The Plan organises land use law in a small number of interlocking instruments and concepts. Those concepts are the practical levers a lawyer, planner or developer must negotiate.

• Zoning and Land Use Table. The Plan establishes a zone map and a Land Use Table that, for each zone, sets objectives and lists development that is permitted without consent, permitted only with consent, or prohibited (cl 2.1; cl 2.3; Land Use Table). The Land Use Table is the immediate statutory source of permissible uses. The consent authority must have regard to zone objectives when determining an application (cl 2.3(2)).

• Mapping. Multiple statutory maps are referenced and used as operative instruments: the Land Zoning Map, Lot Size Map, Land Application Map, Heritage Map, Land Reservation Acquisition Map and Dwelling Opportunity Map. These maps are adopted with the Plan and may be amended by subsequent environmental planning instruments (cl 1.7; cl 2.2; numerous clauses referencing specific maps). The Plan treats combined and electronic maps as valid and requires the maps be made public via the NSW Planning Portal (cl 1.7).

• Consent hierarchy: exempt, complying, and development consent. Part 3 sets out which minimal-impact works are exempt (Schedule 2) and which qualify as complying development (Schedule 3 and the State SEPPs) (cl 3.1-3.2). The Plan preserves the operation of State SEPPs that prevail under the Act (cl 1.9(1)).

• Minimum lot sizes and subdivision controls. Clause 4.1 imposes minimum lot sizes shown on the Lot Size Map, subject to very specific carve-outs (for example strata and community title exceptions, cl 4.1(4); special community title and split-zone rules at cls 4.1AA, 4.1B, 4.1C). Subdivision is generally only permitted with development consent (cl 2.6(1)) and there are constraints on subdividing where a secondary dwelling exists (cl 2.6(2)).

• Exceptions and discretionary variations. Clause 4.6 allows the consent authority to approve development that contravenes a development standard provided the applicant demonstrates that compliance is unreasonable or unnecessary and there are sufficient environmental planning grounds (cl 4.6(2)-(3)). It also records express exclusions to that flexibility (cl 4.6(8)), and requires the consent authority to keep a record of the assessment (cl 4.6(4)). The Plan therefore embeds a statutory pathway for departures from standards, with record-keeping obligations.

• Industry-specific regulatory overlays. The Plan imposes substantive, prescriptive controls for certain intensively regulated activities: intensive livestock agriculture (cl 5.18) and pond-, tank- and oyster aquaculture (cl 5.19 and Schedule 6). Those clauses set thresholds below which consent is not required subject to location tests, and detailed site and operational requirements for consented activities.

• Heritage and cultural controls. Clause 5.10 sets consent requirements for works affecting listed heritage items and heritage conservation areas (Schedule 5), requires consideration of heritage significance, and imposes procedural steps (notification to the Heritage Council and to Aboriginal communities for certain matters) (cl 5.10(2), (4), (7)-(9)).

• Flooding and hazard planning. Clause 5.21 sets out the matters the consent authority must be satisfied of before granting consent in the flood planning area, including compatibility with flood function, not increasing flood impacts elsewhere, and climate-change considerations (cl 5.21(2)-(3)).

• Public land classification and acquisition. Schedule 4 reclassifies specific parcels as operational or community land and clause 5.1 identifies which State authority will acquire land if owner-initiated acquisition is triggered (cl 5.1; Schedule 4).

• Procedural and transitional mechanics. The Plan repeals former local environmental plans that applied to the area and contains a savings clause for development applications lodged before commencement (cl 1.8; cl 1.8A). Clause 1.9A permits suspension of covenants and similar instruments to the extent necessary to enable development in accordance with the LEP, with a list of specific exceptions and preservation of public authorities’ registered interests.

Each of these concepts defines who may do what on a parcel of land, what preliminary documentation and evidence must be provided to obtain consent, and where the Council must apply discretionary judgment subject to the Act and embedded thresholds in the Plan.

The Plan allocates rights, duties and decision-making roles to identifiable groups. The principal categories of affected stakeholders, and how they are affected under the Plan text, are:

• Landowners and prospective developers. The Plan determines what uses are permitted on their land (Land Use Table; cls 2.2-2.3), whether development consent is required for subdivision and demolition (cls 2.6-2.7), and what minimum lot sizes apply (cl 4.1; Lot Size Map). Owners proposing activities specified in the Plan (for example intensive livestock, aquaculture, farm stay, bed and breakfast) face specific substantive criteria before consent may be granted (cls 5.18, 5.19, 5.24, cl 5.4(1)). Owners on land with heritage items listed in Schedule 5 must obtain consent for many works affecting those items (cl 5.10).

