27B Applications that are not relevant applications—small bar licences

An application for a small bar licence is not a relevant application if—

(a) the application relates to the same premises as the premises to which a general bar licence relates, and

(b) the application has not been made under the Act, Schedule 1, clause 39, and

(c) development consent has been obtained under the Environmental Planning and Assessment Act 1979 to sell liquor during the times to which the application relates, and

(d) the times are specified in the development consent.
