rights for the Commission, the Minister, local governments and other actors. Below is a structured account of the operative obligations and entitlements.

Duties of the Commission

• Make recommendations to the Minister as soon as practicable for each financial year on the amount of Commonwealth funds that should be allocated to each local government (s 10).
• Make recommendations in accordance with the Commonwealth Local Government (Financial Assistance) Act 1986 and any approved principles of allocation under that Commonwealth Act (s 11).
• Carry out inspections, hearings, take evidence and make such investigations as necessary to fulfil its functions (s 12(1)). Hearings are ordinarily public (s 12(3)).
• Require local governments to supply specified financial and other information, and expect compliance (s 12(4)).
• Give local governments, WALGA and other persons the opportunity to make written submissions for an allocation year (s 13).
• Prepare and furnish to the Minister, as soon as practicable after 1 September each year, a report on recommendations, methods and activities during the preceding 12 months (s 16C(1)).

Rights and protections of Commission members

• Members have immunity from liability for acts or omissions done in good faith in the exercise or purported exercise of their powers or functions under the Act (s 18).
• Acts, proceedings or determinations of the Commission are not invalid solely because of a vacancy or defect in appointment (s 17).
• Members are to have regard to the general interests of local government in the State when exercising powers (s 6(4)).

Minister’s powers and duties

• Advise the Commission of the amount of Commonwealth funds as soon as the State is advised by the Commonwealth (s 9).
• On receipt of the Commission’s recommendations, either approve them or refer them back to the Commission with reasons and a request for review (s 14(1)).
• If recommendations are referred back, the Minister must provide reasons in writing, and after reconsideration the Minister shall approve the resubmitted recommendations (s 14(2)(a)‑(c)).
• Before allocations are made public, inform the Commonwealth Minister of the particulars (s 15(1)).
• Cause each local government to be informed of the allocation amount for the financial year (s 15(2)).
• Furnish to the Commonwealth Treasurer, after the end of the financial year, a statement of payments in a Treasurer‑approved form, plus an Auditor‑General’s certificate attesting to its correctness (s 16A).
• Lay the Commission’s annual report before each House of Parliament after receiving it (s 16C(2)).
• Request reports from the Commission on local government finance as needed; the Commission must comply as soon as practicable (s 16B).

Duties of local governments

• Provide written submissions if they wish, as the Commission must give them the opportunity to do so (s 13).
• Comply with the Commission’s specified requirements to supply financial and other information as to their affairs (s 12(4)).
• Receive notification of allocated amounts from the Minister and accept unconditional payments when made (s 15(2); s 16).

Financial and reporting duties

• The State must, upon receipt of Commonwealth funds, make unconditional payments to local governments in accordance with the approved allocation without undue delay (s 16). The allocation is as approved under the Act (s 16).
• The Minister must provide a statement of payments to the Commonwealth Treasurer with an Auditor‑General’s certificate as soon as practicable after the end of the financial year (s 16A).

Appointment and administrative duties

• The Governor appoints members, including a Chair nominated by the Minister and a Deputy Chair who is an officer of the Department nominated by the Department chief executive officer and approved by the Minister (s 5(1)(a)‑(b)).
• WALGA must, when requested by the Minister, submit written panels of at least three persons for each of the three categories described; if WALGA fails to submit a panel the Minister may nominate an eligible person (s 5(2)‑(2a)).
• Members’ terms are up to five years and they must resign or be removed under the events listed in s 6(2). Remuneration and allowances are approved by the Minister, but if a member is subject to Part 3 of the Public Sector Management Act, prior written approval of the Public Sector Commissioner is required for payments (s 7).

Rights of local governments and WALGA

• The right to make written submissions to the Commission on allocation matters (s 13).
• The entitlement to be informed by the Minister of the allocation particulars (s 15(2)).
• The right to receive unconditional Commonwealth funds from the State when paid to the State, according to the approved allocation (s 16).

Procedural rights

• Quorum and voting rules: meetings require the Chair or Deputy Chair plus two other members for a quorum; questions are decided by majority vote and the presiding member has a deliberative vote only (s 8(2), (5)‑(6)). The Commission sets its own procedures to the extent not prescribed (s 8(7)).

