Liquor Control (Warralong Restricted Area) Regulations 2013

The instrument rests on a small set of interlocking legal concepts established inside the regulations and by reference to the Act. The primary legal device is the statutory declaration of a restricted area under s 175(1a) of the Liquor Control Act 1988, effected by the regulation-making power and implemented here by regulation 5. The declaration converts a geographically defined patch of land into a zone in which specified conduct regarding liquor is criminalised by the regulations (regulation 5 and regulation 7).

Key defined terms in the regulations do substantial legal work:

• Warralong Aboriginal Community: defined by (a) a 20 km radius circle measured from a fixed point, the Warralong basketball court, using GDA2020 coordinates; (b) land lying within 15 metres of the centreline of that part of Goldsworthy Road which runs between Marble Bar Road and the circle; and (c) land lying within 1 kilometre either side of the centreline of that part of Goldsworthy Road that runs between Great Northern Highway and the circle (regulation 3). The definition therefore combines a circular buffer and linear corridor bands along named road segments.
• Exempt person: the driver of, or a passenger in, a transiting vehicle (regulation 7(2)).
• Transiting vehicle: defined as a vehicle that transits the Warralong Aboriginal Community on a public road without stopping and without discharging any person or item (regulation 7(2)).

The principal prohibitions are set out in regulation 7(1): bringing liquor into the defined area or having liquor in one’s possession there is an offence unless the person is an exempt person. The regulation establishes a two-tier penalty regime tied to the offender’s status: if the offence is "committed by a licensee, a manager of licensed premises or a director of a body corporate that holds a licence", the fine is $5,000; in any other case, the fine is $2,000 (regulation 7(1) penalty).

Enforcement features include:

• A statutory duty on the Director of Liquor Licensing to take all reasonable steps to have notices posted at customary access points that state the offences and penalties (regulation 6(1)), subject to the express non-invalidating clause that failure to post does not invalidate the declaration (regulation 6(2)).
• Expanded police powers to seize and dispose of containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7, notwithstanding specified provisions of the Act (regulation 8). The regulation expressly covers both opened and unopened containers and requires disposal "as soon as is practicable" (regulation 8).

Temporal limitation is a built-in concept: the regulations operate until 31 October 2027 unless repealed earlier (regulation 9). The compilation table and amendment notes show that the regulations have been amended several times since first made in 2013, including insertion and amendment of the expiry provision (Other notes; compilation table).

A number of drafting features matter for interpretation and practical effect. The exemption for a "transiting vehicle" is purely functional, based on behaviour during transit (no stopping, no discharging), rather than the purpose for which the vehicle is used. The posting requirement uses the phrase "customary access route", which the regulations do not define; practical application therefore requires locating those places where such routes enter the community for signage placement (regulation 6(1)). The police seizure power is expressed to operate "despite section 155(4) and (5) of the Act", which signals that the regulation modifies or qualifies the operation of those subsections of the Act in relation to this restricted area (regulation 8).

The regulations identify a compact set of actors who have duties, protections or exposure to penalty.

Primary private persons affected

• Residents and visitors within the geographic area defined as the Warralong Aboriginal Community are directly affected because possession of liquor in that area is an offence unless the person is an exempt person (regulation 7(1)).
• Persons who bring liquor into the Warralong Aboriginal Community commit an offence unless they fall within the exemption (regulation 7(1)).
• Drivers and passengers of vehicles that are transiting the area are expressly exempt, only while the vehicle is transiting and provided the vehicle does not stop or discharge persons or items (regulation 7(2)).

Licence-related persons and businesses

• A licensee, a manager of licensed premises or a director of a body corporate that holds a licence face a higher statutory fine if the offence is "committed by" them,a $5,000 fine, compared with $2,000 in other cases (regulation 7(1) penalty). The regulations therefore create a higher exposure for persons connected with liquor-licensed businesses.
• Licensed premises physically located outside the area but whose staff, managers or directors cause liquor to be brought into the restricted area could be exposed if the facts fall within the statutory wording. The regulations use the wording "committed by a licensee, a manager of licensed premises or a director of a body corporate that holds a licence", creating liability in those specified roles (regulation 7(1)).

