What it does
These regulations do three discrete mechanical things.
First, they prescribe which offences under the Litter Act 2007 are to be dealt with by infringement notice and they fix the penalty expressed in penalty units that is payable under an infringement notice for each prescribed offence. Regulation 4 does this expressly: it operates "for the purposes of section 17 of the Act" and states that the offences listed in column 2 of the table in Schedule 1 are "prescribed as an infringement offence for the purposes of infringement notices" and that the penalty unit amounts in columns 3 and 4 of that table are the penalties payable by a natural person and a body corporate respectively under an infringement notice (reg 4(a)-(c); Schedule 1).
Second, the regulations define the term "Act" within the instrument to mean the Litter Act 2007 (reg 3). That limited interpretive provision confines the instrument's immediate field of reference to that named Act and its section 17, where the mechanism for infringement notices is located.
Third, these regulations rescind the earlier statutory instruments listed in Schedule 2. Regulation 5 states that the legislation specified in Schedule 2 is rescinded; Schedule 2 lists the Litter (Infringement Offences) Regulations 2011 (No. 5 of 2011) and the Litter (Infringement Offences) Amendment Regulations 2019 (No. 75 of 2019).
Commencement is defined narrowly: the regulations take effect on the day on which their making is notified in the Gazette (reg 2). The instrument is dated as notified in the Gazette on 9 September 2020, and it is displayed and numbered in accordance with the Rules Publication Act 1953 (document footer).
Mechanically, therefore, the instrument does not create new substantive offences; it prescribes how certain existing offences under the Litter Act 2007 are to be enforced via infringement notices and specifies the penalty-unit quantum for natural persons and bodies corporate for each listed offence. The instrument also removes the immediately preceding regulatory instruments listed in Schedule 2 and establishes its own commencement by Gazette notification.
