113 Power to remand defendant from time to time (1) This section applies if the Court conducting a preliminary examination adjourns the examination. (2) The Court may remand the defendant into the custody of the Commissioner of Correctional Services: (a) if the remand is for a period of not more than 3 clear days – orally; or (b) otherwise – by warrant. (3) The period of remand cannot exceed 15 clear days unless both the prosecutor and the defendant consent. (4) The Court, on being satisfied that a defendant who has been remanded into custody is, by reason of illness or accident, unable at the expiration of the period for which the defendant was remanded to appear personally before the Court, may in the absence of the defendant order the defendant to be kept in custody for such further period as the Court deems reasonable, but not exceeding 15 days at any one time unless both parties consent to a longer period.
