Liquor Control (Spinifex Restricted Area) Regulations 2014

The instrument uses a small set of interlocking statutory concepts: Restricted Area, Spinifex Native Title Determination Area, tourist, declaration, notice, offence (bringing in or possessing liquor), defence for tourists, seizure and disposal, and time limitation. These concepts are defined and employed as follows.

Restricted Area is defined by reference to a declared geographic area: the Spinifex Native Title Determination Area excluding a portion within Reserve 17614 (reg 5(1)). The spatial perimeter is set out in Schedule 1, which tracks cadastral and latitude/longitude markers and references deposited plans held by the Western Australian Land Information Authority (Schedule 1 note). Schedule 2 provides a map showing the crosshatched Restricted Area and the Anne Beadell Highway (reg 5(2); reg 8(3); Schedule 2).

Tourist is a multi‑element, conjunctive definition in regulation 3 requiring that the person (a) stays at a place at least 50 kilometres from their usual residence for at least one night, (b) intends to be away for less than 12 months, (c) is not on a regular commute between home and work/education, (d) is travelling for holiday, leisure, business, to visit friends or relatives or other reasons, and (e) is not usually resident in the Restricted Area (reg 3). That definition is central to the availability of the defences in regulation 8, which carve out limited possession or consumption privileges for tourists subject to location and continuous‑possession conditions (reg 8(1)-(2)).

The offence structure is straightforward: bringing liquor into, or having liquor in possession in, the Restricted Area is criminalised with fixed monetary penalties (reg 7(1)). There is a calibrated penalty uplift where the offender is a licensee, a manager of licensed premises or a director of a body corporate that holds a licence, elevating the fine for that offender category to $5,000 (reg 7(2)). The public administration obligation sits with the Director of Liquor Licensing to post notices at each place where a customary access route enters the Restricted Area describing the offences and penalties (reg 6(1)). The regulations expressly protect the legal status of the declaration from procedural failure to post notices by providing that failure to comply with the posting duty does not invalidate the declaration (reg 6(2)).

Enforcement is framed by an explicit, broad power for police to seize and, as soon as practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under the regulations (reg 9). That power is stated to operate despite specified subsections of the Act concerning seizure and disposal (reg 9 referencing section 155(4) and (5) of the Act), which signals a deliberate modification to ordinary seizure/disposal rules within this instrument.

Finally, the instrument is time‑limited: it operates until the close of 2 July 2034 unless repealed sooner (reg 10). The instrument has been amended at multiple points since initial publication; the compilation table lists amendments in 2017, 2020, 2023 and 2024 and shows the staggered commencement structure for those amending instruments.

The regulations impose direct obligations and criminal exposure on a limited set of actors and impose duties on specified public officials. The primary groups affected are:

• All persons who might bring liquor into, or have liquor in possession in, the Restricted Area. For these persons the core legal constraint is the offence in regulation 7(1), with monetary penalties specified in the same provision. The ordinary-person fine is $2,000 (reg 7(1) penalty).

• Licensees, managers of licensed premises and directors of corporate licence‑holders. If any of these persons commit an offence under regulation 7(1), a heavier financial penalty applies: $5,000 (reg 7(2)). The instrument therefore differentiates the cost of non‑compliance by professional or corporate actors involved in the liquor trade.

• Tourists, as specially defined in regulation 3, who may rely on narrowly prescribed defences in regulation 8. The tourist definition is conjunctive and sets objective‑looking thresholds (e.g. at least 50 kilometres from usual residence, stay at least one night, intention to be away for less than 12 months), together with non‑commuter and travel‑purpose conditions (reg 3). Tourists who meet those tests will be able to avoid criminal liability in particular circumstances specified in regulation 8(2): either while within 50 metres either side of the Anne Beadell Highway they may continuously possess or consume liquor; in other parts of the Restricted Area they may continuously possess but not consume liquor (reg 8(2)(a)-(b)). The exceptions require continuous possession (reg 8(2)) and the map in Schedule 2 shows the Anne Beadell Highway for locational calibration (reg 8(3)).

• The Director of Liquor Licensing, who must take "all reasonable steps" to post and keep posted notices at each place where a customary access route enters the Restricted Area setting out the offences and penalties (reg 6(1)). That duty is operational rather than discretionary, but the regulation also provides that failure to comply does not invalidate the declaration (reg 6(2)).

• Members of the Police Force, who are empowered to seize and dispose of containers of liquor suspected on reasonable grounds to be connected with an offence under the regulations (reg 9). The power allows disposal "as soon as is practicable" and is stated to operate notwithstanding specified subsections of the parent Act (reg 9).