Notably absent duties and rights

• The Act does not create express statutory penalties or sanctions for local governments that refuse to supply information or for delays in distribution beyond the "without undue delay" instruction in s 16. It also does not stipulate timelines for the Commission’s recommendations beyond "as soon as practicable" in s 10. These absences are material for understanding enforcement scope and timing uncertainty.

Overall, the Act imposes procedural and information obligations on local governments in return for being recipients of Commonwealth funds, gives the Commission investigatory and consultative duties, concentrates approval authority in the Minister while embedding Commonwealth reporting and Auditor‑General certification requirements, and provides statutory immunities to Commission actors carrying out their functions in good faith.

The Act contains relatively few express punitive mechanisms. Its enforcement architecture is administrative rather than penal. The text provides enforcement levers, oversight obligations and immunities, but does not create new criminal offences or prescribe monetary penalties for non‑compliance. Key enforcement and remedial points in the Act are as follows.

Limited direct enforcement powers

• The Commission may "require" a local government to supply such financial and other information as the Commission specifies, and the local government "shall comply" with that requirement (s 12(4)). The statute imposes an obligation, but it does not include a penalty provision or a statutory power to compel compliance through fines, injunctions or prosecution. The Act does not specify enforcement procedures or administrative sanctions for refusal to supply information.

Administrative oversight by the Minister

• The Minister acts as the approving authority for the Commission’s recommendations (s 14(1)). The Minister may refer recommendations back with reasons, compelling the Commission to reconsider and resubmit (s 14(2)(a)‑(c)). This mechanism functions as an administrative control and quality assurance step rather than a punitive sanction. The Minister's power to require reconsideration is a substantive check, because the Minister must provide reasons and the Commission must respond. There is no statutory right of appeal or judicial review clause in the Act itself; standard judicial review principles under general administrative law would still apply, but those are external to the Act.

Timing and pass‑through obligation

• Section 16 requires the State to make unconditional payments to local governments in accordance with the approved allocation "without undue delay" when Commonwealth funds are paid to the State. The phrase "without undue delay" imposes a timing obligation, but the Act does not define it or set a sanction for breach. The remedy for a local government affected by delay would therefore lie outside the statute, such as seeking judicial review or equitable relief, or relying on political and reputational pressure.

Reporting, audit and transparency as enforcement substitutes

• The Act builds reporting and audit obligations that serve as oversight tools. The Minister must furnish to the Commonwealth Treasurer a statement of payments in a Treasurer‑approved form and procure an Auditor‑General’s certificate that the statement is correct (s 16A). The Commission must prepare an annual report by 1 September on its recommendations, methods and activities for the preceding 12 months, which the Minister must lay before each House of Parliament (s 16C). These mechanisms create accountability through auditing and parliamentary scrutiny rather than through statutory penalties.

Immunity and protection for Commission actors

• Members, and deputies, are protected from liability for acts or omissions done in good faith in the exercise or purported exercise of powers under the Act (s 18). This immunity reduces the personal legal risk for Commission action, limiting the practical enforceability of private suits against members for policy or allocation decisions unless bad faith can be alleged and proved.

Removal and vacancy provisions

• The Governor may remove a member for cause, as the Governor sees sufficient (s 6(2)(e)). Membership may cease for bankruptcy/insolvency per the Interpretation Act (s 6(2)(d)), or for ceasing to be an officer of the Department if the member holds the Departmental slot (s 6(2)(f)). These are internal personnel‑level enforcement mechanisms rather than statutory sanctions against bodies.

Regulations

• The Governor may make regulations as necessary or expedient for the purposes of the Act (s 19). Regulatory instruments could, in principle, prescribe enforcement mechanisms, timeframes or penalties, but none are contained in the Act text. The Act reserves to subordinate legislation the capacity to fill enforcement gaps.

What the Act does not do

• It does not create criminal offences or fines specifically for refusal to supply information, failure to make timely distributions beyond the "without undue delay" phrase, or other non‑compliance with Commission procedures.
• It does not give the Commission coercive judicial powers such as summons powers, nor does it provide express statutory mechanisms to compel attendance other than by "requirement" (s 12(1), (4)).

Practical enforcement levers outside the statute

• In practice, enforcement of obligations may be achieved through political leverage, financial withholding or conditional arrangements if authorised by other statutes or funding agreements, or through administrative remedies such as referral to the Auditor‑General or to the Minister. Judicial review of administrative decisions remains available but is governed by general administrative law, not by this Act.

