259 When is an extraordinary vacancy not to be filled? (1) An extraordinary vacancy is not to be filled if the VEC determines that there is insufficient time to conduct a by-election or countback to fill the extraordinary vacancy before the period of 3 months before a general election. (2) The VEC must advise the Minister and the relevant Council of a determination under subsection (1) as soon as practicable after it is made.