• Owners and managers of Reserve 17614 are indirectly affected because the declaration explicitly excludes the portion of the Spinifex Native Title Determination Area that lies within Reserve 17614 (reg 5(1)). Users and occupiers of land adjacent to, or within, that excluded portion will need to account for that spatial carve‑out when deciding whether the regulations apply.

The regulations also affect anyone who needs to determine whether a given place is within the Restricted Area. The instrument supplies Schedule 1 textual boundaries and references deposited plans held by the Western Australian Land Information Authority for cadastral clarification (Schedule 1 note). Schedule 2 contains maps intended to be used in practice to determine whether an activity or possession occurs within the restricted perimeter (reg 5(2)).

Indirect administrative or commercial effects arise for suppliers, tour operators and transporters of liquor who service remote regions traversing or bordering the Restricted Area. They will face compliance choices (avoid delivering into the restricted perimeter; obtain evidence that recipients meet tourist criteria; or route deliveries outside the Restricted Area). The regulations do not create licensing or permitting pathways to bring liquor into the Restricted Area; the instrument instead criminalises the conduct subject to the tourist defences set out in the text (reg 7 and reg 8).

Duties

• Duty on persons not to bring liquor into, or possess liquor in, the Restricted Area, subject to the statutory tourist defences (reg 7(1) and reg 8). This is the primary private duty established by the instrument.

• Heightened liability for certain professional actors: licensees, managers of licensed premises and directors of bodies corporate that hold a licence face a specified higher fine if they commit an offence under regulation 7 (reg 7(2)). The regulation does not create separate offences for those categories; it prescribes a higher penalty where the offender is in one of those categories.

• Duty on the Director of Liquor Licensing to take all reasonable steps to post and maintain notices at each place where a customary access route enters the Restricted Area describing the offences and penalties (reg 6(1)). The phrase "all reasonable steps" sets an objective effort standard for administrative action, but the regulations also insulate the declaration from being invalidated by failure to post (reg 6(2)).

• Duty on police to enforce the law and, under the express authority in these regulations, to seize and dispose of liquor containers suspected on reasonable grounds to be involved in an offence (reg 9). That duty is operational for police exercising their enforcement powers.

Rights, defences and procedural features

• Tourists who meet the definition in regulation 3 and the location/possession/consumption constraints in regulation 8 have a statutory defence to the offence in regulation 7 (reg 8(1)-(2)). The defence is conditional on continuous possession and on whether the tourist is within 50 metres either side of the Anne Beadell Highway or elsewhere in the Restricted Area (reg 8(2)).

• A person has the right to notice of the regulatory scheme in the sense that the Director of Liquor Licensing is required to post notices at customary access routes (reg 6(1)). However, non‑posting does not negate the legal operation of the declaration (reg 6(2)), so the "right" to practical notice is qualified.

• Police are empowered to seize and dispose of containers suspected on reasonable grounds; the instrument uses the standard "suspected on reasonable grounds" qualifier for seizure but then allows disposal "as soon as is practicable" (reg 9). The disposal power operates "despite section 155(4) and (5) of the Act", which in ordinary circumstances might impose additional procedural safeguards or limitations; the regulations therefore create a regime with different practical consequences for handling seized liquor (reg 9).

• Temporal right: the regulations expressly operate only until the close of 2 July 2034 unless sooner repealed (reg 10). That finite term is a legal limit on the instrument’s continuing effect.

Other procedural points

• Commencement is staged; the main operative provisions came into effect the day after publication in the Government Gazette (reg 2). The compilation table evidences subsequent amendments and provides dates for those amending instruments.

• The instrument relies on Schedule 1 and Schedule 2 for spatial precision. Schedule 1 makes express references to deposited plans for cadastral certainty, and Schedule 2 includes maps showing the crosshatched Restricted Area and the Anne Beadell Highway (Schedule 1 note; reg 5(2); reg 8(3)). The law’s operation therefore depends on administrative land records and the map annexures.

Penalty framework

• The regulations prescribe fixed monetary penalties only. For the offence of bringing liquor into, or possessing liquor in, the Restricted Area, the penalty is $2,000 in general (reg 7(1) penalty). If the offender is a licensee, a manager of licensed premises or a director of a corporate liquor‑licence holder, a higher penalty of $5,000 applies (reg 7(2)). The instrument does not provide for imprisonment, community service, licence suspension or other non‑monetary sanctions within its text.