In short, the Act relies on administrative processes, reporting, audit and Ministerial oversight to enforce compliance and to correct or supervise allocation decisions. The statutory architecture provides obligations and reporting duties, but limited express coercive penalties; subordinate regulation or other legal avenues would be necessary to create express sanctions.

The Act expressly cross‑references and operates in conjunction with several Commonwealth and State statutes and institutional frameworks. These interactions define the legal doorway through which Commonwealth funds are channelled and locate the Commission within the broader local government governance architecture.

Commonwealth Local Government (Financial Assistance) Act 1986

• The Act’s core constraint is that the Commission’s recommendations must be made in accordance with the Commonwealth Act and any relevant principles of allocation approved under that Act (s 11). The Commonwealth Act determines the existence, quantum, and allocation principles for national local government financial assistance, with the State bound to respect those Commonwealth parameters when allocating funds among local governments in Western Australia. The Minister must inform the Commonwealth Minister of allocation particulars before they are made public (s 15(1)), and must furnish a Treasurer‑approved statement of payments with an Auditor‑General certificate after the financial year (s 16A). These provisions integrate Commonwealth reporting and auditing expectations into the State’s allocation process.

Local Government Act 1995

• The Act imports definitions from the Local Government Act 1995 for the meanings of terms used in s 5(1)(c). Section 5(1a) confirms that terms used in the nomination categories have the same meanings as in the Local Government Act 1995, thereby aligning the Commission’s representative structure with the State’s statutory local government classification system. Additionally, the defined term "Department" is given the meaning provided by section 1.4 of the Local Government Act 1995 (s 3). The Department’s chief executive officer nominates the Department officer to be Deputy Chairman (s 5(1)(b)), showing an administrative cross‑link between departmental staffing and Commission governance.

Interpretation Act 1984

• A ground for vacancy of office is that a member is, according to the Interpretation Act 1984 s 13D, a bankrupt or a person whose affairs are under insolvency laws (s 6(2)(d)). The Act therefore uses interpretation rules for disqualification grounds.

Public Sector Management Act 1994

• Section 6(3) addresses the relationship between acceptance of office and the application of Part 3 of the Public Sector Management Act 1994. It states that acceptance or acting in the office of member does not of itself render Part 3 or other public sector officer provisions applicable, or affect their application if they already applied. This preserves pre‑existing public sector obligations for those who are already officers while clarifying that appointment to the Commission does not automatically make a private person subject to public sector employment laws. Also, s 7(2) requires the Public Sector Commissioner’s prior written approval for payment of remuneration to a person to whom Part 3 of the Public Sector Management Act applies, linking remuneration approvals into the public sector management regime.

Auditor‑General Act / auditing framework

• Section 16A requires an Auditor‑General’s certificate to accompany the statement of payments supplied to the Commonwealth Treasurer. This invokes the Auditor‑General’s statutory auditing functions, although the Act does not name the Auditor‑General Act; the obligation is concrete and creates an audit verification step for Commonwealth reporting.

Reprints Act and amendments

• The compilation table shows successive amendments and reprints of the Act. Several pieces of legislation amended the Act, including the Local Government Grants Amendment Act 1988 which inserted Part III and the substantive allocation regime (see compilation notes and marginal notes accompanying particular sections). The Act is therefore to be read in its consolidated form as amended (notes list amendments and commencement dates).

Regulations

• The Governor may make regulations for the purposes of the Act (s 19). Regulations may be used to elaborate procedural details, although the Act itself does not set out detailed subordinate rules. Interaction with regulations under other statutes could shape the Commission’s procedures.

Administrative law and judicial review

• The Act does not itself limit judicial review. Decisions of the Commission and the Minister are administrative acts to which standard administrative law remedies would apply. The Act contains no privative clause. The Minister’s approval role and the mandatory approval after reconsideration (s 14(2)(c)) may produce administrative law questions if discretionary boundaries are tested, but the mechanism for review is not specified in the Act.

Collective bargaining or sectoral instruments

• The Act references WALGA as the body that provides panels (s 5(1)(c)) and as a recipient of an opportunity to make submissions (s 13). That institutional link ties the Act into sectoral representation arrangements rather than to industrial or funding agreements.

