#### 626 Failure to obtain approval 626 Failure to obtain approval > > (1) A person who carries out an activity specified in Part A of the Table to section 68 without having obtained a prior approval of the council under Part 1 of Chapter 7 required for the carrying out of that activity is guilty of an offence, subject to subsection (2). > > > > Maximum penalty—50 penalty units (in the case of an individual) or 100 penalty units (in the case of a corporation). > > > (2) (Repealed) > > > (3) A person who carries out an activity specified in Parts B–F of the Table to section 68 without having obtained a prior approval of the council under Part 1 of Chapter 7 required for the carrying out of that activity is guilty of an offence. > > > > Maximum penalty—20 penalty units. > > > (4) A person— > > > > > (a) who carries out an activity without having obtained a prior approval of the council under Part 1 of Chapter 7 required for the carrying out of that activity, and > > > > > (b) who so carries out the activity on the basis of an exemption granted by or under this Act, being an exemption that is subject to conditions, and > > > > > (c) who carries out the activity otherwise than in accordance with the conditions to which the exemption is subject, > > > > is guilty of an offence under subsection (1) or (3) as if the exemption did not apply. > > **s 626:** Am 1994 No 44, Sch 12 (1); 1994 No 82, Sch 3 (9); 1995 No 94, Sch 5.8 \[10\]; 1997 No 152, Sch 3 \[40\]; 2001 No 93, Sch 1 \[12\].