Enforcement powers and processes

• Police enforcement is central. Regulation 9 grants a member of the Police Force the authority to seize and, "as soon as is practicable", dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The seizure power is qualified by the "suspected on reasonable grounds" threshold, which is the evidential predicate for taking property, and the disposal power is immediate in practical effect because disposal is permitted "as soon as is practicable" (reg 9).

• The instrument expressly states that this seizure and disposal power operates "despite section 155(4) and (5) of the Act" (reg 9). That phrase signals that the regulations alter or override the ordinary operation of those provisions of the parent Act within the context of the Restricted Area. Because the text of section 155(4) and (5) of the Act is not reproduced in this instrument, the regulations nonetheless make clear that the seizure/disposal rules here are intended to supplant whatever protections or procedures those subsections otherwise create, at least to the extent of conflict.

• Notice of offences and penalties must be posted at each place where a customary access route enters the Restricted Area; the Director of Liquor Licensing must take all reasonable steps to cause the notices to be posted and to keep them posted while the declaration continues (reg 6(1)). The posting requirement is intended to support enforceability by providing information to travellers and others entering the area, although the regulations also provide that failure to post will not invalidate the declaration (reg 6(2)).

Practical enforcement implications

• The combination of a defined geographic boundary, posted notices at customary access routes and an active police seizure/disposal power creates a regime in which police can remove suspected liquor containers quickly, potentially before charges are laid. The "as soon as is practicable" disposal permission may mean that seized containers are destroyed or removed from evidence tracks sooner than in other contexts.

• Because the regulations authorise disposal despite a referenced parent‑Act provision, defendants and counsel will need to resolve evidentiary consequences where disposals have occurred; the regulations themselves do not set out retention periods or evidentiary rules following disposal.

• The higher penalty for licensees, managers and corporate directors (reg 7(2)) places an elevated compliance cost on persons connected with the licensed trade. Enforcement against corporate actors may therefore produce larger financial sanctions and could affect corporate risk management.

• The tourist defences create operational complexity for enforcement. To apply, a tourist must meet the multi‑part definition in regulation 3 and the continuous possession/consumption conditions in regulation 8. Police will need to assess whether an individual meets both the definitional test and the continuous possession/consumption requirement at the time of encounter; that assessment will determine whether to proceed with a charge, issue an infringement, or rely on other enforcement options.

Interdependence with the Liquor Control Act 1988

• The regulations operate under and for the purposes of the Liquor Control Act 1988. The declaration of the Restricted Area is expressly made "for the purposes of section 175(1a) of the Act" (reg 5(1)). The instrument also invokes and modifies the operation of the Act elsewhere: regulation 9 operates "despite section 155(4) and (5) of the Act". Those cross‑references establish that these regulations are subordinate legislation functioning to implement specific powers and exceptions conferred by the parent Act.

Seizure/disposal interaction

• By stating that reg 9 operates despite s 155(4) and (5) of the Act, the regulations change the default legal regime that would otherwise apply to seizure and disposal of liquor under the Act. The precise effect depends on the content of the referenced subsections in the parent Act, which are not reproduced in this instrument; nonetheless, the regulations explicitly displace them insofar as they would otherwise constrain police seizure and disposal in the Restricted Area. Practically, that means police have enhanced discretion under these regulations to dispose of seized containers as soon as practicable.

Land law and cadastral interaction

• The spatial definitions in Schedule 1 rely on deposited plans held by the Western Australian Land Information Authority under the Land Information Authority Act 2006 (Schedule 1 note). That creates an interdependence between these regulations and cadastral, reserve and land registration systems administered under land law. Determination of whether a parcel, reserve or route falls within the Restricted Area will therefore depend on external land registers and deposited plans.

Administrative law and notice obligations

• The Director of Liquor Licensing’s posting duty is framed as an administrative obligation to take "all reasonable steps." That language imports administrative‑law concepts of reasonableness in carrying out statutory duties. However, the regulation also contains a non‑validation clause: a failure to comply with the posting duty does not invalidate the declaration (reg 6(2)). That clause reduces the scope for procedural‑invalidity challenges to the law’s operation based on notice posting, though other administrative‑law challenges (for example, on the basis of reasonableness of action) are not addressed by the text.

Interaction with native title and reserve regimes

• The Restricted Area is the Spinifex Native Title Determination Area as described in Schedule 1; the declaration expressly excludes the portion within Reserve 17614 (reg 5(1); Schedule 1). The regulation therefore intersects with native title determinations and reserve status. Schedule 1's references to locations and deposited plans indicate that the instrument relies on the cadastral framework and native title mapping outcomes to define the area.