Administrative and enforcement actors

• The Director of Liquor Licensing is given a statutory duty to take all reasonable steps to cause and maintain the posting of notices at customary access routes into the community, describing the offences and specifying penalties (regulation 6(1)). The Director therefore bears an administrative duty to create public notice of the prohibition.
• Members of the Police Force have a specific power to seize and dispose of opened or unopened containers of liquor suspected on reasonable grounds to be the subject of an offence under the regulation, with the disposal to be effected as soon as practicable (regulation 8). Police officers therefore have frontline enforcement responsibility and discretionary power to seize and remove containers.

Who is not covered or is only partly covered

• The exemption for "exempt person" is framed narrowly to the driver or passenger of a transiting vehicle (regulation 7(2)). The regulations do not define other classes of potential exemptions, such as authorised suppliers for medical or ceremonial reasons; such categories are not present in the text.
• A vehicle that stops or discharges any person or item while within the area ceases to be a "transiting vehicle" for the purposes of the exemption and thus those occupants would lose the exemption once stopping or discharging occurs (regulation 7(2)).

Geographic scope and its effects

• The defined area combines a 20 km radius circle from a specified GDA2020 coordinate at the Warralong basketball court and bands along Goldsworthy Road where proximity to the centreline is specified in metres or kilometres (regulation 3). People and businesses whose routes intersect these defined bands or whose premises fall within the circle are within the ambit of the prohibitions.

Who pays and who decides

• Offenders pay the fines specified in regulation 7(1). The Director of Liquor Licensing is required to post notices; police decide on seizure and disposal based on reasonable grounds (regulations 6 and 8). The regulation itself, via regulation 5, performs the declaration; it is a legislative instrument enacted under the enabling Act and the regulation-making power.

Duties imposed by the regulations

• Duty not to bring liquor into the Warralong Aboriginal Community and duty not to have liquor in one’s possession while in the Warralong Aboriginal Community, unless one is an "exempt person" as defined (regulation 7(1)).
• Duty on the Director of Liquor Licensing to "take all reasonable steps to cause to be posted and, while the Warralong Aboriginal Community continues to be a restricted area by operation of regulation 5, to be kept posted at each place where a customary access route enters the Warralong Aboriginal Community a notice" that describes the offences in regulation 7 and specifies the penalties (regulation 6(1)). The obligation is to take all reasonable steps; the precise content and form of such steps is not prescribed beyond what the notice must describe (regulation 6(1)).
• Obligation on transiting vehicle drivers and passengers not to stop or discharge persons or items if they intend to rely on the exemption (regulation 7(2)).

Powers conferred and enforcement mechanisms

• Power for a member of the Police Force to seize and, as soon as is practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The regulation expressly operates "despite section 155(4) and (5) of the Act", indicating that this regulation alters or overrides the application of those subsections in this context (regulation 8).
• Statutory monetary penalties for contraventions as defined in regulation 7(1), with a higher monetary figure applying where the offence is committed by a licensee, manager or director (regulation 7(1) penalty).

Rights and protective features in the text

• The exemption concept is a right to possession/transport during transit, but it is conditional and functional: it applies only to drivers or passengers in a transiting vehicle and only while the vehicle is passing through without stopping or discharging (regulation 7(2)).
• A procedural protection-like feature is the express statement that failure to comply with the Director’s posting obligation does not invalidate the declaration (regulation 6(2)). That clause secures continuity of the restricted-area status regardless of whether notices are posted at one or more customary access routes.
• The seizure power is qualified by the evidentiary threshold "suspected on reasonable grounds" (regulation 8). The regulation therefore ties the power to an objective standard for suspicion.

