16 Duty of person authorising or arranging for unsolicited document

(1)  [Section 16 Subsection (1) amended by No. 50 of 2010, s. 13, Applied:21 Dec 2010] [Section 16 Subsection (1) amended by No. 50 of 2010, s. 13, Applied:21 Dec 2010] A person who authorises or arranges for the distribution of an unsolicited document must ensure that the document is distributed in a way that prevents it from becoming litter.

Penalty:  Fine not exceeding 20 penalty units.

(2)  [Section 16 Subsection (2) substituted by No. 50 of 2010, s. 13, Applied:21 Dec 2010] It is a defence in proceedings for an offence under this section if the defendant establishes that the defendant took reasonable steps to comply with this section.
