Liquor Control (Punmu Restricted Area) Regulations 2010

This instrument revolves around a small set of statutory concepts, each defined or used in the regulations and carrying operational effect.

• Punmu Aboriginal Community (regulation 3). The community is defined spatially: the part of Lot 13 on Deposited Plan 240373 that is within a 30 km radius of the telecommunications aerial at the specified GDA2020 co‑ordinates (22.044618°S, 123.123040°E). The definition is prescriptive and geographically precise; it ties the restricted area to land recorded in title and to specific co‑ordinates and datum (GDA2020). The definition was inserted by amendment in 2019 (note to regulation 3).

• Restricted area (regulation 5). The declared area is explicitly stated to be a “restricted area for the purposes of section 175(1a) of the Act.” The regulation does not restate the content of section 175(1a); it makes the statutory declaration that triggers whatever consequences the referenced Act provision prescribes.

• Exempt person and transiting vehicle (regulation 7(1)). The instrument defines an “exempt person” narrowly as a driver or passenger of a “transiting vehicle.” A “transiting vehicle” is defined in functional terms: a vehicle that transits the Punmu Aboriginal Community on a public road without stopping or discharging any person or item. The two linked definitions create a narrow operational exemption for people merely passing through on public roads without stopping.

• Offence and penalties (regulation 7). The core prohibited conduct is twofold: bringing liquor into the area (or causing liquor to be brought in) and having liquor in one’s possession while in the area (regulation 7(2)). The statutory label is “commits an offence.” The penalties are set as fixed pecuniary fines: $5,000 where the offender is a licence-holder/manager/director; otherwise $2,000 (regulation 7(2)-(3)). The instrument does not specify additional penalties such as licence suspension within the regulations themselves.

• Seizure and disposal (regulation 8). Police members may seize and, as soon as practicable, dispose of any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The regulation expressly says this power operates “despite section 155(4) and (5) of the Act,” creating an express exception or override relative to those Act provisions as they apply to this context.

• Notice requirement (regulation 6). Administrative duty on the Director of Liquor Licensing to post notices at every customary access route describing the offences and specifying penalties, and to keep those notices posted while the declaration remains in force. The regulation imposes a “take all reasonable steps” standard for posting and provides that failure to comply does not invalidate the underlying declaration.

• Temporal scope (regulation 9). The regulations are time-limited, operating until the close of 4 December 2032 unless repealed sooner. The compilation notes show the instrument has been amended multiple times; the expiry is recorded in the notes.

These concepts combine to create an area-based regulatory prohibition on importing and possessing liquor within a defined geographic zone, with limited transit exemptions, mandatory signage, monetary penalties and express police disposal powers.

The regulations identify a discrete set of actors upon whom duties, prohibitions or powers fall, and a residual class of persons who benefit from an exemption.

• Residents and visitors within the defined area. Anyone who is within the Punmu Aboriginal Community (as spatially defined in regulation 3) may be caught by the prohibition on possession of liquor (regulation 7(2)(b)). Possession inside the declared area constitutes an offence unless the person falls within the defined exemption.

• Persons bringing liquor into the area. The prohibition in regulation 7(2)(a) covers both those who personally bring liquor into the area and persons who “cause” liquor to be brought in, which captures direct importation and indirect orchestration. The undefined term “causes” can extend the reach of the offence to organisers or suppliers, subject to evidentiary proof.

• Licence-holders, managers and corporate directors. The regulation treats persons who hold a licence, manage licensed premises or are directors of a body corporate that holds a licence differently by prescribing a higher penalty ($5,000) for offences under regulation 7 where committed by such persons (regulation 7(3)). This creates a higher financial exposure for those with formal liquor industry roles.

• Drivers and passengers in a transiting vehicle. The regulations create an explicit, narrow exemption for “exempt person[s]” defined as drivers or passengers in a “transiting vehicle” (regulation 7(1)). The transiting vehicle must use a public road and must not stop or discharge any person or item while within the Punmu Aboriginal Community. The exemption is therefore functionally limited to vehicles passing through without engagement.

