What it does
This statutory instrument prescribes when casual vacancies in council offices are not to be filled by a recount or a by-election after the Local Government (Number of Councillors) Order 2014 (the "Councillors Order") takes effect. Mechanically, the order prevents the procedures in sections 307 and 308 of the Local Government Act 1993 (the Act) from being used to fill a vacancy where filling it would cause the council’s total number of councillors to exceed the number that the Councillors Order provides will be elected for the municipal area at the next ordinary election (cl 4(1)). It also prescribes how multiple contemporaneous vacancies are to be ordered for the purpose of determining which, if any, vacancies may be filled when the general manager cannot determine their chronological occurrence (cl 4(2)-(5)). The order does not apply to by-elections for mayor or deputy mayor (cl 4(6)), and it contains a special rule for the case where a mayor vacates both the mayoralty and their councillor office (cl 4(7)). The instrument commences on the same day as the Councillors Order (cl 2) and is cited as the Local Government (Casual Vacancies) Order 2014 (cl 1).
The order references and operates by reference to the Act and the Councillors Order (cl 3(1)) and directs that the Acts Interpretation Act 1931 applies to its interpretation as if it were by-laws (cl 3(2)). It adopts the Act’s definitions for any word or expression used both in the order and the Act (cl 3(3)).
The order delegates specific roles to two administrative actors. The general manager of the relevant council must notify the Electoral Commissioner when the random-order procedure is required (cl 4(3)). The Electoral Commissioner is directed to conduct and record a random draw using identical opaque spheres and slips bearing the names of the last holders of the vacant offices to produce a list that fixes the order in which vacancies are to be taken to have occurred (cl 4(4)-(5)). Where the order prevents a recount or by-election under ss 307 or 308 of the Act, those statutory procedures are expressly taken not to apply in the circumstances described (cl 4(1)).