In practice, the Act is an implementing statute that sits between Commonwealth financial assistance law and local government operations. Its key interactions are with the Commonwealth financial assistance legislation for allocation principles and reporting obligations, with State local government law for definitions and departmental roles, with public sector management law for remuneration and status of members who are public servants, and with audit law for certification of payments. The Act leaves open the content of regulations and relies on general administrative law for remedies and for judicial oversight of executive decisions made under the statute.

The Act as compiled contains a number of recorded amendments with dates and short descriptions in the compilation table. The compilation notes and marginal notes attached to sections indicate when provisions were inserted, deleted or amended. Key points from the compilation table and the in‑text marginal notes are set out below, drawn directly from the reprint document.

Original enactment

• The Local Government Grants Act 1978, No. 4 of 1978, received assent on 11 May 1978 and commenced the same day (compilation table).

Significant subsequent amendments and insertions

• Local Government Grants Amendment Act 1985 (No. 56 of 1985), assent 28 Oct 1985. Section 20 (review provision) was inserted by this amending Act (see the marginal note to s 20: "Section 20 inserted: No. 56 of 1985 s. 10.") and the compilation table shows commencement dates for parts of that Act.
• Local Government Grants Amendment Act 1988 (No. 12 of 1988), assent 6 Sep 1988. This amendment substantially added Part III and many of the allocation and reporting provisions. Multiple sections are annotated as "inserted: No. 12 of 1988 s. 6" (e.g., ss 9, 10, 11, 12, 13, 14, 15, 16, 16A, 16B, 16C). Section 2 of the principal Act was deleted by s 2 of the 1988 Act (see marginal note at head).
• Acts Amendment (Public Service) Act 1987 changes are reflected regarding the term "Permanent Head" being read as "chief executive officer" per the Reprints Act note 2. The compilation table records this interpretative change.
• Acts Amendment (Public Sector Management) Act 1994 (Pt. 3) and Public Sector amendments (No. 32 of 1994): marginal notes show amendments to s 6(3) and s 7(2) linking to Part 3 of the Public Sector Management Act.
• Local Government (Consequential Amendments) Act 1996 (No. 14 of 1996): the long title was amended by No. 14 of 1996 s. 4 and several sections indicate amendment by No. 14 of 1996 (for example, s 10 is "inserted: No. 12 of 1988 s. 6; amended: No. 14 of 1996 s. 4"). The amendments updated cross‑references and language to align with broader local government reforms.
• Statutes (Repeals and Minor Amendments) Act (No. 2) 1998 (No. 10 of 1998): affected s 8 procedural wording, with commencement 30 Apr 1998.
• Local Government Amendment Act 2004 (No. 49 of 2004) amended various sections; s 13 shows amendments by No. 49 of 2004 s. 13.
• Machinery of Government (Miscellaneous Amendments) Act 2006 (No. 28 of 2006) updated departmental references and other machinery matters; multiple sections were amended by No. 28 of 2006 (see marginal notes).
• Acts Amendment (Bankruptcy) Act 2009 (No. 18 of 2009) affected s 6(2)(d) to align bankruptcy references with updated law.
• Public Sector Reform Act 2010 (No. 39 of 2010) made further amendments to s 7 and related public sector references, with commencement 1 Dec 2010.

Reprints

• The Act was reprinted as at 1 Mar 2002 to consolidate earlier amendments including those listed at that time (compilation table).
• A second reprint consolidating amendments up to 19 Aug 2011 is noted: "Reprint 2: The Local Government Grants Act 1978 as at 19 Aug 2011."

Specific insertion notes

• Many of the Part III sections were inserted by the 1988 amendment; the marginal text shows "Section X inserted: No. 12 of 1988 s. 6" for ss 9‑16C.
• Section 20 was inserted by the 1985 amendment and introduced the statutory five‑year review cycle.

Transitional or saving provision

• The compilation notes include the text of s 7 of the Local Government Grants Amendment Act 1988, which saves actions done by the Commission before that Act's commencement when performed in accordance with the Commonwealth Act notwithstanding earlier inconsistencies. The saving is recorded in compilation note 3: "Anything done before the commencement of this Act by the Commission in accordance with the Local Government (Financial Assistance) Act 1986 of the Commonwealth is valid notwithstanding anything to the contrary in the principal Act as in force before the commencement of this Act."