• Director of Liquor Licensing. The Director has an administrative duty to “take all reasonable steps” to post and maintain notices at each customary access route entering the area, describing the offences and specifying penalties (regulation 6(1)). The duty is mandatory but framed by a “reasonable steps” standard; failure to post does not invalidate the declaration (regulation 6(2)).

• Members of the Police Force. Police have explicit enforcement powers under regulation 8 to seize and, as soon as practicable, dispose of containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7; the regulation applies “despite” specified Act provisions (regulation 8).

• Transporters and third parties. Although not singled out with specific duties, carriers, freight operators and other third parties involved in transit through or delivery into the area will be affected by the “brings liquor into, or causes liquor to be brought into” wording (regulation 7(2)(a)), with potential exposure depending on the circumstances and proof of causation.

• The public road user. The definition of transiting vehicle links the exemption to use of a public road, so distinctions between public road transit and private access or stopping on non-public tracks determine exposure.

The spatial definition (regulation 3) is central to who is affected in practice: it ties the regulatory net to Lot 13 and a 30 km radius from the specified aerial co‑ordinates. Compliance obligations and enforcement risk therefore attach to anyone who enters, transits, brings goods into or is within that geographic footprint.

The regulations impose a small set of express duties and specify certain limited exemptions that operate as rights of non-prosecution in defined circumstances.

Duties

• Duty on persons not to bring liquor into, or have liquor in possession in, the Punmu Aboriginal Community. Regulation 7(2) makes these actions offences. The obligation is cast as prohibitive: do not bring in liquor; do not possess liquor while inside the area.

• Duty on the Director of Liquor Licensing to post notices. Regulation 6(1) requires the Director to take all reasonable steps to cause, and keep posted while the declaration continues, notices at each place where a customary access route enters the area, describing the offences and specifying penalties. The duty is framed by a “reasonable steps” standard for the Director’s conduct.

• Implicit duty on persons to avoid stopping or discharging items in transit if they want the transiting exemption to apply. The transiting vehicle concept (regulation 7(1)) creates a behavioural requirement for drivers and passengers seeking the exemption: do not stop and do not discharge persons or items while in the area.

Enforcement rights and procedures

• Power for police to seize containers. Regulation 8 gives members of the Police Force the power to seize containers of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The power is subject to the “reasonable grounds” standard for suspicion and the procedural proviso to act “as soon as practicable.”

• Power for police to dispose of seized containers. Regulation 8 expressly allows disposal of seized containers, including unopened containers, and states this applies despite sections 155(4) and (5) of the Act. This creates a statutory route for removal and disposal without further procedural steps within these regulations.

Exemptions and limitations

• Transiting exemption. Regulation 7(1) creates an express exemption for drivers or passengers in a transiting vehicle. Compliance with the conditions of the exemption is behavioural: transit must occur on a public road and without stopping or discharging persons/items.

• Posting failure does not invalidate the declaration. Regulation 6(2) removes the possibility that administrative failure to post notices would nullify the restricted-area declaration in regulation 5. That means the legal prohibition can operate regardless of whether signage has been maintained, while the Director still has an obligation to post “as far as reasonably practicable.”

Rights not expressly provided

• The regulations do not provide statutory exceptions for medical, ceremonial or other specified uses of liquor. The only exemption is the transiting vehicle/driver/passenger construct in regulation 7(1). No mechanism for authorisation, permits, or notice-based exceptions appears in the text supplied.

• No statutory right to retrieve seized liquor. Because regulation 8 permits disposal “as soon as is practicable,” the regulations do not set out a recovery procedure for seized containers or a timeframe for retention prior to disposal.

