What it does
This Act operates as a short, targeted statute that performs three mechanical tasks. First, it retroactively validates a set of documents and processes associated with the Living Marine Resources Management Act 1995 (the Act) that were created, issued or used during a defined validation period. Section 4 states, “For the avoidance of doubt,” and then deems specified classes of applications, permits, licences, identity cards, infringement notices and specified documents under s145(1) of the Act to have been in an approved form, or properly approved, at the time they were issued, purportedly issued, used or purportedly used during the validation period (s4(a)-(e)). The validation period is defined in s3(1) as commencing on 31 May 1996 (the day the 1995 Act commenced) and expiring immediately before the day this Act receives Royal Assent (s3(1) and s3(1) definition of “validation period”).
Second, the Act prescribes a construction rule for the Fisheries (Abalone) Rules 2000 during an “adjustment period”. Section 5(2) directs that, throughout the adjustment period (defined in s5(1) as starting 1 January 2000 and expiring immediately before the day proclaimed under s2(2)), certain expressions in specific Rules are to be read as alternative wording: for example, “third copy” in rule 17(1)(c)(i) is to be read as “yellow sheet”; “white copy” in rule 29(4)(b) as “white sheet”; and “the pink sheet and each copy” in rule 29(5) as “each sheet” (s5(2)(a)-(c)). Section 5 itself commences on a day to be proclaimed (s2(2)).
Third, the Act allocates responsibility for administration temporarily. Until an order under section 4 of the Administrative Arrangements Act 1990 assigns the Act elsewhere, s6 assigns administration to the Minister for Primary Industries, Water and Environment and identifies the Department of Primary Industries, Water and Environment as the responsible department (s6(a)-(b)).
The Act does not create new offences or substantive rights beyond the specific retrospective validations and construction directions. Commencement is staged: all provisions except s5 commence on Royal Assent; s5 requires proclamation (s2(1)-(2)). The Act’s operative mechanisms are therefore retroactive validation, targeted rule construction for an adjustment period, and temporary administrative assignment.