Practical effect of amendments

• The 1988 amendments are the structural pivot, inserting the allocation and distribution regime and the linkages to the Commonwealth Act.
• Later amendments refined member appointment mechanics, remuneration approval, cross‑statute definitions and administrative integration with public sector reform and local government legislative change.

For due diligence, readers should consult the official reprint versions and the Gazette commencement notices listed in the compilation table for precise commencement timings of each amending provision if timing matters for historical compliance, litigation or funding audits. The compilation table in the Act lists the assent and commencement dates for each amending statute as recorded in the reprint.

The Act as provided contains no recorded cases, judicial determinations or litigation history in its text or associated notes. The statute does not name any judicial authorities or provide references to decisions. The compilation notes include only legislative amendment and reprint history, and a saving clause for pre‑commencement Commission acts (see compilation note 3), but there are no reported judicial determinations recorded within this reprint.

Consequently:

• There are no cases cited in the Act or its notes that interpret or apply its provisions.
• No statutory case law trail is embedded in this text. Any litigation that has arisen under or about the Act would need to be researched externally in case law databases and government records; such research lies outside the content of the reprint provided.

Readers seeking precedential interpretation of ambiguity in key phrases of the Act, for example the meaning of "without undue delay" in s 16, the scope of the Commission’s power to "require" information in s 12(4), or the limits of Ministerial discretion under s 14, should perform a targeted case law search. The Act provides administrative pathways and reporting channels which may have generated disputes over timing, disclosure obligations or the appropriateness of allocations, but no such litigation history is supplied in this text.

The absence of litigation references in the reprint does not imply the Act has never been litigated. It only means that the reprint document does not record judicial decisions. For practitioners, auditors and litigators, case law searches and parliamentary records are necessary to uncover any disputes or legal developments that have fleshed out the Act’s contours.

This Act contains several provisions and absences that merit particular attention because they create implementation uncertainty, administrative burdens, or require clarifications often overlooked in practice.

"Without undue delay" is undefined (s 16)

• The State must make unconditional payments to local governments "without undue delay" after receipt of Commonwealth funds. The phrase is open‑ended and the Act provides no timeframe or statutory standard for measuring delay. Practitioners should note the potential for disputes if the State takes what a local government considers an excessive time to pass on funds. Remedies are not set out in the Act; recourse would rely on general administrative law, contractual arrangements or political pressure.

Commission power to "require" information but absence of coercive sanctions (s 12(4))

• The Commission can require local governments to supply financial and other information and the local government "shall comply". The statute does not attach explicit penalties or provide express enforcement mechanisms (for example, a power to fine, to injunctively order compliance, or to refer for criminal sanction) if a local government refuses. That makes the "requirement" more a legislative obligation whose enforcement depends on other levers: Ministerial pressure, public exposure via the Commission’s reports, or legal enforcement through general court remedies. Practitioners should assess whether other statutes, grant conditions, or the Departmental frameworks provide complementary compulsion.

Ministerial approval bottleneck and limited grounds for substantive appeal (s 14)

• The Minister has the power to approve recommendations or to send them back with reasons. After resubmission the Minister "shall approve" the resubmitted recommendations (s 14(2)(c)). The mandatory approval after resubmission could be read to limit substantive second‑order Ministerial discretion, but the Act does not specify what level of amendment is required on resubmission, nor does it provide a pathway for judicial review within the Act. The procedure concentrates a post‑proposal approval function in the Minister that may produce political accountability issues and timing constraints.

WALGA panels and the Minister’s fallback nomination power (s 5(1)(c); s 5(2a))

• WALGA must submit panels of at least three names for each category of member. If panels are not submitted, the Minister may appoint any eligible person as if selected from a panel (s 5(2a)). This gives WALGA structured input but preserves Ministerial discretion to fill vacancies if WALGA does not act. Stakeholders should note the potential for appointment disputes or questions about representativeness.

Ambiguity in what counts as "financial and other information" (s 12(4))

• The Commission may specify the information required. The content of such requests is not limited in the Act; therefore, the scope of information demands could be broad. Local governments should assess data confidentiality, record‑keeping capacity and the administrative costs of compliance. The Act does not address privileged or commercially sensitive information exceptions.

