322 Payment of the surcharge (1) A surcharge is a debt due and payable to the Council by the Councillor on whom it is imposed. (2) The Council is entitled to deduct any amount towards the discharge of the amount of the surcharge from any allowances or other benefit payable to the Councillor on whom the surcharge is imposed. (3) If a Councillor on whom a surcharge is imposed does not pay the surcharge within 3 months of it being imposed or confirmed on a review, the Councillor is suspended until the surcharge is paid and section 37 applies.
