Liquor Control (Wangkatjungka Restricted Area) Regulations 2008

The regulations operate around a small number of discrete statutory concepts and provisions drawn from both the regulations themselves and their relationship to the Liquor Control Act 1988. The primary concepts in the text are:

• Definition of the declared area: regulation 3 specifies “Wangkatjungka Aboriginal Community” as the area of land the subject of two Crown reserves, each described by lot and deposited plan numbers (regulation 3(a) and (b)). The definition is cadastral in form, naming Crown Reserve 35196 (Lot 11 on Deposited Plan 182543 and Lot 99 on Deposited Plan 194196) and Crown Reserve 26889 (Lot 6 on Deposited Plan 168953, Lot 10 on Deposited Plan 173215 and Lot 44 on Deposited Plan 189358). The definition has been amended; the source notes an amendment entry (Regulation 3 amended: SL 2023/26 r. 14).

• Restricted area declaration: regulation 5 makes an explicit declaration that the defined area is a restricted area “for the purposes of section 175(1a) of the Act.” The regulation therefore operates by invoking the Act’s mechanism for creating restricted areas. The regulations do not restate section 175(1a); they operate by reference to it.

• Criminal prohibitions and penalties: regulation 7 establishes the two core offences: bringing liquor into the area or causing liquor to be brought in, and possessing liquor within the area (regulation 7(1)(a) and (b)). The penalties are specified in the regulation text. The ordinary monetary fine is $2,000, with an elevated fine of $5,000 where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence (regulation 7(2)).

• Notice and signage duty: regulation 6 imposes on the Director of Liquor Licensing a duty to “take all reasonable steps” to post, and while the declaration continues to keep posted, a notice at each place where a customary access route enters the declared area. The notice must describe the offences in regulation 7 and specify the penalties (regulation 6(1)(a) and (b)). The regulation expressly states that failure to comply with the posting obligation does not invalidate the restricted area declaration (regulation 6(2)).

• Seizure and disposal authority: regulation 8 alters the operation of sections 155(4) and 155(5) of the Act by permitting a member of the Police Force to seize and, as soon as practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The text begins “Despite section 155(4) and (5) of the Act,” making this a statutory override of those particular provisions to the extent described.

• Temporal limit: regulation 9 sets a sunset date for the regulations, namely the close of 22 April 2026, unless they are sooner repealed. The compilation table and amendment notes record multiple prior amendments and renewals to that expiry date.

These concepts are technical and interlock: the cadastral definition activates the restricted area declaration under the Act; the declaration creates criminal prohibitions and penalties; the signage duty is required to inform those entering by customary access routes; and the seizure power operationalises removal of contraband. The combination of offence, signage and seizure generates an enforcement regime that places obligations on the Director of Liquor Licensing and grants enforcement powers to police, while creating direct criminal exposure for individuals and increased monetary exposure for persons who hold liquor licences or are managers or directors of licence-holding bodies.

The text identifies three stakeholder groups directly exposed to legal obligations, penalties or operational duties.

• Individuals entering or present within the declared area: regulation 7(1) makes it an offence for a person to bring liquor into, or cause liquor to be brought into, the Wangkatjungka Aboriginal Community, or to have liquor in their possession within the community. That captures natural persons and, if a corporate body is the actor that causes liquor to be brought in, it will similarly be exposed under the offence wording “causes liquor to be brought into.” The ordinary monetary penalty applicable to these persons is $2,000 as specified in regulation 7(1) and the penalty table thereafter.

• Licensees, managers of licensed premises and directors of corporate licence-holders: regulation 7(2) applies an elevated monetary penalty of $5,000 where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence. The regulation therefore draws a distinction by actor status, exposing persons who occupy roles within the liquor licensing framework to higher fines. This targets the commercial supply chain and persons with formal positions connected to licensed premises.