Temporal and amendment interactions

• The regulations are time‑limited, operating until the close of 2 July 2034 unless sooner repealed (reg 10). The compilation table shows amendments made by several later instruments (2017, 2020, 2023, 2024), indicating that the regulations have been adjusted over time. The instrument’s effect therefore depends both on its text and on subsequent amending regulations listed in the compilation table; any later repeals or further amendments enacted before 2 July 2034 would change the interaction with other laws.

Absence of other statutory authorisations

• The regulations do not create a separate permitting or licensing pathway allowing liquor to be brought into the Restricted Area; instead, they criminalise the conduct with limited statutory defences for tourists (reg 7 and reg 8). Any other legal permission to bring liquor in would need to derive from other laws or authorisations, which are not referenced in this instrument.

The compiled instrument and its amendment chronology are set out in the compilation table and in various marginal notes within the regulations. Key amendment markers evident from the source are:

• Initial instrument: Liquor Control (Spinifex Restricted Area) Regulations 2014. Publication date 1 July 2014 with regulations 1 and 2 commencing on the day of Gazette publication and the remainder on 2 July 2014 (compilation table).

• 2017 amendment: Liquor Control (Spinifex Restricted Area) Amendment Regulations 2017, published 2 June 2017, with the same staged commencement pattern (compilation table).

• 2020 amendment: Racing and Gaming Regulations Amendment (Liquor Control) Regulations 2020 (Pt. 7) published SL 2020/62 on 22 May 2020 and commencing 23 May 2020 (compilation table). That amending instrument effected at least two textual edits reported in the marginal notes: regulation 4 was deleted by SL 2020/62 r. 19 and regulation 10 was inserted by SL 2020/62 r. 20 (marginal notes accompanying reg 4 and reg 10). The deletion of reg 4 is recorded in the body of the instrument as "[4. Deleted: SL 2020/62 r. 19.]" and insertion of reg 10 is marked "[Regulation 10 inserted: SL 2020/62 r. 20; amended: SL 2023/78 r. 8; SL 2024/109 r. 7.]" This indicates a substantive change to the instrument’s structure and the creation of the time‑limit provision.

• 2023 amendment: Racing and Gaming Regulations Amendment (Liquor Control) Regulations (No. 3) 2023, SL 2023/78 (Pt. 4), published 20 June 2023 and commencing 21 June 2023 (compilation table). The marginal note to reg 10 records that reg 10 was further amended by SL 2023/78 r. 8.

• 2024 amendment: Racing and Gaming Regulations Amendment (Liquor Control) Regulations (No. 3) 2024, SL 2024/109 (Pt. 3), published 26 June 2024 and commencing 27 June 2024 (compilation table). The marginal notes show several changes effected by the 2024 instrument: regulation 3 was amended (SL 2024/109 r. 6), Schedule 1 received an inserted heading and updated text (Schedule 1 inserted: SL 2024/109 r. 8), and regulation 10 was amended (SL 2024/109 r. 7). The 2024 instrument therefore made definitional and schedule revisions.

Marginal and embedded editorial notes in the instrument identify the points of insertion, deletion and amendment, for example:

• The tourist definition is shown as having been amended: "[Regulation 3 amended: SL 2024/109 r. 6.]" (reg 3). That indicates the current tourist definition reflects the 2024 amendment.

• Schedule 1 is marked as inserted and the heading noted: "[Heading inserted: SL 2024/109 r. 8.]" and "[Schedule 1 inserted: SL 2024/109 r. 8.]" signalling the schedule text was introduced by the 2024 instrument.

• Regulation 10 has a compound marginal note showing it was inserted in 2020 and later amended in 2023 and 2024: "[Regulation 10 inserted: SL 2020/62 r. 20; amended: SL 2023/78 r. 8; SL 2024/109 r. 7.]" (reg 10).

The compilation table consolidates the public notice and commencement data for each amending instrument, listing the 2017, 2020, 2023 and 2024 amendments and their Gazette publication dates and commencements. The notes that the regulations expire at close of 2 July 2034 is recorded both in regulation 10 and in the "Other notes" section summarising expiry (Other notes 1).

Taken together, these amendments show the regulation evolved after initial enactment, including deletion of an early provision (reg 4), insertion and modification of the time limitation, and updates to definitions and the schedule that defines the spatial perimeter. The instrument’s textual marginalia anchor those changes to specific subrules in the amending instruments.