"Ordinarily be held in public" for hearings (s 12(3))

• The word "ordinarily" implies the Commission may hold hearings in private in appropriate circumstances, but there is no statutory guidance on when privacy is permissible. This gives the Commission procedural flexibility but creates uncertainty for stakeholders about when hearings will be open to public scrutiny.

Limited statutory sanctions and reliance on reporting/audit mechanisms

• Enforcement and corrective measures hinge on reporting to the Commonwealth Treasurer with Auditor‑General certification (s 16A), annual reports to Parliament (s 16C), and Ministerial supervision (s 14). This architecture relies on transparency and audit to deter non‑compliance rather than on express fines or criminal penalties.

Remuneration for public servants requires Public Sector Commissioner approval (s 7(2))

• Where a member is subject to Part 3 of the Public Sector Management Act, the Minister cannot approve remuneration without the prior written approval of the Public Sector Commissioner. This can slow appointments or payments where public sector appointees are involved and creates an inter‑agency approval step.

Quorum and operational risks with vacancies

• The quorum requires the Chairman or Deputy and two other members (s 8(2)). Although s 17 validates Commission acts despite vacancies, extended vacancies could impair the Commission’s ability to meet quorate and make timely recommendations. The Deputy arrangements for members (s 5(3)‑(7)) create some continuity, but reliance on deputies can change institutional dynamics.

Review timings and statutory horizon (s 20)

• The Minister must conduct a review every five years beginning after 1 January 1991, but the Act provides broad discretion about what the review considers, subject to three listed matters. The periodic review is an obligation to Parliament but provides no mechanism for external triggers except the five‑year cycle.

Reporting burdens and Auditor‑General certification (s 16A)

• The Minister must supply the Commonwealth Treasurer with a statement in a Treasurer‑approved form plus an Auditor‑General certificate. The requirement imposes an annual auditing workload that the State must resource, and the Auditor‑General’s certificate on correctness can lead to preparation costs, audit queries and timing friction.

Interpretive cross‑references

• Several definitions and roles are determined by cross‑reference to other Acts (Local Government Act 1995, Interpretation Act 1984, Public Sector Management Act 1994). Practitioners should verify the current versions of those statutes and their definitions, as amendment in those instruments affects the operation of this Act.

No express right to appeal allocation outcomes

• The Act provides a Ministerial approval path but no statutory internal appeals process for local governments unhappy with allocation decisions. Any challenge would rely on general public law remedies.

These "gotchas" indicate where legal and administrative attention is required: ambiguous timing standards, enforcement gaps around information requests, reliance on audit and transparency rather than sanction, appointment mechanics that blend representative and ministerial inputs, and cross‑statute dependencies that require careful statutory reading.

Compliance obligations under the Act fall to several actors: local governments, WALGA, the Commission, the Minister, the Department and the Auditor‑General. Below is a practical compliance checklist mapped to the Act’s provisions and procedural steps.

For local governments

• Expect to be invited to make written submissions to the Commission each allocation year, and prepare timely, materially accurate submissions that address allocation criteria (s 13; s 10; s 11). Submission content should align with the allocation principles under the Commonwealth Act because recommendations must be made in accordance with that Act (s 11).
• Be prepared to supply financial and other specified information if the Commission requires it, and ensure records and financial statements are current and auditable. The Commission’s power to require information is statutory and local governments "shall comply" (s 12(4)). Ensure clear internal processes to respond to formal information requests.
• Monitor the Commission’s annual report and announcements from the Minister about allocations, as the Minister will inform each local government of its allocation (s 15(2)). Incorporate expected funding into budgetary planning only after receiving the formal allocation notification and the State receiving Commonwealth funds, given the "without undue delay" clause in s 16.
• Maintain dialogue with WALGA and the Department where nomination panels and consultative processes are functioning, as sector representation affects Commission composition and may influence the Commission’s methods (s 5; s 13).

For WALGA

• When requested by the Minister, prepare and submit panels of at least three willing candidates for each of the three membership categories (metropolitan, shire non‑metropolitan, and city/town non‑metropolitan) in writing (s 5(2); s 5(1)(c)). Maintain a process ensuring candidates are willing to serve and meet eligibility standards.
• Provide submissions and sector commentary to the Commission on allocations (s 13). Ensure submissions address Commonwealth allocation principles to help the Commission meet s 11 obligations.