• Liverpool Plains Council (the consent authority). The Plan designates the Council as consent authority subject to the Act (cl 1.6). The Council has primary responsibility for granting or refusing development consent in accordance with the Plan, for considering zone objectives (cl 2.3(2)), for requiring heritage assessments or management plans (cl 5.10(5)-(6)), for assessing flood and hazard matters (cl 5.21), and for applying the discretionary exceptions to standards (cl 4.6). The Council is also the designated State acquisition authority for certain local open space (cl 5.1(2), Schedule Land Reservation Acquisition Map).

• State agencies and Ministers. The Plan identifies specific State authorities with roles: Transport for NSW is the relevant authority for classified roads (cl 5.1(2)), the Minister administering the National Parks and Wildlife Act is the relevant authority for land marked National Park (cl 5.1(2)), and Director-General certification is required in urban release areas for designated State public infrastructure arrangements (cl 6.1(2)). The Plan expressly preserves the operation of State environmental planning policies where they prevail (cl 1.9(1)). For Quirindi Airport matters, the consent authority must consult and act on advice from the relevant Commonwealth body if development will penetrate airport limitation or operations surfaces (cl 7.5(2)-(4)).

• Agricultural and primary production operators. The Plan treats primary production as a priority in certain zones (Zone RU1 Primary Production objectives). It contains multiple provisions that directly affect agricultural practice and rural enterprise decisions: minimum lot sizes (cl 4.1); prohibition of restructuring that would fragment productive land (objectives of cl 4.1); specific constraints on intensive livestock agriculture and small-scale thresholds for exempt activity (cl 5.18); and farm gate/farm stay considerations that require the consent authority to assess impacts on agriculture (cls 5.24-5.25).

• Heritage owners and Aboriginal communities. Owners of land containing items in Schedule 5 are subject to consent requirements for demolition, alterations and subdivision (cl 5.10(2)). The Plan requires notification of local Aboriginal communities and consideration of their responses for development that may affect Aboriginal places (cl 5.10(8)). For archaeological sites not on the State Heritage Register the consent authority must notify the Heritage Council and consider its response (cl 5.10(7)).

• Licensed premises and the live-music sector. Clause 5.20 broadly constrains the consent authority’s ability to refuse development involving playing or performing music for licensed premises: genre, live versus recorded, number of performers, instruments, dancing, stages and décor cannot be used as grounds for refusal, provided noise can be managed and minimised to an acceptable level (cl 5.20(1)-(2)). This affects hospitality operators and the Council’s noise/amenity assessment remit.

• Communities exposed to hazards and nuisances. Residents in flood-prone areas, near airports, or near intensive agriculture/aquaculture operations are affected because the Plan requires the consent authority to consider impacts on risk to life, evacuation, noise and odour, water pollution and adjacency distances (cls 5.21, 7.6, 5.18, Schedule 6).

• Holders of private covenants and registered instruments. Clause 1.9A allows suspension of private covenants and similar instruments where necessary to enable development under this Plan, with enumerated exceptions (cl 1.9A(1)-(3)). Public authorities’ registered interests are preserved (cl 1.9A(3)).

• Owners and operators in urban release areas. Part 6 places preconditions for subdivision and development in designated urban release areas: staged releases, adequate infrastructure arrangements and development control plans with specified content must be prepared before most development proceeds (cls 6.1-6.3).

In short, the Plan affects anyone who owns, uses, develops or regulates land in the Liverpool Plains. It distributes decision-making power primarily to the Council, while imposing substantively prescriptive rules for a number of land use types (agriculture, aquaculture, heritage, flood-prone land, airport environs) and embedding State/other statutory interfaces.

This Plan creates duties for the consent authority and obligations and entitlements for developers and landowners. The principal duties and rights, as expressed in the Plan text, are:

Duties of the consent authority (Council)

• To determine development applications having regard to zone objectives set out in the Land Use Table (cl 2.3(2)).
• To require and consider heritage management documents, heritage impact statements or heritage conservation management plans before granting consent for works affecting heritage items or areas (cl 5.10(4)-(6)).
• To notify and consider responses from the Heritage Council for development on archaeological sites (cl 5.10(7)), and to notify local Aboriginal communities and consider their responses for Aboriginal places of heritage significance (cl 5.10(8)).
• To be satisfied that development in flood planning areas is compatible with flood function and will not worsen flood impacts, and to consider climate-change impacts on flood behaviour (cl 5.21(2)-(3)).
• To ensure essential services and infrastructure are available or adequately arranged before granting consent (cl 7.4; cl 6.2 for urban release areas).
• To follow consultation requirements for airspace operations that penetrate Quirindi Airport surfaces and to refuse consent where the relevant Commonwealth body objects (cl 7.5(2)-(4)).
• To keep a record of assessments under the exceptions-to-standards clause when considering contraventions of development standards (cl 4.6(4)).

