5 Matters or things to be determined by Minister

5 Matters or things to be determined by Minister

(1) The Minister may, from time to time, determine a matter or thing—

(a) at the Minister’s discretion, or

(b) if a constituent council refers the matter or thing to the Minister for determination.

(2) The Minister may determine a matter or thing required to be or may be the subject of an agreement between the constituent councils under this proclamation if—

(a) the constituent councils fail to agree, or

(b) the Minister is not satisfied with an agreement between the constituent councils.

(3) The Minister may delegate the exercise of a function of the Minister under this section to the Chief Executive.

(4) The Chief Executive may sub-delegate to a person the exercise of a function delegated to the Chief Executive under this section.