For the Commission

• Prepare recommendations for the Minister as soon as practicable for each financial year (s 10). Document the methodology used to allocate funds and how that methodology follows the Commonwealth Act and any approved principles (s 11).
• Establish internal procedures for inspections, hearings and evidence‑taking, noting hearings will ordinarily be public (s 12(1)‑(3)). Draft a clear public hearings policy identifying circumstances when non‑public hearings are justifiable.
• Issue formal, written requirements for financial and other information to local governments, specifying deadlines and data standards to ensure compliance and auditability (s 12(4)).
• Invite and record written submissions from local governments and WALGA (s 13). Keep a submission register and maintain transparent records in case of ministerial query or parliamentary scrutiny.
• Prepare the annual report by 1 September each year covering the preceding 12 months, and furnish it to the Minister for tabling (s 16C). Include methodology, recommendations, responses to ministerial requests, and any material variance commentary.
• Maintain proper minutes and ensure quorum for meetings (s 8). The quorum is the Chair or Deputy Chair plus two other members (s 8(2)).

For the Minister and State agencies

• Notify the Commission as soon as the State is advised by the Commonwealth of the amount of Commonwealth funds for the financial year (s 9). Implement an internal protocol to capture Commonwealth advice promptly and to trigger the Commission’s recommendation timeline.
• On receipt of the Commission’s recommendations, either approve them or provide a written request to the Commission to review the whole or part of them, including a statement of reasons (s 14(1); s 14(2)(a)). Maintain documentary records of reasons and correspondence to satisfy parliamentary and audit scrutiny.
• Inform the Commonwealth Minister of allocation particulars before public disclosure (s 15(1)). Coordinate timing of public announcements with the Commonwealth notification requirement to avoid procedural breaches.
• Once Commonwealth funds are received by the State, ensure payments to local governments are made "without undue delay" and are unconditional, as required by s 16. Maintain financial controls and clear accounting entries to support the Auditor‑General’s year‑end certification.
• After the end of the financial year, provide to the Commonwealth Treasurer the required statement of payments in the Treasurer‑approved form, together with the Auditor‑General’s certificate attesting to correctness (s 16A). Engage the Auditor‑General early to schedule audit procedures and timelines for certification.
• Where the Commission needs reports requested by the Minister under s 16B, ensure timely referral and resourcing to facilitate prompt compliance.

For the Auditor‑General

• Be prepared to audit and certify the State’s statement of payments to the Commonwealth, in accordance with the form approved by the Commonwealth Treasurer and the statutory requirement that the Auditor‑General certify the statement’s correctness (s 16A). Coordinate audit timing with the Minister’s requirements and any Commonwealth deadlines.

Cross‑cutting compliance actions

• Maintain documentary evidence at every stage: Commission recommendations, Ministerial approvals or review requests with reasons, correspondence with the Commonwealth, information requests to local governments and responses, and audit files supporting the Auditor‑General’s certificate. These records underpin transparency and satisfy s 16A and s 16C obligations.
• Map dependencies on other statutes: check definitions in the Local Government Act 1995 for classifying metropolitan/shires/towns, confirm applicable public sector employment provisions for members subject to the Public Sector Management Act for remuneration approval, and ensure insolvency/disqualification criteria align with the Interpretation Act (s 3; s 6(2)(d); s 7(2)).
• Review and update procedural rules and templates to match any regulations promulgated under s 19 that relate to the Act, and to accommodate ministerial or Commonwealth administrative requirements.
• Prepare a contingency plan for vacancies to ensure quorum and continuity, using deputy appointment provisions in s 5(3)‑(7) and the validation protection in s 17 in case of short‑term appointment irregularities.
• Budget for administrative costs: Commission meetings, member remuneration (subject to approvals under s 7), audit certification costs, and the staff time required to respond to Commission information requests are recurring costs that must be factored into departmental budgets.

By mapping these statutory responsibilities to internal procedures , formalising notification triggers, information request templates, audit scheduling and record retention , the principal actors can align practice with the Act’s requirements and reduce the procedural and political risks associated with allocation and distribution of Commonwealth local government funds.