• Administrative and enforcement bodies: the Director of Liquor Licensing has a statutory duty under regulation 6(1) to “take all reasonable steps” to post and keep posted notices at each place where a customary access route enters the declared area. That is a positive administrative obligation on the Director’s office to mark customary entry points with notices describing the offences and penalties. The regulation also records that failure by the Director to comply with that obligation does not invalidate the declaration (regulation 6(2)). The Police Force is explicitly empowered under regulation 8 to seize and dispose of containers of liquor suspected on reasonable grounds to be the subject of a regulation 7 offence, notwithstanding sections 155(4) and (5) of the Act.

Indirectly affected parties include businesses and service providers who might otherwise deliver alcohol into the area, transport operators, and any external suppliers who might be engaged by residents or local organisations to transport alcohol. The regulations’ cadastral specificity (regulation 3) means that persons and businesses must ascertain whether a planned delivery route or activity crosses the defined lots. For the Director and police, the regulations impose operational duties and powers that affect resourcing, signage placement, seizure procedures and disposal logistics within the declared parcels, and that will interact with how customary access routes are identified in practice.

Finally, the temporal limit (regulation 9) affects planning horizons. The regulations have an explicit expiry date, which has been amended multiple times as recorded in the compilation table, so affected parties should monitor whether the restriction is continued, amended or repealed before 22 April 2026.

The regulations set out a small number of specific duties and rights. These are not framed as discretionary policy statements but as concrete legal obligations and authorised acts.

Duties

• Director of Liquor Licensing: The Director must “take all reasonable steps” to post, and to keep posted while the area remains a restricted area, at each place where a customary access route enters the declared area, a notice describing the offences under regulation 7 and specifying their penalties (regulation 6(1)(a) and (b)). The duty is qualified by the reasonableness standard “all reasonable steps,” not by an absolute guarantee. Crucially the regulation also states that non‑compliance with that duty does not invalidate the restricted area declaration (regulation 6(2)). That preserves the legal effect of the declaration even if signage is imperfect.

• Police officers: Under regulation 8 a member of the Police Force may seize and, as soon as is practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The power is expressed to operate “despite section 155(4) and (5) of the Act,” signalling that the regulation authorises disposal where those subsections might otherwise limit disposal.

Prohibitions and criminal duties

• Everyone entering the declared area: It is an offence to bring liquor into, or cause liquor to be brought into, the declared area, or to have liquor in one’s possession within it (regulation 7(1)(a) and (b)). The obligation is negative: refrain from bringing or possessing liquor in the area.

Rights and qualifications

• Liability differentiation by actor: where the offender is a licensee, a manager of licensed premises or a director of a corporate licence-holder, the fine is $5,000, higher than the $2,000 fine applicable otherwise (regulation 7(2)). The regulation therefore creates a distinct legal consequence based on occupational or corporate role.

• Non-invalidity clause: regulation 6(2) explicitly preserves the restricted area declaration even if the Director’s signage duty is not met. That is a right-of-state clause safeguarding the legal status of the restriction against procedural failure in posting.

• Temporal right to repeal or expiry: regulation 9 creates a built‑in time limit, establishing that the regulations will cease to have effect at the close of 22 April 2026 unless sooner repealed. That provides a temporal boundary to the duties and liabilities imposed.

Operational implications of these duties and rights

• The “take all reasonable steps” formula allocates the burden of physical notice placement to the Director but does not make the legal operation contingent on perfect signage.

• Police disposal authority, coupled with an obligation to act “as soon as is practicable,” shifts the enforcement approach toward prompt removal of suspected liquor containers, rather than retention pending later processes. The text does not specify disposal procedures, record keeping or appeal paths in the regulations themselves.

• The distinction in fines creates a statutory incentive for licensees, managers and corporate directors to avoid involvement in activities that could give rise to offences in the declared area.

All of the duties, rights and penalties flow from the regulations’ operation in tandem with the Act by specific reference, for example the declaration “for the purposes of section 175(1a) of the Act” (regulation 5) and the override “despite section 155(4) and (5) of the Act” (regulation 8).