Temporal duties and limits

• The obligations and rights created by the regulations are time-limited by regulation 9: the instrument has effect until the close of 31 October 2027 unless sooner repealed. This creates an administrative time horizon for compliance duties and enforcement activities (regulation 9).

Administrative discretion and gaps

• The regulations leave room for administrative or police discretion in a number of respects: what steps are "reasonable" for the Director to take to post notices; where exactly "customary access routes" enter the community for the purposes of posting; police determinations of "reasonable grounds" for seizure; and what constitutes "as soon as is practicable" for disposal after seizure (regulations 6(1), 6(2), 8). These are textual features that allocate discretion rather than prescribe detailed procedures.

Statutory penalties

• The criminal offence created by regulation 7(1) carries a differentiated monetary penalty depending on the actor. If the offence is "committed by a licensee, a manager of licensed premises or a director of a body corporate that holds a licence", the fine is $5,000. In any other case the fine is $2,000 (regulation 7(1) penalty).
• The text is categorical about the scale of fines; it does not provide for imprisonment, remedial orders, or further civil remedies within the regulations themselves.

Police enforcement powers and limitations

• Regulation 8 gives members of the Police Force the authority to seize and dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The power applies "despite section 155(4) and (5) of the Act", indicating that the regulation overrides or qualifies those subsections in relation to this restricted area (regulation 8).
• The seizure power is tied to the "reasonable grounds" standard. The regulation does not elaborate procedural steps such as receipts, evidence preservation, or notice to the owner following seizure. It does, however, impose a timing expectation: the seized container is to be disposed of "as soon as is practicable" (regulation 8). That phrase creates an operational urgency for disposal following seizure.

Practical enforcement mechanics

• The regulations cover both opened and unopened containers, making no distinction in the seizure and disposal power between sealed and unsealed bottles, cans or other receptacles (regulation 8).
• Police officers are empowered to effect disposal; the regulations do not require additional authorisation or a court order before disposal in the restricted area context, because the regulation operates notwithstanding the referenced subsections of the Act (regulation 8).
• The posting requirement in regulation 6(1) is intended to provide notice to persons approaching along customary access routes. However regulation 6(2) closes off a procedural avenue for invalidating the restricted-area declaration on the ground that notices were not posted. In short, failure to post does not invalidate the declaration, while the Director nonetheless has a statutory duty to take reasonable steps to post and maintain notices (regulation 6).

Risk allocation and enforcement outcomes

• The fine differential allocates greater financial exposure to those connected with the liquor industry and persons in specified managerial roles (regulation 7(1) penalty). That differential explicitly targets licence holders and managerial directors for a higher penalty when they commit the listed offences.
• The police discretion to seize and dispose quickly is an enforcement tool that can reduce the likelihood that seized liquor will remain in evidence or require storage. The absence of textual procedural requirements for post-seizure notice or retention in the regulations may accelerate disposal operations in practice (regulation 8).

Who pays, who enforces

• The person who breaches the prohibition pays the fine specified by regulation 7. The Director of Liquor Licensing is responsible for posting notices and police carry enforcement responsibility for seizure and disposal (regulations 6 and 8).

Operational and compliance implications for regulated actors

• Licensees, managers and directors face a higher monetary penalty and therefore may have an incentive to adopt systems to prevent company property or staff from bringing or possessing liquor in the restricted area. The regulations do not specify corporate vicarious liability rules, but the statutory text expressly names those roles as subject to the higher penalty if they commit the offence (regulation 7(1)).

Express references to the Liquor Control Act 1988

• The regulations are made under and operate with reference to the Liquor Control Act 1988. They declare an area to be a "restricted area" for the purposes of section 175(1a) of the Act (regulation 5). The regulations therefore function as a delegated legislative instrument that activates particular statutory mechanisms in the primary Act.
• Regulation 8 operates "despite section 155(4) and (5) of the Act" in giving police seizure and disposal powers over containers of liquor suspected to be the subject of an offence under regulation 7 (regulation 8). The text therefore expressly carves out an exception or modification to the operation of those subsections within the geographic ambit of the regulation.