Rights and obligations of applicants / owners

• Right to carry out exempt development that meets Schedule 2 and Part 3 criteria (cl 3.1).
• Right to apply for complying development where listed in Schedule 3 and to receive a complying development certificate subject to conditions set out or referred to in the Schedule and to the Building Code of Australia (cl 3.2(2)-(4)).
• Obligation to obtain development consent for subdivision, demolition and many listed uses unless the Plan or a State SEPP provides otherwise (cls 2.6-2.7; cl 2.3; Part 3).
• Where an applicant seeks a contravention of a development standard, obligation to demonstrate that compliance is unreasonable or unnecessary and to provide sufficient environmental planning grounds; the consent authority must keep a record of its assessment (cl 4.6(2)-(4)). The Plan notes the Environmental Planning and Assessment Regulation 2021 requires an accompanying document for such applications (cl 4.6(3) note).
• Obligation to comply with specific operational and site requirements for aquaculture and intensive livestock projects (cl 5.19, cl 5.18, Schedule 6). For example, aquaculture development must meet the site location and operational requirements in Schedule 6 and in some zones limited to small-scale aquarium fish production or extensive aquaculture (cl 5.19(2)).
• For certain temporary uses, an applicant must keep the use within the maximum period and restore land to its prior condition when required (cl 2.8(2)-(3), (4)-(5)).
• Where a development affects heritage items/areas or Aboriginal places, applicants must provide heritage assessment documentation and may be required to implement conservation work as a condition of consent (cl 5.10(4)-(6), (10)).

Statutory rights and constraints

• Clause 1.9 expressly recognises that this Plan is subject to any State environmental planning policy that prevails over it under section 3.28 of the Act (cl 1.9(1)). The Plan also lists a SEPP exclusion in cl 1.9(2).
• Clause 1.8A preserves the rights of applicants who lodged development applications before this Plan commenced, requiring those applications to be determined as if the Plan had not commenced (cl 1.8A).

Special statutory mechanics

• Clause 1.9A allows the suspension of covenants, agreements and similar instruments to the extent necessary to enable development in accordance with the Plan, but excludes certain instruments (for example covenants required by the Council, conservation agreements, biobanking agreements and planning agreements) and preserves public authorities’ registered interests (cl 1.9A(1)-(3)). The Governor approved this clause under section 3.16 of the Act (cl 1.9A(4)).
• Clause 5.1 designates which State authority is to acquire land under owner-initiated acquisition provisions and links to the Land Reservation Acquisition Map for detail (cl 5.1(2)).

Not expressed in the Plan

• The Plan itself does not set out penalty amounts or enforcement procedures; those matters are governed by the Act and its regulations. The Plan does, however, impose procedural obligations on the consent authority (for example, record-keeping under cl 4.6(4) and notification obligations in cl 5.10).

Overall, the Plan distributes administrative discretion to the Council but prescribes quite specific duties for certain activities (heritage, flood, aquaculture, intensive livestock), and embeds rights for applicants to rely on pre-commencement DAs and on exempt/compliant development pathways.

The Plan is a statutory environmental planning instrument under the Environmental Planning and Assessment Act and does not itself set out criminal penalties or detailed enforcement procedures. The text frequently cross-refers to the Act (for example cl 1.6, cl 1.9, cl 1.9A and cl 1.8A) and therefore presumes the enforcement regime, offences and penalties in the Act and its regulations will apply to contraventions of the Plan. The Plan does include provisions that create immediate legal effects and process obligations which, if breached, will be enforceable under the Act and the general enforcement powers that the Act provides, but specific penalty schedules are not contained in the local instrument.

Key enforcement-relevant mechanics and obligations that practitioners should note (drawn from the Plan):

• Development consent requirement. The Plan makes many activities subject to development consent. Carrying out those activities without the required consent will engage the enforcement regime of the Act. For example, subdivision, demolition and many uses are expressly made consent-required (cls 2.6, 2.7, 2.3).

• Exempt and complying development limitations. Exempt development under Schedule 2 and complying development under Schedule 3 are lawful only when the Commonwealth and State tests and the Plan’s stated conditions are met (cl 3.1-3.2). A development that purports to rely on exempt or complying status but does not meet the Plan’s requirements may be treated as unauthorised development.

• Record-keeping obligations. The consent authority must keep a record of assessments under the exceptions clause (cl 4.6(4)); failure to keep required records may be reviewable via administrative law mechanisms under the Act.

• Specific procedural obligations with compliance implications:

  • Heritage notifications: the Plan requires the consent authority to notify the Heritage Council or local Aboriginal communities and to take responses into account for certain heritage and archaeological matters (cl 5.10(7)-(9)). Non-compliance with those procedural steps could render a consent susceptible to legal challenge.
  • Consultation with Commonwealth bodies for airport surfaces: the Council must consult the relevant Commonwealth body when developments will penetrate the Limitation or Operations Surface; the Plan forbids granting consent if the Commonwealth body advises construction should not proceed (cl 7.5(2)-(4)). Ignoring required consultation could expose the Council to legal and operational risk.