The instrument specifies monetary penalties and confers seizure and disposal powers on police. It does not add alternative punishments such as imprisonment, nor does it provide detailed procedural rules in the text for prosecution or disposal. The key enforcement and penalty elements are:

• Monetary fines: Regulation 7 sets the penalty structure. A person who brings liquor into, causes liquor to be brought into, or possesses liquor in the Wangkatjungka Aboriginal Community commits an offence. The penalties are tiered: a $5,000 fine applies where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence; otherwise the fine is $2,000 (regulation 7(1) and (2)). The regulation does not specify whether these amounts are maximums or fixed fines; the regulation simply lists the penalty amounts beside the offence description.

• Enforcement powers: Regulation 8 authorises police to seize and dispose of containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7, notwithstanding sections 155(4) and 155(5) of the Act. The power is exercised “as soon as is practicable.” The regulation uses the term “member of the Police Force,” placing operational responsibility on police officers to take action where reasonable grounds exist to suspect an offence.

• Interaction with Act provisions: Regulation 8 expressly operates “despite section 155(4) and (5) of the Act.” The regulations therefore alter or qualify the default operation of those Act subsections within the context of this declared area. The regulation text does not reproduce sections 155(4) and (5), it simply records that the police disposal power is authorised notwithstanding their terms.

• Signage and ascertainment: Regulation 6 imposes a posting duty on the Director of Liquor Licensing to inform persons entering the declared area of the offences and penalties. The duty is a practical enabler of enforcement; it aids legal notice and public awareness of the offences. Regulation 6(2) limits the effect of any failure in posting on the legal validity of the declaration.

• Procedural gaps left to other law and practice: The regulations do not themselves specify enforcement procedure for prosecutions, evidentiary requirements beyond “reasonable grounds” for seizure, record keeping for disposals, or a recovery process for seized liquor. Those matters would be governed by the Act, police practice and prosecutorial policy, and any relevant general criminal and civil procedural law, none of which are reproduced in these regulations.

Who pays and who acts

• Payment of fines will fall on offenders as prescribed: $2,000 for most persons and $5,000 for licensees, managers and directors (regulation 7(2)). The police act as the primary on‑the‑ground enforcers for seizure and disposal (regulation 8). The Director of Liquor Licensing bears the administrative burden of posting and keeping signage at customary entry points (regulation 6(1)).

The regulations therefore create a relatively simple enforcement architecture: criminal offence plus monetary fines, with police authorised to seize and dispose of contraband containers promptly, and administrative responsibility for signage allocated to the Director.

The regulations are framed to operate in direct relation to the Liquor Control Act 1988 by specific cross‑references, and they also interface indirectly with cadastral and administrative law concepts.

Direct statutory references

• Section 175(1a) of the Act: Regulation 5 declares the Wangkatjungka Aboriginal Community to be a restricted area “for the purposes of section 175(1a) of the Act.” That locates the regulations within the Act’s framework for restricted areas. The regulations do not restate the content of section 175(1a) but rely on it as the legal mechanism under which restricted area declarations operate.

• Section 155(4) and (5) of the Act: Regulation 8 begins with “Despite section 155(4) and (5) of the Act,” and then authorises police to seize and dispose of containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. That phrasing demonstrates that the regulations are intended to modify or override the application of those particular subsections of the Act insofar as they might otherwise constrain police disposal powers in this declared area.

Administrative and cadastral interaction

• Cadastral definition: Regulation 3 defines the community by reference to Crown reserves and lot numbers. That means the regulations interact operationally with land title and cadastral records. Determination of whether a particular location falls within the declared area will require reference to deposited plans and lot identifiers noted in regulation 3. The regulation has been amended (Regulation 3 amended: SL 2023/26 r. 14), showing that the cadastral description can be altered by later regulations.

• Director of Liquor Licensing duties vs statutory immunity: Regulation 6 imposes a signage duty on the Director but also states that failure to comply with the duty does not invalidate the declaration (regulation 6(2)). This creates an interplay between administrative process (posting notices) and legal effect (the declaration remains in force regardless).