Who decides

• The Director of Liquor Licensing decides on posting notices and the steps to be taken to keep notices posted (regulation 6(1)).
• Police members decide on seizure and disposal in the field, based on reasonable grounds that a container is the subject of an offence under regulation 7 (regulation 8).

Who pays

• Offenders pay specified fines: $5,000 for licence‑holders/managers/directors; $2,000 for others (regulation 7(2)(a)-(b) and (3)). The regulations do not provide for costs orders, compensation or licence sanctions within the text presented here.

These duties, powers and exemptions define the compliance landscape: prohibitions on possession/importation, a narrow transit exemption, an administrative duty to post notices, and operational police powers to remove and dispose of liquor.

The regulations prescribe clear, fixed monetary penalties and give operational enforcement powers to police, while delegating administrative notice duties to the Director of Liquor Licensing.

Penalties

• Monetary fines. Regulation 7(2) designates the prohibited conduct as an offence and prescribes two monetary penalty levels. Where the offender is a licence-holder, manager of licensed premises or a director of a body corporate that holds a licence, the fine is $5,000 (regulation 7(2)(a); regulation 7(3)). In any other case the fine is $2,000 (regulation 7(2)(b)). The text does not specify alternative penalties such as imprisonment, community service or demerit-style sanctions; only the two pecuniary penalties are provided in these regulations.

• Classification as an offence. The regulations use the term “commits an offence” for the proscribed conduct (regulation 7(2)). That label triggers court- or enforcement-based resolution mechanisms notwithstanding the regulations do not elaborate on court procedures, enforcement notice mechanisms or infringement notice processes within the text provided.

Enforcement powers

• Seizure on reasonable grounds. Regulation 8 authorises a member of the Police Force to seize any opened or unopened container of liquor suspected on reasonable grounds to be the subject of an offence under regulation 7. The statutory standard is “suspected on reasonable grounds,” which imposes an objective threshold for a lawful seizure decision.

• Disposal authority. The police may dispose of seized containers “as soon as is practicable.” The regulation explicitly permits disposal of opened or unopened containers and makes the provision operate “despite section 155(4) and (5) of the Act,” thereby displacing those Act provisions for the purpose of enforcement under regulation 8. The wording allows disposal without the retention or administrative disposal process that might otherwise be required under the referenced Act sections.

• Timing and procedure. The instructions to police combine a standard of suspicion with a speed directive: seizure and disposal are permitted when there are reasonable grounds and disposal should occur “as soon as is practicable.” The regulations do not set out procedural safeguards, retention periods, evidentiary recording requirements or appeal mechanisms for seized goods within the text of these regulations.

Administrative enforcement

• Notice posting duty. Regulation 6(1) requires the Director of Liquor Licensing to “take all reasonable steps” to cause and keep notices posted at customary access routes. That administrative requirement supports enforcement by informing the public of the offences and penalties, but the regulations preserve enforcement despite posting failures (regulation 6(2)).

Enforcement implications

• Practical enforcement will rely on police exercising judgment about reasonable grounds and on the identification of containers as subject to the offence. The disposal power, coupled with the lack of an express recovery mechanism, means seized liquor may be destroyed or otherwise removed expeditiously.

• Licence-holders and persons in positions of corporate responsibility face higher pecuniary exposure ($5,000) for infractions. The higher penalty creates a differentiated enforcement burden tied to the regulated status of the actor (regulation 7(3)).

• The explicit override of specified Act provisions via regulation 8 alters the usual statutory sequence for seizure and disposal in this geographic context; the regulations therefore produce a distinct enforcement regime for the declared area.

In sum, enforcement is characterised by defined monetary penalties, police seizure and prompt disposal powers subject to a “reasonable grounds” standard, and an administrative notice duty that supports public awareness without being a condition precedent to enforcement.

The regulations operate by reference to the Liquor Control Act 1988 and expressly interact with specified provisions of that Act. The text also brings into play other statutory and administrative systems by defining the area with reference to cadastral records and geodetic datum.