The instrument as presented contains no case citations, judicial decisions, or references to litigation. The text and compilation notes do not record any judicial review, appellate or trial court proceedings concerning these regulations. There are no named cases, judgments, or citations within the body of the regulations or the schedules. Accordingly, based solely on the instrument provided here, there is no recorded litigation history to summarise.

If litigation has occurred, it is not reflected in this compiled text. Users seeking reported judicial treatment of these specific regulations should consult legal databases, court records and published judgments outside of this instrument to ascertain whether any courts have interpreted the definitions, the tourist defences, the seizure/disposal power, the posting obligation, or the interaction with section 155(4) and (5) or section 175(1a) of the Liquor Control Act 1988. The instrument itself does not identify any such cases.

Several drafting and operational features in the instrument create specific compliance and enforcement pitfalls that users should note.

• Tourist definition is conjunctive and detailed. The regulation requires multiple conditions to be satisfied simultaneously (reg 3). All five elements of the tourist definition must be present: a place at least 50 km from usual residence and at least one night’s stay; an intention to be away for less than 12 months; not travelling on a regular journey between home and work/education; travel for one of the listed reasons; and not usually resident in the Restricted Area. Failure to satisfy any one element removes the statutory defence in reg 8. Practically, this requires evidence of distance from usual residence, intended duration and travel purpose, which may be difficult to prove at point of contact with police.

• Continuous possession requirement is strict. Regulation 8(2) requires tourists to "continuously maintain possession" of the liquor to rely on the defence, with a separate consumption allowance only when within 50 metres either side of the Anne Beadell Highway. The instrument does not define "continuously maintain possession", leaving room for factual dispute about what temporary lapses, bag storage or brief handovers mean for the defence. The instrument also does not state whether refrigeration or locked storage in a vehicle counts as continuous possession.

• Location sensitivity. The special consumption allowance applies only within 50 metres either side of the Anne Beadell Highway (reg 8(2)(a)); elsewhere tourists may possess but not consume (reg 8(2)(b)). The spatial delineation is therefore legally significant. Schedule 2 purports to show the highway and crosshatched Restricted Area (reg 5(2); reg 8(3)), but maps can require technical interpretation in the field and the instrument relies on deposited plans for cadastral precision (Schedule 1 note).

• Customary access route is not defined. Regulation 6(1) requires notices to be posted "at each place where a customary access route enters the Restricted Area", but the instrument does not define "customary access route". That term could be open to contest about which tracks or routes qualify, raising practical uncertainty about where notices must be placed and what notice a traveller may have had. The regulation mitigates invalidity risk by providing that failure to post does not invalidate the declaration (reg 6(2)), but the absence of a definition increases ambiguity for both administrators and entrants.

• Disposal of seized containers may remove evidence. Regulation 9 authorises police to dispose of seized containers "as soon as is practicable", and does so "despite section 155(4) and (5) of the Act" (reg 9). Early disposal may mean physical evidence is eliminated before judicial processes progress, which could complicate prosecutions or defense investigations. The regulations do not set out retention periods or evidentiary procedures post‑disposal.

• Higher penalty for industry actors. Licensees, managers and directors face a $5,000 fine if they commit the offence (reg 7(2)), which is materially higher than the ordinary $2,000 fine. The instrument does not explain the rationale or provide graduated sanctions, so those actors must monitor supply chains and staff behaviour to avoid elevated exposure.

• Spatial carve‑out for Reserve 17614. The declaration explicitly excludes the portion of the Spinifex Native Title Determination Area that lies within Reserve 17614 (reg 5(1)). Users should not assume the entire native title determination area is restricted; careful attention to Schedule 1 and deposited plans is required to locate excluded land.

• Time limitation and amendment risk. The regulations expire at close of 2 July 2034 (reg 10). Amendments or repeals prior to expiry could change obligations; conversely, expiry without replacement would remove the restrictions. The compilation table records several amendments since 2014, showing that the instrument has been subject to iterative change. Parties should therefore monitor legislative instruments for further changes.

• Posting failure does not invalidate the declaration. While this avoids procedural voiding of the restriction (reg 6(2)), it also means lack of posted notice is not a safe harbour for entrants who claim ignorance. Offenders remain liable even where notices were not properly posted, although lack of notice may still be relevant in discretionary prosecutorial decisions.