Scope of interaction evident in the text without importing outside material

• The regulations do not restate the full content of the referenced sections of the Act. They rely on the statutory framework of the Act and modify aspects of enforcement (seizure and disposal) and designation (restricted area) by regulation. The treatment of those specific statutory references indicates that the regulations are intended to work together with the Act to create a place-based prohibition and enforcement regime.

Administrative-law implications

• The Director of Liquor Licensing is an actor created by the Act and is given a duty under the regulations to take reasonable steps to post notices (regulation 6). The regulations thus place an administrative duty on an office that exists under the Act, binding the Director to an operational role in the implementation of the restricted-area regime.
• The police powers in regulation 8 invoke the "reasonable grounds" standard for suspicion. That standard is an ordinary administrative-law evidentiary threshold, but the regulations do not add procedural safeguards beyond the reasonable grounds formulation.

Interaction with licensing law and corporate exposure

• By naming "a licensee, a manager of licensed premises or a director of a body corporate that holds a licence" in the penalty clause, the regulations create direct offence-based exposure for persons and corporate office-holders who are part of the regulated licensing framework under the Act (regulation 7(1)). The regulations therefore intersect with licensing obligations and the regulatory status of persons who hold or operate under licences issued under the Act.

Temporal and repeal interactions

• Regulation 9 fixes an expiry date for the regulations (31 October 2027) unless the regulations are repealed earlier. That expiry mechanism interacts with any review or renewal processes under the Act or regulation-making power, requiring administrative attention as the expiry approaches if continued effect is intended (regulation 9).

Limitations on applying other law not stated

• The regulations do not purport to exclude or limit other criminal, civil, or administrative law obligations beyond the specific references to the Act. They do not, for example, specify interaction with road traffic or health legislation; any such interactions would arise under those regimes and are not addressed in the text of these regulations.

The regulations have an amendment history recorded in the compilation table and notes appended to the instrument. The essential points from the compilation table and the embedded amendment notes are as follows.

Original instrument

• Liquor Control (Warralong Restricted Area) Regulations 2013 were published in the Western Australian Government Gazette on 20 September 2013 (p. 4360‑1) (Compilation table). Regulations 1 and 2 commenced on 20 September 2013, and the remainder of the regulations commenced the following day, 21 September 2013 (regulation 2).

Amendments and insertions

• 2016 Amendment: Liquor Control (Warralong Restricted Area) Amendment Regulations 2016 were published in the Gazette on 16 September 2016 (p. 3942-3). The compilation table records commencement of regulations 1 and 2 on 16 September 2016 and the other regulations on 17 September 2016 (Compilation table). The body text notes that regulation 3 was amended (see regulation 3 amended: Gazette 16 Sep 2016 p. 3942), and that regulation 4 was deleted (see note "[4. Deleted: Gazette 16 Sep 2016 p. 3942]"). Additionally, regulation 9 was inserted in the 2016 amendments (regulation 9 inserted: Gazette 16 Sep 2016 p. 3943).
• 2019 Amendment: Liquor Control (Warralong Restricted Area) Amendment Regulations 2019 were published in the Gazette on 9 August 2019 (p. 3025). The compilation table records commencement of regulations 1 and 2 on 9 August 2019 and the other regulations on 10 August 2019. Regulation 9 was amended by this instrument (regulation 9 amended: Gazette 9 Aug 2019 p. 3025).
• 2022 Amendment: Racing and Gaming Regulations Amendment (Liquor Control) Regulations (No. 3) 2022, Part 4, published as SL 2022/158 and commenced on 10 September 2022 (Compilation table). The text of regulation 3 notes it was amended by SL 2022/158 r. 11, and regulation 9 was amended by SL 2022/158 r. 12 (regulation 3 amended: SL 2022/158 r. 11; regulation 9 amended: SL 2022/158 r. 12).