Interactions with the Liquor Control Act 1988

• Declaration under section 175(1a). Regulation 5 declares the Punmu Aboriginal Community to be a restricted area “for the purposes of section 175(1a) of the Act.” The regulations do not reproduce section 175(1a) but explicitly link the declaration to that Act provision; the effect is that the regulations operate as the functional instrument that triggers whatever consequences the Act associates with a restriction under section 175(1a) (regulation 5).

• Override of Act seizure/disposal rules. Regulation 8 states it operates “despite section 155(4) and (5) of the Act.” That language creates an express statutory exception for seizure and disposal in the context of alleged offences under regulation 7. The regulations therefore displace the procedural or substantive constraints in those Act subsections to the extent they would otherwise restrict police power to seize and dispose of containers in this declared area.

• Criminal/regulatory label. The regulations themselves use the language “commits an offence” for prohibited conduct (regulation 7(2)), which implies enforcement under the Act’s broader enforcement architecture. However, the regulations do not attempt to re‑write the Act’s court, procedural or penalty mechanisms beyond specifying the fines and the police disposal power.

Geodetic, land-title and administrative records

• Land reference and datum. Regulation 3 ties the area to “that part of Lot 13 on Deposited Plan 240373 (Record of Qualified Certificate of Crown Land Title Volume LR3124 Folio 556) that is within a radius of 30 km” of the specified aerial co‑ordinates (GDA2020). That makes the application of the regulations depend on cadastral records and the geodetic datum GDA2020. Effective identification of the regulated footprint therefore requires reference to land title records and correct use of the datum.

• Public road distinction. The exemption for a “transiting vehicle” requires transit “on a public road” (regulation 7(1) definition). That introduces interplay with laws and instruments that define or locate public roads and with local government or other administrative instruments that authorise or identify roads.

Police powers and general criminal procedure

• Police powers are expressly engaged by regulation 8. The regulation grants seizure and disposal authority to members of the Police Force, subject to a “reasonable grounds” threshold. Because the police are the enforcing agency, the application of the regulations will operate within general policing and criminal procedure frameworks, insofar as those frameworks are not displaced by the regulations.

Limits and gaps in statutory cross-references

• No express interaction with health, customs, Aboriginal cultural heritage or other regimes. The regulations do not, within the text supplied, reference other statutes (other than the Liquor Control Act) such as health legislation, customs, biosecurity or Aboriginal heritage law. Any interaction with such regimes would therefore arise from general legal overlap rather than explicit statutory cross-reference in the regulations.

• No internal appeals or permit mechanism. The regulations do not create a permit process, authorisation regime or appeals mechanism specific to the declared area. Where rights under other statutes provide such mechanisms, interaction will be determined by those statutes, not by these regulations.

In summary, these regulations function as a geographically targeted instrument that depends on and modifies certain aspects of the Liquor Control Act framework (notably sections 175(1a) and 155(4)-(5)) and that requires administrative and cadastral inputs (land title, public roads, geodetic co‑ordinates) for practical implementation.

The compilation notes in the instrument record the legislative history of the regulations and identify amendments and insertions by date and Gazette reference.

Key chronological points from the compilation table and footnotes:

• Original instrument: Liquor Control (Punmu Restricted Area) Regulations 2010, published 3 December 2010 (Gazette p. 6060-2). Regulations 1 and 2 (citation and commencement) commenced on 3 December 2010; the remainder commenced on 4 December 2010 (regulation 2 and compilation table).

• 2013 amendment: Liquor Control (Punmu Restricted Area) Amendment Regulations 2013, published 15 November 2013 (Gazette p. 5266). The usual commencement pattern applied: regulations 1 and 2 commenced on 15 November 2013 and the rest on 16 November 2013 (compilation table).