Criminal prosecution and police procedure

• The regulations create offences and penalties (regulation 7) but do not set out the prosecutorial process or evidentiary standards beyond “reasonable grounds” for seizure in regulation 8. Thus enforcement and adjudication will proceed under the Act and the general criminal procedure framework. The regulations interact with those broader processes without duplicating them.

Temporal interaction and statutory lifecycle

• Regulation 9 establishes a sunset date (22 April 2026) unless sooner repealed. The compilation table records repeated amendments and renewals to that expiry date (see the compilation table and amendment notes). That shows that continuance of the regulation depends on further legislative action. The temporal limit interacts with other laws and administrative planning because the status of the restricted area may change at expiry or upon repeal.

Absence of other statutory modifications

• Beyond the two explicit cross‑references to sections of the Act, the regulations do not purport to amend other statutes or to create additional statutory exceptions outside the scope described. The practical operation will therefore depend on reading these regulations together with the Act and, as relevant, with police operational policies for seizure and disposal, cadastral records for the defined area, and general criminal law for prosecution of offences created by regulation 7.

The regulations have been subject to multiple amendments and renewals. The compiled text and the compilation table record the instrument’s legislative history as contained in the source. Key entries are:

• Original instrument: Liquor Control (Wangkatjungka Restricted Area) Regulations 2008, published 22 April 2008. Regulations 1 and 2 commenced 22 April 2008 and the substantive regulations commenced 23 April 2008 (see regulation 2 and the compilation table).

• Amendment Regulations and renewals: The compilation table records successive amendments and republishes with varied commencement dates. Notable entries include amendment instruments published in 2009 (21 April 2009; substantive parts from 22 April 2009), 2010 (20 April 2010; substantive parts from 21 April 2010), 2013 (19 April 2013; substantive parts from 20 April 2013), and 2016 (4 March 2016; substantive parts from 5 March 2016). Each of these items is listed in the compilation table with Gazette references.

• 2019 and 2022-2025 amendments: The compilation table records further amendments contained within the Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2019 (published 22 March 2019), the Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2022 (SL 2022/38, published 25 March 2022), the Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2023 (SL 2023/26, published 6 April 2023), the Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2024 (SL 2024/13, published 21 February 2024), and the 2025 regulations (SL 2025/54, published 16 April 2025). The compilation table records commencement dates for the substantive provisions as the day after Gazette publication for each instrument, consistent with regulation 2(b).

• Specific amendments recorded in the text: Regulation 3 includes a marginal note that it was amended (Regulation 3 amended: SL 2023/26 r. 14). Regulation 4 is noted as deleted by SL 2022/38 r. 7. Regulation 9 shows a long list of amendment entries in square brackets indicating the various times its content has been altered (Gazette 21 Apr 2009 p. 1370; 20 Apr 2010 p. 1513; 19 Apr 2013 p. 1569; 4 Mar 2016 p. 629; 22 Mar 2019 p. 860; SL 2022/38 r. 8; SL 2023/26 r. 15; SL 2024/13 r. 6; SL 2025/54 r. 8).

• Expiry and re‑instrumentation pattern: The notes state that “These regulations expire 22 April 2026 (see r. 9).” The compilation table’s multiple entries for the regulation across several years, together with the amendments to regulation 9, show the instrument has been periodically renewed or updated, with its expiry extended or re‑set on successive occasions.

• Publication and commencement pattern: Regulation 2 establishes the commencement mechanism used across amendments: regulations 1 and 2 commence on the day of Gazette publication, and the rest of the regulations operate from the day after. The compilation table reproduces this pattern for each amendment instrument.

This amendment history, as recorded in the source, shows that the regulations have been maintained and revised through successive statutory instruments and continue to be subject to amendment up to and including an SL entry in 2025.

