### 263A Prosecution of offences > [*\[Section 263A Inserted by No. 7 of 2007, s. 75, Applied:30 Apr 2007\]*](/view/html/inforce/2007-04-30/act-2007-007#GS75@EN) > > > (1)  An offence against this Division is an indictable offence. > > > (2)  However, a court of summary jurisdiction may hear and determine proceedings for an offence against this Division if the court is satisfied that it is proper to do so and the defendant and the prosecutor consent. > > > (3)  Where, in accordance with [subsection (2)](#GS263A@Gs2@EN) , a court of summary jurisdiction convicts a person of an offence against this Division, the penalty that the court may impose is a fine not exceeding 5 000 penalty units or imprisonment for a term not exceeding 2 years, or both.
