105A Preliminary examination to be conducted If an information is laid under section 101 for an indictable offence, a preliminary examination must be conducted by the Court unless: (a) an indictment for the offence signed under section 300 of the Criminal Code has been presented; or (b) the offence is dealt with under Division 2.