The compiled text of the Liquor Control (Wangkatjungka Restricted Area) Regulations 2008 in the source includes no recorded litigation history, case citations, or judicial decisions related to these regulations. The text lists the regulations, their contents, compilation table and amendment history, but contains no references to court challenges, appeals, or judicial consideration of the regulations themselves.

Because the regulations create criminal offences and authorise seizure and disposal by police (regulations 7 and 8), they potentially give rise to enforcement action that could be litigated in the courts, but the source does not record any such proceedings. The text does not identify any decisions interpreting the regulations, section 175(1a) of the Act, or the interaction with section 155(4) and (5) of the Act in the context of these regulations.

In short, the document before you provides the regulatory text, amendments and expiry data but nothing in it reports or summarises litigation concerning these regulations. Any reported decisions, prosecutions, or judicial review proceedings would need to be sought in case law databases or court records outside the text of these regulations, because they are not included in the instrument’s compilation as provided.

The regulations appear straightforward on their face but the text contains several features that create practical pitfalls for those responsible for compliance, enforcement or legal advice.

• Cadastral precision matters: The declared area is defined by Crown Reserve numbers and lot/deposited plan identifiers (regulation 3). Parties must consult current cadastral maps and deposited plans to determine whether a location falls within the declared area. A mistaken belief about geographical boundaries is not addressed in the text. The regulation’s reliance on lot and deposited plan references means that small errors in mapping or misreading plan numbers can be determinative.

• Signage duty is qualified and non‑dispositive: The Director of Liquor Licensing is required to “take all reasonable steps” to post notices at customary access routes (regulation 6(1)). However regulation 6(2) states that a failure to comply with the posting requirement does not invalidate the declaration. That means that lack of effective signage will not itself provide a legal defence to the offences in regulation 7, even though signage is the statutory mechanism for informing entrants. Advisers should note that the posting duty is a standard of reasonableness rather than absolute performance, and its non‑invalidity clause may limit procedural defences.

• Elevated fines for licence‑connected actors: Regulation 7(2) elevates the fine to $5,000 where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence. That creates a particular compliance risk for persons in those roles, and it also creates ambiguity for organisations about which individuals within the organisation could attract the elevated fine. The regulation does not set out joint and several liability rules or corporate penalties beyond the specific naming of actors.

• Police disposal power subject to “reasonable grounds” and “as soon as is practicable”: Regulation 8 empowers police to seize and dispose of containers “suspected on reasonable grounds” to be the subject of an offence under regulation 7, and to dispose of them “as soon as is practicable.” The text does not prescribe procedures for notices about disposals, retention periods, recordkeeping, or appeals. That raises practical questions about evidence preservation and return claims that are not answered by the regulations themselves.

• Interaction with the Act left implicit: The regulations operate “for the purposes of section 175(1a)” and “despite section 155(4) and (5) of the Act” (regulations 5 and 8). The text does not reproduce those Act provisions. Advisers must therefore read those sections in the Act to understand the full scope and any limits of the delegated powers and the statutory framework within which these regulations operate.

• Time‑limited nature: The regulations expire at the close of 22 April 2026 unless sooner repealed (regulation 9). The instrument has a history of amendments and reissue as shown in the compilation table. Parties should not assume permanence and should check whether the restriction has been extended, amended, or repealed near the expiry date.

• No procedural detail for prosecutions and disposals: The regulations create offences and authorise seizure and disposal but do not set out the prosecutorial process, evidentiary thresholds for proving possession or causation, or protocols for disposal. That procedural silence means that many enforcement details will be governed by the Act, general criminal law, police practice and prosecutorial discretion rather than by the regulation text.

• “Customary access route” undefined in the text: Regulation 6 requires posting at each place where a “customary access route” enters the declared area. The regulations do not define “customary access route.” That could create disputes about where notices must be placed and whether the Director’s steps were reasonable in any particular set of circumstances.

These features create areas where practical implementation and legal strategy will need careful attention, including precise mapping, documentation of signage efforts, internal compliance policies for licence‑holders and their managers, preserving evidence in enforcement contexts, and checking the Act for complementary or overriding provisions.

