### 138 Activities causing detrimental effect > [*\[Section 138 Amended by No. 45 of 1997, s. 28, Applied:13 Nov 1997\]*](/view/html/inforce/1997-11-13/act-1997-045#GS28@EN) Unless otherwise authorised, a person must not carry out any activity which is likely to have a serious effect on the marine environment and involves or results in– > > > > (a) the disturbance of the bed of any State waters; or > > > > > (b) the removal of, or interference with, fish or marine or benthic flora or fauna in any State waters; or > > > > > (c) the discharge, release or deposit of any matter in any State waters. > > Penalty: Fine not exceeding 5 000 penalty units or imprisonment for a term not exceeding 2 years, and a daily fine not exceeding 50 penalty units.
