307 Power to impose surcharge (1) If a council has suffered loss as a result of dishonesty or serious illegality, the council may apply to NTCAT to impose a surcharge on a person whose dishonest or illegal act gave rise to the loss. (2) If NTCAT imposes a surcharge on a person, the amount of the surcharge must not exceed the total of the following amounts: (a) the amount of the loss suffered by the council; (b) the amount incurred by the council to recover the surcharge. (3) The surcharge is imposed by giving the person a decision notice.