Other notable drafting history details

• Regulation 4 was deleted in the 2016 amendment (note "[4. Deleted: Gazette 16 Sep 2016 p. 3942]"). The compilation table and notes record the multiple amendments and the dates on which those amendments took effect.
• The insertion and later amendment of regulation 9 show that the regulators set a sunset date and have adjusted that date by later instruments (regulation 9 inserted: Gazette 16 Sep 2016 p. 3943; regulation 9 amended: Gazette 9 Aug 2019 p. 3025; SL 2022/158 r. 12). As currently recorded in the compilation, the regulations expire at the close of 31 October 2027 unless sooner repealed (Other notes; regulation 9).

Practical consequence of amendment history

• Anyone relying on the regulations for operational or compliance purposes should use the consolidated text and the compilation table to ensure they are applying the current boundaries, definitions and expiry. The amendments have materially engaged with the geographic definition (regulation 3) and the temporal limit (regulation 9), so historic versions of the instrument may differ from the present text in these respects (compilation table; Other notes).

The compiled instrument and its accompanying notes do not record any judicial decisions, appeals or litigation concerning these regulations. The document supplied is a consolidation of the Liquor Control (Warralong Restricted Area) Regulations 2013 with its published amendments and compilation notes; it contains no references to court cases or judicial determinations.

What the source does and does not show

• The compilation table and "Other notes" section record the regulatory amendments and expiry details; they do not list any cases, judicial summaries, or litigated interpretations of the regulations (compilation table; Other notes).
• Because the source text supplied is a statutory compilation and not a case law database or annotated statute with reporter references, it does not record litigation history. The absence of cases in this document does not necessarily mean no litigation has occurred; it means the instrument as compiled here does not include any litigation annotations or references.

Implication for practitioners

• Practising lawyers, compliance officers and researchers seeking to know whether these regulations have been the subject of judicial scrutiny must consult legal databases, court records or other secondary sources beyond this statutory compilation. The statutory text itself gives no litigation history or recorded judicial interpretation.
• For present purposes, any interpretive disputes over terms such as "customary access route", "reasonable grounds" for seizure, "as soon as is practicable", and the scope of the exemption for transiting vehicles would have to be checked against case law resources outside the compilation, because the instrument itself contains no adversarial or judicial material bearing on these phrases.

Several drafting and practical features of the regulations can produce unexpected compliance or enforcement consequences if not carefully attended to.

Precision of geographic definition

• The Warralong Aboriginal Community is defined by a specific centre point and radial and corridor distances (regulation 3). Reliance on precise coordinate data is necessary to determine whether a parcel of land or a vehicle route falls within the restricted area. The coordinates are given in GDA2020 and a practical compliance approach requires mapping the 20 km radius circle and the specified road corridor bands against actual travel routes and property boundaries (regulation 3).
• The definition includes land lying within specified distances "of the centreline" of named road segments. Determining the "centreline" in practical, legal terms may require reference to authoritative road plans or cadastral information to avoid uncertainty as to whether a point lies within the 15 metre or 1 kilometre band (regulation 3).

Narrowness of the exemption and the transactional risk

• The "exempt person" status is narrowly defined as "the driver of, or a passenger in, a transiting vehicle" and "transiting vehicle" is defined by its behaviour , it must not stop or discharge any person or item while transiting the community (regulation 7(2)). That narrow exemption can be lost by a momentary stop or by discharging any item, which can convert otherwise lawful transit into an offence. Practitioners and drivers should be aware that the exemption is conditional and behaviour-dependent.
• The exemption explicitly covers only drivers and passengers of transiting vehicles. Persons who are not in vehicles, or who are in vehicles that stop or discharge, are not within the statutory exemption and therefore risk offending if they have liquor in their possession or bring liquor into the area (regulation 7(1) and 7(2)).

