#### 438Z Termination of suspension 438Z Termination of suspension > > (1) The Minister may, by order published in the Gazette, terminate the suspension of a council under this Part. > > > (2) The Minister is to terminate the suspension of a council under this Part no later than 30 days after the inquiry report date, unless the council is dismissed on or before that date. > > > (3) However, a failure to terminate the suspension within that 30-day period does not affect the validity of an order terminating the suspension that is made after that 30-day period. > > > (4) For the purposes of this section, the inquiry report date is the date the report of the person or persons who held the public inquiry is provided to the Governor or the Minister, as the case requires. > > **ss 438Z–438ZC:** Ins 2013 No 44, Sch 1 \[41\].