• 2016 amendment and deletion: Liquor Control (Punmu Restricted Area) Amendment Regulations 2016, published 28 October 2016 (Gazette p. 4918). The published notes record that regulation 4 of the original instrument was deleted by this 2016 amendment (see the bracketed note “[4. Deleted: Gazette 28 Oct 2016 p. 4918.]” in the text). Regulations other than 1 and 2 commenced on 29 October 2016 (compilation table).

• 2019 amendment (registration to Racing & Gaming Regulations Amendment): The Racing and Gaming Regulations Amendment (Liquor Control) Regulations (No. 2) 2019, Pt. 3, published 29 November 2019 (Gazette p. 4106-7). Regulation 3 in the current text was inserted on 29 November 2019 (note attached to regulation 3), and the instrument notes an amendment on 29 November 2019 (regulation 9 was later amended as noted below).

• 2022 amendment: Liquor Control (Punmu Restricted Area) Amendment Regulations 2022, SL 2022/202, published 2 December 2022. Regulations 1 and 2 commenced on 2 December 2022 and the rest on 3 December 2022 (compilation table). The compilation table references SL 2022/202 r. 4 as an amendment to regulation 9 (see the note appended to regulation 9 indicating amendment by SL 2022/202 r. 4).

• Expiry provision established/confirmed: The notes and regulation 9 state that these regulations expire at the close of 4 December 2032 unless sooner repealed. The note on regulation 9 indicates it was inserted in 2016 and subsequently amended in 2019 and 2022.

Practical implications of the amendment record

• Geographic definition update. The insertion of regulation 3 in 2019 (Gazette 29 Nov 2019 p. 4107) altered or clarified the spatial definition of the Punmu Aboriginal Community as captured in the current text; the explicit reference to GDA2020 co‑ordinates in regulation 3 reflects that amendment.

• Deletion of regulation 4. The 2016 amendment removed an earlier provision numbered 4. The regulation text as supplied shows that deletion but does not reproduce the deleted content, so the current regulatory structure no longer contains the former provision.

• Ongoing renewal. The instrument has been amended in multiple years (2013, 2016, 2019, 2022) showing periodic legislative maintenance, and is subject to a specified expiry date in 2032 unless repealed earlier (regulation 9 and compilation notes).

For legal practice, the compilation table tells practitioners which versions were in force on particular dates and provides the Gazette and statutory instrument references needed to trace exact historical text. The notes identify the dates on which specific changes (insertions, deletions, amendments) took effect, which assists with retrospective compliance or enforcement queries.

The regulations as supplied do not record any court decisions, administrative determinations or formal litigation in their text or compilation notes. The compilation table and notes list only the statutory amendment history and do not include any references to proceedings or case law.

What the instrument itself reveals about potential litigation vectors

• Enforcement actions under regulation 7 and disposals under regulation 8 could generate disputes requiring court or tribunal determination, but no such outcomes are recorded in the document supplied. The regulations create enforceable offences (regulation 7(2)) and give police the power to seize and dispose (regulation 8), which are the sorts of measures that, in practice, can be the subject of judicial review, constitutional challenge, challenge to police conduct, or prosecution/defence contests. The instrument does not record outcomes of any such proceedings.

• Procedural questions. Regulation 8’s express operation “despite section 155(4) and (5) of the Act” signals a point of statutory tension that could raise litigation questions about the extent to which an exercise of police power and disposal is lawful in particular circumstances. Any litigation addressing that tension would need to engage both the regulations and the referenced Act provisions; nothing in the instrument reports such litigation.

• Geographic scope disputes. The definition in regulation 3 ties the regulated area to Lot 13 and a 30 km radius from specific GDA2020 co‑ordinates. Disputes about the exact spatial footprint or the application of the 30 km radius in marginal cases could in principle be litigated, but again there is no record of such litigation in the document provided.

Absence of recorded litigation is itself a datum: the instrument’s compilation notes do not include case law citations, and no clauses refer to judicial precedent. Users seeking authoritative litigation history must consult court records, annotated statutes or law reports outside this instrument.