Compliance under these regulations is straightforward in principle but requires attention to geographic boundaries, operational practices, record keeping and coordination between administrative and enforcement actors. The following practical steps follow directly from the provisions.

For individuals and community residents

• Do not bring liquor into the declared area, and do not have liquor in your possession while in the area, unless and until the regulations are repealed or the prohibition is lawfully lifted (regulation 7(1)). The penalty for ordinary persons is $2,000 (regulation 7).

• If you are unsure whether a location lies within the declared area, consult cadastral records for the Crown reserves and lot/deposited plan numbers listed in regulation 3 or seek legal advice. The regulation’s definition is by lot and deposited plan identifiers (regulation 3).

For licensees, managers and directors

• Avoid transporting or authorising the transport of liquor into the declared area. Regulation 7(2) applies an elevated fine of $5,000 where the offender is a licensee, a manager of licensed premises, or a director of a corporate licence‑holder. Internal compliance policies and staff training should explicitly prohibit any activity that would cause liquor to be brought into the listed lots.

• Maintain records showing proof of instructions and steps taken to prevent deliveries or supplies to the declared area to evidence internal compliance in case of enforcement action.

For the Director of Liquor Licensing and administrative staff

• Take all reasonable steps to post and keep posted a notice at each place where a customary access route enters the declared area that describes the offences in regulation 7 and specifies their penalties (regulation 6(1)(a) and (b)). Document the locations identified as customary access routes, the steps taken to post notices, dates of posting, the content of notices and any maintenance or replacement actions to demonstrate the exercise of the “all reasonable steps” standard.

• Although failure to post does not invalidate the declaration (regulation 6(2)), administrative best practice recommends comprehensive documentation to reduce operational risk and to assist public awareness.

For police and enforcement personnel

• Exercise the seizure and disposal power under regulation 8 where a container of liquor is suspected on reasonable grounds to be the subject of a regulation 7 offence. The regulation authorises seizure and disposal “as soon as is practicable.” Maintain records of reasonable grounds for seizure, chain of custody, disposal method, the time disposal occurred, and any communications with affected persons.

• Ensure that seizure and disposal operational procedures are consistent with other statutory obligations and with police policies, particularly since regulation 8 operates “despite section 155(4) and (5) of the Act,” and the regulation itself does not provide detailed disposal procedures.

General steps for practitioners advising affected parties

• Check cadastral boundaries: Verify the actual lot and deposited plan boundaries in regulation 3 against current land records to determine whether an address or location is within the declared area.

• Read the Act sections referenced: Obtain and read section 175(1a) and sections 155(4) and (5) of the Liquor Control Act 1988 to understand the statutory framework and to identify any complementary or limiting provisions that affect enforcement or rights. The regulations rely on those provisions and do not repeat them.

• Monitor the instrument’s currency: Regulation 9 sets the expiry at close of 22 April 2026 unless sooner repealed. The compilation table shows a history of renewal and amendment. Practitioners should verify that the restriction remains in force at any relevant time and check the Gazette and SL instruments for amendments.

• Document compliance efforts: For licence-holders and managers, maintain contemporaneous documentation of instructions, training and compliance checks to demonstrate that proactive measures were taken to avoid accidental breaches.

• Consider logistical measures: For transport and delivery businesses, implement geofencing or route checks where GPS systems are used, or add address screening checks on orders to ensure deliveries do not inadvertently enter the defined lots.

• Prepare for seizure and disposal incidents: Advise clients on what to do if police seize containers. Since the regulation authorises disposal “as soon as is practicable,” clients should be prepared to secure evidence before entry into the area where lawful and feasible, and to document interactions with police.

These compliance steps align directly with the duties, prohibitions and enforcement powers spelled out in regulations 3, 5, 6, 7, 8 and 9 of the instrument. They do not assume procedures beyond the regulations and the Act; for procedural or evidentiary questions arising in enforcement or prosecution, consult the Act and relevant prosecutorial and police practice documents.