Posting and notice: inability to invalidate declaration

• The Director of Liquor Licensing has a duty to take all reasonable steps to post notices at customary access routes (regulation 6(1)). However regulation 6(2) states that a failure to comply with the posting duty does not invalidate the declaration in regulation 5. That provision removes an administrative challenge that would otherwise be available to contest the legal existence of the restricted area on notice grounds. In practice, inability to rely on the posting obligation to defeat the restricted area status is a critical procedural detail that can surprise those expecting signage non-compliance to be a route to invalidation (regulation 6(2)).

Seizure and disposal powers

• Regulation 8 authorises police to seize and "as soon as is practicable, dispose of" opened or unopened containers of liquor suspected on reasonable grounds to be the subject of an offence. The dispositional language gives police authority to remove the items from circulation quickly. The practical consequence is that seized liquor may be disposed of rather than stored for significant periods, and the regulation does not set out detailed post-seizure procedures such as notice to owner or evidentiary preservation steps (regulation 8).
• The seizure power applies "despite section 155(4) and (5) of the Act". Because the regulation alone records this interaction, parties should not assume that ordinary protections in section 155(4) and (5) will apply in the restricted-area context without checking the Act’s text and any relevant judicial interpretation (regulation 8).

Penalty differential and role-specific exposure

• The higher fine where an offence is "committed by a licensee, a manager of licensed premises or a director of a body corporate that holds a licence" (regulation 7(1)) creates greater financial exposure for those who occupy specified roles in the licensed liquor industry. This may generate internal compliance costs and require explicit policies to prevent staff, corporate officers or licensees from causing liquor to be brought into the area (regulation 7(1) penalty).
• The regulation does not state whether fines for corporate entities are to be applied to the corporate entity as such or to the individual officers named; the wording applies the higher fine "if committed by" those individuals or office-holders, so entities and individuals should consider how their internal risk is allocated (regulation 7(1)).

Ambiguities and administrative discretion

• Terms such as "customary access route", "reasonable grounds", and "as soon as is practicable" are not defined. These are standard open-textured administrative terms that create scope for differing interpretations and, therefore, enforcement discretion (regulations 6(1), 8).
• The Director's obligation is to take "all reasonable steps" to post notices. What counts as reasonable may depend on local conditions and resources. The regulation does not prescribe how many notices, what size, or in what languages signage must be in, leaving practical decisions to the Director's office (regulation 6(1)).

Temporal limits and ongoing review

• The regulations have an explicit expiry date, at the close of 31 October 2027, unless earlier repealed (regulation 9). This creates a hard stop beyond which the statutory prohibitions will lapse unless renewed or reenacted. Organisations and individuals with ongoing compliance obligations must track the expiry and any potential legislative renewal processes (regulation 9).

Practical mapping and operational compliance

• Because the definition relies on a centre point coordinate and specified road segments, businesses and drivers should map the precise boundaries and identify customary access routes to ensure compliance. Failure to do so can result in inadvertent violations given the fine scale of the distances involved (regulation 3).

This section sets out concrete, source-grounded steps for persons and organisations to place in their compliance playbook based on the text of the regulations.

For drivers and passengers

• If you are a driver or passenger transiting the Warralong Aboriginal Community on a public road and you do not stop and do not discharge any person or item, you fall within the "exempt person" definition and are not committing the offence by reason of carriage alone (regulation 7(2)). Ensure that the vehicle does not stop and that no items or persons are disembarked while within the defined area if relying on this exemption.
• If it is necessary to stop, unload, or discharge persons or items while in the area, avoid having liquor in the vehicle or in personal possession while stopped, as the exemption ceases to apply upon stopping or discharging (regulation 7(2)).

For residents, visitors and community members

• Do not bring liquor into the defined Warralong Aboriginal Community or have liquor in your possession there unless you qualify as an "exempt person" under regulation 7(2). The statutory prohibition is absolute in form and carries the monetary penalties set out in regulation 7(1).
• Be aware that police may seize and dispose of containers suspected on reasonable grounds to be the subject of an offence, and that disposal is to be effected "as soon as is practicable" (regulation 8).