For applied legal work, the relevant action points from the instrument are to: rely on the regulation text for current obligations and penalties; consult court databases and legal reporting services for any subsequent litigation; and map the spatial definition against cadastral and geodetic records to pre‑empt disputes about geographic application.

The regulations contain several drafting and operational features that can produce surprising results if overlooked. These items are concrete, traceable to the text, and affect compliance and enforcement outcomes.

• Narrow scope of exemption. The only statutory exemption is for an “exempt person,” defined as the driver or passenger in a “transiting vehicle” (regulation 7(1)). A “transiting vehicle” must use a public road and must not stop or discharge any person or item while within the Punmu Aboriginal Community. If a vehicle stops, or if a driver or passenger removes or receives an item, the exemption falls away. Users who assume simple passage is sufficient risk exposure if they stop or interact within the area.

• “Causes liquor to be brought into” is broad. Regulation 7(2)(a) covers both bringing liquor into the area and causing it to be brought in. The term “causes” is not defined and may capture indirect actors such as organisers, suppliers, or persons who arrange delivery. That language can extend liability beyond the person physically carrying liquor.

• Differential penalties for licence‑holders and corporate actors. Regulation 7(3) imposes a higher fine ($5,000) where an offence is committed by a licence-holder, manager of licensed premises or a director of a corporate licence-holder. Persons in those roles face increased financial exposure compared with private individuals ($2,000). Entities connected to liquor supply need to understand that the regulations target them specifically.

• Posting failure does not prevent enforcement. Regulation 6(2) explicitly states that failure to comply with the Director’s posting duty does not invalidate the declaration in regulation 5. That means enforcement can proceed even if notices are not posted. Parties cannot rely on lack of signage as a defence under these regulations.

• Police disposal permitted “despite” Act provisions. Regulation 8 allows police to seize and dispose of opened or unopened containers suspected on reasonable grounds to be subject to an offence, and it operates “despite section 155(4) and (5) of the Act.” Practically, police may dispose of containers quickly; the regulations do not set a retention period or recovery process. Those whose goods are seized may find prompt disposal limits options to contest the seizure or recover property.

• Geographic complexity. The regulated area is defined by reference to Lot 13 on a deposited plan and to a 30 km radius from specific GDA2020 co‑ordinates (regulation 3). Determining whether a particular point lies within the regulated area requires cadastral and geodetic mapping; casual assumptions about community boundaries or informal local descriptions may be inaccurate.

• Temporal limitation and amendment history. The instrument expires at the close of 4 December 2032 unless repealed earlier (regulation 9). The compilation notes show multiple amendments (2013, 2016, 2019, 2022). Parties relying on historical compliance should confirm which version applied at a given time.

• No statutory carve-outs for ceremonial, medical or licensed uses (within the text). The regulations do not provide express permitted uses such as for authorised cultural or health-related reasons. The only statutory exception in the text is the transiting vehicle exemption. If such exceptions exist under other law they are not addressed here.

• Possible interaction with public road definition. The transiting vehicle exemption depends on transit on a “public road” (regulation 7(1)). What constitutes a public road may vary by local instrument or administrative record, and misclassification could affect whether the exemption applies.

• “As soon as is practicable” is open-ended. In regulation 8 the police may dispose “as soon as is practicable,” a temporal phrase that allows rapid disposal but does not quantify procedural safeguards. The lack of detail on how quickly or under what formal process disposal occurs can be operationally important.

These points are not legal conclusions about the validity of enforcement actions; they are factual features of the regulations that materially affect compliance risk, evidential exposure and operational planning for persons affected by the restricted area.

For practitioners advising clients (licensees, transport operators, community members, visitors, public authorities), the regulations set out clear prohibitions and a narrow exemption. Compliance planning should be concrete and spatially informed.

