What it does
Mechanically, the Liquor Control (Weymul Restricted Area) Regulations 2024 declare a geographically defined area to be a liquor-restricted area for the purposes of the Liquor Control Act 1988, create a stand‑alone prohibition on bringing or possessing liquor in that area, prescribe penalties for breaches, authorise police seizure and disposal of containers suspected to be linked to an offence, require the Director of Liquor Licensing to post specified notices at customary access routes, and insert a cross‑reference into the Liquor Control Regulations 1989. The primary operative provisions are: the definitions of the area and access road (regulation 3), the declaration of the Weymul area as a restricted area under section 175(1a) of the Act (regulation 4), the notice requirement on the Director (regulation 5), the offences and fines (regulation 6), the seizure and disposal power for police (regulation 7), and the temporal limit (regulation 8). The regulations commence in two stages: Part 1 (other than regulation 3) on the day of publication on the WA legislation website, and the remaining provisions on the following day (regulation 2). The instruments expire at the close of 19 March 2029 unless sooner repealed (regulation 8). The regulations amend the Liquor Control Regulations 1989 by inserting a reference to regulation 6(1) of these regulations into the Table in regulation 27(4) (regulation 10).
The declaration is made expressly "for the purposes of section 175(1a) of the Act" (regulation 4). The text requires the Director of Liquor Licensing to take all reasonable steps to post, and keep posted while the area remains restricted, notices at each place where a customary access route enters the Weymul area that describe the offences in regulation 6(1) and specify the penalties for those offences (regulation 5(1)). The regulations state that non‑compliance with the posting requirement does not invalidate the declaration (regulation 5(2)). The offence provision makes it an offence to bring liquor into, or cause liquor to be brought into, the Weymul area, or to possess liquor in the Weymul area, with a general penalty of $2,000 and an elevated penalty of $5,000 where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence (regulation 6). Regulation 7 authorises a member of the Police Force, despite sections 155(4) and (5) of the Act, to seize and dispose as soon as is practicable any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 6(1).