For licensees, managers and directors of licensed entities

• The regulations impose higher financial exposure for licence-related actors. If an offence is "committed by a licensee, a manager of licensed premises or a director of a body corporate that holds a licence", the fine is $5,000 rather than $2,000 (regulation 7(1) penalty). Implement internal controls, staff training and written policies to ensure that staff and company vehicles do not bring liquor into the restricted area.
• Consider pre-trip checklists and documentation for company vehicles and contractors that may traverse the area to ensure no liquor is carried or that vehicles are transiting without stopping if carriage is necessary (regulation 7(2)).

For the Director of Liquor Licensing and agency administrators

• The Director must take all reasonable steps to cause notices describing the offences and penalties to be posted at each place where a customary access route enters the community and to ensure notices are kept posted while the area remains a restricted area (regulation 6(1)). Document the steps taken to identify customary access routes, the locations where notices are posted, the content and date of each notice, and any maintenance or replacement activity. The record will evidence that reasonable steps were taken, even though failure to post does not invalidate the declaration (regulation 6(2)).
• Given the undefined term "customary access route", consult with the local community and road authorities to identify and agree the customary routes used to enter the area so that notices are placed in meaningful and legally defensible positions (regulation 6(1)).

For Police and enforcement agencies

• Seizure and disposal must be carried out on "reasonable grounds" that containers are the subject of an offence under regulation 7, and disposal should occur "as soon as is practicable" after seizure (regulation 8). Ensure that operational procedures document the grounds for seizure, any chain-of-custody or record-keeping steps taken before disposal, and the rationale for timing of disposal to the extent practicable.
• Because regulation 8 operates "despite section 155(4) and (5) of the Act", coordinate with legal advisers to confirm any internal policy changes needed to align seizure and disposal procedures with the modified statutory regime (regulation 8).

Mapping and boundary identification

• Use the GDA2020 coordinates provided in regulation 3 to map the 20 km radius circle from the Warralong basketball court centre point and to identify the centreline and the specified corridor bands along Goldsworthy Road. Where necessary, obtain official cadastral, road-centreline and mapping data to confirm whether particular points, routes or properties fall within the defined area (regulation 3).
• Because the definition uses specific distances from centrelines (15 metres and 1 kilometre bands), ensure that survey or mapping processes use the correct datum and measurement methods to avoid inadvertent breaches due to imprecise location data (regulation 3).

Record-keeping and evidence

• Where a person or organisation might need to demonstrate compliance, keep contemporaneous records: vehicle logs, staff briefings, notices posted, maps showing routes traversed, and any correspondence with the Director or police concerning compliance actions. This documentation will be practically useful if enforcement action occurs (regulations 6, 7 and 8).
• Licensees and corporate actors should record internal compliance policies, training records, and any instructions given to employees and contractors about transiting the restricted area. The higher penalty exposure for those roles makes internal documentation a prudent risk-control measure (regulation 7(1)).

Timing and monitoring

• Be aware of the expiry date of the regulations. The current text states that the regulations have effect until the close of 31 October 2027 unless sooner repealed (regulation 9). Track any further amendments or reauthorisations that may alter geographic scope, penalties, or procedural obligations (regulation 9; compilation table).

Legal advice

• Where circumstances are unclear, for example about whether a stop or discharge occurred, whether a route is a "customary access route", or whether an enforcement action is supported by reasonable grounds, obtain legal advice. The regulations contain open-textured standards and conditional exemptions, and factual questions will determine compliance or liability (regulations 6, 7 and 8).

By following the source text in the regulations , mapping boundaries, implementing no-carriage or strict-transit policies, documenting signage and reasonable steps, and ensuring police coordination where seizures occur , regulated actors can align behaviour with the statutory duties and reduce the risk of contravention under the Liquor Control (Warralong Restricted Area) Regulations 2013.