• Interaction with other laws left implicit. The instrument references sections of the parent Act and deposited plans held under land law, but does not reproduce their content. Interpreting seizure/disposal limits or precise land boundaries therefore requires cross‑reference to the parent Act and land records.

For individuals, businesses and public officials seeking operational compliance, the regulations point to concrete steps and evidentiary considerations.

For individuals and tourists

• Avoid bringing liquor into the Restricted Area unless you can demonstrate you are a tourist as defined and meet the continuous possession and location conditions in regulation 8. The tourist definition requires that you be at least 50 kilometres from your usual place of residence for at least one night, intend to be away for less than 12 months, are not a regular commuter, are travelling for an allowed purpose, and are not usually resident in the Restricted Area (reg 3). Keep documentary evidence where possible (travel bookings, itinerary, identification showing usual residence) in case lawful defence needs to be established.

• If relying on the tourist defence, ensure continuous possession of the liquor. Within 50 metres either side of the Anne Beadell Highway consumption is allowed while continuously maintaining possession; elsewhere tourists may possess but must not consume (reg 8(2)). Practically, that suggests keeping liquor in immediate physical control (on the person or in the immediate control of the traveller) and avoiding situations where the liquor is left unattended, transferred to others, or stored in a communal place without supervision.

• Use the Schedule 2 map and Schedule 1 textual boundaries to plan routes. If in doubt about whether a location is within the Restricted Area, avoid bringing liquor or consume/possess only in places demonstrably outside the crosshatched area. The Schedule 1 note points to deposited plans at the Land Information Authority for cadastral precision (Schedule 1 note).

For licensees, managers and corporate directors

• Implement heightened internal compliance procedures given the increased penalty for industry actors (reg 7(2)). That may include staff training, supply chain controls to prevent deliveries or on‑site storage of liquor in the Restricted Area, signage on vehicles and containers, and written policies prohibiting staff or contractors from knowingly transferring liquor into the Restricted Area.

• When transporting liquor through the region, plan routes to avoid entering the Restricted Area or ensure recipients qualify as tourists under the regulation and can maintain continuous possession, with documentary proof where possible. Because the regulation does not create licensing exceptions, avoid presuming an administrative permit will be available unless a separate authorisation is obtained under another law.

For the Director of Liquor Licensing and enforcement agencies

• Post and maintain notices at each place where a customary access route enters the Restricted Area, making clear the offences and the specified penalties in regulation 7 (reg 6(1)). Keep records of steps taken to post notices and to maintain them, because the statutory standard is "all reasonable steps", and documentation of those steps will support administrative accountability even though posting failure does not invalidate the declaration (reg 6(2)).

• Police should develop operational guidance for seizure and disposal under regulation 9, including procedures for forming reasonable grounds, documenting seizures, and recording the timing and manner of disposals. Because the regulations permit disposal "as soon as is practicable" and operate despite specified subsections of the Act, agencies should record chain‑of‑custody and reasons for disposal to preserve administrative and prosecutorial integrity.

Evidence and record‑keeping

• Individuals and businesses should retain documentary proof relevant to tourist status and continuous possession: travel bookings, camp receipts, logs showing distance from usual residence, statements of intended duration, and contemporaneous records of possession. This evidence will be relevant to demonstrating the availability of the defence in reg 8.

• Enforcement agencies should document the location of encounters with suspected offenders using the Schedule 2 map and cadastral references in Schedule 1 to avoid spatial disputes. Photographs, GPS coordinates and references to deposited plan numbers will assist in verifying whether an encounter occurred inside the Restricted Area.

Monitoring and review

• Because the regulations have been amended multiple times and expressly expire at the close of 2 July 2034 (reg 10), affected parties should monitor legislative instruments for further amendments or repeal. The compilation table records prior amending instruments (2017, 2020, 2023, 2024) and provides a precedent for change.

Practical minimisation of enforcement risk

• The simplest compliance strategy for most private parties is to avoid bringing liquor into the Restricted Area. For travellers, consuming or possessing liquor only outside the crosshatched area on Schedule 2 removes risk. For tour operators and suppliers, routing and contractual provisions can be used to ensure deliveries and passenger briefings comply with the restrictions.

• Where certainty is needed in marginal cases (for example, whether a route is a customary access route, whether a parcel of land is in the excluded reserve), seek cadastral clarification from the Land Information Authority or administrative guidance from the licensing authority rather than relying on informal assessments.

By following these practical steps and retaining documentary support for claims about tourist status or possession, persons and entities can reduce exposure to the monetary penalties set out in regulation 7 and to seizure/disposal actions under regulation 9.
