> > (1) The Secretary may require a licensee of a listed live music and performance venue to give evidence that sufficient live events have been held at the licensed premises to justify a reduction in the following—
> >
> > > (a) the base fee element of the licence under clause 10(2)(c),
> >
> > > (b) the trading hours risk loading element of the licence under clause 12(3A)(c).
>
> > (2) The requirement must be made by written notice to the licensee.
>
> > (3) The notice must specify the period (the specified period) to which the evidence must relate.
>
> > (4) The notice may require the evidence in the form of—
> >
> > > (a) records that show the live events held at the licensed premises during the specified period, or
> >
> > > (b) a declaration made by the licensee that specifies the live events held at the licensed premises during the specified period.
>
> > (5) A reduction under clause 10(2)(c) or 12(3A)(c) does not apply to a licence in relation to the specified period if the licensee—
> >
> > > (a) fails to give the Secretary the evidence, or
> >
> > > (b) gives the Secretary the evidence, but the evidence fails to satisfy the Secretary that sufficient live events have been held.

> > (6) In this clause—

> > live event means a live music performance or other arts and cultural event.