• Suspended private instruments. Clause 1.9A suspends private covenants and similar instruments to the extent necessary to enable development under the Plan but does not affect registered public authority interests (cl 1.9A(1), (3)). That suspension is limited; disputes about the scope of suspension could give rise to private litigation or challenge to an approval.

• Infrastructure and urban release preconditions. Part 6 requires certification by the Director-General and the preparation of a development control plan before certain subdivisions proceed (cls 6.1-6.3). Failure to meet the Part 6 preconditions may invalidate subdivision approvals or give rise to refusal.

• Industry-specific compliance duties. Intensive livestock agriculture (cl 5.18) and aquaculture (cl 5.19, Schedule 6) include threshold and locational restrictions that determine whether consent is required or whether an activity is prohibited. Non-compliance with those operational requirements will affect lawfulness and expose operators to enforcement under the Act and relevant fisheries or agriculture legislation identified.

What the Plan does not do, and what that means for enforcement:

• The Plan does not prescribe its own penalty regime. Practitioners must therefore look to enforcement tools in the Environmental Planning and Assessment Act 1979, the Local Government Act 1993 and other relevant Acts for the forms of enforcement and penalties that will be applied to breaches of the Plan.
• The Plan contains multiple cross-references to other Acts where licensing or approvals may still be required (for example, Heritage Act 1977, Fisheries Management Act 1994, Crown Land Management Act 2016). Non-compliance with those separate statutory regimes can carry distinct enforcement consequences outside the operations of the LEP.

In practice, enforcement and penalties applicable to breaches of Plan rules will be those in the Environmental Planning and Assessment Act, regulations and any relevant sectoral legislation referenced in the Plan. The Plan itself creates procedural and substantive preconditions whose breach will be assessed in enforcement actions or judicial review under the Act.

The Plan extensively cross-references and is designed to operate alongside State policies and other statutory regimes. The text itself specifies interactions and limits. Key interactions are as follows:

• The Environmental Planning and Assessment Act 1979 (the Act). The Plan is made under the Act and repeatedly invokes specific Act provisions: the Plan is made in accordance with the relevant standard environmental planning instrument under s 3.20 of the Act (cl 1.2); the Governor approved cl 1.9A under s 3.16 of the Act (cl 1.9A(4)); clause 1.9(1) expressly subjects the Plan to SEPPs as provided by s 3.28 of the Act. Clause 1.8A references Division 3.5 of the Act for the treatment of pending applications. In short, the LEP is subordinate to and operates within the Act’s framework.

• State Environmental Planning Policies (SEPPs). Clause 1.9(1) affirms that State environmental planning policies that prevail over the Plan will do so under the Act. Clause 1.9(2) specifically excludes the operation of a particular SEPP clause (State Environmental Planning Policy (Rural Lands) 2008, cl 9) on the Plan area. The Land Use Table and notes also refer to numerous SEPPs that may be relevant for particular developments (for example, SEPP Housing 2021, SEPP Transport and Infrastructure 2021, SEPP Resources and Energy 2021, SEPP Resilience and Hazards 2021, SEPP Industry and Employment 2021, SEPP Primary Production 2021).

• Heritage and Aboriginal cultural heritage. The Plan interacts with the Heritage Act 1977 and the National Parks and Wildlife Act 1974: cl 5.10 requires consent for works affecting heritage items listed in Schedule 5 and sets notification/consultation triggers. The Plan notes that Aboriginal heritage is not mapped in Schedule 5 and that assessments should be undertaken under s 4.15 of the Act and with reference to the National Parks and Wildlife Act (cl 5.10 Note 2).

• Fisheries and aquaculture regime. Clause 5.19 and Schedule 6 cross-reference the Fisheries Management Act 1994, aquaculture industry development plans published under that Act and the Fisheries Management (Aquaculture) Regulation 2017. They impose site and operational requirements that are framed to be consistent with aquaculture industry plans and State strategies (see definition of “aquaculture industry development plan” and the NSW Oyster Industry Sustainable Aquaculture Strategy in cl 5.19(7)). In practical terms the Plan sits within a hierarchy: State and Commonwealth SEPPs and Acts override or interact with the LEP where specified; sectoral licensing and environmental regimes continue to operate alongside LEP permissions; certain Plan provisions are explicitly designed to complement or defer to other regulatory regimes (aquaculture, heritage, Crown land, airport operations). Practitioners must therefore combine a Plan analysis with a mapping of relevant State and Commonwealth statutory and policy instruments to determine the full set of permits and constraints affecting a proposed project.