1. Map the regulated area precisely

• Obtain cadastral records for Lot 13 on Deposited Plan 240373 and plot the 30 km radius from the specified GDA2020 co‑ordinates (22.044618°S, 123.123040°E) to identify the regulated footprint (regulation 3). The GDA2020 datum is specified; mapping must use the same datum to avoid positional errors.

2. Understand the prohibited conduct

• Prohibition is twofold: bringing liquor into the area (or causing it to be brought in) and possessing liquor while in the area (regulation 7(2)(a)-(b)). For individuals and organisations, avoid transporting, delivering, leaving or otherwise introducing liquor into any part of the mapped area.

3. Train drivers and vehicle users on the transiting exemption conditions

• If relying on the “transiting vehicle” exemption, ensure drivers and passengers do not stop within the area and do not discharge persons or items while within it (regulation 7(1)). Transit must be on a public road. Create written operational instructions for drivers, include GPS routing to avoid non-public tracks, and document each transit to show continuing movement without stopping if challenged.

4. For licence-holders, managers and corporate directors: heightened exposure

• Recognise the higher penalty ($5,000) for offences committed by persons in these roles (regulation 7(3)). Implement procurement controls and supply-chain checks to ensure staff, contractors and delivery services do not inadvertently bring liquor into the area. Keep records proving compliance efforts.

5. Manage deliveries and supply chains

• Prohibit deliveries of liquor into the regulated area unless authorised by law other than these regulations. Where carriers or third parties undertake mixed loads, instruct them to segregate and not discharge alcoholic products in the area. Maintain written contracts and instructions to carriers that specify the prohibition area and penalties.

6. Liaise with the Director and with Police

• The Director of Liquor Licensing has a duty to post notices at customary access routes (regulation 6(1)). For stakeholders seeking clarity on signage locations or wanting to ensure adequate community notification, contact the Director’s office. For operational enforcement questions or to report suspected non-compliance, coordinate with local police, who are authorised to seize and dispose of containers under regulation 8.

7. Record-keeping and evidence

• Keep records demonstrating reasonable steps to comply with the prohibition: instructions to staff, route plans for transiting vehicles, delivery manifests showing no delivery into the area, and any permits or communications authorising exceptions under other laws (if applicable). These records will assist defence of alleged offences and show compliance diligence.

8. Responding to seizures

• If police seize containers, obtain clear details of the grounds for seizure and whether disposal has occurred or will occur “as soon as is practicable” (regulation 8). Document the seizure, request a receipt or record, and, where appropriate, seek legal advice promptly to determine possible contestation routes or recovery options, noting that the regulations grant disposal authority.

9. Community and cultural considerations

• The regulations do not specify exceptions for cultural or ceremonial uses. If such uses are contemplated and there is a need to provide alcohol for lawful authorised ceremonies, consider whether other statutory regimes provide authorisation and document the legal basis. Absent explicit statutory exception in these regulations, exercise caution.

10. Monitor legislative changes and expiry

• The regulations have been amended several times; confirm the current text is in force and monitor for further amendments or repeal. Note the expiry date (close of 4 December 2032) recorded in regulation 9 and the compilation notes. Advise clients to review the instrument periodically and before operating in or near the area.

Practical checklist for an operator or adviser

• Map coordinates and confirm whether premises or routes fall within the 30 km radius.
• Update delivery and routing systems to exclude the restricted footprint or to flag transits that must not stop.
• Train drivers on the transiting rules and require trip logs.
• Communicate prohibition to suppliers and carriers via contractual clauses.
• Ensure licence‑holders and managers have compliance protocols and written policies.
• Maintain records of compliance steps and communications with authorities.
• If seized, obtain police records promptly and seek legal advice.

These steps follow directly from the regulatory text: the spatial definition (regulation 3), the posting duty (regulation 6), the prohibitions and exemptions (regulation 7), the seizure and disposal power (regulation 8) and the temporal scope (regulation 9).
